HomeMy WebLinkAboutSeptember 28, 1966 MUNICIPAL BUILDING BROUGHAM A meeting of Pickering Township Council was held on WEDNESDAY, the TWENTY-EIGHTH day of SEPTEMBER, 1966, at EIGHT o'clock p. m. PRESENT: Reeve C. W. Laycox Councillors: J. williams R. Chatten H. Spang D. Beer D. J. PIitz. Clerk J. Paulkner, planning Director A special meeting of Council was called to consider a draft by-law to amend the provisions of By-law 3031. Mr. Faulkner outlined briefly the purpose of this meeting. By-law 3037 was discussed at considerable length pertaining to the amendments to the zoning of the Greenbelt Conservation Zone nG" ,designations in Lots 11 and 12, Concession 5 to read Rural Agricultural Zone A. Wm. G. Lawson submitted his argument on behalf of Mrs. Barclay, owner of land affected by the new zoning. The same by-law and the proposed altering of parts of 'the Rural Agricultural Zone "An designations in Lot 13, 14 15, and 16, Concession 5 and Pt. Lot 22, Concession 4. to read Pit and Ouarry Zone no" was also discussed at great length by COUDcil and the various Pit and Quarry operators whose land will be directly affected by this new zoning. The following persons appeared before Council: Mr. Milton Mowbray, representing J.B. Regan & Company. J.B. Regan. Mr. D. Schmeigelow, representing Highland Creek Sand and Gravel Company. Mr. Laughrin, representing Aztecana Corporation. All the above noted persons representing the various Pit and Quarry operators presented their arguments as to why they felt their holdings of approximately 600 acres should be zoned "Ou rather than only those protions now used for this purpose. POINTS OF ARGUMEtft' 1. The proper time to zone this area as "on is now, before residential development takes place, which if it was allowed could result in these areas becoming lost to the industries. -2- 2. The tax yield from P & Q operations would be greater than what would be received from "A" zoning. --: 3. Township can control the condition of worked pits by its regulatory By-law #3010. 4. Potentional market for the aggregate in this area is growing rapidly, the convenience to the area is important and the time to take gravel is now. 5. The industry provides employment of local residents, both labour and truck drivers. 6. Properties are too valuable to be allowed to remain in a wor'kë out pit appearance. Chatten was of the opinion that areas now zoned "A II should remain in this zoning until such time that owners are ready to use the property for the mi"ling of gravel. He further indicated that to protect prospective land purchasers, for residential development on adjacent properties that the official plan have incorporated the intended use of adjoining properties. On commenting on tax revenue from the lands now zoned Pit and Quarry it was indicated that the revenue equals about 1 mill of the total tax which is approximately $32,000.00. This When distributed leaves about $2400.00 for road up-~eep. It was indicated that heavier assessed values will be levied on these lands. The Council intended to enforce their by-law #3010 which regulates Pit and Quarry operations. The availability of the gravel and the demand which will be created in the very near future calls for proper zoning in order that there is no delay in getting this gravel as it is needed. Council members had mixed feelings about zoning all land now owned by the Pit & Quarry operators as 0 zoning at this time. Council convened into Committee of the Whole at 9:45 p.m. The discussion covered all aspects of the earlier comments made by Pit owners and Council with the result the following motion was made: Motion ~ MOVED by Councillor J. Chatten that the areas designated as "G" on map Schedule "C" 5/13-16 and 4/21-24 dated September 27, 1966 be zoned as "Q" with the areas designated for "HQ" and "A" being left in a "G" zone. ,..".1'7" . .c '! Williams, that the corporation of the Township of Pickering zone the areas designated on map, Schedule "c" 5/13-16 and 4/21-24 dated September 27th, 1966, "0" and "HO" be zoned "0" except for a 200 foot Buffer strip adjacent to road allowances, with the buffer strip retaining ~. its "A" designation subject to immediate negotiations on abutting roads. CARRIED . Committee of the i"olhole reconvened into Council requesting the Pit and çuarry Operators to enter the Chambers, 10:10 p.m. The following resolution was put to Council. Resolution #416 MOVED by Councillor H. Spang, seconded by Councillor D. Beer, that the Council of the Corporation of the Township of Pickering zone the areas designated on map Schedule "C" 5/13-16 and 4/21-24" dated September 27th, 1966. iiQii and iiHQii be zoned ViQii except for a 200 foot buffer strip adjacent to road allowances, with the buffer strip retaining its "A" designation subject to immediate negotiations on abutting roads. Lawson submitted his argument requesting that lands owned by his client Mrs. Barclay be zoned I¡AU agriculture and not greenbelt as recommended by the Planning Board. lilliam G. Lawson submitted a map prepared by the Conservation authority pointing out that the land which he would like to see zoned " A II are not flood plain lands and that this is proven by the fact that the C. A. do not show this as beinß flooded at the time of Hurricane Hazel. The MTCA however do control land fill within their controlled areas and Mr. Lawson indicated that before buildings were erected on this property the M'l'CA would have to approve same. Council reconvened into Committee of the Whole at 11:25 p.m., to discuss the problem at hand. It was reasoned by Councillor J. Williams that the lands in question be zoned iiAli and put the following motions: Motion Moved by Councillor J. Williams, seconded by Councillor R. Chatten that the recommendation of the Township Planning Board dated September 27, 1966 be and is adopted, that By-law 3037 be amended by altering the Greenbelt aGH designation in Lots 11 and 12, Concession 5 to read Rural Agricultural liA" as shown on Schedule "CI, Map 5/9-12 dated September 27, 1966; the line being estab11shed as the flood line as determined by the MTRCA plus a 75 foot horizontal buff~as recommended by Committee of the Whole, September·28, 1966. CARRIED . -4- Motion ~ MOVED by Councillor J. Williams, seconded by Councillor R. Chatten, that the Council of the Corporation of the Township of Pickering recommends to the Township Planning Board reconsider their recommendation of Sept. 27th, 1966, relating specifically to Lots 11 and 12, Concession 5, and further that particular consider- ation of the 75 foot buffer strip required by the Township both a view to either reducing or eliminating this requirement specific instances, as recommended by Committee of the Whole, Sept. 28/66. CARRIED . Council convened into Council at 11:45 p.m. and passed the following resolutions: Resolution #417 MOVED by Councillor J. Williams, seconded by Councillor R. Chatten that the recommendation of the Township Planning Board dated September 27, 1966, be and is adopted, that By-law 3037 be amended by altering the Greenbelt "Gii designation in Lots 11 and 12, Concession 5 to read Rural Agricultural ~ÎAÎ1 as shown on Schedule Î'ICiV Map 5/9-12 dated September 27, 1966; the line being established as the flood line as determined by the MTRCA plus a 75 foot horizontal buffe~ CARRIED. Resolution #418 MOVED by Councillor J. Williams, seconded by Councillor R. Chatten, that the Council of the Corporation of the Township of Pickering recommends to the Township Planning Board reconsider their recommendation of September 27th, 1966 relating specifically to Lots 11 and 12, Concession 5, and further that particular consideration of the 75 foot buffer strip required by the Township with a view to either reducing or eliminating this requirement specific instances. CARRIED. BY-LAW By-law Number 3203 Councillor R. Chatten, seconded by Councillor H. Spang moves for leave to introduce a By-law of The Township of Pickering to amend the provisions of By-law number 3037 as amended and that same now be read a first time. Councillor R. Chatten seconded by Councillor D. Beer moves that By-law Number 3203 to amend the provisions of By-law number 3037 as amended be now read a second time, and that Council go into Committee of the Whole thereon. þ The Committee of the Whole Arises and reports the By-law as read. Councillor R. Chatten, seconded by Councillor J. Williams moves that the report of the Committee of the Whole on By-law Number 3203 be adopted, and that the said By-law be now read a Third time and PASSED, that the Reeve and Clerk sign the same, and the Seal of the Corporation be affixed thereto.
