That the City-owned lands in the Duffin Heights Development Area fronting on Brock Road south of Dersan Street (as shown on Attachment 1) be declared surplus to the needs of the City. 2. That City staff be directed to take such steps and do such things as are necessary to effectively market and sell the said lands, and that the sale be exempt from the requirements of the City's Acquisition and Disposal of Land Policy so as to permit the more effective marketing thereof. 3. That, prior to entertaining Offers to Purchase, City staff report back to Council to provide information concerning the manner in which staff proposes to market and sell the lands. 4. That the proceeds of sale of the lands be transferred to the City's Operations Center Reserve Fund in accordance with paragraph 17 of Council budget resolution 143/16. 5. That the appropriate City of Pickering officials be authorized to take the necessary actions as indicated in this report. Executive Summary: The City is the registered owner of the lands shown on Attachment 1 to this Report. These lands have not been identified as suitable for any municipal use. Consequently, staff seek direction from Council to proceed with the sale of the lands to generate revenues which can be applied towards the construction of the City's new Municipal Operations Centre. Financial Implications: It is anticipated that the proceeds of sale of the lands will substantially reduce the amount of external borrowing required by the City to construct the new Municipal Operations Centre. Discussion: The lands consist of approximately 5.3 hectares (10.6 acres) fronting on Brock Road south of Dersan Street in the Duffin Heights Development Area. The Official Plan designation of the lands is "Mixed Use Areas— Mixed Corridors". This designation permits office or retail uses and/or multi-storey residential development. The lands have not been identified as suitable for any municipal use. LEG 06-16 October 11, 2016 Subject: Duffin Heights Mixed Use Corridor Land Dispositions Page 2 To effectively market the lands, staff propose to use methods similar to those previously employed to sell surplus lands in Duffin Heights. If Council adopts the recommendations in this Report, staff will proceed to develop a marketing plan and to obtain appraisals of the fair market value of the lands. Staff will then report back to Council seeking approval of the proposed marketing plan. It is likely that this will take place in camera, as the marketing plan will contain sensitive commercial information concerning the lands that should not be disclosed until after a sale is concluded. Staff seek an exemption from the requirements of the City's Acquisition and Disposal of Land Policy to permit the more effective marketing of the lands. For example, the Acquisition and Disposal of Land policy requires advertising in a local publication. While this may be suitable for the sale of small parcels of surplus land, it will not yield a good result when selling valuable development lands: The marketing plan to be brought forward by City staff will propose the advertisement of the lands in publications of broader circulation. These will be much more likely to reach prospective purchasers of development land. In accordance with Council budget resolution 143/16, staff propose that all proceeds of sale of the lands be transferred to the City's Operations Center Reserve Fund.
