Ashe Councillors J. Anderson D. Kitchen K. Matheson A. Robertson B. Searle K. Spratley N.C. Marshall - Administrator-Clerk ALSO PRESENT: D. Armstrong 1. Auyang Planning Director Senior Planner ADOPTION OF MINUTES (II) Moved by Councillor Spratley, seconded by Councillor Robertson that the minutes of the meeting of June 7th 1976, be adopted. CARRIED PRESENTATIONS (III) 1. 2. On behalf of Council Mayor Ashe presented certificates for successful completion of the Ministry of Transportation and Communications Courses to the following members of staff: Michael Laskowski Municipal Road Design Course # 76 -31 Robert Starr Municipal Construction Survey Course # 76 -34 The Mayor presented Mr. S.C. Norton a member of the Roads Department with a gold watch, commemorating his 25 years service with the Municipality. DELEGATIONS Mrs. Helen Craig a resident on Rosebank Road, spoke with respect to the Rosebank Secondary Plan and noted that while she objected to the designation of her property as open space the majority of the lands surrounding her were below the M.T.R.C.A. F~ood Plain Line. She indicated that she had not objected earlier to the open space designation on her land in light of the open space designation on the east side of Rosebank Road which had subsequently been changed by the Municipality. Mr. Rick Hull, President of the Rosebank Ratepayers' Association reiterated the Association's earlier concern and requested that the residential and open space designation that appeared on the Seconda~y Plan which was circulated to the ratepayers be reinstated. He also voiced the ratepayers concern over the proposed emergency road. - 64 - 17/76 (III) 3. DELEGATIONS (Continued) 4. Mr. Thor Eckland of Marshall, Macklin and Monoghan appeared on behalf of the F.W. Hill Estate and clarified several items that had been identified by previous speakers. Mrs. Anthony owner of property at the intersection of Toyneva1e and Rosebank Road expressed concern over the relocation of the proposed emergency road to the top of the riverbank. (IV) REPORTS Ontario Humane Society Report for the month of May 1976, with comparison figures for the month of May 1975. See Appendix I (V) RESOLUTIONS REPORT OF THE EXECUTIVE COMMITTEE OF JUNE 7th 1976 (CLOSED SESSION) See Appendix II Resolution 83/76 Moved by Councillor Kitchen, seconded by Councillor Spratley that the recommendations contained in the Executive Committee Report of June 7th 1976 (Closed Session) be adopted. REPORT OF THE PLANNING COMMITTEE OF JUNE 8TH 1976 See Appendix IV Resolution 85/76 Moved by Councillor Robertson, seconded by Councillor Spratley that the recommendations contained in the Planning Committee Report of June 8th 1976, be adopted. CARRIED - 65 - 17/76 . (V) RESOLUTIONS (Continued) Resolution 86/76 Moved by Councillor Kitchen, seconded by Councillor Matheson that the week of June 25th to July 1st 1976 shall be observed as "CANADA WEEK" in the Town of Pickering. CARRIED Resolution 87/76 Moved by Councillor Robertson, seconded by Councillor Spratley that the week of June 20th to June 26th 1976 be observed as "SENIOR CITIZENS WEEK" in the Town of Pickering. CARRIED Resolution 88/76 Moved by Councillor Searle, seconded by Councillor Spratley that whereas Section 636a of the Municipal Act as enacted by Statutes of Ontario, 1973, c.124 transfers the responsibility for the hearing of the applications for cancellation, reduction or refund of taxes to the Council of the Municipality; AND WHEREAS notices in writing of applications have been received by the Clerk of the Municipality for the cancellation, reduction, and refund of taxes for various reasons; AND WHEREAS upon investigation and receipt of reasonable explanations all claims have been substantiated; BE IT THEREFORE RESOLVED that the Council of the Town of Pickering accept the following list of applications and authorize the adjustment of taxes to be made accordingly. CARRIED See Appendix V Resolution 89/76 Moved by Councillor Robertson, seconded by Councillor Spratley that the tender of Bay Sports Equipment Limited in the amount of $3,000.00 ($250.00 monthly) for the leasing of the Pro Shop at the Don Beer Sports Arena, as recommended by the Assistant Director of Recreation in his memorandum dated June 16th 1976, be accepted. CARRIED ~..., - 66 - 17/76 (VI) BY-LAWS By-Law Number 424/76 Councillor Kitchen, seconded by Councillor Searle moved for leave to introduce a By-law of the Town of Pickering to adopt Amendment Number 26 of the Official Plan for the Town of Pickering District Planning Area, Region of Durham (Rosebank Secondary Plan) and that same now be read a first and second time, and that Council go into Committee of the Whole thereon. CARRIED MOTION Moved by Councillor Robertson, seconded by Councillor Spratley that the Residential Designation be returned to the table land on the lands situated on the north- west corner of Rosebank Road where it abuts highway #401. CARRIED MOTION Moved by Mayor Ashe, seconded by Councillor Robertson that page #15 vii (F) under the Roads and Access Designation be amended by deleting the last sentence - "this may, of required, become an open road allowance but steps must be taken at that time to direct major industrial traffic away from the residential streets" CARRIED MOTION Moved by Councillor Matheson, seconded by Councillor Searle that the industrial designation on the east side of Rosebank Road north of Toyneva1e be returned to that of the plan circulated to the ratepayers. LOST The Committee of the Whole arises and reports the By-law as read. THIRD READING Councillor Kitchen, seconded by Councillor Anderson moved that the report of the Committee of the Whole on By-law Number 424/76 be adopted, and that the said By-law be now read a Third Time and PASSED, that the Mayor and Clerk sign the same, and that the Seal of the Corporation be affixed thereto. By-Law Number 425/76 - Two Readings only Councillor Spratley, seconded by Councillor Robertson moved for leave to introduce a By-law of the Town of Pickering respecting residential fences and swimming pool enclosures in the Town of Pickering, and that same now be read a first and second time, and that Council go into Committee of the Whole theron. CARRIED - - 67 - 17/76 (VI) BY-LAWS (Continued) By-Law Number 425/76 (continued) It was agreed that this By-law would be considered at the Executive Committee Meeting of June 28th 1976. By-Law N~ber 426/76 Councillor Anderson, seconded by Councillor Spratley moved for leave to introduce a By-law of the Town of pickering to dedicate a one foot reserve on Lodge Road as a Public Highway Block XN, Plan M-997 (J.D.S. - Valley View Heights) and that same be now read a first, second and third time, and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the corporation be thereto affixed. CARRIED By-law read a first, second and third time and finally passed. By-Law Number 427/76 Councillor Kitchen, seconded by Councillor Robertson moved for leave to introduce a By-law of the Town of pickering to amend By-law Number 176/75 (for the regulation of traffic under the jurisdiction of the Town of pickering) and that same be now read a first, second and third time, and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the corporation be thereto affixed. CARRIED By-law read a first, second and third time and finally passed. (VII) OTHER BUSINESS CbUIlcillor Kitchen ~ndered whether the By-law Oœ:' Building Department could investigate the possibility of insisting that any building in excess of two stories be required to install smoke detectors which he understood is the case in other municipalities. (VIII) CONFIRMATION BY-LAW þ By-Law Number 428/76 Councillor Robertson, seconded by Councillor Anderson moved for leave to introduce a By-law of the Town of pickering to confirm the proceedings of the Council of the Corporation of the Town of pickering at its meeting held on the 21st day of June 1976, and that same be now read a first, second and third time, and the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. PROCEDURAL BY-LAW That the report of the Town Solicitor dated June 9th 1976, with respect to the Council Procedural By-law 3714/69, be received for information. RESOLUTION - CITY OF WINDSOR That the resolution of the City of Windsor, submitted with their letter of May 25th 1976, and dealing with a possible outbreak of encephalitis not be endorsed in view of the fact that it is to be considered by the Association of Municipalities of Ontario and suitable resolution will go forward to the Province from this agency. 1975 AUDIT FEES That the report of the Treasurer-Collector dated June 4th 1976, with respect to the 1975 budget fees be approved and the over-expenditure of $l,700.00 be charged to G/L 2128 9. 10. 11. . - 2 - APPENDIX III FORMER ROADS DEPARTMENT BUILDING - BROUGHAM That the Municipality turn over the keys to the former Roads Garage in Brougham to the Federal Government and give up possession to the facility immediately, as recommended by the Administrator-Clerk in his report dated June 3rd 1976. SUMMER GARDENING PLOTS That the report of the Director of Recreation and Transportation dated May 12th, 1976 dealing with the establishment of Summer Gardening Plots be received and that this project be included for consideration in the 1977 budget. 7. METRO SANITARY LANDFILL SITE - CONCESS'ION 3 - ACCESS ROAD That the report of the Director of Public Works dated May 19th 1976, with respect to the access road to the Liverpool Sanitary Landfill Site be adopted and that a by-law be prepared closing a portion of Valley Farm Road in COncession III Subject to Metropolitan Toronto entering into an agreement whereby Metro will construct, at no cost to the Municipality, a year-round full load road to the satisfaction of the Ðirèctoror Public WOrks, as outlined in Mr. R.L. J 11. -t : ç - 2 - , APPENDIX II BROCK NORTH AND SOUTH LANDF'ILL S'ITES That the report of the Director of Public WOrks dated May 20th 1976 dealing with the Brock North Sanitary Landfill Site be received for information. M.T.R.C.A. WATERFRONT PLAN WHEREAS the M.T.R.C.A. Waterfront Plan 1972-76 was beneficial to a vast number of people in the Durham Region and in particular those residents in the Ajax- Pickering Area; and WHEREAS approximately 9~Mil1ion Dollars was expended in the Ajax-Pickering sector of the waterfront in the first five year plan; and WHEREAS the Municipalities of Ajax and Pickering have experienced large population growth in the last two years and will experience even greater growth in the next few years; and WHEREAS more open space and public access to Lake Ontario and Frenchman's Bay is a positive element in the growth of recreational facilities to meet the needs of our existing and yet to arrive Municipal citizens; and WHEREAS by Resolution of the Regional Council of Durham has failed to appreciate the advantages of participation in the second five year plan of waterfront acquisition and development by the M.T.R.C.A.; and WHEREAS it would be short-siqhted not to participate in the 1977-81 Waterfront Plan as a logical progression from the 1972-76 Plan; and WHEREAS all other municipal jurisdictions within the M.T.R.C.A. boundaries, including those regions without direct frontage on the waterfront, have given tentative approval to the 1977-81 Plan; THEREFORE BE IT RESOLVED that the Council of the Corporation of the Town of Pickering petition the M.T.R.C.A. to levy the Regional Municipality of Durham for its financial share in the M.T.R.C.A. Waterfront Plan 1977-81 in the amount of $151,403.00 per annum, 1977-81 inclusive.
