HomeMy WebLinkAboutJanuary 26, 1976 .. - 10 - 3/76 COUNCIL MEETING A meeting of the Pickering Town Council was held on Monday, the TWENTY SIXTH day of JANUARY 1976 at 9:50 p.m. PRESENT: Mayor G. Ashe Councillors - J. Anderson D. Kitchen K. Matheson B. Searle N.C. Marshall - Administrator-Clerk J.P. Mys1ik - Deputy Clerk (I) RESOLUTIONS Resolution Number 14/76 MOVED by Councillor Kitchen, seconded by Councillor Anderson, that WHEREAS the Council of the Corporation of the Town of Pickering made objection on October 2nd, 1972, to the Minister of Treasury, Economics and Intergovernmental Affairs concerning a proposal by the Borough of Scarborough to provide for a Regional Shopping Centre designation generally located at or near the intersection of provincial highways 401 and 2, and Port Union Road (Proposed Amendment No. 304); AND WHEREAS the Council of the Corporation of the Town of Pickering made representations concerning the above-mentioned objection to the Ontario Municipal Board at a hearing held January 6th, 1975 for that purpose; AND WHEREAS the Ontario Municipal Board, in its decision dated March 20th, 1975, and amended April 24th, 1975, rejected the proposal of the Borough of Scarborough, stating, in part "the designation on the Rouge Community Secondary Plan for the subject site shall be changed from Regional Commercial Centre to Community Commercial Centre and the text of the plan modified"; AND WHEREAS the Divisional Court of the Supreme, Court of Ontario in its decision of December 4th, 1975 upheld the Ontario Municipal Board in its rejection of the proposal; AND WHEREAS the Council of the Corporation of the Town of Pickering has submitted a Reply to Petition dated May 12th, 1975, to the Honourable The Lieutenant-Governor In Council of the Province of Ontario supporting the decision of the Ontario Municipal Board as affirmed by the Divisional Court; The Council of the Corporation of the Town of Pickering does hereby reaffirm its objection made October 2nd, 1972, and its Reply to Petition dated May 12th, 1975. AND FURTHER respectfully submits that the decision of the Ontario Municipal Board dated March 20th, 1975 and amended on April 24th, 1975 be upheld. CARRIED Recorded Vote: Yea: Messrs. Ashe, Anderson, Kitchen, Matheson and Searle. - 11 - 3/76 (I) RESOLUTIONS (Continued) Resolution Number 15/76 MOVED by Councillor Matheson, seconded by Councillor Searle, that the rates for the Dia1-A-Bus System be increased, effective January 28th, 1976, as follows: ~ Adult Fare Adult Fare Children's Fare Children's Fare 45<: Cash 40<: (Tickets) 35<: Cash 30<: (Tickets) CARRIED Proposed Amendment to Resolution Numbe'r15/76 MOVED by Councillor Kitchen, seconded by Councillor Anderson, that the proposed change to the rates for the Dia1-A-Bus System become effective on February 1st 1976. LOST (II) BY-LAWS By-law Number 348/76 Councillor Anderson, seconded by Councillor Searle, moves for leave to introduce a By-law of the Town of Pickering to declare that certain land is required for the purposes of the Municipality and set aside that property for those purposes (Part North half of Lot 31, Concession 4) and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. CARRIED By-law read a first, second and third time and finally passed. By-law Number 349/76 Councillor Searle, seconded by Councillor Anderson, moves for leave to introduce a By-law of the Town of Pickering to amend By-law Number 266/75 limiting the number of Automobile Service Stations and Public Garages and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. CARRIED By-law read a first, second and third time and finally passed. CARRIED - 13 - 4/76 (III) RESOLUTIONS (Continued) Item #8 There was some discussion of the Bubble for the Tennis Courts. It was clarified that one third of the cost is to be covered by the users through membership fees, one third of the cost would be covered by a Wintario Grant and one third would be financed through, the municipality. The Bubble would be the property of the municipality. Amendment MOVED by Councillor Anderson, seconded by Councillor Robertson that the $40,000.00 for the Bubble for the Tennis Courts be deleted from the Capital Forecast for 1976. CARRIED Resolution 17/76 - Item #8 MOVED by Councillor Anderson, seconded by Councillor Robertson that the Five Year Capital Expenditure Quota for the years 1976-1980 approved during the Executive Committee Meeting of January 26th 1976 and amended at Council of February 2,1976 be adopted and forwarded to the Region of Durham for their consideration. Meeting CARRIED Resolution 18/76 - Item #9 MOVED by Councillor Anderson, seconded by Councillor Robertson that the budgetary allowance for renovations to the picnic shelter at Grand Valley Park be utilized for the purchase of tents for the Town of Pickering Day Camp Program, subject to further committee approval of program details, as recommended by the Director of Recreation and Transportation in his report of January 16th 1976. CARRIED Resolution 19/76 - Item 10 MOVED by Councillor Anderson, seconded by Councillor Robertson that the Ma~r be~directErlto negotiate with the Metropolitan Toronto and Region Conservation Authority and Ontario Hydro for the turning over of the Conservation Authority Park on Sandy Beach Road for incorporation in the parks system of the Town of Pickering. CARRIED Item #13 Association of Kinsmen- Clubs - Heritage Day Councillor Kitchen indicated that as a member of the Kinsmen Club he pre~red to refrain from voting on this item. Resolution 20/76 - Item #13 Moved by Councillor Anderson, seconded by Councillor Robertson that the Municipality take out a half page advertisement in the special Canadian Heritage issue of the Kin Magazine at a cost of $145.00 CARRIED - 14 - 4/76 (III) RESOLUTIONS (Continued) Department Head Reports Attention was drawn to the fact that the Fire Department Report indicated several fires in the Airport Site. These fires are increasing in number. It was also indicated that the Federal Government and the provincial GoveDnment have not given any assistance for fire protection in the northern part of the municipality. It was furthermore pointed out that there have been several complaints received from school bus drivers about the condition of the roads in the Airport Site. The question was asked whether any further action can be taken to pressure the Federal Government to come to an agreement with the municipality for the maintenance of the roads. Direction was given that the Administrator-Clerk contact the Town Solicitor to discuss the possib1ities. It was also indicated that the municipal roads department has done a very good job in maintaining the municipal roads not withstanding the unfavourable weather conditions. Relative to the Transportation report Councillor Matheson indicated that he thought that it is time to institute a partial fixed route system during rush hours. Resolution 21/76 MOVED by Councillor Searle, seconded by Councillor Robertson that the following Department Head Reports for the month of January 1976 be adopted: Administrator-C1erk's Department Planning Department Treasury Department Legal Department Fire Department Public Works Department Recreation & Transportation Department CARRIED Reso1ùtion 22/76 MOVED by Councillor Anderson, seconded by Councillor Spratley that (1) By-law 334/75 is in conformity with the Official Plan of the Town of Pickering approved and in force at the time said By-law was passed, namely the 15th day of December 1975; (2) No further Official Plan has been proposed by the Council nor approved by the Ministry of Housing since the passing of said By-law 334/75 and which said By-law would not be in conformity, including the District Plan of the Town of Pickering District Planning Area, Region of Durham which was adopted by the Council February 17th 1975 and recommended to the Region of Durham for approval. CARRIED - 15 - 4/76 (III) RESOLUTIONS (Continued) Don Beer Arena It was indicated that complaints have been received about the condition:of the washrooms at the arena, condition of the ice and the general cleanliness of the building. It was suggested that the staff be increased in order to maintain this facility in excellent condition. Direction was given to the Administrator-Clerk to obtain a report of the cost of better maintenance in the Don Beer Arena. Resolution 23/76 MOVED by Councillor Robertson, seconded by Councillor Matheson that the rates for the Don Beer Arena be increased effective June 1st 1976, to the following rates: School rates remains at $10.00 per hour Subsidized - from $25.00 per hour to $27.50 per hour Non-Subsidized - from $30.00 per hour to $32.50 per hour Out of Town - from $35.00 per hour to $40.00 per hour Non-Prime (Local) from $20.00 per hour to $22.50 per hour Non-Prime (Out of Town) from $25.00 to $27.50 per hour as recommended by the Executive Committee during their Budget Meeting of January 12th 1976. CARRIED Resolution 24/76 MOVED by Councillor Spratley, seconded by Councillor Kitchen that the tender of Lymbird Lumber Company Limited in the amount of $8,170.00 for the supply of lumber £or the Creative Wood Forts be accepted. CARRIED (IV) BY-LAWS By-Law Number 350/76 Councillor Andersoniseconded by Councillor Matheson moved for leave to introduce a By-law of the Town of Pickering to authorize the execution of an amending agreement between the Corporation of the Town of Pickering and Brock North General Contractors Limited with respect to the construction of a dwelling unit on Part of Lot 3, Plan 282 in the Town of Pickering and tHat same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. , CARRIED By-law read a first, second and third time and finally passed. - 16 - 4/76 (IV) BY-LAWS (Continued) By-Law Number 351/76 Councillor Kitchen, seconded by Councillor Matheson moved for leave to introduce a By-law of the Town of Pickering to authorize'.. the execution of an agreement between the Corporation of the Town of Pickering and Her Majesty the Queen in right of the Province of Ontario as represented by the Minister of Transportation and Communications with respect to the Roads Needs Study for the Town of Pickering and that same be now read first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. CARRIED By-law read a first, second and third time and finally passed. By-Law Number 352/76 Councillor Matheson, seconded by Councillor Searle moved for leave to introduce a By-Law of the Town of Pickering to designate certain highways or portions of highways within the Town of Pickering as "SCHOOL BUS LOADING ZONES" and same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. CARRIED By-law read à first, second and third time and finally passed. By-Law Number 353/76 Councillor Robertson, seconded by Councillor Matheson moved for leave to introduce a By-law of the Town of Pickering to designate certain highways within the Town of Pickering as "through highways" and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. CARRIED By-Law read a first, second and third time and finally passed. By-Law Number 354/76 Councillor Searle, seconded by Councillor Matheson moved for leave to introduce a By-law o~ the Town of Pickering respecting the payment of collection of taxes, and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and passed and that the Sea1~of.the Corporation be thereto affixed. CARRIED By-law read a first, second and third time and finally passed. (IV) - 17 - 4/76 BY-LAWS (Continued) By-Law Number 355/76 (V) Councillor Searle, seconded by Councillor Anderson moved for leave to introduce a By-law of the Town of Pickering to fix instalment dates, penalty amounts and interest rates respecting the payment and collection of taxes and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. CARRIED By-Law read a first, second and third time and finally passed. CONFIRMATION BY-LAW By-Law Number 356/76 (VI) Councillor Searle, seconded by Councillor Robertson moved for leave to introduce a By-law of the Town of Pickering to confirm the proceedings of the Council of the Corporation of the Town of Pickering at its meeting held on the 2nd day of February 1976 and that same now be read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. HAMLIN PROPERTY IN WHITEVALE That a by-law be passed designating the former Hamlin property located in Lot 31, Concession 4, and more appropriately described by Roll Number 4-182 for Municipal purposes as a final step envisaged in the tax registration procedure set out in the Department of Hunicipal Affairs Act. AUTOMOBILE SERVICE STATION BY-LAW That by-law number 266/75 be amended to permit the operation of an automobile paint and repair shop at 968 Dillingham Road. BUILDING AND PLUMBING INSPECTIONS That the report of the Administrator-Clerk dated January 21st 1976 and the reports of the Director of Public Works dated January 9th and 15th 1976 with respect to Building Inspection within the Municipality be received for information. RESOLUTION - REGIONAL MUNICIPALITY OF WATERLOO That the resolution of the Regional Municipality of Waterloo with respect to the extension of funding for L.I.P. Programs beyond the traditional grant not be endorsed. ASSOCIATION MEMBERSHIPS That the report of the Administrator-Clerk dated January 20th 1976 with respect to Association Memberships for the Town of Pickering be adopted. ACCESS ROAD - BAY RIDGES CO~~UNITY CENTRE AND LIBRARY That the report of the Administrator-Clerk dated January 19th 1976 be accepted and that the recommended improvements to the access road to the Bay Ridges Community Centre and Library be carried out, subject to a satisfactory agreement with the Reqion of Durham. FEASIBILITY STUDY ON COMPUTER AUTOMATION That the report of the Treasurer-Collector dated January 7th 1976 with respect to the Reaion of Durham's Feasibility Study on Computer Automation be adopted and a copy of the report be submitted to the Regional Finance Department for their consideration. ACCOUNTS FOR APPROVAL That the Accounts to the amount of 559,797.61 dated December 31st 1975, as submitted by the Administrator- Clerk, be approved. SCARBOROUGH OFFICIAL PLAN PROPOSED AMENDMENT That the attached resolution concerning the Scarborough Official Plan Proposed Amendment Number 304, which resolution is dated the 26th day of January 1976, be adopted, and that a certified true copy of the adopted Resolution be forwarded to the Ministry of Housing forthwith; and that the said Resolution be forwarded to the Council of the Regional Municipality of Durham for its consideration. 16.
