Boxma (I) ADOPTION OF MINUTES II MOVED by Councillor Robertson, seconðed by Councillor Matheson that the minutes of the meeting of November.. 4th 1974 be adopted. DELEGATIONS (II) ¡ , 1. Moved by Councillor Searle, seconded by Councillor Kitchen that Mr. O'Leary be heard. 2. Mr. 0' Leary appeared before Council as a taxi cab owner in support of the granting of a second taxi brokerage within the Municipality. He was of the opinion that the presence Of a second brokerage would break the existing monopoly and create legitimate competition within the business that would lead to better service to the Community. He mentioned a notice in the paper. wherein the drivers going to the new brokerage had offered a 10% reduction to the Senior Citizens. He later learned that this was in violation of the Municipal By-law and suggested that it be amended to permit this reduction. Mr. O'Leary also read a letter from Mr. Norman Hughes, a driver with the Moon Dispatch System, wherein he listed a number of complaints. Moved by Councillor Kitchen, seconded by councillor Searle th~~ Mr. Marshall be heard. Mr. Marshall spoke in favour of the second brokerage from the position of a taxi driver. He outlined several deficiencies that existed within the present brokerage ranging from inferior equipment to dispatching favouring certain drivers. 3. Mr. Paul Tasse, another taxi cab driver, urged Council to issue the second brokerage licence. He related how he and other drivers had been denied their livelihood by the action of the existing brokerage wherein their cabs had been taken off the air. Council noted that perhaps Mr. Ralph Mahood, who was also listed on the Agenda as a Delegation, was not aware of the fact that the meeting started early, and for this reason proceeded to the other matters of business on the Agenda. (III) 1. 2. 3. 4. 5. 6. 7. 8. - 171 - 28/74 RESOLUTIONS REPORT OF THE EXECUTIVE COl.1MITTEE OF NOVEMBER 11TH 1974 The Executive Committee Dresents its Report and respect- fully reports and recammënds as follows: RECOMMENDATIONS - (For Council Approval) ONTARIO HOUSING ACTION PROGRAM That whereas the Province of Ontario has established a Housing Action Program to expedite the servicing of land and the production of housing, that the Council of the Town of Pickering express its general willingness to participate in the Ontario Housing Action Program, subject to necessary financial arrangements. NORTH PICKERING EXPROPRIATIONS That the Offers of Full Compensation made by the Province of Ontario of $3,600.00 for part of Lot 3, Concession 5 and $20,450.00 for part of Plan 614, Concession 2 be referred to our Legal Counsel for his recommendation and his advice concerning the need for an independent appraisal. CHRISTMAS CAROL PRESENTATION That the Pickering Travelling Choristers be invited to give their Annual Christmas Carol Presentation in the Council Chambers of the Municipal Building on KOOday. December 23rd 1974 at 7:30 p.m. TENDER - MOTOR TRUCK CHASSIS That the tender for the supply of a Motor Truck Chassis for the Fire Department in the amount of $7,744.45 be awarded to Chrysler Truck Centre Limited, as indicated in the Fire Chief's report of October 31st 1974 and the Buyer's report of October 31st 1974. KINSALE COMMUNITY ASSOCIATION That the North East Pickering Community Centre be renamed the Kinsale Community Centre and that ~si06 bQ 88de La the 1975 budget for the improvements requested, as recommended by the Director of Recreation and Transporta- tion in his report of November 1st 1974. PICKERING LANDFILL SITES That the report of the Solicitor of Metropolitan Toronto dated October 4th 1974 and the communication from Councillor Spratley concerning Pickering Landfi11 Sites dated October 16th 1974 be received, the contents noted and filed. TAXI LICENCES That the issuance of a second Taxi-cab Brokerage Licence, as indicated by the Town Solicit~ in his report of November 6th 1974 be authorized. INDUSTRIAL RAIL SPUR That whereas the C.N.R. has given assurance that the cost of constructing the portion of the Spur Line to Ontario Hydro's property would not exceed $10,000.00; be it therefore resolved that Council accept the agreement with Ontario Hydro with raspect to the construction of the Industrial Rail Spur, and that a By-law be passed authorizing t~ MAyor and Clerk to sign the same. - 172 - a.ft I' 74. 9. ~XECUTIVE CQ~ITTEE ACCOUNTS That the accounts in October 31st 1974 be REPO~ LCoþ~iftuodl the amount of $454.620.31 dated approved. 10. BAY RIDGES KINSMEN PARK That the Director of Recreation and Transportation be authorized to proceed with the installation of water to the Bay Ridges Kinsmen Park, as outlined in his memorandum of November 8th to the Manager, with the cost not to exceed $3,200.00. 11. 'ARM ASSESSMENT APPEALS That the basis of settlement of the Farm Assessment Appeals, as proposed by Mr. J.A. Kennedy, namely: for O.M.B. appeals 8.8% for the yeats 1968 to 1973, and for the appeals pending before the local judge at the rate of 7.3% for 1971,4.9% for 1972,4.6% for 1973, as indicated by the Solicitor in his report of November 7th 1974, be accepted. R~lution 288/74 MOVED by Councillor Anderson that items Executive Committee adopted. Matheson, seconded by Councillor 1, 3, 4, 5, 6, 8,9, 10, 11 of the report of November 11th 1974 be CARRIED Item 2 Councillor Anderson noted that the Jomar Subdivision was outside the area of expropriation and on this basis the Provincial offer for the lot in this subdivision should reflect a greater value. Resolution 289/74 MOVED by Councillor Matheson, seconded by Councillor Anderson that item 2 of the Executive Committee report of November 11th 1974 be adopted. CARRIED Item 7 Deferred pending the appearance of Mr. Mahood. Resolution 290/74 MOVED by Councillor Searle, seconded by Councillor Matheson that WHEREAS Section 636a of the Municipal Act enacted by Statutes of Ontario, 1973, c.124 transfers the responsi- bility for the hearing of the applications for cancella- tion, reduction or refund of taxes to the Council of the Municipality¡ AND WHEREAS notices in writing of applications have been received by the Clerk of the Municipality for the cancellation, reduction and refund of taxes for various reasons; AND WHEREAS upon investigation and receipt of reaeonabla explanations all claims have been substantiated; . BE IT THEREFORE RESOLVED that the Council of the Town of Pickering accept the following list of applications and authorize the adjustment of taxes to be made accordingly. CARRIED (IV) BY-LANS By-Law Number 130/74 Councillor Anderson, seconded by Councillor Matheson, moves for leave to introduce a By-law of the Town of Pickering to authorize the execution of a Letter of Agreement between the Corporation of the Town of Pickering and Ontario Hydro with respect to the con- struction of the industrial rail spur, and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. CARRIED By-law read a first, second and third time and finally passed. By-Law Number 131/74 Councillor Spratley, seconded by Councillor Robertson, moves for leave to introduce a By-law of the Town of Pickering to authorize the execution of an agreement between the Corporation of the Town of Pickering and Comsa Holdings Limited and Nicolae Comsa with respect to the rental of the Don Beer'Sports Arena for Summer Hockey School, and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. CARRIED By-law read a first, second and third time and finally passed. Recorded Vote: Yea: Messrs. Ashe, Anderson, Matheson, Robertson, Searle, Spratley. Nay: Mr. Kitchen (V) OTHER BUSINESS 1. The Mayor drew the attention of Council to a meeting with the Minister of the Environment, The Honourable William Newman, scheduled for November 19th 1974 at 3:30 p.m. Notice of Motion: Councillor Robertson served notice that he intends to introduce the followinq motion at the next meeting of Council: . MOVED by Councillor Robertson, seconded by Councillor Matheson that the Council of the Town of Pickering implement an Official Flag for pickering, and decide on methods of obtaining suitable designs. DELEGATIONS MOVED by Councillor Kitchen, seconded by Councillor Robertson that Mr. Walker, a Solicitor representing Mr. Mahood, be heard. Mr. Walker asked that the Clerk read into the record a prepared brief submitted by Mr. Mahood with respect to the subject of the taxi brokerage and the need for an addi ti onal one. Motion MOVED by Councillor Kitchen, seconded by Councillor Robertson that item 7 of the Executive Committee report of November 11th 1974 be deferred for further consideration. Councillor Kitchen was of the opinion that in view of the statements made during the meeting that all taxi cabs operating within the Municipality should be inspected by the Police Department on the following day to ensure that they meet the safety standards set out in the Taxi Cab By-law and to confirm the ownership of the respective vehicles. OTHER BUSINESS Councillor Kitchen asked that the subject of the issuance of the four remaining taxi cab licences be brought forward to the next Executive Committee for consideration. He also requested that the Taxi Cab By-law be put on the Agenda for the next Executive Committee meeting for a detailed review. Mayor Ashe advised the Council of a Special Council meeting scheduled for December 12th 1974 at 7:00 p.m. during which the Durham Region would be presen~inq the initial concepts of the Regional Official Plan. ~his would be followed by a Public Presentation in the Council Chambers at 8:00 p.m. All of the material used in the presentation would be on display at the Sheridan Mallon December 13th for the benefit of those who were unable to attend the Public Presentation during the previous evening. (VI) - 178 - 28/74 CONFIRMATION BY-LAW By-law Number 132/74 (VII) Councillor Robertson, seconded by Councillor Searle, moves for leave to introduce a By-law of the Town of Pickering to confirm the proceedings of the Council of the Corporation of the Town of Pickering at its meeting held on the 18th day of November 1974, and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. CARRIED By-law read a first, second and third time and finally passed.
