By-law No.7500/16
Being a by-law to amend Restricted Area (Zoning) By-law 3036,
as amended, to implement the Official Plan of the City of Pickering,
Region of Durham being Part of Lot 18, Concession 2, in the City
of Pickering (A 01/15) '
Whereas the Council of The Corporation of the City of Pickering passed By-law 7085/10,
amending By-law 3036, to permit a mixed use development for townhouse dwelling
units, apartment buildings, and commercial uses on lands being Part of Lot 18,
Concession 2, in the City of Pickering;
And whereas By-law 7085/10 includes an "(H)" Holding Symbol preceding the
"RH/MU-3" Zone, which has the effect of preventing the development of the lands until
such time as appropriate arrangements have been made to the satisfaction of the City
of Pickering respecting the acceptance of an updated Master Environmental Servicing
Plan (MESP) by the City and the Toronto and Region Conservation Authority (TRCA);
acceptance of a Stormwater Management and Hydrogeological Report consistent with
the updated MESP by the City and the TRCA; acceptance of a revised Environmental
Impact Study by the City and the TRCA; receipt of an acceptance letter from the
Ministry of Culture of the Stage I and 2 Archaeological Report; acceptance of a Noise
Impact Study by the Region of Durham; acceptance of an updated Phase I
Environmental Site Assessment by the Region of Durham; and execution and
registration of a Development Agreement with the City of Pickering;
And whereas the Owner has satisfied the engineering, transportation, environmental
and site design requirements of the Region of Durham, the Toronto and Region
Conservation Authority, and the City of Pickering, and has entered into an appropriate
agreement to the City's satisfaction for all the requirements for the development of the
mixed use project;
And whereas an amendment to amending By-law 7085/10, to remove the "(H)" Holding
Symbol preceding the "RH/MU-3" Zone is therefore deemed appropriate;
Now therefore the Council of The Corporation of the City of Pickering hereby enacts as
follows:
1. Schedule I •
Schedule Ito By-law 7085/10, is hereby amended by removing the "(H)" Holding
Symbol preceding the "RH/MU-3" Zone designation on Part of Lot 18,
Concession 2, as set out on Schedule I attached hereto.
2. Text Amendment
Section 5. of By-law 7085/10 is hereby repealed.

3. Area Restricted
By-law 3036, as amended by By-law 7085/10, is hereby further amended only to
the extent necessary to give effect to the provisions of this By-law as set out in
Section 2. above, and as set out in Schedule 1 attached hereto. Definitions and
subject matter not specifically dealt with in this by-law shall be governed by the
relevant provisions of By-law 3036; as amended.
4. Effective Date
This By-law shall come into force in accordance with the provisions of the
Planning Act.
