Bedfo rd (1 ) ADOPTION OF MINUTES MOVED by Councillor Anderson, seconded by Councillor Robertson that the minutes of the meeting of January 21st 1974 be adopted. (11) DELEGATIONS 1. , The Mayor invited ~r. Sims, a Solicitor representing ~r. Moodie, to speak with respect to the two Resolutions dealing with Mr. Moodie's property. By way of a sketch distributed to ~ers of Council, Mr. Sims illustrated the proposed use of the property as a ten~ and trailer park. 2. MO'~D by Councillor Robertson, seconded by Councillor Spratley that Mr. Ginter be heard. ~r. Ginter, owner of Paulynne Park, spoke in oppo.1t~a to the extension of the trailer camo. He read a lètëer from Mr. Souter of the l-i. T . R. C. A. wherein the Con..rvat.l.1ta Authority discouraged the expansion of Mr. Mood1ets operation in this area. CARRIED Resolution 27/74 MOVED by Councillor Anderson, seconded by Councillor Searle that the Town of Pickering go on record as being strongly opposed to the Terms set down in the announcement made by the Provincial C~vernrnent in regards to the Expropriation of Lands for the North Pickering Development, as follows: 1. We feel that there is a need for a Hearing of Necessity as set forth under the Expropriation Act, and would insist on the reasons for this section being overlooked, and - 22 - 3/74 Resolution 27/74 continued 2. We oppose the action being taken without any consultation with the Planning Department of the Town of Pickering, Region of Durham or their respective Councils and that copies of this Resolution be forwarded to the respective ~!inisters of the Provincial C~vernrnent, and the Chairman of the Regional Municipality of Durham. Resolution 28/74 MOVED by Councillor Anderson, seconded by Councillor Spratley that the Council of the Town of Pickering re-affirrn the position taken by the previous Council on its objections to the proposed Pickering Airport, as stated in Resolution # 8~/72, and further that the Planning Department be directed to prepare a submission to the Inquiry Commission and further that this submission register the objections of the Town Council to the proposed Airport and any other relevant objections which the Planning Department deem necessary to include in the submission under the Terms of Reference set down by the Commission. Ashe, ~nderson, Kitchen, Matheson, Robertson, Spratley, Searle Amendment to Resolution 28/74 rIDVED by Councillor Anderson, Seconded by Councillor Spratley that the following be added to Resolution 28/74: "Plus the new evidence presented to the newspapers by Councillor Spratley, relative to the Noise Zones; this can be incorporated in the brief prepared by the Town or in a separate brief by Councillor Spratley under the authorization of Council; using his e~eriences as a pilot to submit new evidence as set out under the Terms of Reference in Section II (1 - C) as it relates to the procedures as to the presentation to be presented to the J\irport Inquiry Commission." Ashe, Ki tchen, r,fatheson, Robertson and Searle - 23 - 3/74 Resolution 29/74 MOVED by Councillor Searle, seconded by Councillor Kitchen that the M.T.C. be requested to install traffic lights at the intersection of Sheridan Mall Parkway and Highway # 2, and that the Regional Traffic Engineer be asked to review the entire question of street lights on Highway # 2 from Fairport Road to Notion Road, as recommended by the Executive Committee, January 28th, 1974. CARRIED Resolution 30/74 MOVED by Councillor Searle, seconded by Councillor Robertson that the Engineer's reports of Nove~ber 27th and 29th, 1973 dealing with the Town Works Yard, be adopted, and specifically that: a) Council direct the Planning Department to recommend a Works Yard site in a suitable location to serve the Town of Pickering's future needs. b) That Council decide whether they wish an alternative site to the 5th Concession site or cash in lieu and conclude the arrangements with Metro based on that decision. c) That Council authorize a short study to determine the need, size of buildings and cost based on the Town of Pickering's boundaries and lesser responsibilities. d) That the firm of Totten, Sims, Hubicki Associates Limited be retained for such a study. As recommended by the Executive Committee, January 28th, 1974. CARRIED Resolution 31/74 MOVED by Councillor Searle, seconded by Councillor Spratley that the To~m Engineer be authorized to continue Winter Control on the roads under the jurisdiction of the Town of Ajax and Regional Municipality of Durham for the 1973-74 winter season, as recommended in his report of December 6th, 1973, and that the two jurisdictions be billed accordingly, as recommended by the Executive Committee, January 28th, 1974. CA.RRIED Resolution 32/74 MOVED by Councillor Robertson, seconded by Councillor Matheson that a Committee consisting of the Mayor, By-law Enforcement Officer and Councillor Matheson be formed and that they be directed to approach the Town of Ajax with a view to establishing a mutual animal shelter with each Municipality providing its own 'animal control service, as recommended by the Executive Committee, January 28th, 1974. ' CARRIED - 24 - 3/74 Resolution 33/74 MOVED by Councillor Robertson, seconded by Councillor Kitchen that the Mayor and Clerk be authorized to sign a lease with the Ontario Hydro Commission'covering the rental of the Commission-o~med land being used as a parking lot at the Don Beer Arena in accordance with the Hydro's letter of December 10th 1973 and that the term of such lease be for a minimum of twenty-five years, as recommended by the Executive Committee, January 28th 1974. CARRIED Resolution 34/74 MOVED by Councillor Robertson, seconded by Councillor Spratley that the Treasurer be authorized to advance the Pickering Public Library Board, an amount of $10,832.00 pending receipt of funds under the Federal- Provincial Winter Capital Project funds for renovations to the Rouge Hills Library, as recommended by the Executive Committee, January 28th 1974. CARRIED Resolution 35/74 MOVED by Councillor Spratley, seconded by Councillor Matheson that the Clerk's report of December 10th 1973 dealing with the appointment and payment of a Poundkeeper for the Municipality be approved and that the necessary by-law be passed, as recommended by the Executive Committee, January 28th 1974. CARRIED Resolution 36/74 r-mVED by Councillor Anderson, seconded by Councillor Spratley that WHEREAS Sideline 10/11 in Concession 7 and ~ is a Class IIBII road; and WHEREAS it is being used by a considerable number of gravel trucks whose G.V.N. exceeds the regulations on Class "B" roads ~ BE IT THEREFORE RECOW~ENDED that the Durham Region Police Force he requested to enforce the regulations of the Highway Traffic Act as it relates to Class liB" roads, and in particular Sideline 10/11 in Concession 7 and 8 and that the Class "B" roads be posted accordingly, as recommended by the Executive Committee, January 28th 1974. CA.RRIED Resolution 37/74 MOVED by Councillor Snratley, seconded by Councillor Anderson that 1) By-law 4341/73 is in conformity with the Official Plan of the Town of Pickering approved and in force at the time said By-law was passed, namely the 16th day of April, 1973. - 25 - 3/74 Resolution 37/74 (Continued) 2} No further Official Plan has been proposed by Council nor approved by the Ministry of Treasury, Economics and Intergovernmental~ffairs since the passing of said By-law 4341/73 and which said By-law would not be in conformity, including the overall revision adopted hy Council, January 18th, 1971 and Official Plan amendment ~18 adopted by Council October 4th, 1971, and both being before the Minister of Municipal Affairs. 3) And further, that the objections received objecting to this By-law be considered invalid. CARRIED Resolution 38/74 MOVED by Councillor Spratley, seconded by Councillor Robertson that the salaries of the non-Union staff be adjusted in accordance with the recommendations of the Executive Committee held on January 30th, 1974. CARRIED (V) BY-LAWS By-law Number 24/74 Councillor Matheson, Seconded by Councillor Searle moves for leave to introduce a By-l~w of the Town of Pickering to authorize participation in the ontario Municipal Employees Retirement System and that same now be read a first and second time, and that Council go into Committee of the Whole thereon. The Committee of the Whole arises and reports the By-law as read. Councillor Matheson, Seconded by Councillor Robertson moves that the report of the Committee of the Whole on By-law Number 24/71 be adopted, and that the said By-law be now read a Third Time and P~SSBD, that the Mayor and Clerk sign the same, and the seal of the Corporation be affixed thereto. CARRIED ~, By-law Number 25/74 Councillor ~ßtheson, Seconded by Councillor Kitchen moves for leave to introduce a By-law of the Town of Pickering to authorize the execution of a deed dated January 30th, 1974 between J.D.S. Investments Limited and the Corporation of the Town of Pickering and that same now be read ä first and second time, and that Council go into Committee of the Tfuole thereon. The Committee of the Whole arises and reports the By-law as read. Councillor Matheson, Seconded by Councillor Anderson moves that the report of the Committee of the t~ole on By-law Number 25/74 be adopted, and that the said By-law be now read a Third Time and PASSED, that the r«ayor and Clerk sign the same, and the seal of the Corporation be affixed thereto. CARRIED (VI) 1. 2. (VII) - 26 - 3/74 OTHER BUSINESS Council asked that the comments of the Durham Regional Health Board be secured concernincr the extension of the Moodie Trailer Camp. It was agreed that these motions be referred to the Planning Committee for direction. Concern was expressed over the excessive speed being used by gravel trucks on Liverpool Road North. The Clerk was asked to determine whether it is a 30 M.P.H. speed limit and request the police to enforce it. CONFIID4ATION BY-LAW By-law Number 26/74 (VIII) Councillor Kitchen, Seconded by Councillor Robertson moves for leave to introduce a By-law of the Town of Pickering to confirm the proceedings of the Council of the Corpora- tion of the To~m of Pickering at its meeting held on the 4th day of February, 1974 and that same now be read a first and second time, and that Council go into Committee of the Whole thereon. The Committee of the Whole arises and reports the By-law as read. Councillor Kitchen, Seconded by Councillor Spr~tley moves that the report of the Committee of the Whole on By-law Number 26/74 be adopted, and that the said By-law be now read a Third Time and PASSED, that the Mayor and Clerk sign the same, and the seal of the Corporation be affixed thereto.
