Mys1ik Town Manager Town Clerk Deputy Clerk (I) ADOPTION OF MINUTES Meeting of March 6th 1978 (II) 1. DELEGATIONS Honourable Norman Cafik, M.P. addressed Council to clarify the Government of Canada's position with respect to the Pickering Museum. 2. Mr. Bruce McDonald, Solicitor, representing E.R.S. Holdings Limited spoke against the recommendation of the Executive Committee to refuse his clients application for a Wayside Pit Permit and requested that this Permit be approvedsubject to his client entering into an agreement with the Town of Pickering to restore the pit to the Town!s satisfaction. 3. Mr. A. Brown, representing the Pickering Historical Society and other interested citizens were in attendance to speak to Item #6 of the Executive Committee Report regarding the expropriation of the Museum. 4. Mr. Derek Willis was present to speak to Item #1 and #2 of the Planning Report. (III) REPORTS Report of the Ontario Humane Society for the month of February 1978. (IV) RESOLUTIONS REPORT OF THE EXECUTIVE COMMITTEE OF MARCH 13th 1978 See Appendix I Resolution 29/78 Moved by Councillor Geraghty Seconded by Councillor Fisher That the Report of the Executive Committee dated March 13th 1978, be adopted with the following amendments: Item #6 was deferred pending the attendance of Mayor Anderson .at a Council Meeting. Item #13 was lost. CARRIED - 20 - 5/78 (IV) RESOLUTIONS (Continued) REPORT OF THE PLANNING COMMITTEE OF MARCH 14th 1978 See Appendix II Resolution 30/78 Moved by Councillor Fisher Seconded by Councillor Geraghty That the Report of the Planning Committee dated March 14th 1978, be adopted. CARRIED Resolution 31/78 Moved by Councillor Cahill Seconded by Councillor Kitchen That By-law 765/78 is in conformity with the Official Plan of the Town of Pickering approved and in force at the time said by-law was passed, namely the 20th day of February 1978¡ And that no further Official Plan has been proposed by Council nor approved by the Ministry of Housing since the passing of said By-law 765/78 and which said by-law would not be in conformity, including the District Planning Area, Region of Durham which was adopted by Council on February 17th 1975, and recommended to the Region of Durham for approval. CARRIED Resolution 32/78 Moved by Councillor Kitchen Seconded by Councillor Geraghty That the program of proposed expenditures for highway improvement for the year 1978 in the amount of $1,151,700.00 be adopted; And that the Town of Pickering hereby petitions the Ministry of Transportation and Communications for a subsidy for the year 1978 in the amount of $586,000.00. CARRIED (V) BY-LAWS Councillor Robertson, seconded by Councillor Fisher moved for leave to introduce By-laws of the Town of Pickering: By-Law Number 776/78 To authorize the execution of a Licence Agreement between the Town of Pickering and Charles McArthur Johnston and Maureen Margaret Johnston respecting Part of Lot 152, Plan M-20. File Number D 3310 - 21 - 5/78 (V) BY-LAWS (Continued) By-Law Number 777/78 To authorize the execution of two Agreements between the Town of Pickering and Fireside Custom Homes Ltd., with respect to Lots 21 and 22, Plan 1041, Pickering. (LD 266, 429-431, 531-2/77) File Number B 2310 By-Law Number 778/78 To regulate the construction of driveway entrances upon highways under the jurisdiction of the Town of Pickering and to repeal Town of Pickering By-law #196/75. File Number E 4200. By-Law Number 778/78 was referred back to the Executive Committee. By-Law Number 779/78 To authorize the execution of a Site Plan Agreement between the Town of Pickering and Foodex Systems Limited with respect to Part Lot 23, Concession 1, Pickering. File Number B 2310. By-Law Number 780/78 To authorize the execution of an Agreement between the Town of Pickering and Mario Zuccarini Construction Limited with respect to Part of Lots 1 to 5, Plan 189 and Part of Lot 33, Range 3, B.F.C., Pickering. (LD 123/77) File Number B 2310. By-Law Number 781/78 Being a Restricted Area By-law to amend Restricted Area By-law 3036, as amended, and to implement the Township of Pickering Official Plan on Part Lot 28, Concession 1, in the Town of Pickering. File Number B2310, A2/77. THIRD READING Councillor Robertson, seconded by Councillor Fisher moved that the report of the Committee of the Whole on By-law Numbers 776/78, 777/78, 779/78, 780/78, 781/78 be adopted, and that the said By-laws be now read a Third Time and PASSED and that the Mayor and Clerk sign the same, and the Seal of the Corporation be affixed thereto. CARRIED By-Laws read a first, second and third time and finally passed. - 22 - 5/78 (VI) OTHER BUSINESS Resolution 33/78 Moved by Councillor Fisher Seconded by Councillor Cahill That the app1icationfor a Wayside Pit Permit by E.'e R. S. Holdings Limited be reconsidered. CARRIED Resolution 34/78 Moved by Councillor Fisher Seconded by Councillor Cahill That the request by E.R.S. Holdings Limited fora Wayside Pit Permit in conjunction with the Ministry of Transportation and Communication Contract Number 77-133, be approved, subject to the applicant entering into an agreement with the Town of Pickering guaranteeing the restoration of the pit to the satisfaction of the Town. (VII) CONFIRMATION BY-LAW By-Law Number 782/78 Councillor Kitchen, seconded by Councillor Cahill moved for leave to introduce a By-law of the Town of Pickering to confirm the proceedings of the Council of the Corporation of the Town of Pickering at its meeting held on the 20th day of March 1978, and that same be now read a first, second and third time and that the same be now finally passed and. that the Mayor and Clerk sign. the same and that the Seal of the Corpora~ion be thereto affixed. CARRIED By-Law read a first, second and third time and finally passed. (VIII) ADJOURNMENT The meeting adjourned at the hour of 9:09 P.M. A qualified architect and urban sociologist be assigned to the study team, satisfactory to the Town. The assurance that those staff members identified in their otiginal proposal to carry out the study be ' guaranteed. 2. 3.
