Anderson COUNCILLORS: Byers Cahill Coburn Fisher Robertson Stoner ALSO PRESENT: N. C. Marshall - Town Manager B. Taylor - Town Clerk ( 1 ) ADOPTION OF MINUTES Regular Meeting of July 6, 1981. Special Meeting of August 20, 1981 (II) 1. DELEGATIONS Mr. Ron Cameron, 1981 United Way Campaign Chairman, addressed Council to make application for a per capita grant from the Town in support of the 1981 United Way Campaign. 2. Mr. Wally Kitchener, representing the Pickering Hockey Association, addressed Council to submit a brief and petition in support of the proposed recreation complex and presented a plaque to Mr. Thomas Quinn, Director of Parks and Recreation, for his support and co-operation of the Pickering Hockey Association. -... 15/81 - 66 - ( I I) RESOLUTIONS Resolution #58/81 Moved by Councillor Fisher Seconded by Councillor Stoner That provision be made in the 1982 budget for a per capita grant of 30i for the year 1982 to the United Way of Ajax-Picker- ing; and that permission be granted to fly the United Way flag at the Municipal Offices during the campaign period. CARRIED Recorded Vote Yea: Councillors Coburn, Fisher, Stoner and Mayor Anderson Nay: Councillors Byers, Cahill and Robertson Resolution #59/81 Moved by Councillor Stoner Seconded by Councillor Robertson That the application made by the Town Clerk to the Region of Durham to increase the Town's Ontario Municipal Board quota from $4,484.950.00 to $5,193,000.00 be confirmed. CARRIED Resolution #60/81 Moved by Councillor Stoner Seconded by Councillor Fisher That the reports of the Treasurer-Collector dated July 3rd and August 10th 1981 with respect to the 1980 Equalization Factors be adopted; and that the revised 1980 Equalized Assessment Report for the Region of Durham, submitted by the Regional Assessment Commissioner on July 24th 1981, be adopted. CARRIED 15/81 - 67 - Resolution #61/81 Moved by Councillor Stoner Seconded by Councillor Coburn That Tender T-24-81 submitted by Elirpa Construction Limited in the amount of $205,398.50 for the construction of Clements Road be approved subject to the approval of the Regional Municipality of Durham of the watermains and sanitary sewers in regard to this tender. CARRIED Resolution #62/81 Moved by Councillor Stoner Seconded by Councillor Robertson That Co-operative Tenders WD 25-81 and WD 26-81 submitted by Canadian Salt Company Limited for the supply of sodium chloride in the amount of $2,730/tonne, F.O.B. Oshawa dock and T.H. Forsythe Haulage Limited for the delivery of sodium chloride in the amount of $1.22/tonne be approved. CARRIED Resolution #63/81 Moved by Councillor Stoner Seconded by Councillor Robertson That Co-operative Tender SSD 31-81 submitted by Imperial Oil Limited in the amount of 20.36i per litre for the supply of No.2 Domestic Fuel, less a firm discount of 4.64i per litre be approved. CARRIED 15/81 - 68 - Resolution #64/81 Moved by Councillor Robertson Seconded by Councillor Stoner WHEREAS, on May 16, 1981, Council made Resolution 16/81, Items 1 and 2 of which approved rezoning and draft plan applications (A 83/80 and 18T-80073) submitted by M.A. Miller respecting Lot 8, Plan 509; and WHEREAS, on June 4, 1981, the Land Division Committee of the Regional Municipality of Durham approved an application to sever that part of Draft Plan 18T-80073 designated as Lot 12 and Block 13 thereon (LD 220/81); and WHEREAS such severance cannot be concluded under existing zoning until each parcel has frontage of at least 18 metres; and WHEREAS such frontage can be secured by the lifting of the reserve designated as Block B on Plan M-1171 and the establishment of a reserve across the easterly end of Lot 11, Draft Plan 18T-80073; NOW THEREFORE BE IT RESOLVED THAT: 1. Upon the receipt by the Town of a registrable deed for a reserve across the easterly end of Lot 11, Draft Plan 18T-80073, the Council shall consider a By-law to dedicate Block B, Plan M-1171, as public highway (Lodge Road). CARRIED Resolution #65/81 Moved by Councillor Stoner Seconded by Councillor Byers That Tender T-22-81 submitted by Pollard Industrial Roofing Limited in the amount of $12,361.00 for the repair and replacement of the Works Centre roof, be approved. CARRIED 15/81 - 69 - Resolution #66/81 Moved by Councillor Robertson Seconded by Councillor Coburn WHEREAS it is the intention of Council to construct a Re- creation Complex as part of the Town Centre Development, and WHEREAS it is anticipated that a Capital Grant will be obtained from Wintario to assist in defraying the cost of this facility, and WHEREAS it is a condition of such grants that the Municipal Council formally accept the terms and conditions that are a requirement of obtaining a Wintario Capital Grant; BE IT THEREFORE ENACTED THAT Council hereby accepts the terms and conditions attached to the obtaining of a Wintario Capital Grant and the Mayor and Clerk are hereby authorized to acknowledge, in writing, the acceptance by the Town of Pickering of these terms and conditions. CARRIED Recorded Vote Yea: Councillors Byers, Coburn, Fisher, Robertson, Stoner and Mayor Anderson Nay: Councillor Cahill 15/81 - 70 - Resolution #68/81 Moved by Councillor Cahill Seconded by Councillor Byers WHEREAS over the past number of years the public has express- ed concern and objection over the use of off-road motorized recreational vehicles on public and privately owned lands; and WHEREAS several reports have been written on this subject with the conclusion that the major problem in urbanized areas is primarily with vehicles such as motorcycles, mini-bikes and trailbikes but also, to an ever increasing degree, with snowmobiles, pedalbikes, all-terrain and modified large-tired vehicles; and WHEREAS many organizations in the Province have been estab- lished to promote the safe and lawful usage of recreational vehicles in defined areas and to meet the interests of owners in terms of providing marked trails, competition and an opportunity for persons with similar interests to assemble; and WHEREAS unfortunately these efforts have had a minimal deterrent effect on the majority of vehicle owners and certain problems connected with the ownership and use of off-road motorized recreational vehicles still exist, namely: 1. Damage to public and private property, namely, grass, vegetation, soil compaction, fences and structure; 2. Disturbing the peace of residents due to the high level of noise exission of vehicles; 3. Pollution through exhaust fumes, gas and oil spillage; Safety hazards for people and primarily children because of speed, inexperience and disregard for reasonable precautions in relation to the terrain of the area being travelled (e.g. hilly and woody areas, playground areas); 4. 5. Lack of parental control, in terms of the age and capability of the driver in the areas where the vehicles are being driven; 6. The limited ability to enforce existing legis- lation relating to off-road motorized recreational vehicles by law enforcement officers; and The reluctance of the Provincial Government to pass effective legislation to control the sale and use of off-road motorized recreational vehicles; 7 . and 15/81 - 71 - WHEREAS it is the opinion of the Council of the Corporation of the Town of Pickering that the most effective method of controlling and minimizing the detrimental effects of the off-road motorized recreational vehicles is to request the Provincial Government, in the strongest possible terms, to enact certain legislation; NOW THEREFORE, BE IT RESOLVED THAT: The Town Clerk request the Provincial Government to enact legislation which would implement the following recommended procedures: 1. (a) (b) (c) (d) (e) (IV) all off-road motorized recreational vehicles prior to sale by any means, must be registered and licensed in the same manner and under the same regulations and penalties as an automobile or motorcycle; all drivers of off-road motorized recreational vehicles must be tested and licensed to operate such vehicles by the Ministry of Transportation and Communications. In the event of juveniles operating vehicles, or otherwise contravening any regulations, the parent or guardian shall be held respons- ible for such actions; registered owners of off-road motorized recreational vehicles shall be responsible and liable for all usage of the vehicles (e.g. in the event an unlicensed driver was operating the vehicle in contravention of a By-law or other legislation, both the driver and the owner would be charged with the appropriate offences); off-road motorized recreational vehicles found operating on public or private property without written or designated permission may be impounded by the Police Department having local jurisdiction; and off-road motorized recreation vehicles used in an ancillary capacity to a farm operation be exempt from the legislation in question. By-law Number 1347/~1 Being a By-law to amend By-law 1024/79 appointing the members of the Pickering Hydro-Electric Commission fÖr the term June 22, 1979 to November 30, 1982,bbth inclusive. By-law Number 1348/81 Being a By-law to provide for interest to be added to tax arrears. By-law Number 1349/81 Being a Restricted Area By-law to amend Restricted Area By-law 2520, as amended, to implement the Official Plan of the Town of Pickering District Planning Area Region of Durham, in Part of Block Y, Plan M-16 in the Town of Pickering. By-law Number 1350/81 Being a By-law to authorize the execution of a Release by the Corporation of the Town of Pickering of Terence James Ryan, from a Demolition Agreement respecting Part Block 3, Plan 353, being all of Lot 97, Plan 1041, Pickering By-law Number 1351/81 Being a By-law to authorize the execution of a Release by the Corporation of the Town of Pickering of Theodorus Jan Hendrik Vermeulen and Martini Vermeulen from a Demolition Agreement respecting Lot 76, Plan 816, Pickering. By-law Number 1352/81 Being a By-law to authorize the execution of a Rlease by the Corporation of the Town of Pickering of Joseph and Ingrid Verbancic from a Demolition Agreement respecting Part Lot 32, and Part of the road allowance between Lots 32 and 33, Concession 1, Pickering. By-law Number 1353/81 Being a By-law to authorize the execution of a Release by the Corporation of the Town of Pickering of Samuel Neill and Margaret Neill from a Demolition Agreement respecting Lot 25, Plan 274, Pickering. By-law Number 1354/81 Being a By-law to authorize the execution of a Release by the Corporation of the Town of Pickering of Pine Ridge Nuerseries Limited from a Demolition Agreement respecting Part Lot 18, Concession 2, Pickering. 15/81 - 73 - By-law Number 1355/81 Being a By-law to authorize the execution of a Release by the Corporation of the Town of Pickering of Nick Rohwer Construction Limited from a Demolition Agreement respecting Lots 35 and 36 and Part Lot 37, Plan 283, Pickering (Parts 1 and 2, Plan 40R-3S32). THIRD READING Councillor Stoner, seconded by Councillor Fisher moved that the report of the Committee of the Whole on By-law Numbers 1303/81, 1313/81, 1347/81, 1348/81, 1349/81, 1350/81, 1351/81, 1352/81, 1353/81, 1354/81 and 1355/81 be adopted, and that the said By-laws be now read a Third Time and PASSED and that the Mayor and Clerk sign the same, and the Seal of the Corporation be affixed thereto. CARRIED By-laws read a first, second and third time and finally passed. (V) OTHER BUSINESS 1. Councillor Cahill requested an opinion from the Town Solicitor on the proposed amendment to the Human Rights legislation. Councillor Byers stated that there are problems with drainage on lots in plans of subdivision and submitted a draft by-law to regulate drainage for which the Town Solicitor was aked to report its feasibility. 2. 3. Councillor Coburn indicated that the parking lot at Swensen's Ice Cream Parlour is dangerous and introduced the following motion: Resolution #69/81 Moved by Councillor Coburn Seconded by Councillor Robertson That the Town Solicitor take whatever action is necessary to bring the Swensen's Ice Cream Parlour and Rave Variety property into compliance with the site plan agreement. CARRIED 4. 5. (VI) - 74 - 15/81 Councillor Stoner announced that History In Action will take place on September 12 and 13, 1981. The following matters were discussed prior to the regular meeting: a) A presentation of the final drawings of the recreation complex will be given at the firm of Beddall/Shukla on Thursday, September 24, 1981 at 7:00 P.M. c) With respect to a land severance on Milton Road by Mrs. Krygsman, a suburban standard for the construction of Milton Road was permitted by Council Council directed that Rockport Developments must plant a hedge according to the site plan agreement. d) e) Council will authorize all street dances in future because of problems incurred by the Police this year. f) Planning Committee Meetings were scheduled for September 29th and October 20th at 7:30 P.M. CONFIRMATION BY-LAW By-law Number #1356/81 Councillor Stoner, seconded by Councillor Fisher moved for leave to introduce a By-law of the Town of Pickering to confirm the proceedings of the Council of the Corporation of the Town of Pickering at its meeting held on September 8, 1981, and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed.
