(II) 'Part 'A' Information Reports Councillor Ashe, Chair, gave an outline of the requirements for a Statutory Meeting under the Planning Act. He outlined the notification process procedures and also - noted that if a person or public body does not make oral or written submissions to the City before the by-law is passed, that person or public body are not entitled to appeal the decision of City Council to the Ontario Municipal Board, and may not be entitled to be added as a party to the hearing unless, in the opinion of the Board, there are reasonable grounds to do so. 1 Cite/ 00 Planning & Development Committee Meeting Minutes Monday, April 11, 2016 7:00 pm — Council Chambers Chair: Councillor Ashe C. Rose, Chief Planner appeared before the Committee to act as facilitator for the public portion of the meeting, explaining the process for discussion purposes as well as the order of speakers. 1. Information Report No. 04-16 Draft Plan of Subdivision Application SP-2015-07 Zoning By-law Amendment Application A 16/15 Woodview Land Development Corporation (Geranium Homes) Part of Lot 10, Plan 329 (1952, 1958 and 1960 Woodview Avenue) A public information meeting was held under the Planning Act, for the purpose of informing the public with respect to the above-noted application. D. Wylie, Principal Planner, Policy, appeared before the Committee and through the aid of a power point presentation, provided an overview of the application. She noted the applicant is proposing the development of 23 lots for detached dwellings. She outlined the public comments received to date. Matthew Cory, Malone, Given Parsons Ltd., appeared before the Committee on behalf of the applicant. He indicated they were still waiting for agency comments. Through a power point presentation, he provided an overview of the environmental considerations, density as well as an outline of the proposed elevations. Joe Moire, 1959 Woodview Avenue, appeared before the Committee in opposition to the application. He stated he had previously appeared before Council with respect to a similar application for these lands and provided copies of letters which he had submitted at that time. He stated that numerous trucks were using Woodview Avenue at that time to bring in loads of fill which had been dumped within the wetlands. He stated he disagreed with the statement that only a portion of the development was in the wetlands, noting it was within the wetlands, which does not comply with Provincial policies related to significant wetlands. He noted his concerns for the resulting damage to the ecosystem. A resident of 121 Finch Avenue, Pickering, appeared before the Committee in opposition to the application. She stated she resides at the northern portion of the proposed development, and noted the south portion of her property is very swampy. She noted her concerns with respect to the neighbouring properties and questioned how the water would be redirected. She also noted concerns for the proposed buffer which would result in flooding, thereby damaging the ecosystem, and endangering wildlife. She stated that she had submitted her concerns in writing to staff. 2 c 1 A Planning & Development ' Committee Meeting Minutes Monday, April 11, 2016 7:00 pm - Council Chambers Chair: Councillor Ashe A representative from Golder Associates Ltd. appeared before the Committee, noting a study had been conducted on the site to address concerns raised. He also noted that groundwater should not be impacted by the development, explaining the means to minimize the impact. Moved by Councillor McLean Seconded by Councillor Cumming That the rules of procedure be suspended in order to hear Report PLN 05-16 as the next item. Carried. (III) Part `B' Planning & Development Reports 1. Director, Corporate Services & City Solicitor, Report PLN 05-16 Zoning By-law Amendment Application A 02/16 All-Mar Developments Limited Part of Lot 19, Range 3, BFC, being Part 3, Plan 40R-2194 (970 Brock Road) Recommendation Moved by Councillor McLean Seconded by Mayor Ryan That Zoning By-law Amendment Application A 02/16, submitted by All-Mar Developments Limited, to permit "Professional Office" and "Business Office" uses on lands being Part of Lot 19, Range 3, BFC, being Part 3, Plan 40R-2194 be approved, and that the draft Zoning By-law Amendment as set out in Appendix I to Report PLN 05-16 be forwarded to Council for enactment. Amy Emm, Planner II, appeared before the Committee and through the aid of a power point presentation, provided an overview of the application. She noted the applicant is proposing 32 three storey townhouse units with vehicle access on an internal.road. She stated the units would be fronting onto Altona Road, with all units housing two car garages. Matthew Cory, Malone, Given Parsons Ltd., appeared before the Committee on behalf of the applicant. Through a power point presentation, he outlined the proposal to change the density from low to medium, stating that the townhouse development seems the best use for the property, noting the irregularity of the site. He stated that technical comments had not yet been received, and that they would come back at that time to address resident concerns. Cy Durdle, 1497 Altona Road, Pickering, appeared before the Committee in opposition to the application. He stated concerns with property values decreasing, traffic, lighting as well as noise. He also noted parking would be a major problem as well. He noted there was no logic to the traffic studies being conducted during August when schools are out and traffic is light. He felt the previous application of ten homes was more acceptable as the current application is not consistent with low density. Peter Shaver, 266 Richardson Street, Pickering, appeared before the Committee in opposition to the application. He stated the neighbourhood is currently low density, with no walkability to amenities. He noted parking would flow onto Richardson Street and put a strain on the neighbourhood with increased traffic and safety concerns. He also stated concerns with garbage and lighting, also noting that the proposed walkways would be too narrow. Steve Alexiadis, 278 Richardson Street, Pickering, appeared before the Committee in opposition to the application. He stated concerns with privacy, home values, water and parking problems. David Golding appeared before the Committee stating he owns property on Richardson Street. He stated his concerns with parking issues as well, noting parking would flow onto Richardson Street. He also noted his opposition to the density, stating the area should remain low density. Haitao Liu, 274 Richardson Street, Pickering, appeared before the Committee in opposition to the application, stating concerns over density, traffic, parking and safety. He also felt the applicant should do additional research. 4 Cr./ 114 Planning & Development , '�" Committee Meeting Minutes liON� t4I�[ Monday, April 11, 2016 7:00 pm — Council Chambers Chair: Councillor Ashe Joe Pacione, 331 Sheppard Avenue, Pickering, appeared before the Committee in opposition to the application, stating 32 units is not consistent with the neighbourhood, which should remain low density. He felt there were other areas in Pickering that were more suitable for higher densities. He noted that a development of 10 homes would placate everyone. James Comeau, 1478 Altona Road, Pickering, appeared before the Committee in opposition to the application, noting his concerns with grading as he currently has issues with drainage on his property. He stated his desire to see barriers in order to protect his property, noting concerns as well for a drop in his property value as well as garbage and privacy issues. Chris Kvorka, 270 Twyn Rivers Drive, Pickering, appeared before the Committee in opposition to the application, noting 32 units were not in line with the neighbourhood. He also noted concerns for increased traffic, and parking overflow and felt the original application of 10 homes was more acceptable. Farhan Basharat, 1477 Altona Road, Pickering, appeared before the Committee in opposition to the application. He stated the entrance to the development was directly in front of his driveway and would impact the character of the area. Darryl Nurse, 324 Sheppard Avenue, Pickering, appeared before the Committee in opposition to the application. He stated there are significant concerns with this development, noting safety issues with blind spots which have been created as a result of previous grading which raised the elevation. He also noted other areas in Pickering with high densities primarily back onto public or greenspace, not onto areas of low density homes. He noted that the grading has also created flooding issues in the area. Florence Yu, 274 Richardson Street, Pickering, appeared before the Committee in opposition to the application, stating the low density area of the neighbourhood is what brought her to Pickering. She stated the City needs to grow slowly in a safe way. Matthew Cory noted they were taking note of the resident's concerns and would be addressing them. A discussion period ensued with Members questioning the resulting consequences should the application be challenged, and whether this would set a precedent.
