Taylor - Town Clerk ( 1 ) ADOPTION OF MINUTES Regular Meeting of January 18, 1982 Special Meeting of January 25, 1982 ( I I) RESOLUTIONS Resolution #7/82 - See Appendix #1 Moved by Councillor Stoner Seconded by Councillor Byers That the Report of the Executive Committee dated January 25, 1982, be adopted. CARRIED Recorded Vote on Item #8 Yes: Councillors Byers, Fisher, Stoner and Mayor Anderson No: Councillors Cahill, Coburn and Robertson 5/82 - 14 - Resolution #8/82 - See Appendix #2 Moved by Councillor Coburn Seconded by Councillor Byers That the Report of the Planning Committee dated January 26, 1982 be adopted with the following amendments: Items #5 and #6 were deferred until the Council Meeting of February 15, 1982. CARRIED The following motions were considered in conjunction with the preceding resolution: Resolution #9/82 Moved by Councillor Robertson Seconded by Councillor Stoner That Item #2 of the Planning Committee Report be deferred for two weeks pending the owner securing an agreement with the Region of Durham. LOST Resolution #10/82 Moved by Councillor Robertson Seconded by Councillor Fisher That Item #2 of the Planning Committee Report be amended in Condition #3 by deleting all words after the phrase "subject lands" in the seventh line and substituting there- for the following: "subject to the owner entering into an agreement to the satisfaction of the Region of Durham". CARRIED 5/82 - 15 - Resolution #13/82 Moved by Councillor Byers Seconded by Councillor Cahill That subject to the comments of area residents being sol- icited, the Town of Pickering close the pathway between Old Forest Road and Rosebank Road North and lease these lands to abutting property owners at a nominal cost. CARRIED (III) BY-LAWS Councillor Cahill, seconded by Councillor Robertson moved for leave to introduce By-laws of the Town of Pickering: By-law Number 1426/82 To alter the wards within the Town of Pickering. By-law Number 1427/82 To authorize the execution of an Agreement between Emma Nellie Krygsman and the Corporation of the Town of Pickering respecting the construction of part of Milton Road (LD147/81). By-law Number 1428/82 Being a Restricted Area By-law to amend Restricted Area By-law 3036, as amended, to implement the Official Plan of the Town of Pickering District Planning Area, Region of Durham, in Part Lot 28, Concession 1 in the Town of Pickering. By-law Number 1429/82 To authorize the execution of an Agreement between J.F. Coughlan Construction Co. Ltd. and the Corporation of the Town of Pickering respecting the future development of Part Lot 33, Range 3, B.F.C., Pickering (LD275!81). By-law Number 1430/82 To amend the Town of Pickering Municipal Code to fix instal- ment dates respecting the collection of taxes. - 16 - 5/82 By-law Number 1431/82 To amend the Town of Pickering Municipal Code to adopt the 1982 estimates of all sums required during the year for the purposes of the Municipality of the Corporation of the Town of Pickering and to provide for the levying of the rates necessary to cover the estimated 1982 levy from the Council of the Corporation of the Regional Munici- pality of Durham. By-law Number 1432/82 To amend By-law 1064/79 licensing, regulating and governing taxicabs and limousine drivers, owners and brokers. CARRIED The following motion was considered in conjunction with By-law 1426/82: Moved by Councillor Cahill Seconded by Fisher That By-law 1426/82 be amended to provide for a five ward system as per sample submitted and to assure that the resi- dents in the rural area shall always have representation on the Council of the Town of Pickering regardless of where the Regional representative resides. LOST Recorded Vote on the preceding amendment: Yes: No: Councillors Cahill and Fisher Councillors Byers, Coburn, Robertson, Stoner and Mayor Anderson THIRD READING Councillor Robertson, seconded by Councillor Cahill moved that the report of the Committee of the Whole on By-law Numbers 1426/82, 1427/82, 1428/82, 1429/82, 1430/82, 1431/82 and 1432/82 be adopted, and that the said By-laws be now read a Third Time and PASSED and that the Mayor and Clerk sign the same, and the Seal of the Corporation be affixed thereto. CARRIED By-laws read a first, second and third time and finally passed. Recorded Vote on the Third Reading of the By-law: Yes: Councillors Byers, Coburn, Fisher, Robertson, Stoner and Mayor Anderson Councillor Cahill No: 5/82 - 17 - (IV) OTHER BUSINESS 1. Councillor Byers requested a report on what will be accomplished with the by-law to licence places of amusement. Resolution #14/82 2. Moved by Councillor Fisher Seconded by Councillor Stoner That the Town of Pickering request the Ministry of Transportation and Communications to install a flashing light at the intersection of Highway #7 and Regional Road #31 (Westney Road). CARRIED 3. Staff was directed to prepare a Development Plan for the Hamlet of Greenwood to be submitted to Council in the Fall of 1982. Engineering studies are to be prepared by the developer of the proposed subdivision in Greenwood only for this particular property and at his cost. (V) CONFIRMATION BY-LAW By-law Number 1433/82 Councillor Cahill, seconded by Councillor Byers moved for leave to introduce a By-law of the Town of Pickering to confirm the proceedings of the Council of the Corporation of the Town of Pickering at its meeting held on January 25, 1982 and February 1, 1982, and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. CARRIED By-law read a first, second and third time and finally passed. That the purchasers of the homes within the development be advised with (within) the agreement of purchase and sale that although there is a proposed school site within the development, the students from the subject development may have to be transported to existing schools and that a school is not likely to be built for several years and only then if it can be justified to the satisfaction of the Minister of Education. That the owner agree to the satisfaction of the Town: a) to provide a report indicating the effect that storm water management, site grading, and below and above ground services within the area of the draft plan will have on the natural environment of abutting lands. b) to undertake and guarantee any work necessary to maintain the natural environment of abutting lands. 15. That temporary turning circles be provided at the two temporary termini of Street 'F' . 16. That Lots 1 to 188 inclusive, be developed for single detached residential purposes and Blocks B, C, D, Y and F-Q inclusive be developed for single detached, semi- detached and/or single attached residential purposes at a net density in conformity with the Highbush Community Plan. .. ' - 5 - 18. That Block 'A' be developed for church purposes (including a day nursery as a permitted use). That Blocks Sl - S32 inclusive be developed as a public school site. However, should the Durham Board of Education not exercise its acquisition option, and the Town de- cline its opportunity to purchase, these Blocks may be developed for single detached residential purposes in the manner in. dicated on the draft plan. 17. APPLICATION FOR REZONING BY THE NEW LIFE TABERNACLE ON TOYNEVALE ROAD TO PERMIT. A DAY NURSERY FILE NUMBE&.- B 2310 - A 94/81 That By--law 1399/81 is in conformity with the Official Plan of the Region of Durham and in force at the time that this by-law was passed, namely the 16th day of November, 1981; ~, ~ and that no further official plan has been proposed by Council nor approved by the Ministry of Housing since the passing of said By-law 1399/81 in which the said by-law would not be in conformity. 2.
