Anderson - (Attending Site Selection '86) (I) ADOPTION OF MINUTES Meeting of January 20, 1986. (II) DELEGATION 1. David Reid, President, Rosebank Road North and Area Community Association, addressed Council in support of the draft plan of subdivision and zoning amendment application submitted by Sandbury Building Corporation, Dekkema Developments and E.L. Stroud. See Resolution #8/86 Item #2 2. Mr. Bernie Luttmer, representing Swan's Marina, addressed Council with respect to the conditions of approval of his rezoning application. He inquired into the expected costs of improvements to Liverpool Road. See Resolution #9/86 (III) RESOLUTIONS Resolution #8/86 - See Appendix I Moved by Councillor Stoner Seconded by Councillor Robertson That the Executive Committee Report dated January 27, 1986, be adopted. Absent: Mayor Anderson CARRIED 3/86 Resolution #9/86 Moved by Councillor Robertson Seconded by Councillor Stoner That By-law Amendment Application A 40/85 submitted by T.W. Beddall on behalf of the owners, B. & M. Luttmer, to change the zoning on lands being Lots 27 and 28, Plan M-89 and Part 1, Plan 40R-4563, from ' (H) 03B' - (Holding) Waterfront Zone, to an appropriate zoning that will permit redevelopment of these lands for marina and related uses including restaurants, boat and engine repair shops, marina offices, and a temporary residential dwelling unit, be APPROVED, subject to the following conditions: 1. That prior to the forwarding of an implementing by-law to Council: i) the owner enter into an appropriate development agreement with and to the satisfaction of the Town which shall include-provisions respecting the improvement of Liverpool Road (sidewalks, curbing, boulevard improvements and sodding, street lighting) across the frontage of the subject property; ii) the owner enter into an appropriate agreement with and to the satisfaction of the Region of Durham respecting the extension of Regional water supply to the subject property. 2. That prior to the issuance of a building permit, i) the owner satisfy The Metropolitan Toronto and Region Conservation Authority respecting the issuance of permits in accordance with Regulation 170; ii) the owner enter into an appropriate site plan agreement with and to the satisfaction of the Town. 3. That the temporary residential dwelling use proposed by the owner be permitted through the use of a 'temporary use' by-law under Section 38 of the Planning Act, 1983, for a period of three years and be restricted to a maximum floor area of 248 square metres. 4. That the implementing by-law, i) require the provision of a minimum of 68 parking spaces (on-site) and a maximum of 80 boat slips for the development; ii) establish a gross floor area limitation of 93 square metres for 'sit-down/take-out, restaurants and 17 square metres for 'take-out only' restaurants; iii) establish a maximum gross floor area of 980 square metres for marina related uses such as boaters' lounge, clubroom, storage, washrooms, offices, service centre, repair shops, terrace areas and restaurants. CARRIED 3/86 Resolution #10/86 Moved by Councillor Brenner Seconded by Councillor Arthurs WHEREAS, on April 5, 1983, the Council of the Corporation of the Town of Pickering requested that the Woodlands Community Plan be reviewed, particularly as it affects the Highway 401 and Kingston Road corridor; and WHEREAS, on January 21, 1985, the Council concurred in the extension of the particularity of that review to include five specific sites north of Kingston Road; and WHEREAS, on July 2, 1985, by Resolution 51/85, item 6, the Council received for information Planning Report 39/~5, dated June 17 1985, respecting carrying out of that review, ' NOW THEREFORE, BE IT RESOLVED THAT: 1. The Director of Planning is hereby directed to undertake a review of land use planning policies in the Woodlands Community, particularly as they affect the Highway 401-Kingston Road corridor, including the eight sites identified A, B, C, D, E, F, G and H in Planning Report 9/85. CARRIED Resolution #13/86 ~Moved by Councillor Stoner Seconded by Councillor Robertson That the 1986 salaries for the Non Un Town Manager's c ........ - ion Group contained in the v~aentla± submission January , adopted by Council. of 28, 1986 be CARRIED 3/86 Resolution #14/86 Moved by Councillor Stoner Seconded by Councillor Robertson WHEREAS the stated purpose of the Environmental Protection Act, R.S.O. 1980, chapter 141, as amended, "is to provide for the protection and conservation of the natural environment": and WHEREAS, pursuant to the provisions of section 3 of the Act, the Minister of the Environment may, inter alia, a) investigate problems of waste management; and and b) conduct monitoring programs; WHEREAS it has been determined by the Ministry of Labour that some 70 chemicals have been detected by gas chromatography in Pickering at the waste disposal site known as the Brock West (Liverpool) Sanitary Landfill Site owned and operated by the Municipality of Metropolitan Toronto pursuant to a certificate of approval issued pursuant to the Act; and WHEREAS, although the concentration of the chemicals did not exceed Ministry of the Environment ambient air quality criteria, a) there are no ambient air standards for the majority of the compounds detected at the site: b) the criteria that do exist are set up on the basis of odour and criteria associated with possible health effects would be higher; c) the toxicity of mixtures is a poorly understood phenomenon rendering inadequate the simple analysis conducted; d) three compounds suspected of carcinogenic potential in man were reported at very low levels; e) other toxic chemicals might be present but not identified by gas chromatography; and f) some individuals may have particular allergies or susceptibilities to chemicals at levels well below those of the typical human; NOW THEREFORE BE IT RESOLVED THAT: 1. The responsible Director under the Act is most strongly urged to issue a stop order directed to the person responsible for the source of contamination (i.e. chemical emissions) under section 7 of the Act. 3/86 2. The Director is most strongly urged, a) to suspend or revoke the certificate of approval pursuant to section 38 of the Act, as the use of the waste disposal site creates a nuisance, is not in the public interest and results in a hazard to the health and safety of persons; or b) to order the Municipality of Metropolitan Toronto and any other owner to bring the site and the waste management systems utilizing the site into conformity with the Act and its regulations, pursuant to section 42 of the Act, as such systems and the site are not in conformity with the Act and its regulations. 3. The Town Clerk is instructed to respectfully request a meeting between the Mayor, a second representative of this Council and the Minister for the express purpose of determining the specific action or actions being taken or to be taken by any person, including the Minister, a) in response to the specific concerns expressed herein and ' b) in response to the specific concerns previously expressed by this Council and by Town staff at this Council's request. By-law NUmber 2145/86 Being a By-law to amend By-law 2144/86 (Interim Control-Planning) THIRD READING Councillor Stoner, seconded by Councillor Coburn moved that the report of the Committee of the Whole on By-law Numbers 2051/85, 2140/86, 2141/86, 2142/86, 2143/86, 2144/86 and 2145/86 be adopted, and that the said By-laws be now read a Third Time and PASSED, and that the Mayor and Clerk sign the same and the seal of the Corporation be affixed thereto. CARRIED (V) OTHER BUSINESS 1. Councillor Arthurs requested that the Director of Public Works prepare a report outlining the warrants required for pedestrian crosswalks in the Town. 2. Councillor Stoner inquired into the status of the Interim Control By-law for Cherrywood and Green River. (VI) CONFIRMATION BY-LAW By-law Number 2146/86 Councillor Stoner, seconded by Councillor Robertson moved for leave to introduce a By-law of the Town of Pickering to confirm the proceedings of the Council of the Corporation of the Town of Pickering at its meeting held on February 3, 1986 and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. PEDESTRIAN CROSSWALKS ON LIVERPOOL ROAD AND BY-LAW TO REDUCE SPEED LIMIT ON LIVERPOOL ROAD FILE NUMBER - E 4000 That the Town Clerk be directed to prepare a by-law to reduce the speed limit on Liverpool Road between Bayly Street and Annland Street from 50 K.P.H. (30 M.P.H.) to 40 K.P.H. (25 M.P.H.); and that the Director of Public Works be directed to install a pedestrian crosswalk on Liverpool Road at Tatra Drive and a 3-way stop at Liverpool Road and Krosno Boulevard; .. and that school crossing guards be maintained on Liverpool Road. 2. That the streets within the draft plan be named to the satisfaction of the Town. 9. That the owner submit for approval by the Town, site plans and streetscape elevations showing the location and relationship of all buildings prior to issuance of any building permits. 10. That prior to final registration of this plan, the owner: a) satisfy the requirements of The Metropolitan Toronto and Region Conservation Authority, and the Durham Board of Education; b) submit a Draft 40M-Plan to be approved by the Town Planning Department; c) submit a detailed tree inventory and preservation programme to the satisfaction of the Town and agree that no trees be removed until such time as this programme has been approved by the Town except as authorized by the Director of Parks and Recreation. (contd) 11. That the owner make satisfactory arrangements with the Town regarding the removal, demolition and/or retention of all structures on the subject property. 12. That prior to final registration of this plan, the owner: a) satisfy the Town's Director of Public Works that the appropriate stormwater detention pond has been constructed (Stroud's Detention Pond); and b) satisfy the Town with respect to necessary contributions to the required stormwater detention pond (Stroud's Detention Pond). 13. That the following warning clause be registered as specified on all lots in draft plan of subdivision 18T-85022 located within 300 metres of the existing Canadian National Railway right-of-way, north of Sheppard Avenue. That prior to the registration of the plan, the owner satisfy the Town that appropriate access to both Highway No. 2 and Sheppard Avenue has been provided. 15. That Blocks 150 - 160 (inclusive) be developed for residential purposes in conjunction with abutting lands in draft plan of subdivision 18T-84019 and be maintained to the satisfaction of the Town until such time as they are developed. 16. The owner construct at his own expense, to the satisfaction of the Town a 3 metre wide walkway extending from Street B to Rosebank ~Road. 17. That the owner construct at his own expense, to the satisfaction of the Town a 1.8 metre high wood privacy fence along the west boundary of the Approved Plan. ! I 4. 1986 BUDGET FOR ANIMAL CONTROL FILE NUMBER ' F 2300.15 That the Council of the Town of Picketing hereby approves the 1986 budget for animal control as outlined in Report 3-86 of the Treasurer of the P.A.W. Joint Animal Control Committee. I I 5. SALE OF TOWN-OWNED LAND FILE NUMBER - D 3360 That the request of Mr. John E. Travis dated December 17, 1985 to purchase approximately 48 square metres of the proposed parkland in Lot 34, Range 3 be approved; and that the Town Manager be authorized to secure an appraisal of this property; I and that the lands be offered for sale to Mr. Travis at a price recommended by the appraiser plus the appraisal costs, survey costs and any other costs associated with the sale of these lands. ! DESIGNATION OF HOUSE AND PROPERTY OWNED BY MRS. JUDITH PHILLIPS IN THE HAMLET OF GREENWOOD FILE NUMBER - D 3400 Whereas pursuant to Section 29.6 of the Ontario Heritage Act, the council of a municipality may pass a by-law to designate property to be of historic or architectural value or interest; and Whereas the house owned by Mrs. Judith Phillips is re- cognized as being a building of historic and architect- ural value and private funds have been expended to re- store this building; Now Therefore the Council of the Corporation of the Town of Pickering hereby directs the Town Clerk to prepare a by-law to designate this property pursuant to the Ontar- io Heritage Act. 15. HEART AND STROKE FUND MONTH FILE NUMBER - A 2111 That Mayor Anderson be authorized to proclaim the month of February 1986 as "Heart and Stroke Fund Month" in the Town of Pickering; and that permission be granted to fly this organiz- ation's flag during the month of February 17. WHITE CANE WEEK FILE NUMBER - A 2111 That Mayor Anderson be authorized to procl, aim the week of February 2 - 9, 1986 as "White Cane Week" in the Town of Pickering. 18. NATIONAL "NON-SMOKING WEEK" FILE NUMBER - A 2111 That Mayor Anderson be authorized to proclaim the week of January 16th to 22nd, 1986 as "National Non-Smoking Week" in the Town of PIckering. 19.
