DELEGATIONS 8 Chrystal Garrick, 1853 Pine Grove Avenue, addressed Council with respect to revised draft plan of subdivision submitted by G. and N. Sa1pietro. She stated that although the plan approved by Council on December 17, 1990 was the preferred plan, she can support the revised plan if she receives assurance that the conditions of approval include the appropriate zoning in order for rear lots to be developed. She a1 so requested that the transfer of land at a nominal fee be included for access to Street A. 6/91 31 (II ) DELEGATIONS - (continued) 3. Ray Morgan, 1881 Pi ne Grove Avenue, addressed ~o~n:i 1 with respect to revised draft plan of subdlvlslon submitted by G. and N. Sa1pietro. He stated that a 1 though he prefers the plan approved by Counc i 1 on December 17,1990, he supports Ms. Garrick's requests. Faye Waugh, 1847 Woodv; ew Avenue and Kathy Hubbard, 1839 Woodvi ew Avenue, addressed Counc; 1 wi th respect to revised draft plan of subdivision submitted by G. and N. Sa1pietro. They spoke in support of Ms. Garrick's concerns and requested Council's support in acquiring local improvements through the Region. 2. 8 (III) RESOLUTIONS Resolution #28/91 Moved by Councillor Dickerson Seconded by Councillor Johnson That Draft Plan of Subdivision 18T-85006 approved by Council on December 17,1990 be rescinded. CARRIED 8 Resolution #29/91 Moved by Councillor Dickerson Seconded by Councillor Johnson That upon forwarding of Draft Plan of Subdivision 18T-85006 to the Region of Durham for approval (as identified on the Council Recommended Pl an dated Apri 1 2, 1991) Pl anni ng Staff prepare a restri cted area (zoni ng) by-1 aw to rezone Part of Lot 6, P1 an 282 (F. and C. Garrick, Assessment Roll 010-021-15100-0000) from IIR411 Residential to an appropriate zoning to permit an exception to Section 5.14 of Zoning By-law 3036 to allow an increased setback for ca 1 cu1 a ti on of requ; red frontage (15.0 metres) for any lot fronting Street A of Draft Plan of Subdivision l8T-85006. This by-law shall be brought forward to Council on May 6, 1991. CARRIED Resolution #30/91 8 Moved by Councillor Dickerson Seconded by Councillor Johnson That Council reconmend that the Region of Durham withhold draft plan approval of the aforementioned Plan of Subdivision until such time as this by-law referenced above to rezone Part of Lot 6, Plan 282 (F. and C. Garrick, Assessment Roll 010-021-15100-0000) is final and binding. CARRIED 6/91 32 Resolution #31/91 8 Moved by Councillor Dickerson Seconded by Councillor Johnson That Pickering Town Council approval of Draft Plan of Subdivision l8T-85006 recommended to Regional Council be amended by rescinding the Town Council recommended plan dated December 17, 1990 and substituting there to the applicants proposed revision dated March 27, 1991, (No. 9/P89053/WV-DRAF2) prepared by Walker Wright Young Associates Ltd. subject to the following conditions: 1. That thi s recommendation apply to the pl an dated March 27, 1991 as revi sed in red for the creati on of 36 lots, and bearing the Town's recommendation stamp. 3. That the owner make satisfactory arrangements with the Town regarding the required parkland dedication. That the owner enter into a subdivision agreement with and to the satisfaction of the Town. 2. 4. That the owner make satisfactory arrangements regarding the provision of all services required by the Town. 5. That the owner agree to dedicate the road allowance wi th proper corner round; ngs and s; ght tri ang1 es to the Town. 8 6. That the owner agree to convey to the Town: (a) the 1.0 metre road widenings shown as Blocks 39 and 40 on the Council Recommended Plan; (b) (c) any other easements as required; the 0.3m reserve shown as Blocks 41 and 42. 7. That the owner make satisfactory arrangements with the appropriate authorities regarding the provision of underground wiring, street lighting, cable television and other similar services. 8. That the street within the draft plan be named to the satisfaction of the Town. 9. That the owner submit for approval by the Town, site plans and streetscape elevations showing the location and relationship of all buildings prior to the issuance of any building permits. That the owner make satisfactory arrangements with the Town regarding the removal, demolition and/or retention of all structures on the subject property. In accordance with Town policy, the owners provide for the upgradi ng of the Pi ne Grove Avenue and Woodvi ew Avenue frontages on the subject 1 ands to full urban standards to the satisfaction of the Director of Public Works. That prior to final registration of this plan, the owner satisfy the Durham Regional Works Department with respect to an appropriate servicing scheme to provide full municipal services to the proposed lots within this development. That prior to final registration of this plan, the extension of Pine Grove Avenue eastward to A1tona Road through Draft Plans of Subdivision l8T-86043 (Lebovi c) , l8T -84018 (Brancaccio) , and l8T -84015 (Petrou/Lioukras) be constructed and open for vehicular traffic. That Block 37 be developed for residential purposes in conjunction with abutting easterly lands and this Block be maintained to the satisfaction of the Town until such time as it is developed. That prior to registration of the Plan, the owner shall provide access to Street A for two proposed lots (being the easterly portion of Part Lot 6, Plan 282, F. & G. Garrick, Assessment Roll 010-021-15100-0000) through appropri ate road allowance dedi cati ons to the Town of Pi ckeri ng and/or property transfers to abutting property owners, to insure compliance with the proposed zoning by-law referred to in Resolutions #29/91 and #30/91. CARRIED (V) 1. OTHER BUSINESS 2. Councillor Dickerson stated that the Minister of the Environment announced that no Metro Toronto garbage is to go out of the Greater Toronto Area. Councillor Brenner requested information from the Town Clerk with respect to stages in the appointment process. 3. Counci 11 or Brenner introduced the foll owi ng Noti ce of Motion for April 15,1991: 8 Moved by Councillor Brenner Seconded by Councillor Mitchell That the Town Clerk be directed to prepare a by-law to prohibit parking on the south side of Twyn Rivers Drive adjacent to St. Monica's School between the hours of 6:30 a.m. - 8:30 a.m. and 4:00 p.m. - 6:30 p.m. 4. Counci 11 or Brenner wi 11 introduce a Noti ce of Moti on with respect to a report on the Conf1 ict of Interest Act for April 15,1991. 5. Councillor Johnson inquired into the status of a response from Metro Toronto regarding roadside dumping. 6. Councillor Johnson stated he will introduce Notices of Motion regarding Pickering as a IIno junk mail area" and IIno free newspaper de1iveryll. 7. Councillor Johnson requested information from the Fire Chi ef on a fi re in Brougham where mounds of gravel blocked driveway entrances. The following matters were discussed prior to the regular meeting: 8. (a) Resolution #35/91 8 Moved by Councillor Dickerson Seconded by Councillor Brenner That the Town of Pi ckeri ng agrees to i ndemni fy the Region of Durham, should it arise, with respect to Bayview Street subject to the Regional Works Department satisfying the Town of Pickering that a walkway and fencing is provided for the continued easement along their lands. CARRIED 6/91 37 (V) OTHER BUSINESS - (continued) 8 (b) Councillor Dickerson requested information on the Town's mailing policy with respect to business logos on Town envelopes. (c) Counci 11 or Johnson requested gradi ng i nformati on at the subdivision at Park Crescent and Hil1view Crescent. (VI) CONFIRMATION BY-LAW By-law Number 3696/91 Councillor Van Kempen, seconded by Councillor Johnson moved for leave to introduce a By-law of the Town of Pickering to confirm those proceedings of the Council of the Corporation of the Town of Pickering at its meeting held on the 2nd day of April, 1991 and that the same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed.
