A Meeting of the Pickering Town Council was held on Monday, June 29,
1992 at 8:32 p.m.

DELEGATIONS
Dave Ryan, representing the Waste Reduction Committee,
provided recommendations for the handling of yard waste in
1992 and future years.
Sandra Mills, 760 Hampton Court, addressed Council with
respect to the application for rezoning and Official Plan
amendment submitted by H. Swais Limited to permit a car
wash on the northeast corner of Whites Road and Oklahoma
Drive. She stated that Council should not approve this
application because of water restrictions, the owner has
been contravening the zoning by-laws because he is
operating a gas pump without service bays, the owner does
not have proper building permits and there is no local
ratepayers group in the immediate area that could condone
this application. The car wash at Whites Road and Kingston
Road is not open 24 hours each day as stated at the
Planning Committee Meeting of June 17, 1992. She noted
that employees in a car wash must wear protective ear
guards because the noise level is very high. Many cars
will be processed through the car wash in the winter which
will cause pollution in the area. She asked why no
environmental, market or traffic study was carried out for
this application.

Richard Ward, R. R. #2, Blackstock, addressed Council with
respect to the application for rezoning and Official Plan
amendment submitted by H. Swais Limited to permit a car
wash on the northeast corner of Whites Road and Oklahoma
Drive. He stated that the criteria for site plan approval
has not been met. No traffic study has been undertaken and
the zoning provides for an automobile service station but
the actual use is a self=serve gas bar. He stressed that
the Town has allowed this applicant to build in
contravention of the zoning by-law. He noted that food is
being sold from the gas kiosk which puts it in competition
with the adjacent plaza and he stated that the site plan
should have been circulated to the public.
John Brisimitzis, 777 Hampton Court, addressed Council with
respect to the application for rezoning and Official Plan
amendment submitted by H. Swais Limited to permit a car
wash on the northeast corner of Whites Road and Oklahoma
Drive. He stated that he complained about a gas station on
the subject lands and was told that it was allowed under
the zoning by-law but a car wash was not. Although
businesses are needed, they must be appropriate and there
is no guarantee that the car wash will be a quiet
operation. He noted that many people object to this
proposal.
Bob Mitchell, representing H. Swais Limited, addressed
Council with respect to the application for rezoning and
Official Plan amendment submitted by H. Swais Limited to
permit a car wash on the northeast corner of Whites Road
and Oklahoma Drive. He stated that the Fairport Beach
Ratepayers Association represent most people in the West
Shore area. Mr. Swais has held two community meetings at
the Fairport Beach Public school to hear the residents'
concerns and he noted that only two families of over 6,000
in the area have objected to this application. Over
$20,000 worth of landscaping has been provided and he
stated that Mr. Swais has not been operating a car wash in
contravention of the zoning by-law. Most residents want
the car wash instead of the service bays.
Agnes Rezsa, 1950 Woodview Avenue, representing herself and
the owners of 1942, 1952, 1956, 1958 and 1960 Woodview
Avenue, addressed Council with respect to "Report No.3;
Preliminary Management Plan" prepared on behalf of the
Rouge Valley Park Advisory Committee. She stated that she
does not oppose the Rouge Valley Park but she does oppose
the proposed park boundary. The proposed park boundary
passes through her property and the property of the those
persons she is representing and she does not want their
lands designated for lease, purchase or stewardship and she
does not want restrictions on their properties. The
properties which she represents are all tableland and the
boundary is supposed to exclude developed table land. The
Park Advisory Committee should be encouraged to move the
boundary to the rear of the properties she represents.
Don Goundry, 482 Rougemount Drive, addressed Council with
respect to "Report No.3; Preliminary Management Plan"
prepared on behalf of the Rouge Valley Park Advisory
Committee. He stated that many private properties are
affected by the park plan. He supports the principle of
the park project but the proposed park boundary runs
through private property and proposed many restrictions on
the use of their property. Current laws provide for
protection of the environment. Restrictions on properties
will lower their value and there has not been enough public
dialogue with the Park Advisory Committee.

Lorne Almack, representing the Pickering Rural Association,
addressed Council with respect to the draft plan of
subdivision submitted by M.P.L. Oakwood Holdings Limited in
the Hamlet of Claremont. He stated that Council must
protect the rural environment of the Town. The houses in
this subdivision would put septics at the headwaters of the
Duffins Creek. These estate residential developments are
becoming socially unacceptable and persons in these
developments do not volunteer for such things as a fire
fighter. If growth is wanted or needed in Claremont, then
the Hamlet Plan should be revised after having public
participation. The Ministry of Natural Resources and the
Ministry of the Environment do not support this plan no do
the Town planners.
Don Bennett, representing the Claremont and District
Residents Association, addressed Council with respect to
the draft plan of subdivision submitted by M.P.L. Oakwood
Holdings Limited in the Hamlet of Claremont. He stated
that his Association wants growth in the hamlet and they
support a diversified mix of housing. The developer will
try to scale the project so that it is somewhat
affordable. Growth will keep the hamlet vibrant and help
sustain businesses but the Association does not want the
hamlet boundaries expanded to use up viable farm land.
Miles Wan, 1042 Moorelands Crescent, addressed Council with
respect to the motion regarding Route #7 of Pickering
Transit. He asked that the public transit system in the
Rosebank area be continued because he does not own a car.
Transit services are available to other urban areas in the
Town and he stated that Council must have a commitment to
service for the long term.
Kim Thompson, representing LACAC, addressed Council with
respect to the Hamlet of Whitevale Heritage Conservation
District. She stated that it has become apparent that many
residents in Whitevale have questions about this matter and
as a result, the designation of a Heritage Conservation
District may be jeopordized. She asked that the Town
Solicitor request a postponement of the Ontario Municipal
Board hearing so that LACAC can answer the residents'
questions.
Julia Hayes, 3169 Golf Club Road, addressed Council with
respect to the Hamlet of Whitevale Heritage Conservation
District. She stated that a prime condition of a heritage
by-law is that it be passed in good faith. Most residents
do not have enough information about this matter and
persons wanting an exemption from the by-law have no been
contacted by the residents' association. She wants her
property rights protected and not restricted and she feels
she is being prejudiced against because she does not want
to belong to the community association.
Mrs. Jamie Pearce, 3190 Golf Club Road, addressed Council
with respect to the Hamlet of Whitevale Heritage
Conservation District. She stated that she wants to be
exempt from the District and she does not want to confer
with LACAC on any building she wants to do on her home.
Sarah Roberts, 3177 Golf Club Road, addressed Council with
respect to the Hamlet of Whitevale Heritage Conservation
District. She asked that Council support the Notice of
Motion that will exempt those properties who have asked to
be exempt in writing and she asked that the Ontario
Municipal Board hearing not be delayed. She wants to work
with the community on a heritage designation and if there
should be a delay of the OMB hearing, the residents can
request it.

Jack Raitt, 3173 Golf Club Road, addressed Council with
respect to the Hamlet of Whitevale Heritage Conservation
District. He stated that he wants to be exempt from the
by-law to designate a heritage conservation district but
does not want to quash the by-law.
Marlene Crandall, 465 Churchwin Street, addressed Council
with respect to the Hamlet of Whitevale Heritage
Conservation District. She stated that some people who
want the heritage district designation have had their house
for sale. She asked that she be exempt from the heritage
conservation district.

Wayne Hassall, 3425 North Road, addressed Council with
respect to the Hamlet of Whitevale Heritage Conservation
District. He stated that he wants to be exempt from the
by-law to designate a heritage conservation district. He
stated that all people who want to be exempt should be
exempted at tonights meeting, then the community can
discuss the guidelines in the District Plan.
Judy Griffiths, 470 Whitevale Road, addressed Council with
respect to the Hamlet of Whitevale Heritage Conservation
District. She noted that as of three weeks ago, people who
wanted to be exempt from the by-law to designate the
heritage conservation district requested a delay of the
Ontario Municipal Board hearing but now this has changed.
The issue of the proposed landfill sites and the issue of
the Heritage Conservation District are not connected. She
wants her house to be designated individually and this
would be more acceptable. She stated that she supports the
Notice of Motion to allow exemptions to the by-law to
designate a heritage conservation district because her
rights are being infringed upon.
Caroline Fremont, 3165 Factory Street, addressed Council
with respect to the Hamlet of Whitevale Heritage
Conservation District. She stated that there should have
been a community forum on the matter that was held in the
hamlet. She is concerned that the heritage guidelines may
be too restrictive and wants to be exempt from the District
based on present information. She would agree to a
deferment of the Ontario Municipal Board hearing.
John Hayes, 3169 Golf Club Road, addressed Council with
respect to the Hamlet of Whitevale Heritage Conservation
District. He wants to be exempt from the by-law to
designate a heritage conservation district and supports the

hearing only if the by-law to allow exemptions is passed.
He noted that no representative of the residents
association has talked to him.
Hannah Mitchell, 1491 Finch Avenue, addressed Council with
respect to the draft plan of condominium submitted by
771380 Ontario Limited at the northwest corner of Finch
Avenue and Valley Farm Road. She noted that the area
residents have not been happy with the townhouse
development at a high density. The developer has
threatened to build 28 cheap units instead of 36 quality
units or refer the matter to the Ontario Municipal Board
which will approve his project. She asked if the site plan
process can guarantee a certain quality proposal and if the
residents can be represented at the site plan approval
stage.

Lorraine Clark, 1470 Finch Avenue, addressed Council with
respect to the draft plan of condominium submitted by
771380 Ontario Limited at the northwest corner of Finch
Avenue and Valley Farm Road. She stated that landscaping
is an important feature to her and that drainage from the
subject lands is presently a problem.

Item #1 was amended by deleting the word "not" in the phrase "not

Item #2 was added to the Report to read as follows:
That Zoning By-law Amendment Application A 5/92, submitted
by H. Swais Limited, on lands being Part of Lot 28, Range
3, B.F.C., Town of Pickering, to permit a retail gasoline
outlet (gas bar) without enclosed service bays and a
hydraulic hoist, be APPROVED, subject to the following
conditions:

That Town Council enact a by-law to adopt the
Amendment to the Pickering District Plan resulting
from Official Plan Amendment Application 92-P/2;

on Route 7 to allow residents transportation to work; and

Corporation of the Town of Pickering leased from Her
Majesty the Queen in Right of Canada as represented by
Public Works Canada the Altona Community Centre in
Part of Lot 31, Concession 9, Pickering; and
Whereas the Corporation of the Town of Pickering
wishes to terminate that lease effective July 31,1992;
Now Therefore Be It Resolved That:
1.
The corporation of the Town of Pickering shall
dispose of its leasehold interest in the Altona
Community Centre in Part Lot 31, Concession 9,
Pickering at midnight on July 31, 1992.
2.
The Town Solicitor is hereby authorized to give
notice to the landlord to effect the disposition
of the leasehold interest referred to in section
1 and to execute any other documents in
furtherance thereof.
