(II) 1. 2. e ADOPTION OF MINUTES DELEGATI ONS Lorrai ne Cl ark, 1470 Fi nch Avenue, addressed Counci 1 with respect to the draft plan of condominium submitted by 771380 Ontario Limited on the northwest corner of Finch Avenue and Valley Farm Road. When this project was first proposed, the neighbours objected but the developer made the project seem appea1ing. Since that time, this land has been sold three times and now there will be many backyards abutting her property, there will be a large retaining wall along her lands and her property will be devalued. Gord Mitchell, 1491 Finch Avenue, addressed Council with respect to the draft plan of condominium submitted by 771380 Ontario Limited on the northwest corner of Finch Avenue and Valley Farm Road. There is high density development in close proximity to his property of which he has no objection, however, this development will devalue the surrounding properties. He agreed to a 27 unit development that had a uni que architecture but the present proposal does not reflect what he had originally agreed to. (II) 3. 8 4. 5. 8 6. 7. 8. 8 14/92 82 DELEGATIONS - continued Li nda Paul, representi ng 771380 Ontari 0 L imi ted, stated that her clients met with the staff and residents last September and revised the plan to ensure that all the concerns of the nei ghbours were incorporated in the plan. Kim Thompson, representing LACAC, addressed Council wi th respect to By-l aw Number 4039/92 to amend By-l aw 3632/91 to designate the Hamlet of Whitevale as a Heritage Conservation District. She urged Council to enact the by-law because it means a lot to the residents of Whitevale and they have been working on thi s for many years. The LACAC wi 11 be meeti ng wi th the residents to determine if exemptions from the by-law are possible at a later date. The concerns of the residents can be incorporated in the implementation of the guidelines for the Heritage Designation. Sandra Rider, Main Street, addressed Council with respect to By-law Number 4039/92 to amend By-law 3632/91 to designate the Hamlet of Whitevale as a Heritage Conservation District. She moved to Whitevale because of the heritage atmosphere and has 1 i ved there for 16 years. The issue of a Heri tage Desi gnati on fi rst arose about 10 years ago but the residents were afraid of it. The intent of a Heritage Designation is to preserve and not dictate to the homeowner. The residents feel there is a need to protect the heritage atmosphere and there should be no problems for people to be exempted from the designation. Judy Fri edl addressed Counci 1 wi th respect to By-l aw Number 4039/92 to amend By-l aw 3632/91 to desi gnate the Hamlet of Whitevale as a Heritage Conservation District. She has lived in Whitevale for nine years and stated that people have pride in their houses and the community. She was very disapPointed that Council is even questi oni ng the by-l aw because of compl ai nts from a small number of people. The heritage of Whitevale must be protected and it would have the advantage of providing for a live historical area. Laura Carney addressed Counci 1 wi th respect to By-l aw Number 4039/92 to amend By-l aw 3632/91 to des i gna te the Hamlet of Whitevale as a Heritage Conservation District. She stated that the Heritage Designation is required for the protection that it will offer her. Julia Hayes, Golf Club Road, addressed Council with respect to By-law Number 4039/92 to amend By-law 3632/91 to designate the Hamlet of Whitevale as a Heritage Conservation District. She stated that the residents were not informed of all the issues and asked Counci 1 to slow the process down in order to provi de time to study the issue further. She woul d like to too the Ontario Municipal Board approve the by-law with the requested property owners exempted. She felt that this issue has become too emotional and is intertwined with the dump issue. The Whitevale District Plan provides for a large amount of interference into the rights of a property owner. She stated that she does not intend to sell her property to a developer. (II ) 9. 8 10. 11. 12. 8 13. 14. 15. 8 16. 14/92 83 DELEGATIONS - continued Sarah Roberts, 3177 Gol f Cl ub Road, addressed Counci1 with respect to By-law Number 4039/92 to amend By-law 3632/91 to designate the Hamlet of Whitevale as a Heritage Conservation District. Upon review of all the pertinent documents, she can understand the desire of the residents to have a Heritage Designation, however, her house was built in the 1950's and is not of a heritage nature and she therefore wants to be exempt from the by-law. Caroline Fremont, addressed Council with respect to By-law Number 4039/92 to amend By-law 3632/91 to designate the Hamlet of Whitevale as a Heritage Conservation District. She stated that she has lived in Whitevale for 23 years and did not attend the vari ous meeti ngs that were hel d wi th respect to the designation. She hoped that the Ontario Municipal Board heari ng is postponed and further time is gi ven to study the heri tage issue. She wants to be exempt from the by-l aw at thi s time only because she is not totally informed on the issue. Anna Willson, representing LACAC, stated that she was present to answer any questi ons Counci 1 may have on the Whitevale Heritage Conservation District issue. Jack Reid, 3173 Golf Club Road, addressed Council with respect to By-law Number 4039/92 to amend By-law 3632/91 to designate the Hamlet of Whitevale as a Heritage Conservation District. He wants his property to be exempt from this by-law because his house is not of a heri tage nature and he does not have enough information on the issue. Judy Griffiths, addressed Council with respect to By-law Number 4039/92 to amend By-law 3632/91 to designate the Hamlet of Whitevale as a Heritage Conservation District. She stated that she does not support the Heritage Designation because it will create unnecessary red tape and she has already carried out extensive renovations on her house. Tommy Thompson, Byron Street, addressed Counci 1 with respect to By-law Number 4039/92 to amend By-law 3632/91 to designate the Hamlet of Whitevale as a Heritage Conservation District. He stated that he has lived in Whitevale for 20 years and has run into problems all along to get a heritage designation. He stated that everyone has been advi sed of the pub1i c meetings to discuss this issue. Fred Beer, representi ng the Pi ckeri ng Rura 1 Association, addressed Council with respect to By-law Number 4039/92 to amend By-1 aw 3632/91 to desi gnate the Hamlet of Whiteva1e as a Heritage Conservation Di strict. He stated that Council shoul d support the designation because it is not only IIWhiteva1ell heritage but also the Townls heritage. John Hayes, Gol f Cl ub Road, addressed Counci1 wi th respect to By-law Number 4039/92 to amend By-law 3632/91 to designate the Hamlet of Whitevale as a Heritage Conservation District. He stated that he only wants to be exempt from the designation. (II ) 17. e 18. (III) 84 14/92 DELEGATIONS - continued Al Graham, Cl aremont, addressed Council with respect to By-l aw Number 4039/92 to amend By-l aw 3632191 to designate the Hamlet of Whitevale as a Heritage Conservati on Di stri ct. He stated that the important issue to be resolved is the protecti on of the Town's heritage. Carl Roberts addressed Counci 1 wi th respect to By-l aw Number 4039/92 to amend By-l aw 3632191 to desi gnate the Hamlet of Whitevale as a Heritage Conservation Di stri ct. He stated that the by-l aw shoul d be passed with the exemptions and people should be kept informed of this issue. RESOLUTIONS Resolution #90/92 - See Appendix #1 Moved by Councillor Van Kempen Seconded by Councillor Higdon That the report of the Executive Committee Meeting of June 8, 1992 be adopted with the following amendment: Items #1 and #2 were deferred for two weeks. Item #9 was deferred for two weeks. Councillor Van Kempen declared an interest in Items #3, #4 and #5 because he and his spouse own a business on the subject property. 8 Recorded Vote on Item #12: CARRIED Yes: Absent: Councillors Brenner, Higdon, Pistritto and Van Kempen Councillors Johnson, Wellman and Mayor Arthurs Resolution #91/92 Moved by Councillor Pistritto Seconded by Councillor Van Kempen WHEREAS in a 1 etter da ted May 21, 1992, the Di rector of Sol i d Waste Management for the Municipality of Metropolitan Toronto advised the Regional Commissioner of Works that he will be recommendi ng that the Brock West Landfi 11 Si te be closed on Saturday; and WHEREAS the residents of the Town of Pickering who have no other opportuni ty to di spose of thei r waste duri ng the week wi 11 be denied an essential level of service that is available to other municipalities in the Region of Durham who use a Regional landfill site; and WHEREAS the closure of the Brock West Landfill Site on Saturdays will encourage an increase in the illegal disposal of waste on roadsides and vacant properties and lead to higher clean-up costs; and 8 14/92 85 Resolution #91/92 - continued It WHEREAS waste from the Region of Durham I s transfer stati ons, whi ch are open Saturday morni ngs, is haul ed to the Brock West Landfi 11 Si te on Saturday morni ngs and thi s closure will seriously hamper their operations; NOW THEREFORE the Counci 1 of the Corporati on of the Town of Pickering hereby requests the Council of Metropolitan Toronto to ensure that the Brock West Landfill Site is kept open on Saturday mornings. CARRIED 8 Resolution #93/92 Moved by Councillor Van Kempen Seconded by Councillor Higdon Whereas Mr. Al ex Robertson has been an i nvol ved and dedi cated member of the conmunity over the past 30 years to make the Bay Ridges Community and indeed the entire Town of Pickering a better place to live; and Whereas ~ex Robertson has been a Member of the Council of the Town of Pi ckeri ng, wi th the excepti on of two yea rs , from its inception on January 1,1974 to November 30,1988; and Whereas Alex Robertson was instrumental in convincing Ontario Hydro to allow the Town of Pickering to use the lands in Parts of Lots 20,21 and 22a as a passive park; Now Therefore The Council of the Corporation of the Town of Pi ckeri ng hereby resol ves that those 1 ands now known as the Ontari 0 Hydro Passi ve Park be renamed to be known as the Al ex Robertson Community Park. 8 CARRIED Recorded Vote: Yes: Absent: Councillors Brenner, Higdon, Pistritto and Van Kempen Councillors Johnson, Wellman and Mayor Arthurs 14/92 86 Resolution #94/92 tit Moved by Councillor Van Kempen Seconded by Councillor Higdon Whereas, by Statement of Claim dated February 25, 1987, issued in the District Court of Ontario (now the Ontario Court, General Division, at Newmarket, Court File No. 8040/87), Nolmar Properties Ltd. commenced a legal proceeding against The Corporation of the Town of Pickering and Ertl and Rowan Inc. for the sum of $175,000 plus costs relating to the development of Plan 40M-1234, Pickering; and Whereas, following extensive pre-trial proceedings, Nolmar Properties Ltd. has offered to settle the proceeding respecting both The Corporation of the Town of Pickering and Ertl and Rowan Inc. upon the payment to it of $5,000 inclusive of costs; and Whereas Ertl and Rowan Inc. has agreed to pay $2,500 of that $5,000 sum and General Accident Assurance Co, has agreed to pay $1,250 of that $5,000 sum; Now Therefore Be It Resolved That: 1. The Corporation of the Town of Pi ckeri ng hereby concurs in the settlement of this matter upon the payment to Nolmar Properties Ltd. of $5,000, inclusive of costs, of which $1,250 sha11 be payable by the Corporation. THIRD READING 8 Counci 11 or Pi stri tto, seconded by Counci 11 or Hi gdon, moved that the report of the Conmittee of the Whol e on By-l aw Numbers 4014/92, 4015/92, 4016/92, 4017/92, 4018/92, 4019/92, 4020/92, 4021/92, 4022/92, 4023/92, 4024/92, 4025/92, 4026/92, 4027/92, 4028/92, 4029/92, 4030/92, 4031/92, 4032/92, 4033/92, 4034/92, 4035/92, 4036/92, 4037/92, 4038/92 and 4039/92 be adopted and the said by-laws be now read a third time and PASSED and that the Mayor and Cl erk sign. the same and the seal of the Corporation be affixed thereto. CARRIED (V) 1. OTHER BUSINESS 2. Councillor Van Kempen stated that he appreciated having the meeting of the Members of Council with the Town Manager to discuss communications. Counci 11 or Van Kempen requested that Pi ckeri ng Hydro review it policy on out-of-Province travel. 3. Councillor Van Kempen reminded residents that they can still expect Jim Wiseman, MPP, to attend the Planning Committee Meeting on June 17,1992. Councillor Pistritto stated that there will be a public meeting on July 9, 1992 to explain the Whitevale Heritage Conservation District by-law. 4. 5. Counci 11 or Brenner reported that the Region of Durham has imposed restrictions on lawn watering. Counci 11 or Brenner further reported that the summer collection of yard waste has been extended until June 30, 1992. 8 6. 14/92 (V) 90 OTHER BUSINESS - continued 7. The following matters were considered prior to the regular meeting: a) The Town Manager reported that he has been advised by the Director of Community Services and Facilities that the Town is running out of ice time and therefore some of the adul t groups may need to fi nd other faci 1 i ti es. Mr. Qui nn was directed to meet with the owners of the Art Thompson Arena and representati ves of the adul t 1 eagues to determi ne if an arrangement can be made for these leagues. The Town Manager distributed a memo from the Director of Public Works explaining why yard waste wi 11 not be pi eked up duri ng the summer. Council asked that the contract for yard waste be extended to June 30, 1992 and that the Waste Reduction Committee come to Council on June 22, 1992 to discuss the matter. 8 b) (VI) CONFIRMATION BY-LAW By-law Number 4040/92 - Counci 11 or Van Kempen, seconded by Counci 11 or Pi stritto moved for 1 eave to introduce a By-l aw of the Town of Pi ckeri ng to confi rm those proceedi ngs of the Counci 1 of theCorporati on of the Town of Pickering at its meeting held on the 15th day of June, 1992 and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed.
