A Meeting of the Pickering Town Council was held on Monday, October 17, 1994 at 7:30 P.M.

Regular meeting of October 3, 1994.

PRESENTATION
Mayor Arthurs gave a brief presentation with regards to Pickering's Economic
picture, accessibility and the enhancement of the Town to improve quality oflife.

Il..ELEGA TIONS
1.
Myrna Picotte, representing the AjaxlPickering/Whitby Association of Community
Living made a presentation to Councillor Johnson for his work over the last five
years in acquiring a corporate sponsor.

DELEGATIONS
2.
Mr. Earl Ducette, representing the AjaxlPickering Hospital Board addressed
Council to advise that paid parking will be implemented at the hospital. Mr.
Ducette thanked Council for their long term support and asked them to support
the decision for this implementation. He outlined the three reasons for this
implementation being; 1) the recommendation of the Operational Review,
unfunded expenses that the Ministry expects through paid parking, 2) upgrading
and maintenance of roads and parking, and 3) the hospital could lose funding if
they don't charge for parking (look less efficient). He stated that funding for
operations comes from the Ministry and funding for capital projects comes from
fund raising.

Paul White, representing the Fairport Beach Ratepayers Association addressed
Council with respect to the Notice of Motion regarding "No Left Turn" from
Bayly Street onto West Shore Boulevard. He advised that he has lived in the
community since 1971 and does not wish it to be the roadway for Durham Region.
He requested that a solution be reached which will not affect the local residents,
the school buses or the area businesses. Mr. White advised Council that his
Association has donated $1,000 to the Hospital and he challenged other
Associations to become more involved in activities throughout the community.
Mr. White also advised Council that he has spoken with residents in the area and
has been advised that many of them have experienced gas leakages at their homes.

Peggy Byers, 782 Hillcrest Road addressed Council with respect to the Notice of
Motion regarding road works on Hillcrest Road and other areas of the West Shore
Community. She stated that the traffic problem is progressively getting worse.
There are three schools in the area, many children crossing the road and a
tremendous amount of traffic which creates a dangerous situation. She suggested
that a few be inconvenienced rather than have a child hurt or killed.

Carol Pistchik, 966 Vistula Drive addressed Council with respect to the Notice of
Motion to establish a School Crossing on Eyer Drive to serve Our Lady of the Bay
Separate School. She requested a crosswalk in front of the school and advised
that staff and parents will act as crossing guards. She advised that changes have
been made to alleviate the problem such as: 1) no stopping in front of the school,
and 2) no pulling into the driveway.

Tom Mohr, representing the Pickering East Shore Community Association
presented a heritage project to the Pickering Library. Mr. Mohr advised that the
Association participated in a Heritage Project at the Frenchman's Bay Festival and
over 50 photographs were donated be various organizations. The pictures have
been mounted for protection and it is the wish of the Association that the History
Room at the Pickering Library act as custodians of this item. He thanked the many
contributors and those who assisted and presented the photos to Mr. Dave Farr,
Chair of the Library Board.

Mrs. Sparkes, 752 Hillcrest Road addressed Council with respect to the Notice of
Motion regarding Hillcrest Road. She stated her concern over the condition of the
road and questioned why Bayly St. and Sanok Dr. have been done and not
Hillcrest Road.
8.
Terry Nuspl, 140 Woodview Drive addressed Council with respect to the Notice
of Motion regarding Hillcrest Road. She read a letter to Council from Bob
Mitchell, President of the BaywestILookout Point Association concerning a local
traffic only sign. The Association is in support of a traffic study for the area and
also of the by-law which supports a local traffic only sign. Many roads require
reconstruction and a reconstruction program should be implemented immediately.

JeffHailitay, owner of Premier Auto Salons, addressed Council with respect to the
decision to appeal the decision of the Committee of Adjustment with respect to
Chip King Inc. He advised that his business replaces windshields and repairs
window chips. He stated his concern that a business would be discourage in these
economic times.

Dennis Fourcaudot, representing Chip King Inc. addressed Council with respect to
the decision to appeal the decision of the Committee of Adjustment with respect to
Chip King Inc. He stated that Chip King Inc. is a responsible business and are
willing to pay for a vendors licence each year. He advised that the Waste
Reduction committee are in support of this establishment.

Maria Serpa-Gauvin, 931 Essa Crescent, addressed Council with respect to the
Notice of Motion to establish a School Crossing on Eyer Drive in front of Our
Lady of the Bay Separate School. She stated her concern and the steps which
have been taken for the safety of her children going to school. She advised that
the Durham Regional Police, Councillors Brenner and Wellman were all in support
of this school cross one year ago and requested that this crossing be installed
immediately with the appropriate signage.

Tony Quaresma, District Manager for B.F.I. addressed Council with respect to the
garbage tender. He stated his concern with receiving the addendum to the tender
just two days before closing. He advised of the reasons a bid was not included on
the addendum and outlined the positive aspects of a two man rear loader.

Laidlaw Waste Systems in the amount of $2.14 (unit price per stop per month) for
curbside collection and haulage to the Brock West Landfill Site (Item # 1) and in the
amount of $3.08 (rate per kilometre - haulage fee) overhaul to alternate landfill site (Item
#4);
and
(b)
J & F Waste Systems in the amount of $0.59 (unit price per dwelling unit per month) for
collection of garbage from bulk containers and haulage of same to Brock West Landfill
Site (Item #2) and in the amount of $2.00 (rate per kilometre - haulage fee) for overhaul
to alternate landfill site (Item #4);
subject to adjusting the basis unit price annually dependent upon fluctuations in the
Consumers Price Index as to increase or decrease the unit price proportionally,
be approved.

WHEREAS, on April 1'8, 1994, the Council of The Corporation of the Town of Pickering made
Resolution 55/94 authorizing and directing its solicitors to commence an action against the
appropriate parties for certain purposes relating to the closure of the Brock West Landfill Site;
and
WHEREAS it is advisable to,
(a)
authorize the issuance of a specific Statement of Claim and the prosecution of the
consequent action, both by Osler, Hoskin & Harcourt on behalf of the Town; and
(b)
ratify any previous action taken by Osler, Hoskin & Harcourt on behalf of the Town in
furtherance of this authority and the authority set out in Council Resolution 55/94;
NOW THEREFORE BE IT RESOLVED THAT:
1.
The Council of The Corporation of the Town of Pickering hereby,
(a)
authorizes and directs its solicitors, Osler, Hoskin & Harcourt, to issue a Statement of
Claim in form and content substantially similar to that attached hereto as Schedule A, in
respect of the Brock West Landfill Site, and to take all appropriate steps to prosecute the
consequent action, including any actions required to obtain any appropriate interlocutory
relief; and

(b)
authorizes and ratifies any previous action taken by its solicitors, Osler, Hoskin &
Harcourt, in furtherance of the authority and directions set out in paragraph (a), above, or
in Council Resolution 55/94.

NOW THEREFORE BE IT RESOLVED THAT:

WHEREAS commuter traffic is using the local roads such as West Shore Boulevard, Oklahoma
Drive and Hillcrest Road in the West Shore community in the morning to reach Highway #401
and other roads leading into Metropolitan Toronto; and
WHEREAS this commuter traffic is causing delays and safety concerns for local residents using
these roads to commute to work or take children to school;
NOW THEREFORE the Council of the Corporation of the Town of Pickering hereby directs that
a by-law be prepared to restrict the use of West Shore Boulevard to local traffic and busses
between the hours of7:00 a.m. and 9:30 a.m.; and
THAT the Durham Regional Police be requested to strictly enforce this by-law.

WHEREAS the Council of the Regional Municipality of Durham has not taken a stand with
respect to the EEll site;
NOW TÌIEREFORE the Council of the Corporation of the Town of Pickering hereby supports
Mayor Arthurs Notice of Motion to oppose a site selection process undertaken by the Interim
Waste Authority with respect to the EEll site to be presented to Regional Council on October 26,
1994.

That By-law 4518/94 be amended by amending Schedule "A" of the By-law as follows:
Be it resolved that paragraph 6, sub-paragraph 2( d) of the agreement dated October 17, 1994
between the Corporation of the Town of Pickering and Village at the Pines Inc. be amended to
read as follows:
"Replacing existing roof top make-up air units serving and benefiting common areas and hallways
to be completed no later than December 31, 1994".
And be it further resolved that paragraph 6, sub-paragraph 3 shall be deleted and replaced by the
following:

"The owner shall not permit the occupancy of any condominium dwelling unit until the work in
sub-section (1) above, in respect of that unit and the work described in sub-section (2) above in
respect of the building in which that unit is situate has been completed to the satisfaction of the
Town, provided that this condition shall not prevent the continued occupancy of any dwelling unit
by its current tenant. However, nothing will prohibit the occupancy of a dwelling unit or building
if at the time of such occupancy, the only work remaining to be completed is that specified in
paragraph 6 sub-paragraph 2( d) above. "

The following matters were discussed prior to the regular meeting:

The Town Manager distributed correspondence concerning the conveyance
ofland for a parkette on Lytton Court by Cougs Pickering Ltd.

Hollinger property and abutting owners will be installed.
e)
The Town Manager discussed the condominium conversion application of
Pickering Place Apartments.
f)
Councillor Higdon advised that she has received complaints from residents
on Helen Court concerning the storm sewer installation.
g)
Councillor Johnson advised that he has received a call from the owner of
1546 Oakburn St. concerning the expenses he will incur due to his change
of address as a result of the lot reductions on his street.

OF NEWSPAPER VENDING BOXES AND CANADA POST
MAILBOXES

That the Public Works Department be authorized to commence discussions with
Canada Post Corporation and with the various Newspaper Publishing Companies
respecting the regulation, installation and maintenance of Newspaper Vending
Boxes and Canada Post Mailboxes; and
that the Public Works Department from those discussions formulate a fair policy
respecting the installation and maintenance of Newspaper Vending Boxes and
Canada Post Mailboxes; and
that the Public Works Department in co-operation with the Region of Durham, the
Ministry of Transportation and the Town's Legal Department draft a by-law to
establish a policy to regulate Newspaper Vending Boxes, Canada Post Mailboxes
and their respective locations within the Town of Pickering; and

that the by-law and the regulating policy be prepared for Council's approval as
soon as possible, so that all Newspaper Vending Box and Canada Post Mailbox
locations may be brought into conformity in 1995.

Equipment not be made, but that the actual cost of replacement purchases in 1994,
estimated at $410,820, be funded instead from General Fund; and
that a 1994 General Fund contribution in the amount of $40,000 be made to the
Capital Fund to cover the renovating and upgrading of the Whitevale Library.
