COUNCIL MINUTES
A Meeting of the Pickering Town Council was held on Monday, October 3, 1994 at 7:30 P.M.

DELEGATIONS
1.
The following persons addressed Council with respect to the resolution to delete
the extension of Bay lawn Drive:
a)
Ken McLean, 861 Baylawn Drive stated that the decision made would
impact on all the residents of the area and he requested that Baylawn not be
extended. Their property was purchased in an enclave development. Snow
removal, bus stops and emergency response are not an issue. He requested
common sense and an appreciation for the residents who invested and
committed to Pickering.
b)
Dan Murphy, 895 Baylawn Drive submitted a petition from the residents of
Baylawn and requested a fair, decisive and responsible decision be made.
Numerous letters and phone calls have been made to Council regarding this
matter. IfBaylawn is extended associated costs would be incurred, such as
street lights at Fairport and Baylawn due to heavier traffic and a bridge
would be needed over the ravine. Higher density traffic would also create
a safety hazaRoad The police and fire services are not concerned about a
cul-de-sac on Baylawn Drive

Kay Gerditschke, 895 Baylawn Drive advised that she moved from a very
busy street in Scarborough to an enclave. The size of home is not what is
important but the road and the safety of the children. Emergency vehicles
have no difficulty in entering or exiting this street.
d)
Paul Gerditschke, 895 Baylawn Drive also stated that he moved from a
busy street in Scarborough and would like to see Baylawn remain closed.
Kids play on the street and the extension would create more traffic.
e)
Jennifer Caradonna, 873 Baylawn Drive advised that she moved to
Baylawn Drive because it was quiet and she did not have to be concerned
with traffic. She requested that the residents be considered and the
extension be denied.
f)
Shelley Leblond, 874 Baylawn Drive advised that she likes the quiet, safe
neighbourhood and feels it is an ideal environment for kids. She also
requested that the residents be considered and the extension be denied.
g)
Merlin Nair, 871 Baylawn Drive advised that he was told that the area in
question was conservation and nothing would be developed.
h)
John Noble, 846 Baylawn Drive advised that he is the last neighbour on the
north side and is hoping for a cul-de-sac not a bridge. The cost of
constructing a bridge would become an issue because a culvert would not
do it and wildlife would be lost. He stated his opposition to an extension.
i)
Laurel Schollen, 905 Duncannon Drive advised that she is a long term
resident and has been writing letters to Council for six years concerning
the traffic on Bushmill and does not want to see the same thing happen on
Baylawn Drive The issue is safety of the children and if Baylawn is
extended, people will take short-cuts creating more traffic and danger. She
strongly encouraged Council to keep Baylawn Drive closed.

Craig Kurysh, 905 Duncannon Drive advised that safety of the children is
the main issue and he urged Council not to extend Baylawn Drive

Charles Gerditschke, 894 Baylawn Drive advised that Toronto has closed
roads for the preservation of neighbourhoods. Emergency vehicles
entering and exiting is not an issue, safety of the children is. An extension
will create more traffic, creating more danger to the children. The street is
too narrow and would be dangerous if opened up.
I)
Doug Dickerson, 1298 Dona Park Road advised that Council dealt with
Darwin Drive two weeks ago and those who spoke then are speaking now
also against the extension of Baylawn Drive Council know what the
people want and expect. Do not open Baylawn Drive
Paul Gauvreau, 946 Duncannon Drive stated that it would be a tragedy to
lose wildlife or have a bridge constructed or a super mailbox or transformer
on your property, but this pails in comparison to the death of a child. More
cars on the road would create a higher chance of accidents. Do not extend
Baylawn Drive
John Whitnall, 858 Baylawn Drive advised that if this extension is
approved it would be a callus disregard for the safety and common sense of
the residents. He stated his support of the cul-de-sac on Baylawn Drive
David Daly, 857 Baylawn Drive questioned how a road can go through
when the trees are supposed to be protected.

Arthur Noah, 865 Baylawn Drive advised that Baylawn Drive is rounded
off not cut off as the overhead showed. No sign, which he has seen in
other developments, was erected stating possible development. He stated
his concern for safety of area and residence.
q)
John Tannahill, 898 Baylawn Drive advised that the prime concern is the
safety of children in the area. He did not buy his home with the knowledge
of a street going through to Whites Road.
r)
Rob Kozeluh, 958 Duncannon Drive joined those who stressed concern for
the safety of children and urged Council not to open Baylawn Drive

Walter Winborn, 866 Baylawn Drive advised that he does not have any
children but supports his neighbours in the fight for the safety of their
children. Council has already cul-de-saced Darwin Drive and should be
consistent in doing the same on Baylawn Drive

Susan Nakamura, 862 Baylawn Drive stood in support of neighbours.

Rob Powell, 875 Baylawn Drive advised that he purchased his home
thinking Baylawn Drive would be a dead-end street. He biggest concern is
for the safety of the children and if Baylawn is extended, it will be used for
cutting through to Whites Road, creating more traffic and more chances for
accidents.

Bruce Bradley, 890 Baylawn Drive stood in support of neighbours.
Sean Murphy, 895 Baylawn Drive stated that he is concerned that street
activities would be hindered if Baylawn Drive is opened up and requested
that Council do not extend this street.
x)
Frank Magnus, 877 Baylawn Drive stated that the residents concerns and
reasonable and sensible. The children of the area are use to the enclave and
extending Baylawn Drive would create a danger to them. Please readdress
the problem carefully and do not vote in favour of the extension.
y)
Brian Thomas, 881 Baylawn Drive concurred with his neighbours
comments.
Debbie Rhodes, 869 Baylawn Drive also concurred with her neighbours
comments.
John England, 917 Duncannon Drive made reference to the comments
made at the previous Council meeting concerning Lynn Heights Drive
Ken McDougall, 886 Baylawn Drive concurred with his neighbours and
stated that the extension of Baylawn Drive to Whites Road was not
planned three years ago.
Sherry Senis, 1003 Sherman Crescent advised that she had spoken with
numerous residents in the area and they were vehemently against the
extension of Baylawn Drive Their prime concern is for the safety of the
children and she submitted a petition which has been signed by the
residents in opposition to this extension.
Mike Sagat, 859 Baylawn Drive stated that the neighbours have common
sense and are safety conscious and he hopes to find the same on Council.
Darren Micikyaw, 889 Baylawn Drive advised that safety is the biggest
concern.

DELEGATIONS
George Coutts, representing the Pickering Rotary Club, addressed Council with
respect to the waterfront trail, lending support to Council for the waterfront
walkway. The Rotary Club has worked jointly with various organizations in
creating this walkway and the project is fully funded. He advised that they are
further willing to work with the Town to see this walkway become a reality.
Mark Crearar, Primrose Court, addressed Council with respect to the Notice of
Motion regarding the location of the supermailbox on Primrose Court. He
requested that this mailbox be removed from the court onto a piece of property not
privately owned. This type of move was done on Duncannon and he would like to
see it done of Primrose Court.
The following persons addressed Council with respect to the Notice of Motion
regarding traffic on Brookridge Gate and Dalewood Drive:
a)
Dale Goldhawk, 1049 Dalewood Drive, representing Dalebrook
Neighbourhood Association stated that the residents live in an unsafe
neighbourhood, where drivers do not stop for the stop signs. The road is
not designed for the heavy traffic it experiences and the hydro box has been
damaged on three separate occasions. The Planning Department stated at
the onset of this development that Brookridge Gate would have a cul-de-
sac, but the street was put through, creating the traffic to go from a trickle
to a roar. The 24-hour donut shop proposed for the Rougemount Plaza
will create more traffic. Please cul-de-sac Brookridge Gate.
b)
Wendy Smith-Heard, 1025 Dalewood Drive advised that she lives at the
intersection of Dalewood Drive and Brookridge Gate and that those
coming to this intersection do not stop for the stop signs. It is an
extremely dangerous intersection where she fears for the safety of her
children constantly. She and her children are prisoners in their own home
due to the amount and noise of the traffic.
c)
Nina Hnidec, 385 Brookridge Gate advised that she lives on the south/east
corner of Brookridge Gate and Altona Road and fears for the safety of the
children. She stated that there is a tremendous increase in traffic and the
proposed donut shop will create more. The cul-de-sac at Brookridge Gate
and Altona Road is necessary and she is willing to give up a small portion
of her land for this purpose.
d)
Laura Sutton, 1005 Rouge Valley Drive stated that she was before Council
eight years ago concerning Twyn Rivers Drive. She advised that she is
representing the 600 families on the other side of the development and they
are not in favour of this proposal. She requested that Council not make a
decision until they see the affect the new lights at Altona Road and Hwy.
#2 will have on this problem. A proper traffic study is required. Planning
for Ward 1 is extremely poor.
Christine Lenix, 390 Brookridge Gate advised that she lives on the corner
of Brookridge Gate and Altona Road and if Council cul-de-sacs
Brookridge Gate she will lose a large chunk of her property. She stated
that the cars do not speed and the drivers know that there are children in
the area. She suggested that walls not be built but the route of the problem
be found.
Mark Charette, 1450 Rougemount Drive stated that he is speaking on
behalf of the residents of Rougemount Drive and that the problems on this
street are as great if not greater than those of the area in question. It is not
a viable solution to move traffic from one neighbourhood to another,
Council should wait until lights go in at Altona Road and Hwy. #2.

Sheron Leonhardt, 2379 Denvale Drive addressed Council with respect to the
proposed School Crossing at Major Oaks Road and Pepperwood Gate. She
advised that she wrote to Councillor Johnson about the feasibility of having a
crosswalk at Valley Farm Road Public School. The parents and the P.T.A. are
angry that this crosswalk is not in. She requested that Council vote in favour of
this motion.
6.
Janice Frampton, 1810 Post Drive addressed Council with respect to Darwin
Drive. She stated that the Region of Durham also has a say in what happens to
these roads. She suggested that Council prepare a by-law concerning the
advertising by developers.

WHEREAS the Social Development Council of AjaxlPickering received a grant in 1994 from the
Ministry of Citizenship, the Anti-Racism Secretariat, to develop a programme to fight racism in
the community call "Taking A Stand"; and
WHEREAS the Social Development Council will require more time and further funding to
develop this programme; and
WHEREAS through this programme, the Town of Pickering initiated its anti-racism policies; and
WHEREAS the proposal for further funding must be submitted to the Ministry of Citizenship and
Culture prior to October 7, 1994;
NOW THEREFORE the Council of the Corporation of the Town of Pickering hereby directs that
a letter of support by the Town of Pickering for the grant application by the Social Development
Council be forwarded to the Minister of Citizenship and Culture.

WHEREAS the residents feel that these supermailboxes will bring extra traffic through the cul-de-
sac and thus making it less safe; and
WHEREAS these supermailboxes will create litter throughout the Court and are unsightly on a
homeowner's side yard;
NOW THEREFORE the Council of the Corporation of the Town of Pickering hereby requests
Canada post to install the supermailboxes that are meant to serve the residents of Primrose Court
on Fairport Road beside the walkway leading from Primrose Court.

WHEREAS it has been a continuous problem with traffic using Brookridge Gate and Dalewood
Drive as a shortcut to Rougemount Drive and highway #2; and
WHEREAS this traffic is speeding and not stopping at the Brookridge Gate and Dalewood Drive
stop signs and thus creating a very unsafe situation in a residential neighbourhood;
NOW THEREFORE the Council of the Corporation of the Town of Pickering hereby adopts the
recommendations of the Brookridge Gate and Dalewood Drive community with respect to
diverting traffic from this neighbourhood.

WHEREAS the Atomic Energy Control Board may require an Environmental Assessment Review
in order to consider the relicensing of the Pickering Nuclear Plant; and
WHEREAS Section 12 and Section 13 of the Rules of the Atomic Energy Control Board
provides that such Review may be held,

WHEREAS since the opening of the Pickering Nuclear Plant, new information and questions have
been raised pertaining to levels of tritium, the lack of a second fast shutdown for Pickering" A"

Atomic Energy Control Board initiate a public review of the relicensing of the Pickering "A" and
"B" Nuclear Generating Station.

Clerk sign the same and the seal of the Corporation be affixed thereto.

O'fHER BUSINESS
1.
Councillor Brenner advised that a Notice of Motion concerning Hillcrest Road
would be coming before Council on October 17, 1994.
2.
Councillor Brenner advised that a Notice of Motion concerning traffic in the West
Shore area would be coming before Council on October 17, 1994.
3.
Councillor Pistritto questioned when the fire numbers would be installed in
Cherrywood.
4.
Councillor Pistritto advised that he has received complaints concerning water
accumulation in front of280 Waterford Gate.

OTHER BUSINESS
a)
The Town Manager advised that the Mills Property is included in the
Whitevale Heritage District. To limit height and lot coverage would be in
conflict with the zoning by-law.
b)
The Town Manager advised that sales at the Ed Bauer Corporation are
successful.
c)
The Town Manager advised that a thank you letter had been received from
the Food Bank for the printing of flyers.
d)
The Town Manager commented on the memo which had been distributed
by the Director of Planning concerning Director Industrial Properties.
e)
The Town Manager advised that the Region should be commencing
installation of street lights at the intersection of Dixie Road and Glenanna
Road this fall.
f)
The Town Manager advised that the explosion at the home on Marksbury
Road approximately one year ago was caused by a gas fracture under the
home.
g)
Councillor Pistritto commented on the errors which he has found in the
electors list.
h)
Councillor Johnson commented on the dust problems being experienced in
the area of Oak burn and Waterford Gate.
i)
Councillor Brenner questioned the date on a letter received from the
Region of Durham concerning a West Shore Traffic Study.
j)
k)
Councillor Van Kempen questioned the garbage tender.
Councillor Van Kempen requested a copy of a memo concerning the
Infrastructure Program which the Town Manager received two weeks.
CONFIRMATION BY-LAW
By-law Number 4507/94
Councillor Wellman, seconded by Councillor Higdon moved for leave to introduce a By-law of
the Town of Pickering to confirm those proceedings of the Council of the Corporation of the
Town of Pickering at its meetings held on the 19th day of September, 1994 and the 3rd day of
October, 1994 and that the same be now finally passed and that the Mayor and Clerk sign the
same and that the Seal of the Corporation be thereto affixed.

TOWN OF PICKERING
That the Executive Committee of the Town of Pickering having met on September 26, 1994,
presents its twelfth report to Council and recommends:
1.
ZONING BY-LAW AMENDMENT APPLICATION A 23/93
DIRECTOR INDUSTRIAL PROPERTIES (THE SORBARA GROUP)
PART OF LOT 29, RANGE 3, BROKEN FRONT CONCESSION
(603 - 647 AND 699 KINGSTON ROAD)
FILE NUMBER - B 2310 - A 23/93

Eastern Property (National Sports)
That Zoning By-law Amendment Application 23/93 be APPROVED AS
REVISED to permit, on lands being Part of Lot 29, Range 3, Broken Front
Concession, Retail Warehouse - Types A and B, and Sports Practice Facility uses,
in addition to all currently permitted uses, subject to the following conditions:
1.
That prior to forwarding an implementing Zoning By-law for Council's
consideration for the eastern property (National Sports), the owner receive
Revised Site Plan Approval (file S 6/86) from the Town to address, but not
necessarily be limited to, the following concerns:
(a)
landscaping; loading areas; streetscape; pedestrian connections;
facade improvements; entrance treatment; signage; and refuse
storage; and
(b)
that the owner enter into an appropriate agreement with and to the
satisfaction of the Town regarding such revisions.

2.
That By-law 2471/87 be amended to include, but not necessarily be limited
to, the following provisions:
(a)
add, as permitted uses, Retail Warehouse - Types A and B, in
addition to all currently permitted uses;
(b)
add, as a permitted use, Sports Practice Facility, including a
definition for same.

That Zoning By-law Amendment Application 23/93 be APPROVED AS
REVISED to permit, on lands being Part of Lot 29, Range 3, Broken Front
Concession, commercial club, commercial-recreational establishment, duplicating
shop, place of amusement, and private club uses, in addition to all currently
permitted uses, subject to the following conditions:

That prior to forwarding an implementing Zoning By-law for the western
property (multiple-tenant building) for Council's consideration, the owner
receive Revised Site Plan Approval (file S 11184) from the Town to
address, but not necessarily be limited to, the following concerns:
(a)
landscaping; loading areas; streetscape; pedestrian connections;
facade improvements; entrance treatment; signage; and refuse
storage; and

(b)
that the owner enter into an appropriate agreement with and to the
satisfaction of the Town regarding such revisions.
2.
That By-law 1810/84 be amended to include, but not necessarily be limited
to, the following provisions:
(a)
add, as permitted uses, commercial club, commercial-recreational
establishment, duplicating shop, and private club uses, in addition to
all currently permitted uses but remove" social club" from the
commercial club definition.;
(b)
provide updated definitions for existing permitted uses, such as
"home improvement centre" and "industrial or commercial
equipment suppliers"; and
(c)
add any other provisions as necessary.

GRANT REQUEST FROM PACT
AND PHILHARMONIC

That a grant in the amount of $1,104.83 be made to PACT and the Pickering
Philharmonic to offset the rental fee of the East and West Salons at the Recreation
Complex on January 28, 1995 for a joint fund raising event;
and that this amount be charged to Account 2195 (Grants To Organizations and
Individuals)
