Farr R. Johnson - (Arrived at 9:45 p.m. - Absent on Town Business) E. Pistritto D. Ryan S. Senis ALSO PRESENT: C.M.T. Sheffield - Town Manager B. Taylor - Town Clerk N. Carroll - Director of Planning D. Kearns - Co-ordinator of Council Services (I) ADOPTION OF MINUTES Regular Meeting of June 19, 1995. (In PRESENTATION Mayor Arthurs made presentations of awards to the staff of the Transit Department and the Department of Culture and Recreation. (III) DELEGATIONS 1. Louise Farr, 1928 Malden Crescent and Maieka Lindon, 2001 Lynn Heights Drive, addressed Council to support ALS Awareness Month. 104 (III) DELEGATIONS 2. Sally Longo, Christine Kent and Margaret McKay, representing the Ajax/Pickering Community Care, addressed Council regarding the Home Support and COPE programs offered by that organization. Ms. Kent advised that there are seven offices within Durham and she outlined the various programs available to the residents. 3. Shirley Copp, addressed Council regarding the zoning by-law amendment application to permit a Montessori School at Kingston Road and Rougemount Drive. She stated that she was in receipt of a number of letters from various area community associations in support of this application and she requested unanimous support of Council. She also requested that Mr. De La Torre and herself be placed on the July 17, 1995 agenda. 4. Leo Papagni, representing Baby-O Donuts in the Town Centre Mall, addressed Council with respect to his business being closed in favour of a larger business. (M RESOLUTIONS Resolution #110/95 Moved by Councillor Pistritto Seconded by Councillor Brenner 1. That Town Council RECEIVE FOR INFORMATION the draft new Pickering Official Plan dated, June, 1995. 2. That Town Council ENDORSE a public consultation process on the draft new Pickering Official Plan, generally as outlined in Recommendation Report No. 15/95, and request staff to make any necessary revisions to the Draft Plan, and forward a recommended new Official Plan to Council for consideration before the end of 1995. That through the public consultation process staff investigate the interest of hamlet community groups for continued growth of hamlets beyond the level identified in the Draft Official Plan. CARRIED Council considered the following motion in conjunction with the above resolution: Resolution #111/95 Moved by Councillor Pistritto Seconded by Councillor Ryan . That staff investigate the interest of community groups in the hamlets for continued growth in the proposed Official Plan. CARRIED 105 Resolution #112/95 Moved by Councillor Brenner Seconded by Councillor Senis That the Town Manager be authorized to commit up to $50,000 to the Ministry of Transportation of Ontario toward the cost of designing the Highway 401 widening so as to accommodate a pedestrian/cyclist bridge over Highway 401 linking Pickering's downtown with the GO Station in the area between Liverpool Road and Glenanna Road, and that staff continue discussions with the 46 Ministry to ensure that the footings necessary to support the bridge are constructed as an integral component of the Highway 401 widening. CARRIED Resolution #113/95 Moved by Councillor Pistritto Seconded by Councillor Brenner That staff be authorized to demolish and dispose of the vacant house in Lynn Heights Park and authorize a $15,000 over-expenditure in Capital Account 2718-6129 for this purpose. DEFERRED FOR THREE MONTHS Councillor Senis declared an interest as her home is adjacent to this propertX. • Council considered the following motions in conjunction with the above resolution: Resolution #114/95 Moved by Councillor Pistritto Seconded by Councillor Brenner That staff take the necessary steps to secure the house in Lynn Heights Park from vandalism. CARRIED Resolution #115/95 Moved by Councillor Pistritto Seconded by Councillor Brenner That the above resolution be deferred for three months to receive LACAC's comments. CARRIED If., 106 Resolution #116/95 Moved by Councillor Brenner Seconded by Councillor Senis That the Council of the Town of Pickering adopt the Fee Schedule as outlined in Report No. PW- 3/95 so as to recover all municipal costs associated with the inspection, preparation, maintenance and/or restoration of an approved Newspaper Box or Canada Post Box location; and • That the Public Works Department be instructed to ensure that all Newspaper Box and Canada Post Box locations are brought into conformity with the regulating By-law by September 30, 1996. CARRIED Resolution #117/95 Moved by Councillor Ryan Seconded by Councillor Brenner That the recommendation of the Durham Regional Police Service for the implementation of the northern Amberlea Watch be approved. CARRIED Resolution #118/95 • Moved by Councillor Pistritto Seconded by Councillor Ryan That the 1995 General Insurance Report of Frank Cowan Company Limited dated May 16, 1995 be received; and That the total annual premium of $293,941 for the renewal term of 1995-96 plus an increase of $225 to provide for additional boiler and machinery insurance be approved. CARRIED Resolution #119/95 Moved by Councillor Farr Seconded by Councillor Senis WHEREAS the Province of Ontario has enacted legislation that precludes municipalities from receiving transit subsidies if they purchase buses outside of the Province; and WHEREAS this legislation does not allow for fair competition therefore resulting in higher prices for buses; NOW THEREFORE the Council of the Corporation of the Town of Pickering hereby requests the Association of Municipalities of Ontario to request the Province of Ontario to re-examine it's Bus Purchase Policy in order to allow municipalities to acquire buses outside of the Province and to suspend for at least two years Provincial Policy that states that all new buses in Ontario must be low floor system and still retain the privilege of receiving subsidies for these purchases; and ........ continued 107 Resolution #119/95 That copies of this resolution be sent to all transit authorities in Ontario requesting that they advise the Association of Municipalities of Ontario of their support. CARRIED 0 Council considered the following motion in conjunction with the above resolution: Resolution #120/95 Moved by Councillor Senis Seconded by Councillor Farr That the Province be requested to suspend Provincial Policy requiring new buses to be of a low floor system for at least two years CARRIED Recorded Vote: Yes: Councillors Farr, Ryan, Senis and Mayor Arthurs No: Councillors Brenner, Johnson and Pistritto Resolution #121/95 Moved by Councillor Johnson Seconded by Councillor Farr That the intersection improvements recommended in the Read, Voorhees and Associates Ltd. traffic study for the Liverpool Road and Bushmill Street/Linwood Street be incorporated with Tender T-2-95 for Road Improvements CARRIED lVl BY-LAWS That Councillor Farr seconded by Councillor Brenner took leave to introduce by-laws of the Town of Pickering: By-law Number 4633/95 Being a by-law to amend By-law 1562/82 temporarily closing roads for construction purposes (Whitevale Road). By-law Number 4634/95 Being a by-law to authorize the execution of a Subdivision Agreement Amending Agreement respecting the development of Block 44, Plan 40M-1508, Pickering, and the phased assumption of services in Plan 40M-1508 (Danlu, Perdanco, Inperdel - Altona West Developments). 108 (V) BY-LAWS By=law Number 4635/95 Being a by-law to authorize the execution of a Subdivision Agreement and related documentation respecting the development of Part Lot 32, Concession 1, and part of the Road Allowance between Lots 32 and 33, Concession 1, Pickering (Maxcon Developments Ltd. - 18T-86002). By-law Number 4636/95 is Being a by-law to authorize the execution of a Subdivision Agreement and related documentation proposing to subdivide part of Lot 68, Registered Plan 350, Pickering (Brancato Construction Co. Ltd., Draft Plan 18T-84001). By-law Number 4637/95 Being a by-law to authorize the execution of a Subdivision Agreement and related documentation proposing to subdivide part of Lot 24, Plan 329, Pickering (Rondev Homes Ltd., Draft Plan 18T-87043) By-law Number 4638/95 Being a by-law to authorize the execution of a Subdivision Agreement and related documentation proposing to subdivide part of Lots 27 and 28, Plan 329, Pickering (G & L. Developments Inc., Draft Plan 18T-84018 (R) Phase 2). By-law Number 4639/95 Being as by-law to provide for the regulation of Canada Post Boxes and Newspaper Boxes on highways under the jurisdiction of the Town of Pickering. • By-law Number 4640/95 Being a by-law to appoint By-law Enforcement Officers for certain purposes (Parking Regulation - 1735 Bayly Street, Brock Commercial Centre). By-law Number 4641/95 Being a by-law to declare certain municipal lands being part of Lot 19, Range 3, Broken Front Concession, and being designated as Parts 1, 2, 3, 4 and 5, Plan 40R-15930 as surplus to the needs of the Town of Pickering in accordance with By-law 4592/95. By-law Number 4642/95 Being a by-law to amend By-law 2658/88 to delete the holding symbol and related text therefrom. By-law Number 4643/95 Being a by-law to amend By-law 1562/82 temporarily closing roads for construction purposes (Dixie Road). THIRD READING: \0 Councillor Johnson, seconded by Councillor Ryan moved that the report of the Committee of the Whole on By-law Numbers 4633/95. 4634/95, 4635/95, 4636/95, 4637/95, 4638/95, 4640/95, 4641/95, 4642/95 and 4643/95 be adopted and the said by-laws be now read a third time and PASSED and that the Mayor and Clerk sign the same and the seal of the Corporation be affixed thereto. CARRIED 109 (VI) OTHER BUSINESS 1. Mayor Arthurs extended congratulations to Janet Ecker, M.P.P. and thanked Jim Wiseman for his assistance during his term of office. 2. Councillor Pistritto requested a Leave to Introduce a Motion concerning Baby-O Donuts. Resolution #122/95 Moved by Councillor Pistritto Seconded by Councillor Brenner For a Leave to Introduce a Motion concerning Baby-0 Donuts. LOST Recorded Vote: Yes: Councillors Brenner, Johnson and Pistritto No: Councillors Farr, Ryan, Senis and Mayor Arthurs 3. Councillor Johnson gave a report on the Swearing in Ceremonies of Mike Harris. 4. Councillor Johnson commented on the 130 year old Maples being removed around the Claremont park. 5. Councillor Brenner shared a letter which he had received concerning donations to the Teen Foundation. 6. Councillor Brenner commented on his concerns regarding the cutting of school 0 buses in the Amberlea south area. 7. Councillor Brenner advised of an article in the Toronto Star concerning the recommendation for a Toronto Region. 8. Councillor Senis advised of an Information Meeting concerning Frenchman's Bay which is to be held at the Frenchman's Bay Yacht Club at 7 p.m. on June 27, 1995. 9. Councillor Senis advised of the Canada Day Celebrations being held on Saturday at the Kinsmen Park. 10. The following matters were discussed prior to the regular meeting: a. The Town Manager distributed a list of the latest revision to road projects within the Town. b. The Town Manager distributed a report concerning the construction works at Liverpool/Bushmill. C. The Town Manager distributed a brief update of Information Services - Property Data Base Conversion Project. d. Mayor Arthurs advised that a Council Meeting will be required sometime in July. Council concurred with this meeting being held on July 17, 1995. e. Councillor Farr requested a status report on the Voice Mail System being implemented in the Town. 110 (YD - OTHER BUSINESS f. Councillor Farr advised that Mayor Arthurs was the push behind having the Regional Report concerning the airport forwarded to area municipalities. g. Councillor Pistritto read an article to Council concerning Covey Leadership. h. Councillor Pistritto advised that the M.T.R.C.A. have shown an interest in the acquisition of Port Pickering Marina. i. Councillor Ryan requested information concerning the Town's position on the closing of Twyn Rivers Drive. j. Councillor Senis requested a status report on the ten tax payment installments. (YII? CONFIRMATION BY-LAW By-law Number 4644/95 Councillor Brenner seconded by Councillor Senis moved for leave to introduce a By-law of the Town of Pickering to confirm those proceedings of the Council of the Corporation of the Town of Pickering at its meetings held on the 26th day of June, 1995 and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed.
