Special Council Meeting of June 12, 1995. (ID PRESENTATION Mayor Arthurs made the presentation of the 1995 Civic Awards. 97 (III) DELEGATIONS 1. Victor Lind, representing Emix Limited addressed Council with respect to its proposal to construct a bingo establishment on lands south of Kingston Road and east of Dixie Road. He advised that this by-law deals with three separate issues, the road dedication being one small part. The Town Centre West Study requires a two storey building be constructed with a 40% coverage, and this application is for a structure with the appearance of two storeys on the outside and one on the inside with a 17% coverage. He stated that Emix and Rank agree to half of the road on their property. 2. Guy Kellet, representing the Rank Organization, addressed Council with respect to its proposal to construct a bingo establishment on lands south of Kingston Road and east of Dixie Road. He advised that they purchased their first Pickering bingo establishment in 1989 which is now not a suitable location. Bingo halls in other municipalities are drawing the bingo patrons to them which is causing the charitable donations from this establishment to decrease. He stated that a total of 21 charities will receive donations in this new location is approved. 3. The following persons addressed Council with respect to the proposed bingo establishment on lands owned by Emix Limited: a. Bob Burch, representing Schindler Elevator advised that he was satisfied that Emix Limited will provide the road allowance. b. Carol Bamford, 1102 Dunbarton Road advised that the residents have invested time and money into their homes and this application will have a detrimental affect on the area with respect to noise, traffic and litter. The hours of operation could increase to 24 and Council would not have the jurisdiction to stop it. Top Rank Bingo should consult and compromise. She urged Council to defeat this application. C. Larry Brien, representing the Liverpool West Community Association advised that they are not opposed to Bingo halls but the placement should be carefully thought out. The Town Centre West Study stipulates two storeys and this application is for one. Parking could create a problem and potential businesses could be scared off. Council should deny this application and assist the applicant in finding a suitable location. d. John Hayden, 1325 Brands Court, representing the Pickering Breakfast Club advised that the present bingo hall was not built for bingo and they cannot draw patrons from the surrounding municipalities. This business is financially beneficial to the Town and also financially assists service clubs. He urged Council to carefully consider this rezoning application. 4. The following persons addressed Council with respect to the application for rezoning and land severance by Garthwood Homes on Pine Grove Avenue: a. John Woitzik, 1884 Altona Road distributed correspondence from himself, Altona West Community Association and Friends of Altona Forest and Petticoat Creek. He stated that tree preservation is of major importance. If the valley land does not remain under public authority than he would like the option to purchase it but with the Town maintaining it. The buffer zone should be maintained. 98 am DELEGATIONS b. Sue Markos, representing the Altona West Community Association advised that the area residents were very upset when the trees were removed from the property and requested that the remaining trees be protected. She requested that the Association be informed when the draft agreement and zoning by-law come before Council. 5. Louise Boehler, 889 Antonio Street thanked Members of Council and the staff of • the Department of Culture and Recreation for their work on youth programs. She read out letters which had been received from Shawn O'Sullivan and the Harlem Road Kings. She requested to know what would happen to the money paid out by the kids involved in the programs, would Council be sharing the results of the youth survey and would these programs, which begin in July, continue or just be a pilot project. THIRD READING: Councillor Johnson, seconded by Councillor Ryan moved that the report of the Committee of the Whole on By-law Numbers 4622/95, 4623/95, 4624/95, 4625/95, 4626/95, 4627/95, 4628/95, 4629/95 and 4631/95 be adopted and the said by-laws be now read a third time and PASSED and that the Mayor and Clerk sign the same and the seal of the Corporation be affixed thereto. CARRIED 101 (VD OTHER BUSINESS 1. Mayor Arthurs advised of todays Simmonds Technologies Incorporated Sod Turning Ceremony. 2. Councillor Farr advised of the event held at the Loeb Plaza on Saturday, June 17th to raise funds for Leukemia victim Daniel Burton. 3. Councillor Senis advised of a Information Meeting being held Tuesday, June 27th at the Frenchman's Bay Yacht Club concerning the management of Frenchman's Bay. 4. The following matters were discussed prior to the regular meeting: a. The Town Manager advised that all sign permits which have been distributed but not acted upon will be revoked. b. The Town Manager advised that the Student Youth Program will commence in July. C. The Town Manager commented on the request to the Ministry of Transportation for the provision of a pedestrian walkway over the expanded 401 from the area of the Pickering Town Centre to the GO Station. He advised that the Director of Planning would be forwarding a report to Council concerning the financial contribution requested by the Ministry from the Town. d. The Town Manager advised that En-ix Limited have acknowledged agreement to half of the road on their property. e. The Town Manager stated that four appraisals have been received from Mr. McKean on his property. f. Councillor Pistritto advised that upon speaking with a consultant he feels the Towns appraisal could be done quicker than stated. g. Councillor Farr questioned the comments made in the Treasurer's Report concerning Revenue. PICKERING DOWNTOWN CORE: A LAND USE AND DESIGN STUDY RECOMMENDATION OF CONSULTANT GROUP TO UNDERTAKE STUDY FILE NUMBER - B 1000 1. That Markson Borooah Hodgson Architects Inc., in association with Weinstein Leeming Hinde + Associates Ltd., PMA Landscape Architects Ltd., and Royal LePage Strategic Advisory Services, with McCormick Rankin Ltd. as advisors, be retained to undertake the `Pickering Downtown Core" A Design and Land Use Strategy' ; and 2. ZONING BY-LAW AMENDMENT APPLICATION A 19/94 REQUEST TO CREATE LOTS BY LAND SEVERANCE PROCESS GARTHWOOD HOMES LTD. BLOCK 70, PLAN 40M-1700 (NORTH OF PINE GROVE AVENUE/WEST OF ALTONA ROAD) FILE NUMBER - B 2310 - A 19/94 10 That Zoning By-law Amendment Application A 19/94, submitted by Garthwood Homes Ltd., be APPROVED to permit the development of six street townhouses, in addition to retaining open space uses on Block 70, Plan 40M-1700, Town of Pickering, subject to the following conditions: 1. Prior to forwarding an implementing Zoning By-law to permit the street townhouse component for Council's consideration, the owner shall: (a) submit a soil study investigating possible soil contamination to the Town's satisfaction; (b) submit an architectural streetscape drawing, a housing design statement, unit siting plans, and overall site plan to the satisfaction of the Planning Department, (i) with special emphasis on the building envelope and useable front, side and rear yards of proposed unit 6; (ii) which reflect two groupings of three townhouse units per grouping; (iii) which reflect a minimum horizontal distance between buildings of 2.4 metres where units are not joined together in whole or in part; (iv) which provides for an increased building setback from the front lot line for units 1 to 3 in order to accommodate parking of 2 cars end-to-end, in addition to and in front of the parking space enclosed within a private garage; 2 2. (v) which includes the provision of a planted landscaped area of approximately 26 square metres, located east of unit #6 on lands above the Regional Floodline/Top-of-bank within the required buffer area (open space) to be conveyed to the Town; and (vi) that the Planning Department involve area representatives and the Local and Regional Ward Councillors in their review of the items required in this subsection. (c) submit a reference plan indicating the specific delineation of the regional floodline and the top-of-bank; and (d) enter into an appropriate development agreement with and to the satisfaction of the Town including, but not necessarily limited to, provisions regarding: (i) payment of appropriate parkland dedication fees; (ii) the conveyance of Block 68, Plan 40M-1700, and the valleylands below the Regional Floodline/Top-of-bank from within Block 70 to the Town; (iii) ensuring compliance of the development with the architectural statement, siting plan and landscape provisions developed through section (b) above; and (iv) the provision of a 1.8 metre wood privacy fence along the west boundary of the site; (v) other matters pertaining to the development of land which are normally addressed in a subdivision agreement. 2. That the implementing Zoning By-law include zoning standards: (a) permitting one street townhouse unit per lot with a minimum lot frontage of 5.6 metres; (b) requiring that the open space zoning prohibiting all structural improvements be retained over all lands within the required buffer abutting the Petticoat Creek floodline/top-of-bank; (c) requiring an open passive outdoor living area with a minimum depth of 4.5 metres beyond the rear wall of each townhome unit; (d) requiring a minimum rear yard depth of 6.0 metres; (e) providing for the parking of a minimum of two cars on each townhouse lot, one of which is to be enclosed within a private garage; and (f) requiring that the horizontal distance between buildings on adjacent lots, except where such buildings are attached in whole or in part, shall be not less than 2.4 metres. 3 3.
