G; ~ COUNCIL MINUTES A Meeting of the Pickering Town Council was held on Monday, September 15,1997 at 7 40 p.m. PRESENT: Mayor Wayne Arthurs COUNCll.,LORS: M. Brenner D. Dickerson R. Johnson E. (II) (Ill) 1. 2. - General Manager - Town Clerk - Town Solicitor - Director of Planning - Co-ordinator of Council Services ANNOUNCEMENT Mayor Arthurs officially opened the Customer Care Centre and provided details on how the Centre will operate. The General Manager commented on the need for and function of this Centre and those working to address the ongoing concerns. ADOPTION OF MINUTES Regular Meeting of August 5, 1997 Special Meeting of August 5, 1997. DELEGA TIONS Christine Nancekivell, Planner for the Durham Board of Education distributed information to Council with respect to Development Charges. She advised that all requirements necessary for the Education Development Charges imposed on Ontario Hydro had been met. Meagan Mirou, representing the musical group "Latitude", made a presentation to Council. .' 91 3. The following residents addressed Council regarding disabled parking Issues: a) Marty Martel, 1580 Kingston Road advised that he has investigated schools, churches and plazas and a number are not conforming to the by-law. Signs are not being erected, paint is fading and people continue to park in the fire route. He questioned why the by-law is not being enforced. 8 b) Linda Burton 1232 Ilona Park Road stated that less than 10% of , commercial properties meet the by-law. She referred to a September memo from the Town Clerk and commented on a number of inaccuracies. She stated that unless a sign is posted police cannot ticket. She questioned why the by-law has not been enforced. 4. Ron Roberge, representing the Pickering Professional Firefighters Association addressed Council with respect to the Notice of Motion regarding Bill 84. He stated that firefighters across the Province and the Town are opposed to Part 9 of Bill 84. He strongly urged Council to ensure that citizens are properly covered. The public and firefighters would be put at risk if this Bill is supported. 5. Sharon Howes, representing the West Rouge Canoe Club, presented Council with a plaque to thank them for their support and involvement in the 1 st Annual 1997 Dragonboat Challenge. 6. Jamie Bennett, representing L. and e. Dinardo and G. Albanese, addressed Council with respect to his client's application for rezoning and draft plan of subdivision on the east side of Altona Road. He stated that they do not support the staff recommendation for single car garages on certain pie- shaped lots. He requested a revision to allow for double car garages, double driveways tapering to a single curb cut driveway. . (IV) HEARING UNDER DEVELOPMENT CHARGES ACT Resolution #346/97 Moved by Councillor Brenner Seconded by Councillor Johnson That the appeal submitted by Mitchell Construction on behalf of Ontario Hydro respecting the Education Development Charge levied in regards to Building Permit #97-156, be denied.. CARRIED (V) RESOLUTIONS 8 Resolution #347/97 Moved by Councillor Brenner Seconded by Councillor Johnson That the Report of the Executive Committee dated September 8, 1997 be adopted with the following amendments: 8 . - ~ 92 Item #2 was amended by deleting Condition 2.0(b) of the recommended conditions of approval for Zoning By-law Amendment Application A 17/96; and modifying the wording of Condition 2.3.8(d) of draft subdivision conditions to add the following sentence at the end of the last paragraph: "Where required to achieve this objective, curb cuts will be restricted to single car width." Council considered the following motion in conjunction with the above resolution: Resolution #348/97 Moved by Councillor Johnson Seconded by Councillor Pistritto That Item #2 be amended by deleting Condition 2.0(b) of the recommended conditions of approval for Zoning By-law Amendment Application A 17/96; and modifying the wording of Condition 2.3.8(d) of draft subdivision conditions to add the following sentence at the end of the last paragraph: "Where required to achieve this objective, curb cuts will be restricted to single car width." CARRIED Resolution #349/97 Moved by Councillor Brenner Seconded by Councillor Senis THAT the Town of Pickering hereby expresses its opposition to the recent decision by the Ministry of Health to amalgamate the Durham Regional District Health Council with the Haliburton, Kawartha, Pine Ridges District Health Council; and FURTHER THAT the Town of Pickering hereby requests that the Minister of Health to reverse this decision pending; (1) The final conclusions of the Health Services Restructuring Committee (2) The formation of the Greater Toronto Area Services Board January 1998 at which time this matter be considered as part of a Greater Toronto Area District Health Council; AND that a copy of this resolution be forwarded to the Regional Municipality of Durham, all of its area Councils, Dan McTeague, M.P. and Janet Ecker, M.P.P. for their endorsement. CARRIED Recorded Vote: Yes: No Councillors Brenner, Dickerson, Pistritto, Ryan and Senis Councillor Johnson and Mayor Arthurs 93 Resolution #350/97 Moved by Councillor Dickerson Seconded by Councillor Johnson BACKGROUND 8 WHEREAS Ontario Hydro has been plagued with numerous problems over the past month at several of their nuclear stations. The severity of problems has been so great as to require the closure of seven of the nineteen remaining reactors including four here in Pickering. This is the result of unsafe operating practices found to be below the acceptable level of operation; and WHEREAS the Pickering Nuclear Generating Station (PNGS) is one of the Ontario Hydro Plants currently experiencing problems. Recent reports have indicated that as much as 40,000 gallons (180,000 litres) ofliquid industrial waste oil was illegally dumped into a former construction and demolition landfill site at the nuclear plant during construction of the "B" side. The "B" side contains four nuclear reactors constructed between 1977-82; and WHEREAS Ontario Hydro's problem at the Pickering Nuclear Generating Station has created great anxiety among local Pickering residents who are concerned about their safety and the safety of the environment in which they live; and SITUA TIONAL ANALYSIS 4» WHEREAS currently there is speculation that the liquid industrial waste oil could possibly contain PCB's. During the late seventies and early eighties, Ontario Hydro replaced thousands or transformers across the Province and there is a concern that some, any, or all of the dumped oil may have come from any of these transformers; and WHEREAS in order to allay fears among local citizens, it is important that an independent review be undertaken to assess the current conditions at the PNGS for landfill site; and WHEREAS in the interest of our citizens, it is imperative that Council take immediate action to ensure that our residents are not at risk. If a potentially dangerous situation does in fact exist, Council needs to ensure that appropriate measures are taken by Ontario Hydro to remediate the site to meet Ministry of the Environment and Energy (MOEE) environmental compliance; and WHEREAS depending on the extent of the problem at the site, the appropriate protocol would need to be developed for the safe removal, transportation and destruction of any hazardous material; PROPOSED ACTION ~ NOW THEREFORE the Council of the Corporation of the Town of Pickering hereby recommends that an independent consultant be appointed to co-ordinate all facets of this operation to ensure that the proper measures are taken, and to represent the interests of the Town of Pickering. As all details of the problem are not currently known, the independent consultant may require additional resources to conduct a thorough investigation and to ensure that the site is properly remediated; and THAT the consultant will report to Pickering Council as to the extent of the problem and will ensure that appropriate and timely action is being taken by Ontario Hydro to bring the landfill to MOEE compliance; and 94 THAT the independent consultant must have the ability and confidence of the Ministry of the Environment and Energy and be able to access the Minister. As well the consultant must be able to develop a working relationship with key Ontario Hydro officials. To effectively manage communications, the consultant should be adept at developing a proactive community relations strategy and have the ability to address questions of local residents. will ensure that communications with Pickering residents is ongoing during this process; and 8 THAT as Council is aware, Ontario Hydro has agreed to cover the costs of hiring an appropriate independent representative recommended by Council. The MOEE is prepared to ensure that the cost of this independent representative, and any required resources, are the responsibility of Ontario Hydro; and THAT in selecting an independent consultant, Council appreciates that this problem needs to be dealt with in an expedient manner; and RECOMMENDA TION THAT to ensure that nothing is left to change at PNGS, and that local residents can be assured that the landfill problem at the PNGS will not negatively effect their quality of life, it is recommended that MOEE and Ontario Hydro enter into an agreement with the Town of Pickering, similar to the arrangement for the Brock North Remediation (excluding any possible use or re-opening of Brock West) which will ensure that similar measures are used to remediate the PNGS Landfill site in an expedient manner; and AND MOREOVER, IT IS RECOMMENDED: That the Council of the Corporation of the Town of Pickering recommends to the MOEE and to Ontario Hydro that the services of an independent consultant, namely Corporate and Government Consultants Canada be retained; and 8 THAT the Council of the Corporation of the Town of Pickering will thereby ensure that only the highest standards of environmental remediation are undertaken. CARRIED 8 8 - 95 Recorded Vote: Yes: No: Councillors Pistritto, Ryan, Senis and Mayor Arthurs Councillors Brenner, Dickerson and Johnson Resolution #353/97 Moved by Councillor Dickerson Seconded by Councillor Senis WHEREAS Bill 84 allows for the privatization of Fire Departments; a policy which has led to horrific circumstances in the United States; and WHEREAS Bill 84 allows the replacement of full time professional fire fighters with part time workers ofless experience and skill; and WHEREAS Bill 84 provides call back services which will lead to slower response time and will reduce public safety; and WHEREAS the Ontario Government received over 225,000 petitions requesting them to eliminate the threat offire safety but they failed to amend these aspects of the Bill; and WHEREAS the Bill has passed 3rd Reading in the legislature during this sitting; NOW THEREFORE BE IT RESOLVED that the Council of the Corporation of the Town of Pickering hereby declares its intention to not implement Part 9 of Bill 84 and to specifically indicate its opposition to any policy which undermines fire protection. CARRIED Recorded Vote: Yes: Councillors Brenner, Dickerson, Johnson, Pistritto, Ryan, Senis and Mayor Arthurs 8 8 8 96 Resolution #355/97 Moved by Councillor Brenner Seconded by Councillor Dickerson WHEREAS as the Federal Government has announced a government initiative to assist in providing employment experiences to youth; NOW THEREFORE BE IT RESOLVED that the Council of the Corporation of the Town of Pickering requests that as part of Pickering Healthy Community Initiatives, staff of the Department of Culture and Recreation commence discussions with the appropriate Federal Department in an effort to create a Pickering Youth Internship Program that will enable our youth to gain valuable employment experiences in our community. CARRIED Resolution #356/97 Moved by Councillor Ryan Seconded by Councillor Brenner WHEREAS the Council of the Corporation of the Town of Pickering has authorized the discretionary spending by Members of Council on such matters as public relations, conventions, clerical support and travel allowance; and WHEREAS Members of Council do not necessarily spend all that they are allowed for such matters; and WHEREAS there are projects of interest to every Member of Council which may not be provided for in the annual budget; NOW THEREFORE the Council of the Corporation of the Town of Pickering hereby authorizes the use of any unused allowances provided for each Member of Council to be used in a manner that they feel would be of benefit to the Town of Pickering. (VII) OTHER BUSINESS 1. Councillor Pistritto advised that he would be bringing forward a Notice of Motion concerning part-time firefighters and the 25 Year Watch Program. 2. Councillor Pistritto advised that Artfest was extremely successful. 3. Councillor Senis advised that she would be bringing forward a Notice of Motion concerning embarking on a pilot project called 'Road Watch' that will dramatically reduce unsafe driving and fatalities by altering drivers attitudes and promoting good driving habits through awareness, education and enforcement. 4. Councillor Senis requested that the General Manager investigate and advise if the builder at Fairport and Bonita is adhering to top of bank. 5. Councillor Senis also advised that she had received a number of complaints regarding heavy equipment on Fairport Road. 6. Councillor Ryan extended congratulations to the Rouge Valley Comm. Assoc. on their very successful event held this past weekend. 7. Councillor Johnson extended congratulations to the Altona West Comm. Assoc. on the event this past weekend. . e 8 100 8. Councillor Johnson advised the Durham Board of Education have advised him that they will be acquiring the property and building the Westcreek school. 9. Councillor Johnson advised of a number of events taking place this coming weekend. 10. Councillor Brenner expressed his gratitude to the Councillors' Assistant for her involvement in a situation with the Durham Board of Education and Dan McTeague, M.P. 11. Mayor Arthurs advised of a number of upcoming events. 12. The following matters were discussed prior to the regular meeting: a. The Town Solicitor commented on the possibility of acquiring contributions from the Durham Board of Education and the Region of Durham towards the November election. Resolution #358/97 Moved by Councillor Senis Seconded by Councillor Ryan That the matter raised by the Town Solicitor concerning acquiring funds from the Durham Board of Education and the Region of Durham towards the November election be referred to staff. CARRIED b. The Town Solicitor distributed copies of a Notice of Sale pertaining to Stolp Homes. c. The Town Solicitor advised that the by-law concerning the Gates of Pickering has been pulled. d. The Town Solicitor advised that the Region of Durham have forwarded correspondence to her concerning an agreement respecting conservation easements between themselves, ORC and possibly the Town. e. The General Manager advised that a number of staff have recently had a family member pass away. f. The General Manager stated that approval by the Lieutenant Governor is still required for the Princess Diana Park. g. The General Manager advised that a great deal of illegal dumping is still occurring. h. The General Manager advised that Durham Regional Police have two radar units for Pickering. - ~ e 101 (VIII) CONFIRMATION BY-LAW By-law Number 5111/97 Councillor Brenner seconded by Councillor Johnson moved for leave to introduce a By- law of the Town of Pickering to confirm those proceedings of the Council of the Corporation of the Town of Pickering at its meeting held on the 15th day of September, 1997 and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. REGIONAL PLANNING COMMISSIONER'S REPORT 97-P-89 ON: (1) THE PICKERING OFFICIAL PLAN; (2) RELATED REGIONAL OFFICIAL PLAN AMENDMENT APPLICATION OPA 97-007ID; AND (3) COUNTRY RESIDENTIAL PROPOSALS SUBMITTED BY 770661 ONTARIO LIMITED (OPA 86-0 1 OlD), FRISQUE (OPA 86-049ID) AND BROWN (OPA 87-021ID) FILE NUMBER - B 2310 . That Town Council supports resolving the request made by the Altona West Community Association by deleting Deferral 18 and by modifying the Pickering Official Plan to add a new text policy to Section 11.12 to establish the maximum permitted residential density on the lands located at the south-west corner of Pine Grove Avenue and Altona Road, as follows: 11.12 (c) despite Table 6 of Chapter Three, establish a maximum residential density of 63 units per net hectare for lands located at the southwest corner of Pine Grove Avenue and Altona Road that are designated Mixed Use Areas - Local Node and abut lands developed as low density development. 8 2. DRAFT PLAN OF SUBDIVISION 18T -96008(R) ZONING BY-LAW AMENDMENT APPLICATION A 17/96 L. & e. DINARDO AND G. ALBANESE (EAST SIDE OF ALTONA ROAD, NORTH OF WATERFORD GATE) FILE NUMBER - B 2310 -A 17/96 -18T-96008(R) That Town Council recommend to the Region of Durham, that Draft Plan of Subdivision 18T -96008(R) submitted by L. & e. Dinardo and G. Albanese on lands known as Part of Lot 32, Concession 1, Town of Pickering, be APPROVED subject to the following conditions: 1.0 GENERAL CONDITIONS 1.1 That this recommendation apply to the plan identified as the Town Recommended Plan, and bearing the Town's recommendation stamp dated September 8, 1997 subject to further revisions which may be required to address the conditions of approval noted below; the report outlining siting and architectural design objectives for the development must address building envelopes, house designs, siting, and streetscapes as well as garage designs, locations, massing, and projection from the main dwelling; the report outlining siting and architectural design objectives for the development must place special emphasis on building elevations and unit siting along Strouds Lane as well as the provision of adequate on and off-street parking throughout the development; (d) -- (e) 4 the report outlining siting and architectural design objectives for the development must address driveway placement and curb cut location on Street B to ensure adequate room is maintained to accommodate street furniture and boulevard landscaping.
