A Meeting of the Pickering Town Council was held on Monday, September 15,1997 at
7 40 p.m.

ANNOUNCEMENT
Mayor Arthurs officially opened the Customer Care Centre and provided
details on how the Centre will operate. The General Manager commented
on the need for and function of this Centre and those working to address
the ongoing concerns.

Christine Nancekivell, Planner for the Durham Board of Education
distributed information to Council with respect to Development Charges.
She advised that all requirements necessary for the Education Development
Charges imposed on Ontario Hydro had been met.
Meagan Mirou, representing the musical group "Latitude", made a
presentation to Council.

The following residents addressed Council regarding disabled parking
Issues:
a)
Marty Martel, 1580 Kingston Road advised that he has investigated
schools, churches and plazas and a number are not conforming to
the by-law. Signs are not being erected, paint is fading and people
continue to park in the fire route. He questioned why the by-law is
not being enforced.

b)
Linda Burton 1232 Ilona Park Road stated that less than 10% of
,
commercial properties meet the by-law. She referred to a
September memo from the Town Clerk and commented on a
number of inaccuracies. She stated that unless a sign is posted
police cannot ticket. She questioned why the by-law has not been
enforced.

Ron Roberge, representing the Pickering Professional Firefighters
Association addressed Council with respect to the Notice of Motion
regarding Bill 84. He stated that firefighters across the Province and the
Town are opposed to Part 9 of Bill 84. He strongly urged Council to
ensure that citizens are properly covered. The public and firefighters
would be put at risk if this Bill is supported.

Sharon Howes, representing the West Rouge Canoe Club, presented
Council with a plaque to thank them for their support and involvement in
the 1 st Annual 1997 Dragonboat Challenge.
6.
Jamie Bennett, representing L. and e. Dinardo and G. Albanese, addressed
Council with respect to his client's application for rezoning and draft plan
of subdivision on the east side of Altona Road. He stated that they do not
support the staff recommendation for single car garages on certain pie-
shaped lots. He requested a revision to allow for double car garages,
double driveways tapering to a single curb cut driveway.

Ministry of Health to amalgamate the Durham Regional District Health Council with the
Haliburton, Kawartha, Pine Ridges District Health Council; and
FURTHER THAT the Town of Pickering hereby requests that the Minister of Health to
reverse this decision pending;

The final conclusions of the Health Services Restructuring Committee

The formation of the Greater Toronto Area Services Board January 1998 at which
time this matter be considered as part of a Greater Toronto Area District Health
Council;
AND that a copy of this resolution be forwarded to the Regional Municipality of Durham,
all of its area Councils, Dan McTeague, M.P. and Janet Ecker, M.P.P. for their
endorsement.

BACKGROUND

WHEREAS Ontario Hydro has been plagued with numerous problems over the past
month at several of their nuclear stations. The severity of problems has been so great as
to require the closure of seven of the nineteen remaining reactors including four here in
Pickering. This is the result of unsafe operating practices found to be below the
acceptable level of operation; and
WHEREAS the Pickering Nuclear Generating Station (PNGS) is one of the Ontario
Hydro Plants currently experiencing problems. Recent reports have indicated that as
much as 40,000 gallons (180,000 litres) ofliquid industrial waste oil was illegally dumped
into a former construction and demolition landfill site at the nuclear plant during
construction of the "B" side. The "B" side contains four nuclear reactors constructed
between 1977-82; and
WHEREAS Ontario Hydro's problem at the Pickering Nuclear Generating Station has
created great anxiety among local Pickering residents who are concerned about their
safety and the safety of the environment in which they live; and
SITUA TIONAL ANALYSIS

WHEREAS currently there is speculation that the liquid industrial waste oil could possibly
contain PCB's. During the late seventies and early eighties, Ontario Hydro replaced
thousands or transformers across the Province and there is a concern that some, any, or all
of the dumped oil may have come from any of these transformers; and
WHEREAS in order to allay fears among local citizens, it is important that an independent
review be undertaken to assess the current conditions at the PNGS for landfill site; and
WHEREAS in the interest of our citizens, it is imperative that Council take immediate
action to ensure that our residents are not at risk. If a potentially dangerous situation does
in fact exist, Council needs to ensure that appropriate measures are taken by Ontario
Hydro to remediate the site to meet Ministry of the Environment and Energy (MOEE)
environmental compliance; and
WHEREAS depending on the extent of the problem at the site, the appropriate protocol
would need to be developed for the safe removal, transportation and destruction of any
hazardous material;
PROPOSED ACTION
~
NOW THEREFORE the Council of the Corporation of the Town of Pickering hereby
recommends that an independent consultant be appointed to co-ordinate all facets of this
operation to ensure that the proper measures are taken, and to represent the interests of
the Town of Pickering. As all details of the problem are not currently known, the
independent consultant may require additional resources to conduct a thorough
investigation and to ensure that the site is properly remediated; and
THAT the consultant will report to Pickering Council as to the extent of the problem and
will ensure that appropriate and timely action is being taken by Ontario Hydro to bring the
landfill to MOEE compliance; and

THAT the independent consultant must have the ability and confidence of the Ministry of
the Environment and Energy and be able to access the Minister. As well the consultant
must be able to develop a working relationship with key Ontario Hydro officials. To
effectively manage communications, the consultant should be adept at developing a
proactive community relations strategy and have the ability to address questions of local
residents. will ensure that communications with Pickering residents is ongoing during this
process; and

THAT as Council is aware, Ontario Hydro has agreed to cover the costs of hiring an
appropriate independent representative recommended by Council. The MOEE is prepared
to ensure that the cost of this independent representative, and any required resources, are
the responsibility of Ontario Hydro; and
THAT in selecting an independent consultant, Council appreciates that this problem needs
to be dealt with in an expedient manner; and
RECOMMENDA TION
THAT to ensure that nothing is left to change at PNGS, and that local residents can be
assured that the landfill problem at the PNGS will not negatively effect their quality of life,
it is recommended that MOEE and Ontario Hydro enter into an agreement with the Town
of Pickering, similar to the arrangement for the Brock North Remediation (excluding any
possible use or re-opening of Brock West) which will ensure that similar measures are
used to remediate the PNGS Landfill site in an expedient manner; and
AND MOREOVER, IT IS RECOMMENDED:
That the Council of the Corporation of the Town of Pickering recommends to the MOEE
and to Ontario Hydro that the services of an independent consultant, namely Corporate
and Government Consultants Canada be retained; and

THAT the Council of the Corporation of the Town of Pickering will thereby ensure that
only the highest standards of environmental remediation are undertaken.

WHEREAS Bill 84 allows for the privatization of Fire Departments; a policy which has
led to horrific circumstances in the United States; and
WHEREAS Bill 84 allows the replacement of full time professional fire fighters with part
time workers ofless experience and skill; and
WHEREAS Bill 84 provides call back services which will lead to slower response time
and will reduce public safety; and
WHEREAS the Ontario Government received over 225,000 petitions requesting them to
eliminate the threat offire safety but they failed to amend these aspects of the Bill; and
WHEREAS the Bill has passed 3rd Reading in the legislature during this sitting;
NOW THEREFORE BE IT RESOLVED that the Council of the Corporation of the
Town of Pickering hereby declares its intention to not implement Part 9 of Bill 84 and to
specifically indicate its opposition to any policy which undermines fire protection.

WHEREAS as the Federal Government has announced a government initiative to assist in
providing employment experiences to youth;
NOW THEREFORE BE IT RESOLVED that the Council of the Corporation of the
Town of Pickering requests that as part of Pickering Healthy Community Initiatives, staff
of the Department of Culture and Recreation commence discussions with the appropriate
Federal Department in an effort to create a Pickering Youth Internship Program that will
enable our youth to gain valuable employment experiences in our community.

WHEREAS the Council of the Corporation of the Town of Pickering has authorized the
discretionary spending by Members of Council on such matters as public relations,
conventions, clerical support and travel allowance; and
WHEREAS Members of Council do not necessarily spend all that they are allowed for
such matters; and
WHEREAS there are projects of interest to every Member of Council which may not be
provided for in the annual budget;
NOW THEREFORE the Council of the Corporation of the Town of Pickering hereby
authorizes the use of any unused allowances provided for each Member of Council to be
used in a manner that they feel would be of benefit to the Town of Pickering.

WHEREAS the Province Ontario is seriously considering the pooling of soft service taxes
to fund a range of programs within the Greater Toronto Area; and
WHEREAS the residents of Pickering should be afforded the opportunity to decide where
their property taxes are directed; and

WHEREAS at an Emergency Meeting of the GT A Mayors and Regional Chairs held on
August 8, 1997, a resolution was passed to request that the Councils of all member
municipalities place a question before their electorate on November 10th respecting the
downloading of the costs of welfare, social services and social housing onto the property
taxpayer;

NOW THEREFORE the Council of the Corporation of the Town of Pickering hereby
directs that a by-law be prepared to permit a question to be put on the ballot of the 1997
Municipal Elections to ask voters their opinion on the Province's proposed pooling of soft
services property taxes; and
THAT the question be as follows:

OTHER BUSINESS
1.
Councillor Pistritto advised that he would be bringing forward a Notice of
Motion concerning part-time firefighters and the 25 Year Watch Program.
2.
Councillor Pistritto advised that Artfest was extremely successful.
3.
Councillor Senis advised that she would be bringing forward a Notice of
Motion concerning embarking on a pilot project called 'Road Watch' that
will dramatically reduce unsafe driving and fatalities by altering drivers
attitudes and promoting good driving habits through awareness, education
and enforcement.
4.
Councillor Senis requested that the General Manager investigate and advise
if the builder at Fairport and Bonita is adhering to top of bank.
5.
Councillor Senis also advised that she had received a number of complaints
regarding heavy equipment on Fairport Road.
6.
Councillor Ryan extended congratulations to the Rouge Valley Comm.
Assoc. on their very successful event held this past weekend.
7.
Councillor Johnson extended congratulations to the Altona West Comm.
Assoc. on the event this past weekend.

Councillor Johnson advised the Durham Board of Education have advised
him that they will be acquiring the property and building the Westcreek
school.
9.
Councillor Johnson advised of a number of events taking place this coming
weekend.
10.
Councillor Brenner expressed his gratitude to the Councillors' Assistant for
her involvement in a situation with the Durham Board of Education and
Dan McTeague, M.P.
11.
Mayor Arthurs advised of a number of upcoming events.
12.
The following matters were discussed prior to the regular meeting:
a.
The Town Solicitor commented on the possibility of acquiring
contributions from the Durham Board of Education and the Region
of Durham towards the November election.

The Town Solicitor advised that the by-law concerning the Gates of
Pickering has been pulled.

The Town Solicitor advised that the Region of Durham have
forwarded correspondence to her concerning an agreement
respecting conservation easements between themselves, ORC and
possibly the Town.
e.
The General Manager advised that a number of staff have recently
had a family member pass away.
f.
The General Manager stated that approval by the Lieutenant
Governor is still required for the Princess Diana Park.
g.
The General Manager advised that a great deal of illegal dumping is
still occurring.
h.
The General Manager advised that Durham Regional Police have
two radar units for Pickering.

Councillor Brenner seconded by Councillor Johnson moved for leave to introduce a By-
law of the Town of Pickering to confirm those proceedings of the Council of the
Corporation of the Town of Pickering at its meeting held on the 15th day of September,
1997 and that the same be now finally passed and that the Mayor and Clerk sign the same
and that the Seal of the Corporation be thereto affixed.

satisfaction of the Town which shall include, but not necessarily be
limited to the following:
Storm Drainage
(a)
satisfaction of the Director of Public Works respecting a
stormwater drainage and management system to service all
the lands in the subdivision including the provision of a
temporary stormwater management pond, and any
provisions regarding easements;
(b)
satisfaction of the Director of Public Works that stormwater
management techniques are consistent with those approved
for the Altona Forest Environmental Policy Area in
consultation with the Metropolitan Toronto and Region
Conservation Authority and the Ministry of Natural
Resources;
(c) appropriate arrangements to the satisfaction of the Town
respecting maintenance costs and future removal of the proposed
temporary pond when downstream development occurs;

program to the satisfaction of the Town;

in accordance with the provisions of the Altona Forest

conclusions and recommendations of the Edge Management
Plan;

for the development must address building envelopes, house
designs, siting, and streetscapes as well as garage designs,
locations, massing, and projection from the main dwelling;
the report outlining siting and architectural design objectives
for the development must place special emphasis on building
elevations and unit siting along Strouds Lane as well as the
provision of adequate on and off-street parking throughout
the development;

for the development must address driveway placement and
curb cut location on Street B to ensure adequate room is
maintained to accommodate street furniture and boulevard

for the development must address the unit siting and design
for Block 3 to determine if 6 or 7 units will be established
through part lot control;

the satisfaction of the Town regarding cash-in-lieu

satisfactory arrangements with the Town regarding the
removal, demolition andlor retention of all structures on the
subject property;

satisfaction of the Town financially with respect to the
Development Charges Act;

satisfaction of the Town with respect to Block 4 which is to
be developed in conjunction with abutting lands and that
this Block will be maintained to the satisfaction of the Town
until such time as it is developed;

with adjacent lands and any phasing of development that
may be required;
(c)
satisfaction of the Town with respect to the provision of
privacy fencing along the north lot line of lots on the north
end of Street B adjacent to the privately-owned land to the

That Zoning By-law Amendment Application A 17/96 to allow residential
development, be APPROVED to implement Draft Plan of Subdivision
18T -96008(R), subject to the following conditions:
