Brenner D. Dickerson, Chairman R. Johnson D. Ryan S. Senis ABSENT: E. Pistritto (vacation) ALSO PRESENT: T. Quinn N. Carroll S. Reynolds B. Taylor P. Wyger D. Kearns - General Manager - Director of Planning - Director of Culture and Recreation - Town Clerk - Town Solicitor - Co-ordinator of Council Services (D AUTHORITY TO MEET IN CAMERA Resolution #1241/97 Moved by Mayor Arthurs Seconded by Councillor Ryan That pursuant to Section 55(7) of the Municipal Act, R.S.O. 1990, c M.4S, as amended, the Council of the Corporation of the Town of Pickering hereby resolves to conduct a meeting to consider litigation matters. CARRIED 8 8 -. 2 Resolution #125/97 Moved by Mayor Arthurs Seconded by Councillor Ryan That the recommendation set out in Legal Services Report L 60/97 be adopted. CARRIED Resolution #126/97 Moved by Mayor Arthurs Seconded by Councillor Johnson That the recommendation set out in Legal Services Report L 56/97 be adopted. CARRIED Resolution #127/97 Moved by Mayor Arthurs Seconded by Councillor Johnson That the recommendation set out in Legal Services Report L 62/97 be adopted. CARRIED The Town Solicitor advised Members of Council that she received a letter from Allan Weiss dated April 11, 1997 advising that Novacor Construction will be filing for bankruptcy in the near future. Resolution #128/97 Moved by Mayor Arthurs Seconded by Councillor Ryan That the recommendation set out in Planning Report 9/97 be adopted. CARRIED Recorded Vote: Yes: No: Absent: Councillors Brenner, Johnson, Ryan, Senis and Mayor Arthurs Councillor Dickerson Councillor Pistritto The Town Solicitor reported that the Ontario Municipal Board hearing for Woodsmere Properties is scheduled for May 5, 1997. A Planning Report regarding development charge credits for the oversizing of Strouds Land has been circulated and she recommended, and Council concurred, that the Town deal only with Woodsmere Properties at this time respecting development charge credits. - 8 8 8. 3 Resolution #129/97 Moved by Councillor Ryan Seconded by Councillor Brenner That this Council rise from the In Camera Meeting at 7:33 p.m. CARRIED This Special Meeting of Council recessed until the conclusion of the regular Executive Committee Meeting. This Special Meeting of Council reconvened at 10:03 p.m. (ID OTHER BUSINESS 1. Councillor Brenner reported that there will be a fundraising event at the O'Brien Meeting Room on May 30th for the Arsenault family who have a very sick child and he asked that the hall rental fee be waived. Resolution #130/97 Moved By Councillor Brenner Seconded by Councillor Johnson That the hall rental fee in the amount of$374.50, including GST, for the O'Brien Room on May 30, 1997 in support of a fundraising drive for the Arsenault family be approved. CARRIED 2. The Town Solicitor distributed a letter from the Region of Durham dated April 2, 1997 regarding the disposal of various Regional properties and Councillor Brenner asked if staff was preparing a report on this. 3. Councillor Johnson reported that Balsam Road is not properly graded and is in very poor condition. 4. The General Manager distributed a request from Happyland Shows to conduct a carnival at the Metro East Trade centre on Thursday, April 17th to Sunday, April 20th and there was no objection to this. 5. The General Manager reported that the problem of the shutdown at the Pickering Nuclear Generating Station was that the Town was notified by Ontario Hydro and not the Emergency Measures Office. 6. The General Manager distributed a report dated April 3, 1997 from the Health and Safety Co-ordinator respecting the transfer of waste from the Brock North Landfill Site to the Brock West Landfill Site. 7. The General Manager distributed a report dated April 14, 1997 from the Director of Planning indicating that the Durham Board of Education is not exercising its option to acquire the school site on Westcreek Drive. 4 8. The General Manager reported that the Durham Regional Police Services asked if the Town would buy some tickets for a charity carnival to be held in Oshawa and Council declined to buy any tickets. 9. The General Manager reported that he and the Director of Culture and Recreation will be attending a workshop at the Police College in Aylmer on April 22-24, 1997 on safe neighbourhoods. 8 10. The General Manager reported that Metro appears to be allowing the dumping of asphalt at the Brock West Landfill Site and he will provide more details to Council on this matter after investigation. 11. The General Manager reported that he has posted a policy on the wearing of uniforms by firefighters and he was directed to also send a letter on this matter to Mr. Pedwell. 12. The General Manager reported that he has had discussions with representatives ofc.u.P.E. who advised that there may be two Province- wide strikes planned. 13. The Director of Planning reported that the Province will be allowing 36 charity gaming facilities to be located throughout the Province and he asked if Council wanted staff to actively pursue such a facility. He was advised to treat any application for such a facility on its own merit when it is received. 14. The Town Solicitor reported that Craig Marshall cannot get building permits for his development at Pinegrove Avenue and Woodview Avenue until the base course of asphalt has been installed. Craig Marshall has asked to have this requirement waived so that building permits can be issued and his houses completed but no closings will be allowed until the base course of asphalt is installed. Council concurred with this request. 8 15. The Town Solicitor reported that Eastern Power Developers are in the process of constructing the addition to their building without a Building Permit and stated that charges be laid for this offence only after the Site Plan Agreement has been amended to remove the section stating that the addition will not be used for Super Blue Box purposes.
