(lID Resolution #96/97 - Executive Director Operations - Town Clerk - Director of Planning - Co-ordinator of Council Services ADOPTION OF MINUTES Regular Meeting of March 3, 1997 Special Meeting of March 3, 1997 DELEGA TIONS Tammy Sabourin, Regional Red Shield Appeal Director, representing the Salvation Army, addressed Council with respect to its upcoming Red Shield Appeal. She thanked Councillor Senis for once again agreeing to be Chair. She requested that the Red Shield Appeal flag be flown at the Town and advised that canvassers are needed. RESOLUTIONS Moved by Councillor Johnson Seconded by Councillor Brenner That Mayor Arthurs be authorized to make the following proclamations: "RED CROSS MONTH" - March, 1997 "NEW HOMES MONTH" - April, 1997 "RED SHIELD MONTH" - May, 1997 "M.E. AWARENESS DAY" - May 12, 1997 (Myalgic Encephalomyelitis) CARRIED 8 - 8 44 Resolution #97/97 Moved by Councillor Brenner Seconded by Councillor Ryan THAT staff be directed to initiate a public meeting to present and discuss the route of the proposed water transmission line that will commence at the mouth of the Rouge River, travel through the south Rosebank Community and terminate in the Regional Municipality of York; and THAT representatives of the Regional Municipality of York and Durham be invited to make this presentation to the residents of the south Rosebank Community. CARRIED Resolution #98/97 Moved by Councillor Ryan Seconded by Councillor Senis WHEREAS no consistent policies exist at the present time that provides for a review of tenders and contracts entered into by the Town of Pickering; and WHEREAS a review of all tenders and contracts is good business practice and will promote competition which will benefit the taxpayers of the municipality; NOW THEREFORE BE IT RESOLVED THAT staff be directed to prepare a procurement policy that provides for a timely review of all tenders and contracts entered into by the Town of Pickering; and THAT this policy be forwarded to Council before April 30, 1997 for consideration. CARRIED Council considered the following motions in conjunction with the above resolution: Resolution #99/97 Moved by Councillor Brenner Seconded by Councillor Ryan That the first paragraph be amended by including the word 'consistent'. CARRIED Resolution #100/97 Moved by Councillor Pistritto Seconded by Councillor Johnson That the second paragraph be deleted. CARRIED Recorded Vote: Yes: No: Councillors Brenner, Dickerson, Johnson, Pistritto and Mayor Arthurs Councillors Ryan and Senis 45 Resolution #101/97 Moved by Councillor Ryan Seconded by Councillor Senis WHEREAS a spill of leachate occurred at the Brock West Landfill Site on January 13th and 14th, 1997 wherein leachate spilled onto the adjacent MTRCA lands and subsequently into the West Duffin Creek; and . 8 WHEREAS this is the second incident in which there was a spill of leachate ftom the Brock West Landfill Site; and WHEREAS the Town of Pickering was not notified of this incident until it received a copy of a letter dated February 17, 1997 ftom D.l Beach, District Manager, York Durham District of the Ministry of the Environment and Energy to the Commissioner of Works for Metropolitan Toronto; and WHEREAS the Town of Pickering must be immediately informed of all major environmental incidents that occur within its boundaries to ensure that proper measures are being taken to correct the incident and ensure that it will not occur again; NOW THEREFORE the Council of the Corporation of the Town of Pickering hereby expresses its displeasure at not being notified of the spill of leachate at the Brock West Landfill Site for more than a month after the incident occurred; and THAT the Minister of the Environment and Energy be urged to ensure that the Town of Pickering is informed immediately of all environmental incidents that occur within the boundaries of the Town; and . THAT Metropolitan Toronto be requested to immediately notify the Medical Officer of Health for the Regional Municipality of Durham of such incidents in order that appropriate action can be taken if needed. CARRIED Resolution #102/97 Moved by Councillor Brenner Seconded by Councillor Pistritto That the following motion be lifted ftom the table: WHEREAS by Resolution #136196 passed on May 21, 1996, Council authorized that Bradford and Associates be retained to carry out a Corporate Organization ReviewlContinuous Improvement Program; and WHEREAS in a letter dated June 29, 1996, Craig S. Bradford submitted the Management Review of the Town of Pickering; 8 NOW THEREFORE the Council of the Corporation of the Town of Pickering hereby gives consideration to portions of the Bradford Report entitled "A Management Model For Pickering" as set out in Pages 10 to 19 inclusive of the Report. LOST Recorded Vote: Yes: No: Councillors Brenner, Dickerson and Pistritto Councillors Johnson, Ryan, Senis and Mayor Arthurs 8 e 8 46 (IV) BY-LAWS That Councillor Dickerson seconded by Councillor Ryan took leave to introduce by-laws of the Town of Pickering: By-law Number 4952/97 Being a by-law to amend By-law 2366/87, designating parts of Strouds Lane, Foxwood Trail, Autumn Crescent, Valley Ridge Crescent and Thicket Crescent as through highways. By-law Number 4953/97 Being a by-law to further amend By-law 2632/88 to provide for the erection of stop signs at certain intersections within the Town of Pickering. By-law Number 4954/97 Being a by-law to authorize an agreement between the Town and the Regional Municipality of Durham to allow certain employees of the Town to enforce certain by- laws of the Region. By-law Number 4955/97 Being a by-law to authorize the execution of a Development Agreement and related documentation respecting the development of Part Lot 54, Registrar's Compiled Plan 1051, Pickering, designated as Parts 2, 3, 4, 5, 6 and 8, Plan 40R-17242, (Garthwood Homes Limited). By-law Number 4956/97 Being a by-law to authorize the acquisition of those parts of Lot 7, Concession 5, Pickering, designated as Parts 1 to 7, inclusive, Plan 40R-XXXXX for road widening purposes (Salem Road). Resolution #103/97 Moved by Councillor Senis Seconded by Councillor Brenner That By-law 4956/97 be deferred to the April 7th Council Meeting. CARRIED By-law Number 4957/97 Being a by-law to dedicate those parts of Lot 7, Concession 5, Pickering designated as Parts 2, 4 and 6, Plan 40R-XXXXX as public highway (Salem Road). Resolution #104/97 Moved by Councillor Johnson Seconded by Councillor Pistritto That By-law 4957/97 be deferred to the April 7th Council Meeting. CARRIED (IV) By-law Number 4958/97 47 BY-LAWS Being a by-law to dedicate that part of Lot 31, Concession 1, Pickering, designated as Part 8, Plan 40R-16806, as public highway (Rosebank Road). THIRD READING: 8 Councillor Dickerson, seconded by Councillor Ryan moved that the report of the Committee of the Whole on By-law Numbers 4952/97, 4953/97, 4954/97, 4955/97 and 4958/97 be adopted and the said by-laws be now read a third time and PASSED and that the Mayor and Clerk sign the same and the seal of the Corporation be affixed thereto. (V) 1. e 8 h) CARRIED OTHER BUSINESS The following matters were discussed prior to the regular meeting: a) The General Manager distributed correspondence concerning the joint meeting of the Ajax and Pickering Councils to be held on March 31st, 1997,7 p.m. at the McLean Community Centre. b) The General Manager distributed correspondence ftom Durham Emergency Measures Office concerning the Pickering Nuclear Generating Station. c) The General Manager distributed information regarding the Brock West Landfill Site. d) The General Manager advised that Laidlaw experienced difficulty on Friday pertaining to garbage pick-up due to the storm and would be completing their pick-up in Ward 3 on Monday. e) The General Manager advised that the Planning Department are requesting Council's permission to submit the Official Plan to the Ontario Professional Planners Institute for a possible award. Resolution #105/97 Moved by Councillor Dickerson Seconded by Councillor Brenner That the Council of the Corporation of the Town of Pickering certifies that it is aware and supportive of the submission, and subsequent promotion and/or publication, of the Council Adopted Pickering Official Plan (March 1997) and related background reports for the Ontario Professional Planners Institute Excellence in Planning Awards." CARRIED t) The Director of Planning requested and received an extension of time for the report on apartments in houses. g) Councillor Dickerson requested the status on the ClubLink application and the Reininger application. Mayor Arthurs requested a date for review of the candidates for the CAO position. 8 8 8 ~ 48 (VD CONFIRMATION BY-LAW By-law Number 4959/97 Councillor Johnson seconded by Councillor Senis moved for leave to introduce a By-law of the Town of Pickering to confirm those proceedings of the Council of the Corporation of the Town of Pickering at its meeting held on the 17th day of March, 1997 and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed.
