A Meeting of the Pickering Town Council was held on Monday, April 20, 1998 at 7:40 p.m.

1.
Roy Wilshire, representing Can-Sort, addressed Council with respect to the Notice
of Motion to oppose his company's application to amend its Certificate of
Approval. He stated that his company is being held responsible for the problems
that were created in the past by Evergreen Recycling. His Certificate of Approval
was revoked but has now been reinstated and he is applying for an amendment to
increase the tonnage being handled at 1048 Toy Avenue in order to accommodate
Pickering waste.
2.
Charles Kunz, representing Can-Sort, stated that he worked for Durham Materials
on Squires Beach Road and was told that the Police were to be called if the
Wilshires entered their property. When the Can-Sort Certificate of Approval was
suspended in June, 1997, he was asked to help clean up the site and he has been
working for Can-Sort since the Fall to ensure that the Certificate of Approval is
being complied with. He reviewed the letter he sent to Council dated April 17,
1998 commenting on the Notice of Motion and noted that Can-Sort wants to
operate a clean facility and get rid of the poor image that was created by
Evergreen.

Henry Kowazniak, representing Earthwatch, stated that his company is a hauler of
non-hazardous waste. He has known the Wilshires for two years and stated that
they are professional and credible businessmen. His company is committed to
adding more equipment as Can-Sort grows.

Mike Nunes, 1034 Toy Avenue, stated that the impact of dust, dirt and odours on
Sonic Automobile is tremendous. He noted that Can-Sort is wanting to have four
times their current capacity but they can't properly handle their present capacity.
He felt that the Ministry of the Environment is not enforcing the Certificate of
Approval properly. Every truck that services Can-Sort creates dust and the
equipment in his company cannot handle dust and is very sensitive. He stated that
he will move his business if Can-Sort is allowed to increase its capacity.

That the Fire Chief be directed to expand the Fire Services Department's existing public service
and information program ("The Home Safety Awareness Program") to promote the maintenance
of fuel burning appliances and systems, and the installation of smoke alarms and carbon monoxide
detectors in all dwelling units in the Town; and
That the Town Clerk be directed to prepare the necessary amendment to the Town's Fees by-law,
for consideration by Council once the Town's costs to provide the safety kit has been established
by the Fire Chief, in consultation with the Town's Director of Financial Service.

WHEREAS Can-Sort Recycling Ltd., has a history of non-compliance with Town by-laws, it's
zoning and site plan restrictions and with Provincial legislation at it's facility located at 1048 Toy
Avenue occurring both under its direct management and under Ever Green Recycle Canada Inc.
while Can-Sort Recycling Ltd. still owned the subject property and held the license for operations
of the facility; and

WHEREAS as a result of non-compliance the Ministry of Environment charged Can-Sort with
failure to store, sort and process waste material in a proper manner and Can-Sort Recycling Ltd.
pled guilty in March of 1995; and
WHEREAS in a letter dated June 16, 1997 from D.R. Crump, Director, Central Region for the
Ministry of Environment indicated that the Certificate of Approval for A390421 for 1048 Toy
Avenue was suspended because of concern on his part that "the continued use of the building at
this site, and in particular the possible collapse of the roof of the building, may endanger the
health or safety of the people who would ordinarily be using the building in the course of
operating the waste processing site and would make it difficult to deal with any waste at the site
in accordance with the requirements of the Provisional Certificate of Approval"; and
WHEREAS non-compliance is still continuing on the property of 1048 Toy Avenue and currently
and historically has resulted in undue hardships on adjacent businesses and residents; and
WHEREAS Can-Sort Recycling has made application to the Ministry of Environment on April 1,
1998 to amend the Provisional Certificate of Approval for a Waste Disposal Site No. A390421 to
increase the maximum Metric Tonnage of solid non-hazardous waste received per day from 150
to 750 under A5 of the MOE Certificate of Approval, the on site storage of waste from 250 to
1,000 Metric Tonnes under A4, and to accept solid non-hazardous institutional waste; and
.
WHEREAS the Brock West Landfill site was recently closed and residents have expressed
strenuous objection to importing waste from Metro Toronto or other communities;
NOW THEREFORE the Council of the Corporation of the Town of Pickering expresses its
opposition in principle to Can-Sort Recycling Ltd. application to amend the Provisional
Certificate of Approval for Waste Disposal Site No. A390421 for operations at 1048 Toy
Avenue; and
THAT the Chief Building Official in conjunction with the Town of Pickering's By-Law
Enforcement Officers report back to Council with respect to the current status of compliance with
the approved site plans, current zoning restrictions and with respect to property standards by May
19, 1998 and that the report be circulated to the individuals receiving a copy of this resolution;
and
THAT the Town Clerk request that the Ministry of Environment review the operation by Can-
Sort Recycle Ltd. of the waste disposal site - processing at 1048 Toy Avenue, Pickering,
pursuant to MOE Certificate of Approval A390421, to determine whether or not that Site is being
operated in accordance with that certificate particularly with respect to sections A3, A4, AS, A6,
B9, B12, B15, B16, E23 of the Certificate of Approval; and
THAT this resolution be forwarded to:

OTHER BUSINESS
1.
Councillor Brenner thanked Council for promoting the public service program
respecting the installation of carbon monoxide detectors and asked about the status
of the Information Booklet.
2.
Councillor Brenner asked the General Manager to find information on a commuter
water shuttle and the feasibility of Pickering being a designated stop on this
shuttle.
3.
Councillor Brenner asked the Clerk for information on the Multilateral Agreement
on Investment.
4.
The following matters were considered prior to the regular meeting:
a)
The General Manager distributed a memo from the Director of Public
Works respecting Everest Contracting Engineering Inc.
b)
Councillor Dickerson stated that Council should consider giVing pre-
budget approval to the installation of a fixed pontoon boat to allow
pedestrians to cross the channel leading into Frenchman's Bay.

c)
Council considered the memo from the Town Solicitor dated April 16,
1998 respecting the possible purchase of land from Mr. Priest on Front
Street. Council did not authorize the Town Solicitor to obtain an appraisal
of either the cottage lot or the strip of land on the water lot.
d)

That the allowance for secretarial services for Councillors be increased to
$3,600 per year.

Councillor Dickerson seconded by Councillor Brenner moved for leave to introduce a By-law of
the Town of Pickering to confirm those proceedings of the Council of the Corporation of the
Town of Pickering at its meeting held on the 20th day of April, 1998 and that the same be now
finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be
thereto affixed.

That Council authorize a pre-budget expenditure as set out in
Report to Council GM 03-98 to cover the Town's share of the cost
of the study, providing both the Town of Ajax and the Town of
Whitby agree to an equal funding contribution; and that the

participate in and contribute to the cost of the study.

That the Statement of the Treasurer respecting remuneration and expense
payments to Members of Council and Council appointees for the year 1997
be received for information, as outlined in TR Report 15/98.

NOXIOUS WEEDS

That the Council of the Corporation of the Town of Pickering authorizes
the publication of a Public Notice regarding the destruction of weeds under
the provision of the Weed Control Act, R.S.O. 1990 Chapter W.5 of the
Province of Ontario and directs the Regional Weed Inspectors to cause
noxious weeds or weed seeds to be destroyed in such a manner as they may
deem proper;
.
and that the expenses incurred by the said Weed Inspectors in the discharge
of their duties shall be placed on the Collector's Roll of the Town of
Pickering against the respective parcels concerned and that such amounts
shall be collected in the same manner as taxes under the Municipal Act.
