Young The meeting convened at 7:03 p.m. in the Main Committee Room of the Civic Complex. 1. MATTERS ARISING FROM THE MINUTES There were no matters arising from the minutes. 2. ADOPTION OF MINUTES MOTION: Moved by Mr. Newton, seconded by Ms. Billinger and carried unanimously- That the minutes of the 3rd meeting of the Committee of Adjustment held February 27, 2002, be adopted, as amended. MOTION CARRIED 3. ADOPTION OF AGENDA MOTION: Moved by Ms. Billinger, seconded by Mr. Mohr and carried unanimously- That the agenda for the March 20, 2002 meeting be adopted. MOTION CARRIED 4. PICA 11/02 - P. & A. Koleros 496 Rougemount Drive being, Part Lot 96, 97, Plan 283 City of Pickering 20 The applicants request relief from the following provisions of Zoning By-law 2511, as amended: Section 9.2.3 to permit the continuance of a minimum north side yard width of 1.6 metres provided by the existing dwelling on the subject property, whereas the by-law requires minimum side yard widths of 1.8 metres; Section 5.19 to permit the establishment of a minimum 1.3 metre south side yard width to be provided by the garage on the subject property, whereas the by-law requires a minimum side yard width of 1.8 metres in a "R3" zone where a garage is erected as part of a detached dwelling. The applicants request approval of these variances in order to obtain a building permit for additions, totaling approximately 127 square metres in size, to the existing dwelling on the subject property. The Assistant Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department. Written comments were received from the Durham Region Health Department and from the City's Development Control Supervisor, both indicating no concerns. Comments were received from Toronto and Region Conservation Authority indicating that they will not be supporting the application due a significant area of erosion originating on a neighboring property. Mr. Chris Fairhead, designer, was present to represent the application. Also present was Mr. Hubert Wank of 480 Rougemount Drive, expressing some concerns. Mr. Fairhead approached the Committee with a grading plan indicating that the variances would not aggravate the existing situation. He stated that he cannot obtain a building permit without the approval from the Toronto and Region Conservation Authority. Mr. Wank expressed concern with trailers and business vehicles parked on the subject property. He stated that he has no objection to the proposed construction but asked that the applicant conform to the business and parking by-law requirements. DECISION: Moved by Mr. Mohr, seconded by Ms. Billinger and carried unanimously that- this application PICA 11/02, by P. & A. Koleros, be APPROVED on the grounds that the proposed continuance of a minimum 1.6 metre north side yard width, and establishment of a minimum 1.3 metre south side yard width are minor variances that are desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Official Plan and the Zoning By-law, subject to the following conditions: 1. That these variances apply only to the proposed additions, approximately 127 square metres in size, as generally sited and outlined on the applicants' submitted plans with this application. 2. That the applicant obtain a building permit and construct the proposed additions within two years of the date of this decision, or this decision shall become null and void. 3. That the applicant satisfy all requirements of the Toronto and Region Conservation Authority. MOTION CARRIED 21 5. PICA 12/02 - Runnymede Development Corporation Ltd. 1900 Dixie Road being, Block 1, Plan 40M-1591 City of Pickering The applicants request relief from the following provisions of Zoning By-law 3036, as amended by By-law 1494/82, as further varied by PICA 5/88: Section 4.(21) to permit a total of 362 square metres of outdoor storage and display area for a seasonal garden centre to operate from April 1, 2002 to June 30, 2002, whereas the by-law defines a retail store as a building or part of a building in which goods, wares, merchandise, substances, articles or things are stored, offered or kept for retail sale to the public; Section 5.(2) to permit the establishment of a minimum 3.0 metre front yard depth to be provided to the proposed temporary outdoor storage and display area on the subject property from April 1, 2002 to June 30, 2002, whereas the by-law requires a minimum front yard depth of 15 metres; Section 5.21.1(2) to permit a total of 297 parking spaces to be provided on the subject property during the operation of a temporary outdoor storage and display area from April 1, 2002 to June 30, 2002, whereas the by-law requires a minimum of 328 parking spaces on the subject property. The applicants request approval of these variances in order to establish a temporary outdoor storage and display area of approximately 362 square metres in size for seasonal garden supplies in order to allow the establishment of seasonal outdoor storage and display area on the subject property to operate for a temporary time period from April 1, 2002 to June 30, 2002. The Assistant Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department. Written comments were received from the City's Development Control Supervisor expressing no concerns. Mr. Harry Froussios, agent, was present to represent the application. No further representation was present in favour of or in objection to the application. Mr. Froussios stated that he was in support of Planning & Development Department's recommendation. He informed the Committee that the variance application is a repeat of the previous year and that a zoning by-law amendment application has been submitted. DECISION: Moved by Ms. Billinger, seconded by Mr. Newton and carried unanimously that- this application PICA 12/02, by Runnymede Development Corporation Ltd., be APPROVED on the grounds that the proposed establishment of a temporary 362 square metre outdoor storage and display area for a seasonal garden centre, providing a minimum 3.0 metre front yard depth, and resulting in a total of 297 parking spaces serving the subject lands are minor variances that are desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Official Plan and the Zoning By-law, subject to the following condition: 1. That the proposed seasonal garden centre not exceed a size of 362 square metres and only operate from a period between when the decision of the Committee of Adjustment becomes final and binding to June 30, 2002, after which time any open storage shall be removed, and any reduction in the required parking space numbers resulting from this variance shall be restored within two (2) days of the required closing of the garden centre. MOTION CARRIED 22 6. ADJOURNMENT MOTION: Moved by Mr. Mohr, seconded by Mr. Newton and carried unanimously that- The 4th meeting of the Committee of Adjustment be adjourned at 7 :20 p.m. and the next meeting of the Committee of Adjustment be held on Wednesday, April 10, 2002.
