MINUTES of the 8th meeting of the Committee of Adjustment held in the Main Committee
Room of the Pickering Civic Complex on Wednesday, June 12, 2002.

The meeting convened at 7:00 p.m. in the Main Committee Room of the Civic Complex.

MATTERS ARISING FROM THE MINUTES
Mr. Newton outlined corrections on pages 33 and 35 of the minutes of the meeting held
May 22, 2002.

ADOPTION OF MINUTES
MOTION: Moved by Mr. Mohr, seconded by Ms. Billinger, and carried unanimously-
That the minutes of the 7th meeting of the Committee of Adjustment held May 22, 2002, be
adopted, as amended.

MOTION: Moved by Mr. Newton, seconded by Mr. Mohr and carried unanimously that-
this application PICA 24/02, by Silver Lane Estates Inc., be lifted from the table.

The applicant requests relief from Section 5(5)(b )B(I) of Zoning By-law 3036, as amended
by By-law 4508/94, 5027/97 and 5494/99 to permit the establishment of a minimum
3.4 metre setback from Treetop Way for a proposed townhouse unit, whereas the by-law
requires a minimum 4.5 metre setback from any lot line immediately adjoining a street or
abutting a reserve on the opposite side of which is a street for multiple dwelling horizontal
uses.
The applicant requests approval of this variance in order to obtain a building permit for a
proposed townhouse unit on the subject property.
The Assistant Secretary-Treasurer outlined comments received from the City of Pickering
Planning & Development Department and the City's Fire Inspector.
Mr. Kevin Tunney, agent was present to represent the application. No further
representation was present in favour of or in objection to the application. Mr. Tunney
stated that he was in support of Staff's recommendation.
DECISION: Moved by Ms. Billinger, seconded by Mr. Mohr and carried unanimously
that-
this application PICA 24/02, by Silver Lane Estates Inc., be APPROVED on the grounds
that the proposed establishment of a minimum 3.4 metre setback from Treetop Way for a
proposed townhouse unit is a minor variance that is desirable for the appropriate
development of the land, and in keeping with the general intent and purpose of the Official
Plan and the Zoning By-law, subject to the following conditions:
1. That this variance applies only to the proposed townhouse unit as generally sited
and outlined on the applicants' submitted plans with this application.
2. That a minimum 6.0 metre setback is provided to the garage of the proposed
townhouse unit for vehicle parking purposes.
3. That the applicant obtain a building permit and construct the proposed
townhouse unit within two years of the date of this decision, or this decision shall
become null and void.

The applicants request relief from the following provisions of Zoning By-law 2520, as
amended, and varied by PICA 47/98:
Section 8.2.3 to permit the establishment of a minimum 6.1 metre front yard depth to be
provided by a proposed front porch addition to the existing dwelling, whereas the by-law
requires a minimum front yard depth of 7.5 metres.
Section 8.2.5 to permit a maximum lot coverage of 48% provided by the existing dwelling,
including a carport addition, and proposed front porch addition on the subject property,
whereas the by-law permits a maximum lot coverage of 33% and PICA 47/98 permits a
maximum lot coverage of 45%.

The applicants request approval of these variances in order to obtain a building permit for
an enclosed front porch addition to the existing dwelling on the subject property.
The Assistant Secretary-Treasurer outlined comments received from the City of Pickering
Planning & Development Department and the City's Fire Inspector. Comments were
received from the City's Chief Building Official expressing concern with the application
related to ongoing and unresolved illegal construction.
Michael Blackhurst and Patricia Morrissey, owners, were present to represent the
application. No further representation was present in favour of or in objection to the
application.
Mr. Blackhurst stated that the reason for enclosing the previously-approved carport was to
provide a safe play area for his children. He also wishes to enlarge the existing front porch
due to its relatively small size.
Ms. Morrissey asked what they must do in order to satisfy the City regarding the
construction and bring the addition into compliance with the zoning by-law.
Ms. Morrissey advised the Committee of other homes in the area with similar additions.
Mr. Pym outlined numerous matters with respect to the addition not conforming with the
minimum construction standards in the Ontario Building Code. He urged the applicants to
contact the City's Chief Building Official to resolve outstanding issues with the addition,
and suggested that the owners amend their application to reflect the situations of
non-compliance with the zoning by-law.
MOTION: Moved by Mr. Mohr, seconded by Ms. Billinger and carried unanimously that-
this application PICA 27/02, by M. Blackhurst & P. Morrissey, be TABLED on the grounds
that the proposed minimum 6.1 metre front yard depth and maximum lot coverage of 48%
variances are premature in nature, and that the applicant resolve outstanding matters with
respect to the Ontario Building Code, the Zoning By-law, andlor previous Committee of
Adjustment decision before any other minor variance applications are considered by the
Committee of Adjustment.

The 8th meeting of the Committee of Adjustment be adjourned at 7:20 p.m. and the next
meeting of the Committee of Adjustment be held on Wednesday, July 3, 2002.
