A Meeting of the Pickering Town Council was held on Monday, April 19, 1999 at 7:35
p.m.

Ira Kagan, representing Geraldine Hollinger, requested that Council
support a new Schedule F to the Memorandum of Understanding regarding
the agricultural easements to add the Hollinger's property as being exempt
from agricultural easements. He questioned why their name was on the
exempted list that was produced on March 31, 1999 but later that day was
removed. He noted that the Region of Durham asked the Ontario Realty
Corporation to exempt a property only if there is a signed Agreement of
Purchase and Sale whereas the Town has agreed to exempt a property if
there was an agreed upon deal between with ORC to acquire land. He
stated that the Hollingers have made an agreement to buy their land but do
not have an Agreement of Purchase and Sale in the prescribed form. If the
Hollingers are not exempt from agricultural easements, he will be required
to negotiate the Memorandum of Understanding in order to ensure that his
client's interests are protected. Mr. Kagan distributed a copy of a letter
from James W. Harbell of the lawfirm of Stikeman, Elliott, as the
representative of the ORC, indicating that the ORC is willing to place the
Hollinger's property on Schedule F if so desired by the Town.

That Town Council endorse the selection by the Ministry of Citizenship, Culture and
Recreation for the municipalities of Durham Region to host the Ontario Summer Games in
the year 2000; and
That staff be authorized to participate on the Games Organizing Committee to assist with
the Organization and operation of the Games.

WHEREAS on April 6th, 1999, Town Council endorsed in principle a Memorandum of
Understanding attached as Attachment No.1 to Report to Council CAO 03-99, as the
basis for settlement agreement with the Ontario Realty Corporation and the Region of
Durham concerning the issue of agricultural easements, Crown Right, and an upcoming
Ontario Municipal Board hearing scheduled to commence on May 10, 1999; and
WHEREAS additional settlement negotiations have occurred between the parties since the
endorsement in principle of that Memorandum of Understanding, aimed at resolving
various technical and legal considerations of concern to the Town and others; and
WHEREAS significant progress has been made in these negotiations, such that it is now
anticipated that a Memorandum of Understanding between the parties can be finalized,
and a settlement agreement can be reached prior to the Ontario Municipal Board hearing;
NOW THEREFORE the Council of the Corporation of the Town of Pickering hereby
resolves as follows:
THAT staff finalize the Memorandum of Understanding approved in principle by Town
Council on April 6, 1999, and attached as Attachment No.1 to Report to Council CAO
03-99; and
THAT the Mayor and Clerk be authorized to execute the final Memorandum of
Understanding, as well the corresponding minutes of settlement, once completed.

BY-LAWS
That Councillor Ryan seconded by Councillor Brenner took leave to introduce by-laws of
the Town of Pickering:
By-law Number 5482/99
Being a by-law to dedicate Block 31, Plan 40M-1892, Pickering, as public highway
(Sandhurst Crescent).
By-law Number 5483/99
Being a by-law to dedicate that Part of Lot 19, Plan 40M-1252, Pickering, designated as
Part 1, Plan 40R-7581 as public highway (Stroud's Lane).

Councillor Ryan seconded by Councillor Brenner moved that the report of the Committee
of the Whole on By-law Numbers 5482/99 and 5483/99 be adopted and the said by-laws
be now read a third time and PASSED and that the Mayor and Clerk sign the same and
the seal of the Corporation be affixed thereto.

OTHER BUSINESS
1.
. Councillor Brenner introduced a Notice of Motion, seconded by Councillor
Ryan, to request that the Province initiate legislation that would make it
mandatory for all equestrian facilities to require that helmets be worn be all
riders.
2.
Councillor Brenner stated that about half the portables at St. Mary's High
School are not in conformity with the Site Plan and asked that staff
convene a meeting with both school boards to review the issue of
portables.
3.
Councillor Brenner reported that the Durham District School Board has
refused to have the washrooms in the proposed elementary school on
Rosebank Road accessible to the public using the park. He asked that staff
try to resolve this issue.
4.
Councillor Holland reported that April 24th is Community Pride Day and
that he will be advertising for Community Pride awards.
5.
Councillor Dickerson asked that the community participate in Community
Pride Day and noted that there will be a cleanup of the Douglas Ravine on
May 1 st and May 4th in conjunction with the Air Cadets and Cubs.
6.
Mayor Arthurs noted that the Ajax/Pickering Rotary Club and the Hospital
will be holding their TV Auction starting on Friday, April 23rd.
7.
Mayor Arthurs further noted that Council will be considering the 1999
Current and Capital Budget on April 28th at 5:00 p.m.

By-law Number 5484/99
Councillor Ryan seconded by Councillor Brenner moved for leave to introduce a By-law
of the Town of Pickering to confirm those proceedings of the Council of the Corporation
of the Town of Pickering at its regular and special meeting held on Monday, April 1999
and that the same be now finally passed and that the Mayor and Clerk sign the same and
that the Seal of the Corporation be thereto affixed.

TOWN OF PICKERING
That the Executive Committee of the Town of Pickering having met on April 12, 1999,
presents its sixth report to Council and recommends:
1.
APPLICATION FOR GRANT AND LOAN
FOR TERMITE CONTROL
GILLIAN CAMERON, 1933 MALDEN CRESCENT
FILE NUMBER - C 2440
That the letter from Ms. Gillian Cameron, 1933 Malden Crescent,
regarding termite control on her property be received; and
1.
That a grant in the amount of $500.00, representing 50% of the
cost of termite control extermination, be approved; and
That said grant be paid out upon such work being completed; and
That this grant be charged to Account 2195 (Grants to
Organizations and Individuals).
2.
That a loan in the amount of$I,612.00 be made to Gillian Cameron
for repairs to her house as a result of damage done by termites; and
That the amount of this loan, together with an annual interest rate
of 6.95%, be added to the Collector's Roll and collected over a
period of five years.
