Kearns - Chief Administrative Officer - Director of Planning - Manager, Policy Manager - Town Clerk - Committee Co-ordinator (I) RESOLUTIONS Resolution #52/99 Moved by Councillor Dickerson Seconded by Councillor Ryan 1. That Town Council recommend to the Region of Durham, that Draft Plan of Subdivision 18T -98002 submitted by Valleytrail Developments Ltd. on lands known as Part of Lot 21, Concession 2, Town of Pickering, be APPROVED AS FURTHER REVISED based on the Applicant's Revised Plan subject to the conditions outlined in Appendix I to the Addendum to Recommendation Report Number 3-99, except that section 2.3. 14(a) of Appendix I is amended by replacing "the owner will provide to the Town of Pickering" with "staff will provide", so that that section will read: 2.3.14 York-Durham Trunk Sewer Vent 2 (a) That, with regard to the York-Durham Trunk Sanitary Sewer line vent which is located at the Valley Farm Road and Finch Avenue intersection, at such time that the trunk sewer vent stack becomes a fresh air intake following construction of Odour Control facilities associated with the trunk sewer, staff will provide assurances from the Region of Durham that odours will not be emitted from the vent stack; 2. That Zoning By-law Amendment Application A 7/98 to implement Draft Plan of Subdivision 18T-98002 to allow residential development, be APPROVED AS FURTHER REVISED based on the Applicant's Revised Plan, subject to the conditions outlined in Appendix II to the Addendum to Recommendation Report 3-99. -- CARRIED Council considered the following in conjunction with the above resolution: Resolution #52a/99 Moved by Councillor Dickerson Seconded by Councillor Brenner That, with regard to the York-Durham Trunk Sanitary Sewer line vent which is located at the Valley Farm Road and Finch Avenue intersection, at such time that the trunk sewer vent stack becomes a fresh air intake following construction of Odour Control facilities associated with the trunk sewer, staff will provide assurances from the Region of Durham that odours will not be emitted from the vent stack; CARRIED 8 Marilyn Metcalf, 1462 Finch Avenue, advised that she has no difficulty with this development as long as she can be involved in tree preservation and planting. She advised that residents were not provided with the March 2nd Addendum to Recommendation Report #3-99 and would like assurance that any further information pertaining to this property be accessible. Tara Manson, resident, requested that the common vegetation between the lots be preserved. She requested that information be provided to her concerning this issue. Resolution #53/99 Moved by Councillor Brenner Seconded by Councillor Ryan 4t (b) That Town Council, (a) ENDORSE the wording for Regional Node 2 in Table 7 - Regional Nodes: Permissible Uses by Subcategory, within Chapter 3 -- Land Use, of the Pickering Official Plan, as approved by Regional Council on June 17, 1998; and authorize staff to present this position at the upcoming Ontario Municipal Board prehearing and hearing; 1. 2. . 3. 4. 8 3 That Town Council, (a) NOT SUPPORT Regional Official Plan Amendment Application 98-006/D, submitted by Bousfield, Dale-Harris, Cutler & Smith Inc., on behalf of Gentra Canada Investments, to revise the wording for Regional Node 'a', on lands being Part of Lot 18, Concession I, Town of Pickering, and that the Region of Durham be so advised; and authorize staff to present this position at the upcoming Ontario Municipal prehearing and hearing; (b) That Town Council, (a) ENDORSE the Draft Consolidated Issues List set out in Appendix I to Recommendation Report No. 5-99, as the issues for consideration by the Ontario Municipal Board; authorize staff to add to, further revise and refine this Issues List as necessary and appropriate through discussions with other parties; and authorize staff to present the Draft Consolidated Issues List, as may be revised, at the up-coming Ontario Municipal Board prehearing; (b) (c) That staff be requested to bring back a Recommendation Report to Council on Zoning By-law Amendment Application A 16/98, submitted by Bousfield, Dale- Harris, Cutler & Smith Inc., on behalf of Gentra Canada Investments, for the Metro East Trade Centre lands being Part of Lot 18, Concession 1, Town of Pickering, by April 26, 1999, to obtain Council's position on the zoning by-law amendment application prior to the upcoming Ontario Municipal Board hearing. CARRIED Mr. Wiese, 1725 Kingston Road, co-owner of property adjacent to subject lands stated his opposition to this application. This is not a viable development for the area and an independent impact analysis should be undertaken. Peter Smith, representing the applicant, stated that his client concurs with the recommendations set out in the staff report. Resolution #54/99 Moved by Councillor Johnson Seconded by Councillor Ryan That the memorandum of the Chief Administrative Officer dated March 1, 1999 regarding the installation of a sprinkler system in the original structure of the East Shore Community Centre be received; and That an expenditure of $49,000 be approved to install a sprinkler system in the existing facility. (A 9/98) By-law Number 5465/99 Being a by-law to amend By-law 2359/87 regulating parking, standing and stopping on highways and on private and municipal property. 8 8 8 5 By-law Number 5466/99 Being a by-law to name those parts of Lot 28, Range 3, B.F.C., designated as Parts 6 and 7, Plan 40R-18371 and those parts of Lot 6, Registered Plan 456 and part of Lot 28, Range 3, B.F.C., designated as Parts 9 and 11, Plan 40R-1837 (Delta Boulevard) By-law Number 5467/99 Being a by-law to dedicate those parts of Lot 28, Range 3, B.F.C., designated as Parts 6 and 7, Plan 40R-18371 and those parts of Lot 6, Registered Plan 456 and part of Lot 28, Range 3, B.F.C., designated as Parts 9 and 11, Plan 40R-18371 as public highway. By-law Number 5468/99 Being a by-law to provide for a prompt and coordinated response to an Emergency. By-law Number 5469/99 Being a by-law to amend By-law 2366/87, designating Somergrove Crescent as a through highway. By-law Number 5470/99 Being a by-law to dedicate that Part of Lot 33, Concession 2, Pickering, designated as Part 12, Plan 40R-1871 (Road Allowance between Lots 2 and 3) (Third Concession Road) as public highway. By-law Number 5471/99 Being a by-law to appoint By-law Enforcement Officers for the purpose of acting as Process Servers. By-law Number 5472/99 Being a by-law to authorize the execution of a Licence Agreement between Jean Timms and Brian Joseph and The Corporation of the Town of Pickering respecting the operation of the pottery studio at the Pickering Recreation Complex from May 1, 1999 to April 30, 2001. THIRD READING: Councillor Johnson seconded by Councillor Ryan moved that the report of the Committee of the Whole on By-law Numbers 5464/99, 5465/99, 5466/99, 5467/99, 5468/99, 5469/99, 5470/99, 5471/99 and 5472/99 be adopted and the said by-laws be now read a third time and PASSED and that the Mayor and Clerk sign the same and the seal of the Corporation be affixed thereto. CARRIED 8 8 8 6 (III) CONFIRMATION BY-LAW By-law Number 5473/99 Councillor Johnson seconded by Councillor Ryan moved for leave to introduce a By-law of the Town of Pickering to confirm those proceedings of the Council of the Corporation of the Town of Pickering at its meeting held on the 8th day of March, 1999 and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. AJAX AND PICKERING JOINT SERVICES STUDY FILE NUMBER -A 2310.26 . That the Ajax and Pickering Joint Services Study dated February, 1999 which set out a work program to study and review service areas that may be partnered, be endorsed; and That a committee comprised of Mayor Arthurs and Councillor Brenner along with representatives of the Town of Ajax be established to study and review servIce areas. NUCLEAR AND NON-NUCLEAR EMERGENCY PREPAREDNESS STATUS REPORT AND REVISED EMERGENCY MEASURES BY-LAW FILE NUMBER -A 2510.01 2. 8 3. 8 1. That Report to Council, CAO 02-99, regarding the status of Nuclear and Non-Nuclear Emergency Preparedness at the Town, be received. 2. That a new Emergency Measures By-law be adopted by Council as set out in Attachment #1 of this Report. 3. That a copy of this Report and the Town's Emergency Response Manual be forwarded to the Ministry of the Solicitor General and Correctional Services, Region of Durham, Durham Emergency Measures Office, and the municipalities of Ajax, Whitby, Oshawa, Clarington, Brock, Scugog, Uxbridge and the City of Toronto. DRAFT PLAN OF SUBDIVISION 18T-98009 ZONING BY-LAW AMENDMENT APPLICATION A 15/98 CARRA V AGGIO & GAMISCH PART OF LOTS 3 AND 4, PLAN 819 (WEST SIDE OF FAIRPORT ROAD, OPPOSITE BONITA AVENUE) FILE NUMBER - B 2310 1. That Town Council recommend to the Region of Durham, that Draft Plan of Subdivision 18T -98009 submitted by Tunney Planning Inc., and revised by applicant, October 1998, on behalf of the owners, on lands known as Part of Lots 3 and 4, Plan 819, Town of Pickering, be APPROVED AS REVISED, subject to the conditions outlined in Appendix I to Recommendation Report Number 2-99; 2. That Zoning By-law Amendment Application A 15/98, to implement Draft Plan of Subdivision 18T -98009 as revised, be APPROVED, subject to the conditions outlined in Appendix II to Recommendation Report Number 2-99. 3. That interested residents be provided until May 14, 1999, to conduct an independent review of the potential future northward extension of Street B and that such review be submitted to the Town Planning Department and the TRCA. The review shall examine the environmental impact of extending Street B northerly beyond the boundary of Draft Plan 18T-98009. . . 8 . ~} 4. 8 4. a) That any conditions referencing a specific Lot or Block in the Conditions of Approval in Appendix No. I and No. II to Recommendation Report No. 2-99, be amended to reflect the lotting and blocking numbering of the Council Recommended Plan dated March 9, 1999. b) That the following Condition be added: 2.1.15 That the Region of Durham not give final draft approval to the portion of the plan north of Lot 21, including the turning circle at the end of Street B, until the Town of Pickering confirms that Street B will end in a permanent turning circle as currently illustrated on the Council Recommended Plan, or, alternatively, until the Town forwards a revised recommended plan to the Region of Durham which redesigns this portion of Street B to a temporary turning circle which may accommodate northward extension in the future. c) That Condition 2.3.11 (Fencing) be amended to require the installation of a 1.5 metre wood privacy along the rear lot line of proposed Lots #3 to #7, inclusive, prior to the initiation of any building construction within the draft plan and along the rear of Lots #8 to # 14 inclusive prior to occupancy of any unit erected on Lots #8 to # 14. That Town Council recommend to the Region of Durham, that Draft Plan of Subdivision 18T -98005 submitted by Broder Devco Inc., on lands known as Part of Lots 127 and 128, Plan 350, Town of Pickering, be APPROVED AS REVISED, subject to the conditions outlined in Appendix I to Recommendation Report Number 1-99; and subject to the following conditions: 2.3.6 (b) the planting program must include the planting of trees and shrubs adjacent to the west terminus of Street B for privacy and visual enhancement purposes to the satisfaction of the Town: and 2.3,11 (b) the developer shall install a 1.8 metre high chain link fence along the west boundary of the subject lands, to be preceded by temporary protective fencing during initial construction phases; 2. That Zoning By-law Amendment Application A 10/98, to implement Draft Plan of Subdivision 18T -98005 as revised, be APPROVED, subject to the conditions outlined in Appendix II to Recommendation Report Number 1-99; and subject to the following revisions to 2.0 vii): . . 8 e . 9 vii) maximum building height 9.0 metres, except that on Lots 5, 6, and 7 on the Council Recommended Plan, building height will be further restricted to ensure that only bungalow style dwellings may be established; 5. ZONING BY -LAW AMENDMENT APPLICATION A 9/98 PUBLIC WORKS CANADA LAND SEVERANCE APPLICATIONS LD 123/98 - LD 126/98 PART OF LOT 20, CONCESSION 8 (SOUTHEAST CORNER OF CENTRAL STREET AND SIDELINE 20) HAMLET OF CLAREMONT FILE NUMBER - B 2310 - A 9/98 1. That Zoning By-law Amendment Application A 9/98, submitted by Public Works Canada, on lands being Part of Lot 20, Concession 8, Town of Pickering, to change the zoning on the subject lands from "A" - Rural Agricultural Zone to "R6-3" - Detached Dwelling Residential Zone and "OS-HL" - Open Space-Hazard Land Zone in order to permit the development of residential lots for detached dwellings and optional garden suites, on Sideline 20 and a new road extending from Acorn Lane be APPROVED, as set out in the draft amending by-law included as Appendix I to Recommendation Report 4-99; 2. That the amending zoning by-law to implement Zoning By-law Amendment Application A 9/98, as set out in draft in Appendix I to Recommendation Report 4-99, be forwarded to Town Council for enactment with the following revisions to the provisions governing garden suites: I Floor Area (maximum) 65 square metres II Ground Floor Area (maximum) 65 square metres for any structure containing a garden suite III Height (maximum) 5.0 metres, except where a garden suite is constructed as a second floor of a detached garage, in which case the maximum height of the entire structure shall be 6.0 metres. 3. That the request by Claremont Estates Ontario Inc. to permit the creation of residential lots within the lands subject of Zoning By-law Amendment Application A 9/98 through land severance applications so the Durham Land Division Committee, rather than by Draft Plan of Subdivision, be APPROVED.
