CARRIED Resolution #12/99 Moved by Councillor Brenner Seconded by Councillor Holland That Report FIN 01/99 regarding the 1999 Interim Levy and Interim Tax Installment Due Dates be received; and -- 1. an interim levy be adopted for 1999, as permitted in the Fairness for Property Taxpayers Act, 1998 (Bill 79), applicable only to the ResidentiallFarm, Farmlands, Pipelines and Managed Forests as defined under section 3, Ontario Regulation 282/98 under the Assessment Act and to the Payments in Lieu of Taxes (PILs) excluding Federal non-residential properties. 2. for 1999 Interim Tax billing, the tax rates below, representing 50 per cent of the 1998 rates, be approved for the following realty classes as follows: ResidentiallFarm including PILs Farmlands including PILs Pipelines including PILs Managed Forests including PILs .00774867 .00193717 .01580510 .00193717 Payments in Lieu of Taxes: PIL PIL PIL Commercial Occupied Commercial Vacant Unit Commercial Vacant Land .01864847 .01305392 .01305392 7 4. the by-law set out in Report FIN 01/99, providing for the imposition of the tax rates approved under Recommendation 2 above, be read three times and approved by Council; and 5. The appropriate Town of Pickering officials be authorized to take the necessary actions to give effect thereto. CARRIED 8 Resolution #13/99 Moved by Councillor Brenner Seconded by Councillor Pickles That the modifications to By-law 5425/98, made subsequent to second reading, to limit the "vehicles sales or rental establishment" use and the current "Ml- 7/SPC-3" zoning to the site of the existing home and leisure centre are technical and minor in nature and do not affect the general intent and purpose of the By-law. Therefore, in accordance with Section 34(17) of the Planning Act, RS.O., chapter P.13, no further notice is required to be given with respect to By-law 5425/98". CARRIED Resolution #14/99 Moved by Councillor Brenner Seconded by Councillor Holland 8 WHEREAS the Council of the Corporation of the Town of Pickering has expressed concerns about safety issues at the Pickering Nuclear Generating Station over the years; and WHEREAS the Council has recommended and/or initiated various initiatives such as establishing the Ontario Hydro/T own of Pickering Liaison Committee, hiring an independent Consultant to oversee an investigation into alleged dumping of hazardous liquid waste at the Pickering Nuclear Station, initiating a complaint under the Provincial Environmental Bill Of Rights, establishing an 87% level of support through a referendum for an Provincial Environmental Assessment, and WHEREAS the Town of Pickering, as a host Community, must have a more direct involvement in fire safety issues that affect the Station in order to ensure the safety of its residents; and WHEREAS the Atomic Energy Control Board commissioned the services of Morrison Hershfield to conduct a technical review of CAN/CSA Standard N293-95 "Fire Protection For Candu Nuclear Power Plants"; and WHEREAS Morrison Hershfield on June 12, 1998 submitted Report #2982074.00 to the Atomic Energy Control Board identifying that "many of the building and fire code key . . , . 8 e 8 2. The current (1995) National Fire Code of Canada (all Parts) should be adopted and applied to buildings in use; the establishment of emergency plans and procedures; the conduct of activities causing fire hazards. 3. In adopting the National Building Code and Fire Codes as the core fire safety requirements at nuclear facilities, provision should be made to permit the use of Provincial codes as a compliance alternative. 4. CAN/CSA Standard N293 "Fire Protection for Candu Nuclear Power Plants" should be adopted and applied to areas under AECB' s jurisdiction. The requirements of the Standard would be considered additional and complementary to the building and fire code requirement. 5. There is a need to prescribe requirements for a change in the use or renovation of an existing building in order to ensure a proper level of safety. Strict application of building code requirements for new construction may be onerous and impractical. Accordingly, Part 10 Change of Use, and Part 11 Renovation, of the current 1997 Ontario Building Code should be adopted and applied to situations involving a change in use or renovation of a building. 6. In order to ensure that a minimum level of safety exists at operating facilities not under renovation or change in use, retrofit requirements should be developed and applied. This is particularly important recognizing that many of the building code requirements may not have been enforced during construction of the plants. Part 9 of the current 1997 Ontario Fire Code should be used as a guide to developing these requirements. 7. Third Party, independent reviews should be conducted on the Provincial operating agencies to check their compliance mechanism and conformance to the codes and Standard; NOW THEREFORE the Council of the Corporation of the Town of Pickering hereby resolves that that the Pickering Nuclear Generating Station (PNGS) be subject to the following Provincial building construction, retrofit, re-construction and maintenance regulations: 1. 2. 1997 Ontario Building Code Part 10 and Part 11 1997 Ontario Fire Code Part 9; and THAT in compliance with the above mentioned regulations, that Ontario Hydro, as the Owner/Operator for the PNGS apply for all required Municipal approvals; and THAT the Council of the Corporation of the Town of Pickering further requests that Part 1,2,3,8 and 9 of the 1995 National Building Code of Canada be adopted and applied to all areas under AECB jurisdiction and be strictly enforced for compliance in consultation with the Pickering Chief Building Official as set out in Recommendation 3; and THAT the Council of the Corporation of the Town of Pickering further requests that the current (1995) National Fire Code be adopted and applied as set out in Recommendation 2 and be strictly enforced for compliance in consultation with the Pickering Chief Building Official and Designated Municipal Fire Services Official as set out in Recommendation 3; . . 8 8 9 1. All fire safety related systems, components and items within the PNGS, regardless of the level of radiation within said PNGS, or portion of said PNGS, must have documented certification by an organization accredited by the Standards Council of Canada for both testing certification of the item or system, as is mandatory for other occupancies under the Ontario Building Code. The installed configuration, in all aspects, must be within the tolerances stated within the certification listing. Any items or systems found to be non-compliant with this requirement shall require special approval by the Town of Pickering. Fire barriers (walls, ceilings and floors) listed in the Ontario Building Code as compliant with three hour fire barriers are acceptable substitutes for certification listings. Special application for exemption from compliance with this requirement shall be made by the owner within five working days of discovery of the non-compliance. For documentation purposes, the owner shall disclose the relevant inventory of all parts, items and systems related to safety functions. 2. All service rooms, as defined by the Ontario Building Code, shall be bounded on all sides by continuous three hour fire barriers in accordance with acceptance criteria of CAN/ULC-S 101. Service Rooms include but are not limited to the following: Control Rooms, Cable Spreading Rooms, Battery Rooms, MCC Rooms, Oil Storage Rooms, and Transformer Rooms. Workmanship of continuity of fire barriers in all Service Rooms shall be demonstrated by door fan testing and smoke pencil testing as per NFP A 12A 3. The maximum compartment size shall be 600 square metres. All floors, including but not limited to interstitial or mezzanine floor levels, shall be three hour rated. Large openings to permit passage of equipment or machinery shall either be firestopped, fitted with appropriate, approved closures or water curtains as per NFPA13. 4. All plant areas shall be equipped with sprinkler systems conforming to NFP A13. Approved gaseous or foam deluge suppression systems may be used as alternates to NFPA13 compliant sprinkler systems where deemed more appropriate by the owner. 5. All service penetration firestops, with each configuration, shall have three hour FTH ratings as per ULC-S 115-95. Where three hour temperature ratings cannot be achieved for certain penetrants (mechanical or electrical services or structural elements), the penetrants shall be treated on both sides as follows: a) Cables shall be coated for a minimum 610 mm length with a minimum one mm dry film thickness of intumescent cable coating, bearing a current Dffit approval. b) Piping and conduit shall be covered by a 610 mm length by 25 mm thickness of inorganic ULI or ULC listed pipe covering. c) Firestops in containment structures shall, in addition to other requirements stated herein, comply with IEEE Standard 3 17. Seismic Qualifications for all fire safety systems shall be in conformance with IEEE Standard 344. 6. Electrical services, including control, communication and power lines between . . 10 a) Ampacity derating of electrical circuit protective equipment shall be determined in accordance with IEEE Standard 848. b) Intumescent windows or other closures within barriers qualified to UL 1724 and IEEE Standard 848 must be included at the time of test. 7. Electrical circuit protective equipment shall be non-combustible per CAN4-S 114 or have a maximum flame spread rating of 25 and maximum smoke development of 50 per CAN4-S102. Electrical firestops must be non-combustible. Repair or re-entry and resealing materials used for patching electrical firestops may have a flame spread rating of 25 and a smoke development of 50 per CAN4-S 114 provided their total seal area does not exceed 10%. If the repair area with a limited combustibility sealant exceeds 10% of the total firestop area, it must be replaced with a non-combustible material. Any repair materials of firestops and circuit protective equipment must be included at the time of test. Mechanical firestops shall be non-combustible as per CAN4-S 114 or have a flame spread rating of 25 and a smoke development of 50 per CAN4-S 1 02. and 8 THAT in accordance with Recommendation 7, that the Town of Pickering will conduct or oversee through the obtaining of appropriate resources all third party independent reviews of the PNGS to validate compliance mechanism and conformance to the Codes and Standard, and that the Operator/Owner corrects all deficiencies in a timely and complete manner, and that all associated costs be paid by the Owner/Operator. and THAT a copy of this resolution be forwarded to the AECB, all appropriate Federal Departments and Ontario Hydro. CARRIED 8 (IV) BY-LAWS That Councillor Brenner seconded by Councillor Pickles took leave to introduce by-laws of the Town of Pickering: By-law Number 5438/99 Being a by-law to amend Restricted Area (Zoning) By-law 3036, as amended, to implement the Official Plan of the Town of Pickering District Planning Area, Region of Durham in the north part of Lot 29, Range 3, B.F.c., in the Town of Pickering (A 4/98) By-law Number 5439/99 Being a by-law to exempt Blocks 16, 17, 18 and 19, Plan 40M-1887, Pickering, from part lot control. By-law Number 5440/99 Being a by-law to amend By-law 1416/832 providing for the regulation and licensing of places of amusement. , . 11 Being a by-law to assume Alanbury Crescent, Blairwood Court and Lynn Heights Drive, 40M-1652, Pickering, for public use as public highways under the jurisdiction of the Town. By-law Number 5444/99 Being a by-law to amend By-law 1416/82 providing for the regulation and licensing of places of amusement. 8 By-law Number 5445/99 Being a by-law to amend By-law 2632/88 providing for the erection of stop signs. By-law Number 5447/99 Being a by-law to assume Brookshire Square, Gablehurst Crescent and Glenanna Road 40M-1390, Pickering, and Blocks 33 and 34, (Street Widenings), Plan 40M-1390, Pickering for public use as public highways under the jurisdiction of the Town. By-law Number 5448/99 Being a by-law to amend By-law 1416/82 providing for the regulation and licensing of places of amusement. 8 By-law Number 5449/99 Being a by-law to assume services under the jurisdiction of the Town in Plan 40M-1415 and 40M-1416, Pickering. By-law Number 5450/99 Being a by-law to assume Mountcastle Crescent, Redbird Crescent, Plan 40M-1415, Glenanna Road and Echo Point Court, Plan 40M-1416, Pickering, for public use as public highways under the jurisdiction of the Town. By-law Number 5451/99 Being a by-law to appoint By-law Enforcement Officers for certain purposes (parking Regulation - DCC #145, 1635 Pickering Parkway. By-law Number 5452/99 Being a by-law to establish an interim Levy for 1999 for residential, farm, farmlands, pipelines, managed forests realty classes and for Payments in Lieu of Taxes excluding Federal Government non residential realty class properties; and to establish the installment .' . 12 THIRD READING: Resolution #15/99 Moved by Councillor Holland Seconded by Councillor Pickles To lift By-law 5425/99 from the table. 8 CARRIED Councillor Brenner seconded by Councillor Pickles moved that the report of the Committee of the Whole on By-law Numbers 5425/99, 5438/99, 5439/99, 5440/99, 5441/99, 5442/99, 5443/99, 5444/99, 5445/99, 5446/99, 5447/99, 5448/99, 5449/99, 5450/99, 5451/99 and 5452/99 be adopted and the said by-laws be now read a third time and PASSED and that the Mayor and Clerk sign the same and the seal of the Corporation be affixed thereto. . CARRIED (V) OTHER BUSINESS 1. Councillor Ryan directed the c.AO. to contact the Region of Durham and acquire an exact date the lights at the intersection of Rosebank Road and Highway #2 will be working. 2. Councillor Ryan gave notice that a Motion would be coming forward concerning the Town of Pickering's support of the Olympic Games in 2008. 8 3. Mayor Arthurs gave notice that a Motion would be comIng forward concerning the Rouge Valley Health System. (VI) CONFIRMATION BY-LA W By-law Number 5453/98 Councillor Brenner seconded by Councillor Holland moved for leave to introduce a By- law of the Town of Pickering to confirm those proceedings of the Council of the Corporation of the Town of Pickering at its meeting held on the 1st day of February, 1999 and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. APPENDIX #1 TOWN OF PICKERING That the Executive Committee of the Town of Pickering having met on January 25, 1999, presents its second report to Council and recommends: 8 1. LAND SEVERANCE APPLICATION LD 266/98 MARGARETE OTTO PART OF LOT 18, CONCESSION 2 (1774 FINCH AVENUE) FILE NUMBER - B 2310 1. That the request of Margarete Otto, to permit the division of the subject property, being Part of Lot 18, Concession 2 (also known as 1774 Finch Avenue), into two lots through Land Severance Application LD 266/98, rather than by draft plan of subdivision, be APPROVED. 2. That Town Council advise the Durham Land Division Committee and the owner of the subject property that no further severance's of the subject lands will be supported by the Town unless a detailed review of the future development potential of the area reveals that further severance's are appropriate. 2 REGIONAL MUNICIPALITY OF DURHAM'S 1997 COLLISION SUMMARY FILE NUMBER - E 4000 8 That Town Council receive for information Report to Council PW 01-99 discussing the statistics of the Regional Municipality of Durham's 1997 Collision Summary; and That based on the statistics, Town Council request that the Region of Durham formally investigate the cause(s) of the high collision rates for the intersection of Kingston Road at Whites Road and for the mid-block location on Brock Road between Dillingham Road and Bayly Street, and report back to the Town. 3. CONSTRUCTION PRIORITIES FOR REGIONAL ROADS WITHIN THE TOWN OF PICKERING FILE NUMBER - E 4000 That report PW 02-99 recommending Regional Road construction priorities within the Town of Pickering be received, adopted and forwarded to the Regional Municipality of Durham requesting that its recommendations be considered in the 1999 Budget process.
