WHEREAS Hydro Marsh is a dynamic and vibrant wetland system that has been identified by the City,
TRCA and the Region of Durham as an area of great environmental significance; and

WHEREAS the wetland ecosystem is delicate and can ill afford illegal activities that threaten its health;
and
WHEREAS the Pickering Harbour Company on or about the 1st of January, 2002 undertook hydraulic
dredging without the appropriate approvals ITom the Toronto and Region Conservation Authority
(TRCA) and dumped the dredge material on the Cool Water Farms property; and
WHEREAS the pipes used to conduct the dredging crossed property owned by OPG and TRCA but no
approval was obtained for the trespass; and
WHEREAS the dredge material could contain toxins such as pesticides, fertilizers and other chemicals
that may need treatment and may be dangerous to leave on site; and
WHEREAS the perimeter of the property and the pits dug for the dumped material are enclosed by four
to five foot berms that are made of loose dirt which will erode into Hydro Marsh if not properly covered;
and
WHEREAS the portion of the Cool Water Farms property used for dumping is within the TRCA
identified flood zone and eroded material can cause bay fill and damage the adjacent wetland; and
WHEREAS extensive clearing of the site has destroyed a wide array of indigenous fauna, shrubs and
trees; and

WHEREAS the Corporation of the City of Pickering and TRCA have undertaken significant restoration
of the shoreline in this area; and
WHEREAS the Pickering Harbour Company has operated in this area for several generations and is well
aware of the rules and regulation as they pertain to dredging and land use as well as who to contact
should they have any questions; and
WHEREAS TRCA continues to be an active and progressive supporter of wetland preservation and
regeneration within the City of Pickering;
NOW THEREFORE the Council of the Corporation of the City of Pickering expresses its disapproval
and deep concern over the hydraulic dredging process that was illegally carried out in the month of
January 2002 and its associated impacts; and
THAT the Council of the Corporation of the City of Pickering requests that fines be imposed against the
Pickering Harbour Company for the illegal work undertaken given the seriousness of this violation; and
THAT the potential action of TRCA to have the Pickering Harbour Company remediate the damage
caused and return the property to its prior state be supported in full by the City of Pickering; and

THAT TRCA be requested to develop a policy to deal with the disposal and cleansing of dumped
dredged material to ensure, where ever it finally is placed, that it does not create adverse environmental
impacts;
