Greentree - Supervisor, Legislative Services The Manager, Policy Division, provided an overview of the requirements of the Planning Act and the Ontario Municipal Board respecting this meeting and matters under consideration there at. (I) DRAFT PLAN OF SUBDIVISION APPLICATION S-P-2001-04 ZONING BY-LAW AMENDMENT APPLICATION A 16/00 MINISTER'S ZONING ORDER AMENDMENT APPLICATION 18-Z0-02901-08 BITONDO MARKETS LIMITED NORTH PART OF LOT 11, CONCESSION 5 (LANDS ON THE WEST SIDE OF WESTNEY ROAD, SOUTH OF GREENBRIDGE DRIVE) 1. Ron Taylor, Planner II, provided an explanation of the application, as outlined in Information Report #27-01. 2. Alex Artuchov of Urban Lattitude, representing the applicant, offered his assistance to respond to public concerns. 3. Gord Noble, 2385 Conc. 6, stated his concern with storm water control during the construction process. 4. Jeanette Wiles, 3475 Greenwood Rd., submitted a letter and outlined her concerns with the application which include one acre lot designation, water availability and contamination, which has been an issue over the last year, and stormwater control during and after construction. She has previously taken measures to protect her property that is located at the bottom of the hill and intends to closely watch this development to ensure that her quality of life is not impacted. She questioned why they are going minor expansion rather than cluster residential and stated that she has not seen any documentation which would speak to this question. Ms. Wiles questioned why the agencies had longer to respond to this application then residents. She advised that she is present to support her fellow neighbours. 5. John Byberg, 2450 Conc. 6, stated his concerns with respect to increasing the hamlet as an expanded hamlet and not as a cluster, and the fear of a Walkerton issue, having already experienced an ecoli contamination. He wants 2 acre lots, not an average of 2 acres. He stated his concern with long term growth of Greenwood as an unserviced unit and suggests that we tread carefully with development. A study should be undertaken by the City and paid for by the City. Mr. Byberg stated that the residents are not opposed to growth, but they want controlled growth. Judy Sullivan, 3405 Greenwood Road, submitted a letter outlining the issues of the Ratepayers. The concerns outlined in Ms. Sullivan's correspondence and presentation include: piece meal approach, the need for a hamlet study, the lasting impact this development will have on the - 1 - Statutory Public Information Meeting Minutes Pursuant to the Planning Act Thursday, October 18, 2001 7:00 P.M. Chair: Councillor Johnson - - -- community and the 'minor expansion' creating 40 new residents rather than the 16 per year allowed in the Official Plan. She stated the clear need for a community study and advised that the residents are in support of the "cluster designation" and appreciate Block 14. She pointed out that the vegetated buffer strip, which was previously contemplated, was not included in this draft plan but hopefully it will be included in the next draft. The residents believe that the TRCA Valley Stream Corridor Policy should not be compromised and that the top-of-bank needs to be confirmed with Site Visit, including the Greenwood Area Ratepayers Assoc. No additional drainage should be allowed down the slope to the west side of the property, as a problem already exists. A detailed hydro ecological study is required, which she believes the Region has initiated, but. also stated that a terrain analysis is also required but she is not aware of this having been considered to date. She advised that a petition for Cluster Residential designation, a hamlet study, groundwater contamination study and deep not shallow wells has been conducted. Thus far, 65 properties have signed the petition, of which 62 have signed in agreement. 7. Alex Artuchov of Urban Lattitude, representing the applicant, stated his appreciation for Judy Sullivan's concerns and would like to work with the residents. During construction, they are committed to taking the necessary precautions to avoid slides or drainage. They always abide by and have complied with Ministry of Environment standards. They are working in slightly larger than 2 acre average lots and the Ministry of the Environment feels this is sufficient to ensure safety and health. If lots are undersized they will increase as defined by regulations. They will take necessary measures to ensure there is no contamination, and if that means having to go to deep aquifer, then that will be done. He advised that they had reviewed this application with the Region of Durham and were encouraged to do this type of expansion development. He is not really concerned with any slope instability on Lot 6. There was a vegetation buffer strip (walkway) which was removed after consultation with staff, but as the process matures, they will work with the two homeowners to ensure sufficient buffer. Stormwater retention has not been included on the most resent draft because new studies indicated that underground stormwater retention is better. A copy of the recent report will be forwarded to Judy Sullivan. The issues outlined will be addressed and necessary changes will be made to make the subdivision proposal better. 8. Ron Taylor, confirmed that reports will be forwarded to Ratepayer Groups. (II) PICKERING OFFICIAL PLAN AMENDMENT OP A 01-003/P ZONING BY-LAW AMENDMENT APPLICATION A 19/01 CITY INITIATED: NOTION ROAD STUDY AREA PART OF LOT 17, CONCESSION 1 (WEST SIDE OF NOTION ROAD, BETWEEN PICKERING P ARKW A Y AND KINGSTON ROAD, EXCLUDING THE SOUTH-WEST CORNER OF KINGSTON ROAD AND NOTION ROAD) 1. Steve Gaunt, Planner II, provided an explanation of the application, as outlined in Information Report #28-01. 2. Jack Miles, 1964 Notion Road, questioned how this application will impact the existing buildings and uses. 3. Cathy Rose responded that any existing lawful uses would continue to be permitted. New construction or significant additions would be subject to site plan approval. 4. Ralph Vaderwel, 1545 Marsh Dr., thanked staff and Council for undertaking this study. Chair: Councillor Johnson 5. Cathy Rose advised that the road is owned by the City of Pickering but maintenance is shared with the Town of Ajax. Paving may be conducted subject to budget approval in 2001. Money has tentatively been included in development charges.
