(II) DELEGATIONS
1. Al McCormack, 953 Vistula Drive, addressed the Committee regarding two
issues:
a) He commended the City for the positive effect of the by-law to regulate the
placement of news boxes and requested that this by-law be used as a template
and be extended throughout the Region of Durham. Mr. McCormack agreed
to contact Councillor Brenner to discuss this matter further.
b) He expressed concerns regarding the lack of lighting in Petticoat Creek
Conservation Area and requested Council to take the necessary action to
• ensure that lighting is restored.

a) Kathryn Dean, 158 Montgomery Ave., Toronto, spoke favourably about the
abundant farm land and open green space in the City of Pickering. She stated
that based on her research, approximately one acre of farmland is lost per hour
in the GTA. She suggested that development only take place to in-fill or on
brown space as residential sprawling is a liability to the municipality. Ms.
Dean opposes the proposed development and believes it to be inconsistent
with the Durham Region OP.
b) Bill Wilder, President of the Conservation Association, Sideline 12, north of
Durham 5, advised he was speaking in opposition of the proposed
development on behalf of the members of the Association. Mr. Wilder stated
that he/they are against urban sprawl and believe that the proposed
development would constitute urban sprawl. He advised that he opposed this
development in 1996 and remains in opposition.
c) Tommy Thompson, 3181 Byron Street, Whitevale, voiced his objections
relative to the long-term implications of approving this development proposal.
Mr. Thompson indicated that he believes that if Toronto, York and Peel
Regions continue to develop as they have in the past, Pickering will become
Toronto's "last green door". He is concerned that the approval of this
proposal will establish a precedent for other golf courses in the City.
d) Brian Buckles, representing the Green Door Alliance, opposes the
development proposal primarily because the application conflicts with the
urban growth and rural settlement growth goals and targets as defined in the
City's OP. Mr. Buckles discussed the unique characteristics of hamlets and
suggested that the majority of rural growth should be permitted within the
hamlets as opposed to outside. Mr. Buckles further commented that he is
concerned with environmental impacts and that the developer will not stop at
80 units. He suggested that if the development were to be approved, some
type of legal binding agreement must be struck to ensure that further
applications to expand the development be prohibited for a period of time no
less than 15 years. Mr. Buckles reiterated that he did not support this
development.
e) Wendy Duncan, Sideline 12 (on eastern boundary of Cherry Downs), stated
that she cherishes the beautiful surroundings of north Pickering and is proud
to be able to share this asset with others who are not as fortunate to live in
such an area. She stated that Pickering is a unique and diverse City with both
urban and rural areas and believes that this development proposal, which she
opposes, flies in the face of good and sensitive planning.
f) Fred Beer, 4945 Westney Road, stated that he is opposed to the development
proposal and advised that he has applied for an agricultural easement to
protect his land from development. Mr. Beer suggested that the City protect
its agricultural lands rather than exploit them.

g) Angie Jones, representing the Durham Conservation Association, spoke in
opposition to the development proposal. She used overheads to support her
argument that this most recent proposal mirrors a phase of a former
development proposal from the same applicant. She believes that this is not a
coincidence and should be an indicator that the developer has no intention of
stopping as 80 or 125 units. Ms. Jones spoke in detail regarding the
environmental and ecological issues relative to the development. She
suggests that this type of planning is leap-frog planning given that Seaton has
not yet been developed.
h) Isabel Thompson, 3181 Byron Street, Whitevale, is opposed to the
development proposal as she believes it will set a precedent for future
development. Ms. Thompson believes that both the City's and Region's OPs
have gone to great lengths to protect agricultural lands and urban sprawl and
this application is inconsistent with both of these OPs.
i) Michael Tucker, member of the Durham Conservation Association and TRCA
Advisory Committee, stated that in his opinion it does not matter how many
units are approved, the outcome is the same; which he believes to be urban
sprawl through the development of a new hamlet. Mr. Tucker is opposed to
the development proposal and questions why the OPs would be changed at a
time when their inherent logic is most needed. Mr. Tucker also questions
what the City and/or the Region have to gain by approving this application.
Mr. Tucker advised that he has applied for an agricultural easement for his
property.
j) Alastair Gillespie, 2045 Uxbridge/Pickering Townline, stated that he has
• lived there for more than forty years and likes the rural character of the area.
Mr. Gillespie is opposed to the development proposal and stated that he
believes public confidence in the development process will be lost if this
application is approved, given the resident support in opposition.
k) Gordon Duncan, Sideline 12, responded to a question posed earlier in the
meeting by Councillor Pickles, which essentially questioned "Would you
rather approve 80 units and attempt to legally bind the development to this
limit or take the risk and have the OMB issue an Order which could
potentially permit 125 units?" Mr. Duncan stated that he would oppose the
approval of 80 units and risk the OMB decision because by permitting the 80
units, the City would be opening up the opportunity for other developers to
move into other golf courses in the City.
1) Sue McInerney, RR5, Claremont, is an abutting landowner and opposes the
development application. She stated that her major concern is the water and
quoted several statements in an effort to demonstrate the lack of
understanding of water usage/needs in north Pickering. Ms. McInerney
referenced and commented on several sections of the Planning Report. She
stated that this urban style of development would be better suited elsewhere in
Pickering.
m) Steve Murray, 8th Concession, is an abutting landowner and questioned the
conclusions reached in the staff recommendation. He believes that the
development proposal is the epitome of urban sprawl. Mr. Murray quoted
from a letter from Clublink that he believes to make unfounded statements.
Mr. Murray also commented on the impact this development proposal would
have on traffic and water supply and the fact that it would set precedent for
'future development applications.

n) Anja Kalisch, 1765 Woodview Avenue, stated that although she does not live
in north Pickering, she opposes the development application because she
enjoys, and wishes to continue to enjoy, the open green space that north
Pickering offers. Ms. Kalisch quoted studies and stated that scattered
developments actually cost the municipality rather than offer savings. She
stated her concerns relative to the strain on emergency services due to
travelling distances, transportation grid locks as residents would not have
access to mass transportation and water safety. Ms. Kalisch stated that the
farming industry'in the GTA generates $1.3 billion into our economy and
suggested that the City establish growth boundaries that are reasonable and
logical.
o) Lorne Almack, Brock Road, referenced several studies and quoted from
headlines to support his argument against this development proposal. He
believes this development to be urban sprawl and it encourages people to live
in a different place than where they work, recreate, shop, etc. He expressed
that there are environmental concerns with the necessity for the potential
residents to have cars and that there would be additional costs incurred
relative to schools and related transportation needs.
p) Mike Newman, north Pickering resident, spoke regarding the water in the
Mitchell Creek. Mr.Newman is an avid fisherman and fishes almost daily (in
season) and considers himself somewhat of an expert on the Creek. He stated
that the water in the Creek has depleted over the years and believes this to be •
attributed to the existing golf course. Mr. Newman is concerned that the
proposed development would further negatively impact the water supply.
q) Peter Smith, Planning Consultant for Cherry Downs Coventure Ltd., spoke in
support of the proposed development. Mr. Smith referenced a letter dated
June 8th addressed to Mayor and Council which highlighted the most recent
amendments to the development application, including:
i. Elimination of nine units
ii. Relocation of the communal servicing block
iii. Temporary easement for public access over closed portion of
Sideline 14
Mr. Smith stated that he believes this type of development minimizes land
- consumption, allows for a broader range of rural housing options, and has
been intentionally sized to fit with the OP. He quoted from the OP respecting
rural growth objectives and stated that he feels this application fits within
these objectives. Mr. Smith requested Council to support the development
proposal with an amendment to 116 units from 80.
r) Chris Whillans, 2165 8th Concession, spoke in opposition to the development
proposal. Mr. Whillans stated that he could not see any advantage for the City
to approve this development, save and except for money. He recognizes that
development is going to happen but would like to see smart development
planning.
s) Gwen Mobray, Kinsale Road, is opposed to the development proposal
primarily because of the impact it would have on water supply. Ms. Mobray
stated that the stream, which runs through her land, has almost been depleted
and would be further jeopardized with the development.
APPENDIX#1
CITY OF PICKERING
That the Committee of the Whole of the City of Pickering having met on June 11, 2001,
presents its tenth report to Council and recommends:
1. CORPORATE SERVICES AND TREASURER'S REPORT CS 15-01
DEVELOPMENT CHARGES
That Report CS 15-01 of the Director, Corporate Services & Treasurer regarding
Development Charges be received and that:
1. Effective July 1, 2001, as provided for in Section 16 of By-law 5546/99,
the Development Charges referred to in Sections 6 and 11 of that By-law
be increased by 8.68 per cent being the annual increase in the Construction
Price Statistics as repprted by Statistics Canada for the year ended March
31, 2001; and
2. The appropriate officials of the City of Pickering be given authority to
give effect thereto.

1. That Zoning By-law Amendment Application A 36/00, submitted by Mr.
Frank Scanga of F. and A. Scanga Holdings Limited, on lands being Lot
23, Plan 492, City of Pickering, to amend the zoning on the subject lands
to permit the establishment of a maximum one-storey, 130 square metre
converted dwelling capable of supporting a personal service shop,
professional and business office, and limited retail uses, be APPROVED
subject to the conditions outlined in Appendix I to Planning Report.No.
21-01; and
2. That the amending zoning by-law to implement Zoning B-law
Amendment Application A 36/00, as set out in draft Appendix II to Report
Number PD 21-01, be forwarded to City Council for enactment.

1. That Pickering Council recommend to the Region of Durham that
Regional Official Plan Amendment Application OPA 2000-05/D,
submitted by Mr. Peter Smith of Bousfield, Dale-Harris, Cutler & Smith
Inc., on behalf of Cherry Downs CoVenture Ltd., on lands being Part of
Lots 12 to 16, Concession 7, City of Pickering, to:
(i) change the designation of portions of the subject lands from "Major
Open Space" and "Permanent Agricultural Reserve" to "Country
Residential Subdivision";
(ii) permit the development of a maximum of 125 dwelling units on the
subject lands; and,
(iii) permit Regional Council to consider the approval of country
residential subdivisions serviced by privately owned and operated
communal systems for water supply and/or sanitary sewage on a
case by case basis;
be REFUSED.
2. That Pickering Official Plan Amendment Application OPA 00-002/P
submitted by Mr. Peter Smith of Bousfield, Dale-Harris, Cutler & Smith
Inc., on behalf of Cherry Downs CoVenture Ltd., on lands being Part of
Lots 12 to 16, Concession 7, City of Pickering, to:
(i) change the designation of portions of the subject lands from "Open
Space System — Active Recreational Area" and "Agricultural Area"
to "Country Residential";
(ii) permit the development of a maximum of 125 dwelling units on the
subject lands;
(iii) permit the country residential development to be serviced by
privately owned and operated communal systems for water supply
and/or sanitary sewage; and,
(iv) allow a maximum of nine lots proposed on the subject lands to be
serviced by individual water and septic systems;
be REFUSED.
3. That Pickering Council recommend to the Region of Durham that Draft
Plan of Subdivision Application S-P-2000-03, submitted by Mr. Peter
Smith of Bousfield, Dale-Harris, Cutler & Smith Inc., on behalf of Cherry
Downs CoVenture Ltd., on lands being Part of Lots 12 to 16, Concession
7, City of Pickering, to:
(i) develop 9 lots supporting estate residential homes serviced by
individual water and septic systems on a publicly-maintained cul-de-
sac located on the north side of Durham Regional Road No. 31, east
of Sideline 14 and west of Sideline 12;

(ii) develop 16 detached dwellings located on the east and west side of a
realigned Sideline 14 and serviced by a privately owned and
operated communal water supply and sanitary sewage system;
(iii) develop 100 condominium units (both semi-detached and attached
units) in two residential clusters located within one development
block west of Sideline 14 and serviced by a privately owned and
operated communal water supply and sanitary sewage system; and,
(iv) permit the establishment of a communal servicing/maintenance
block, approximately 6.7 hectares in size, on the west side of
Sideline 12;
be REFUSED.
4. That Zoning By-law Amendment Application A 26/00, submitted by Mr.
Peter Smith of Bousfield, Dale-Harris, Cutler & Smith Inc., on behalf of
Cherry Downs CoVenture Ltd., on lands being Part of Lots 12 to 16,
Concession 7, City of Pickering, to permit the development of 125
residential dwelling units (consisting of a mix of detached, semi-detached
and attached units) within two separate development areas on the subject
lands be REFUSED.
5. That Zoning By-law Amendment Application A 29/00, submitted by Mr.
• Peter Smith of Bousfield, Dale-Harris, Cutler & Smith Inc., on behalf of
Cherry Downs CoVenture Ltd., on lands being Part of Lots 12 to 16,
Concession 7, City of Pickering, to permit the establishment of a
communal servicing and maintenance facility block located on the west
side of Sideline 12 serving a majority of the proposed residential
development and a future clubhouse facility located generally north of the
Sideline 14 terminus be REFUSED.
6. That Pickering Council recommend to the Ministry of Municipal Affairs
and Housing that Minister's Zoning Order Amendment Application 18-
ZO-02900-01, submitted by Mr. Peter Smith of Bousfield, Dale-Harris,
Cutler & Smith Inc., on behalf of Cherry Downs CoVenture Ltd., on lands
being Part of Lots 12 to 16, Concession 7, City of Pickering, to permit the
development of 125 residential dwelling units (consisting of a mix of
detached, semi-detached and attached units) within two separate
development areas on the subject lands,_and serviced mainly by privately
owned and operated communal water supply and sanitary sewage systems
be REFUSED.
7. That Staff be authorized to present Council's recommendations as set out
in Items #1 to #6 above, to the Ontario Municipal Board (OMB), as
Council's position on the Cherry Downs CoVenture Ltd. applications, at
the scheduled OMB Prehearing and Hearing.
