By-law No. 7399/14
Being a By-law to amend Restricted Area Zoning By-law 3037, as
amended, to implement the Official Plan of the City of Pickering,
Region of Durham being South Part of Lot 2, Concession 5,
Part 4, Plan 40R-20466, City of Pickering (A 8/14)
Whereas the Council of The Corporation of the City of Pickering passed By-law 5719/00
amending By-law 3037, to rezone the subject lands being South Part of Lot 2,
Concession 5, Part 4, Plan 40R-20466 in the City of Pickering to permit the
development of 14 estate residential lots and to protect and maintain various
environmentally significant lands as open space;
And whereas By-law 5719/00 includes an "(H)" Holding Symbol preceding the
"ER" Zone on Lots 1 and 2 of Draft Approved Plan of Subdivision 18T-86013(R), which
has the effect of preventing the development of a detached dwelling on each of Lots 1
and 2 from occurring until such time as the Owner has satisfied the City, in consultation
with the Region of Durham, that the agricultural Minimum Distance Separation, as set
out by the Ministry of Agriculture, Food and Rural Affairs, provided between non-
agricultural uses on those lands zoned "ER" and livestock operations on other lands is
maintained;
And whereas the Owner has made satisfactory arrangements, to the City's satisfaction;
And whereas an amendment to amending By-law 5719/00, to remove the "(H)" Holding
Symbol preceding the "ER" Zone on Lots 1 and 2 of Draft Approved Plan of Subdivision
18T-86013(R) is therefore deemed appropriate;
Now therefore the Council of The Corporation of the City of Pickering hereby enacts as
follows:
1. Schedule Amendment
Schedule Ito By-law 5719/00 is hereby amended by removing the "(H)" Holding
Symbol preceding the "ER" Zone designation on Lots 1 and 2 of Draft Approved
Plan of Subdivision 18T-86013(R) as set out on Schedule I attached hereto.
2. Text Amendment
Section 5.(4) of By-law 5719/00 is hereby repealed.

3. Area Restricted
By-law 3037, as amended by By-law 5719/00 is hereby further amended only to
the extent necessary to give effect to the provisions of this By-law as set out in
Section 2. above, and as set out in Schedule I attached hereto. Definitions and
subject matter not specifically dealt with in this By-law shall be governed by the
relevant provisions of By-law 3037, as amended.

4. Effective Date
This By-law shall come into force in accordance with the provisions of the •
Planning Act.
