That Wingarden Crescent and Shade Master Drive within Plan 40M-2402 be assumed for public use; 2. That the works and services required by the Subdivision Agreement within Plan 40M-2402, which are constructed, installed or located on lands dedicated to, or owned by the City, or on lands lying immediately adjacent thereto, including lands that are subject to easements transferred to the City, be accepted and assumed for maintenance, save and except for Blocks 13 to 22; and 3. That the Subdivision Agreement and any amendments thereto relating to Plan 40M-2402 be released and removed from title, save and except from Blocks 13 to 22. Executive Summary: The City entered into a Subdivision Agreement with the above-noted developer for the development of the lands within Plan 40M-2402. As all . works and services within this plan have been completed to the satisfaction of City staff, it is appropriate to assume the roads, and the works and services within this plan (save and except for Blocks 13 to 22) under the jurisdiction of the City and to release the developer from the provisions of the Subdivision Agreement. Financial Implications: Not Applicable Discussion: The City entered into a Subdivision Agreement with the above-noted developer for the development of the lands within Plan 40M-2402. As the developer has now completed all of the works and services to the satisfaction of City staff, it is appropriate to assume the roads, and the works and services within the plan, save and except for Blocks 13 to 22. 165 Report LEG 07-14 September 2, 2014 Subject: Final Assumption of Plan of Subdivision 40M-2402 Page 2 Blocks 13 to 22, Plan 40M-2402 (a) Blocks 13 to 18 are currently being used for temporary turning circle purposes. Once Wingarden Crescent and Shade Master Drive are extended southerly, the turning circles will be removed and, in accordance with the Subdivision Agreement, Blocks 13 to 18 will be restored to a `residential' status and conveyed to the adjacent private landowners; • (b) Blocks 19 and 20 are reserves that will be established as public highway once Wingarden Crescent and Shade Master Drive are extended southerly; (c) Block 21 is a reserve that will be established as a public highway upon the development of the lands to the west; and (d) Block 22 is a future development block that can only be developed when Shade Master Drive is extended, providing legal road frontage to it. The,assumption of Blocks 13 to 22 and the release of the Subdivision Agreement from title to these blocks will occur once Wingarden Crescent and Shade Master Drive are extended southerly and the lands to the west of Block 21 are developed. As the works and services within Plan 40M-2402 have been completed to the satisfaction of the City, it is now appropriate to release the developer from the provisions of the Subdivision Agreement, and any amendments related thereto, as it relates to Lots 1 to 12 only.
