That Calvington Drive and Treetop Way within Plans 40M-2339 and 40R-21358 be assumed for public use; 2. That the works and services required by the Subdivision Agreement within Plan 40M-2339, Plan 40R-21358, Blocks 35 and 39, Plan 40M-2119, Block 16, Plan 40M-1943, Parts 1, 3 and 4, Plan 40R-24313 and Block 46, Plan 40M-2119, being Parts 1 to 5, Plan 40R-24314, which are constructed, installed or located on lands, dedicated to, or owned by the City, or on lands lying immediately adjacent thereto, including lands that are subject to easements transferred to the City, be accepted and assumed for maintenance, save and except from Blocks 17 and 18, Plan 40M-2339 and Part 2, Plan 40R-24313; and • 3. That the Subdivision Agreement and any amendments thereto relating to the above-noted lands, including Blocks 17 and 18, Plan 40M-2339 be released and removed from title. • Executive Summary: The City entered into a Subdivision Agreement with the above-noted developer for the development of the lands within Plans 40M-2339, 40R-21358, 40R-24314 and a portion of Plans 40M-2119, 40M-1943 and 40R-24313. As all works and services within these plans have been completed to the satisfaction of City staff, it is appropriate to assume the roads and the works and services within these plans (save and except for Blocks 17 and 18, Plan 40M-2339 and Part 2, Plan 40R-24313, now in the ownership of TRCA) under the jurisdiction of the City and to release the developer from the provisions of the Subdivision Agreement. Financial Implications: Not Applicable 14 Report CAO 15-12 October 1, 2012 Subject: Final Assumption of Plan of Subdivision 40M-2339 Page 2 Discussion: The City entered into a Subdivision Agreement with the above-noted developer for the development of the lands within Plan 40M-2339. That Subdivision Agreement also provided for, (a) the coordinated residential development of lands within Plan 40M-2339 with lands outside the plan (Blocks 12, 13 and 14, Plan 40M-2339 with those parts of Block 46, Plan 40M-2119 being Parts 1-5, Plan 40R-24314, Block 15, Plan 40M-2339 with Block 39, Plan 40M-2119 and Block 35, Plan 40M-2119 with Block 16, Plan 40M-1943); Note: The blocks referred to above within Plans 40M-2119 and 40M-1943 were not assumed at the time Plans 40M-2119 and 40M-1943 were assumed as they were designated for future coordinated residential development and financially secured through the development of Plan 40M-2339. (b) the development of a stormwater management pond on lands outside the plan (Plan 40R-24313); and • (c) the construction of the extension of Treetop Way and Calvington Drive outside Plan 40M-2339 (Parts 1 to 5, Plan 40R-21358). As the developer has now completed all of the works and services within the above-noted lands to the satisfaction of City staff, it is appropriate to: (a) assume the roads, works and services within Plan 40M-2339, Plan 40R-21358, Blocks 35 and 39, Plan 40M-2119, Block 16, Plan 40M-1943, Parts 1, 3 and 4, Plan 40R-24313 and Block 46, Plan 40M-2119, being Parts 1 to 5, Plan 40R-24314, save and except for Blocks 17 and 18, Plan 40M-2339 and Part 2, Plan 40R-24313 which are open space lands now in the ownership of TRCA; and (b) release the developer from the provisions of the Subdivision Agreement with the City dated July 4, 2006 and registered as Instrument No. DR574576, including removing it from Blocks 17 and 18, Plan 40M-2339. The Subdivision Agreement was not registered against Part 2, Plan 40R-24313. Attachments: 1.
