Subject: Sydney Beare Limited, Plan of Subdivision 40M-2167
- Final Assumption of Plan of Subdivision
- File: 40M-2167
Recommendation:
1. That Sandtrap Court within Plan 40M-2167 be assumed for public use;
2. That the works and services required by the Subdivision Agreement within Plan
40M-2167, which are constructed, installed or located on lands dedicated to, or
owned by the City, or on lands lying immediately adjacent thereto, including lands
that are subject to easements transferred to the City, be accepted and assumed
for maintenance, save and except from Blocks 10, 11, 12 and 13; and
3. That the Subdivision Agreement and any amendments thereto relating to Plan
40M-2167 be released and removed from title.
Executive Summary: The City entered into a Subdivision Agreement with the above-
noted developer for the development of the lands within Plan 40M-2167. As all works
and services within this plan have been completed to the satisfaction of City staff, it is
appropriate to assume the road, and the works and services within this plan (save and
except for Blocks 10, 11, 12 and 13) under the jurisdiction of the City and to release the
developer from the provisions of the Subdivision Agreement.
Financial Implications: Not Applicable
Discussion: The City entered into a Subdivision Agreement with the above-
noted developer for the development of the lands within Plan 40M-2167. As the
developer has now completed all of the works and services to the satisfaction of City
staff, it is appropriate to assume the road, and the works and services within Plan
40M-2167, save and except for Blocks 10, 11, 12 and 13. Blocks 10, 11 and 12 are
reserves that are not expected to be lifted and Block 13 has been developed as a golf
course in accordance with a Site Plan Agreement between the City and Cornelius
Degraauw dated November 22, 1993, as amended.
As the works and services within Plan 40M-2167 have been completed to the
satisfaction of the City, it is now appropriate to release the developer from the
provisions of the Subdivision Agreement with the City dated February 25, 2003 and

registered as Instrument No. DR211756. The Subdivision Agreement will also be
released from reserve Blocks 10, 11 and 12 as they are now in City ownership and will
not be dedicated as public highway. The Subdivision Agreement can also be released
from Block 13, as that Block is governed by a separate Site Plan Agreement.
