Subject: Procedure for Council consideration of site specific exceptions to Council
Adopted Development Guidelines
City of Pickering
Recommendation:
1. That Council endorse the procedure outlined in Report PD 32-09 for use in
processing applications requesting a site specific exception to a Council Adopted
Development Guideline that is not associated with a planning application under
the Planning Act requiring Council's consideration;
2. That staff follow the endorsed procedure for processing the request of James
Micklewright, 447 Toynevale Road, for a site specific exception to the Rosebank
Neighbourhood Development Guidelines.
Executive Summary: James Micklewright, owner of 447 Toynevale Road (located
at the south-east corner of Toynevale Road and Oakwood Drive), submitted a request
to the City for a site specific exception to the Rosebank Neighbourhood Development
Guidelines, in order to pursue a land severance application to sever the subject property
to create an additional building lot.
The Planning & Development Committee considered Report PD 28-09 on this matter at
its meeting of October 5, 2009, and referred the matter to staff. Committee did not wish
to consider any action respecting the request without first receiving public comment.
Currently there is not a Council approved procedure for. responding to requests for site
specific exceptions to approved Neighbourhood Development Guidelines that are not
associated with a Planning Act application (such as Plan of Subdivision, Official Plan
Amendment, Zoning By-law Amendment) requiring Council's consideration.
Consequently staff has prepared a procedure for Council's consideration and
endorsement.
Should Council endorse the recommended procedure, staff will process the request of
James Micklewright in accordance with the procedure, and bring an Information Report
and Recommendation Report forward for Council's consideration.

Financial Implications: An application fee of $350.00 is recommended to help offset
City processing costs. This fee will be added to the Planning & Development Schedule
of Application Fees.
Sustainability Implications: Establishing an amendment application and procedure
will provide land owners with an opportunity to have requests for site specific exceptions
to Neighbourhood Development Guidelines considered by Council, and will ensure
opportunity for public comment.
Background:
The Compendium Document to the Pickering Official Plan contains Development
Guidelines for various neighbourhoods in the City. These guidelines act as a bridge
between Official Plan policy and Implementing Zoning By-laws and are approved by
Council. Development applications must conform to the direction provided by the
Guidelines.
Amendments to the Guidelines require Council approval and may be considered
through the review of associated development applications submitted under the
Planning Act (such as Draft Plan of Subdivision, Official Plan Amendment and Zoning
By-law Amendment). However, there are application processes, such as land
severance, that do not come before Council for consideration, and which therefore do
not provide the opportunity for Council's concurrent consideration of site specific
exceptions to the Development Guidelines. The land severance proposed by James
Micklewright at 447 Toynevale Road is such an example.
Staff brought forward Report PD 32-09 to the Planning & Development Committee at its
October 5, 2009 meeting, setting out a recommended procedure for the
processing/notification of the Micklewright exception request. However, Committee
referred the matter to staff advising that it did not wish to deal with the matter without
first receiving public comment.
Consequently, this report sets out a recommended procedure for the processing of
requests for site specific exceptions to Council approved Development Guidelines for
development proposals that are not associated with a Planning Act application requiring
Council's consideration. The procedure includes the opportunity for the public to
provide comment, prior to bringing the matter to Committee for consideration. While
staff do not anticipate receiving site specific Development Guideline amendment
requests on a regular basis, it is important to develop a procedure to address future
applications.

Discussion:
A procedure to address requests for a site specific exception to Council Adopted
Development Guidelines, not associated with a Planning Act land use application
requiring Council's consideration (such as Draft Plan of Subdivision, Official Plan
Amendment, Zoning By-law Amendment), will assist staff and Council to effectively
consider such requests.
It is recommended that the following procedure be endorsed:
• land owner to submit a completed application form and fee ($350.00), along with
supportive information, planning rationale, and conceptual plans (application form
to be developed);
• Planning & Development Department to seek area resident and agency input
through:
o a mail out to neighbouring residents within a 150 metre radius of the subject
property and external agencies (potentially impacted by the proposal),
outlining the proposal, requesting comments, and advising of the date for a
Resident Information Meeting;
o posting information respecting the application on the City's website until the
day of the Resident Information Meeting;
• Resident Information Meeting to be held on the same day as the Planning &
Development Committee Meeting, where residents and other interested parties
are able to express their opinions respecting the proposal;
• Planning & Development Department to prepare a Recommendation Report for
consideration at a Planning & Development Committee Meeting, once the
Department is in a position to comment on the application.
Should this procedure be endorsed, the Planning & Development Department will
create an application form for this purpose and shall apply the application fee.
However, considering that the request of James Micklewright was submitted to the City
prior to the establishment of a formal application process or fee, staff will process this
specific application without a formal application form or fee.
Further, should Council endorse the recommended procedure, staff will process the
request of James Micklewright in accordance with the procedure, and bring an
Information Report and Recommendation Report forward for Council's consideration.
