PRESENT: Ms. S. Archer, Chairperson Mrs. D. Kerr Mrs. C. Scorer Mr. M. Puterbough ALSO PRESENT: Mrs. C. Livie, Secretary-Treasurer Mr. J. Cole, Planner. '-" The Meeting convened at 7:00 p.m. in the Committee Room of the Civic Centre. 1. MATTERS ARISING FROM THE MINUTES There were no matters arising from the minutes. 2. ADOPTION OF MINUTES '-" MOTION: Moved by Mrs. Kerr, seconded by Mrs. Scorer and carried unanimously that- the minutes of the 6th meeting of the Committee of Adjustment held May 20th, 1992, be adopted. 3. P /CA 38/92 - W. J. Lawlor Block E & Part of Lots 10 & 11, Plan 65 Also known as 666 Pleasant Street Town of Pickerin2 The applicant requests relief from the provIsIOns of Section 5.19(a) of By-law 2511 to permit a detached accessory structure (shed) to be located a minimum of 0.45 metres from the south lot line and 0.45 metres from the west lot line, whereas the By-law requires that accessory structures be located in the rear yard not less than 1.0 metres from all lot lines. Approval of this variance application is required in order to obtain a building permit for a proposed acessory structure. The Secretary-Treasurer outlined comments received from the Planning and Public Works Departments. The applicant and committee members were provided with a copy of all comments received. Mr. & Mrs. W. Lawlor were present to represent the application. No further representation was present in favour or in objection to the application. Mr. Lawlor advised that in his opinion a setback of 0.45 metres (18") is sufficient to maintain the exterior of the proposed shed. If the shed is setback 1.0 metres, it will look odd and the space will be used for the storage of junk. Also, he would like to maintain as much recreation area in his backyard as possible. He has spoken to his neighbours and they agree that the shed should be setback 0.45 metres (18"). Mr. Lawlor advised that the sheds which exist on the properties adjacent to the variance situation are less than 0.45 metres from the lot lines. The existing shed on his property is only 6" from the lot line, however, it will be removed. Some discussion took place concerning eavetroughs and roof drainage, as mentioned in the comments received from Public Works. Mr. Lawlor was advised that he should request clarification of these comments from the Public Works Department. . '-" Mr. Puterbough asked Mr. Lawlor if he would be willing to amend the proposed setback to approximately 0.50 metres (20"). Mr. Lawlor replied that he would but that he would prefer not to. Mr. Puterbough stated that in his opinion a 0.45 metre setback is not sufficient for the exterior maintenance of the proposed shed. - 38- MOTION: Moved by Mrs. Kerr, seconded by Mrs. Scorer that - this application, P /CA 38/92 by W. J. Lawlor, as outlined, be REFUSED on the grounds that there is sufficient area on the subject property to allow an accessory structure (shed) to be built in compliance with the provisions of the By-law. MOTION LOST MOTION: Moved by Mrs. Kerr, seconded by Mr. Puterbough and carried that- this application, P /CA 38/92 by Wm. Lawlor, be DEFERRED to the next regular meeting w on July 2nd, 1992, for consideration by five members of the Committee of Adjustment. 4. P /CA 39/92 - C. Ebrahim Lot 27, Plan 331 Also known as 689 Marksbury Road Town of Pickerin&: The applicant requests relief from the provisions of Section 10.2.3 of By-law 2511, as varied by P /CA 34/91, to permit the establishment of a minimum 4.62 metre front yard depth provided by the existing dwelling with a covered verandah, whereas the By-law, as varied by P /CA 34/91, requires that the existing dwelling provide a minimum 6.14 metre front yard depth. Approval of this variance application is required in order to bring the subject property into compliance with the provisions of the By-law. The Secretary-Treasurer outlined comments received from the Planning and Public Works Departments. The applicant and committee members were provided with a copy of all comments received. Mr. C. Ebrahim was present to represent the application. No further representation was present in favour or in objection to the application. Mr. Ebrahim advised that his intent is to upgrade the property, he added that the comments he received from his neighbours indicated they feel the new verandah enhances ......... the property. DECISION: Moved by Mr. Puterbough, seconded by Mrs. Kerr and carried unanimously that - this application, P /CA 39/92 by C. Ebrahim, as outlined, be APPROVED on the grounds that the requested variance is minor in nature, desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Durham Regional Official Plan, the Pickering District Plan and Section 10.2.3 of By-law 2511, subject to the following condition: 1. That approval of this variance apply only to the dwelling and verandah in existence on the subject property on the date of this decision. 5. PICA 40/92 - M. & A. Chin-Leung Lot 10, Plan 40M-1448 Also known as 550 Dahlia Crescent Town of Pickerin&: The applicants request relief from the provisions of: a) Section 10.2.3 of By-law 2511 to permit a minimum 5.7 metre rear yard depth to be provided by the existing dwelling with a proposed addition, whereas the By-law requires that a dwelling provide a minimum 7.5 metre rear yard depth; and w b) Section 10.2.6 of By-law 2511 to permit a maximum lot coverage of 34.4% to be provided by the existing dwelling with a proposed addition, whereas the By-law requires that a dwelling provide a maximum lot coverage of 33%. Approval of this variance application is required in order ~o permit the issuance of a building permit for a proposed addition (approximately 28 m ) to the rear of the existing dwelling on the lot. .39. The Secretary- Treasurer outlined comments received from the Planning and Public Works Departments. The applicant and committee members were provided with a copy of all comments received. Mr. & Mrs. M. Chin-Leung were present to represent the application. No further representation was present in favour or in objection to the application. Mr. Chin-Leung requested that if a condition is imposed for a time limit to obtain a building permit that he would like three years. Mr. Chin-Leung requested clarification of the Public Works comments respecting window v openings. He was advised that he should contact the Public Works Department for clarification of their comments. Mrs. Kerr stated that, as there is a discrepancy in the plans submitted with this application, in her opinion, a lot coverage of 34.4% may be required. She asked Jeff Cole if the Planning Department would have a problem with the application being approved as applied for. Mr. Cole replied that they would not. DECISION: Moved by Mrs. Kerr, seconded by Mr. Puterbough, and carried that- this application, PICA 40/92 by M. & A. Chin-Leung, as outlined, be APPROVED on the grounds that the requested variances are minor in nature, desirable for the appropriate development of the land and in keeping with the general intent and purpose of the Durham Regional Official Plan, the Pickering District Plan and Sections 10.2.3 and 10.2.6 of By-law 2511, subject to the following condition: 1. That a building permit for the proposed addition as generally outlined in this application be obtained within three years of the date of this decision or this decision shall become null and void. '-" 6. P /CA 41/92 - Yorkwood Investments Limited Lot 33, Plan 40M-1692 Also known as 102 Sweet briar Court Town of Pickerin2 The applicants request relief from the provisions of Section 10.2.3 of By-law 3036 to permit the establishment of a minimum 6.5 metre front yard depth to be provided by a proposed dwelling on the lot, whereas the By-law requires that a dwelling provide a minimum 7.5 metre front yard depth. Approval of this variance application is required in order that a building permit may be obtain for a proposed dwelling as outlined in building permit #92-572. The Secretary- Treasurer outlined comments received from the Planning and Public Works Departments. The applicant and committee members were provided with a copy of all comments received. Mr. M. Godfrey was present to represent the application. No further representation was present in favour or in objection to the application. Mr. Godfrey advised that the dwelling had initially complied with the front yard setback requirement of the By-law. However, the Public Works Department has indicated that a curved driveway is unacceptable. Consequently, the location of the dwelling has been turned in order to straighten the driveway, resulting in the variance situation. DECISION: Moved by Mrs. Kerr, seconded by Mrs. Scorer and carried unanimously that - this application, P /CA 41/92 by Yorkwood Investments Limited, as outlined, be APPROVED on the grounds that the requested variance is minor in nature, desirable for the appropriate development of the land and in keeping with the general intent and purpose of the Durham Regional Official Plan, the Pickering District Plan and Section 10.2.3 of By-law 3036. '-" - 40- 7. PCA 42/92 - L. & M. Thomas Part Lot 31, Concession 4 (Main Street) Hamlet of White vale The applicants request relief from the provisions of: a) Section 5(1)(b)(iii) of By-law 2677/88 to permit the continuance of a minimum 4.32 metre front yard depth provided by the existing dwelling on the lot, whereas the By-law requires that a dwelling provide a minimum 9.0 metre front yard depth.. Section 5.18(a) of By-law 2677/88 to permit the continuance of a minimum 4.11 metre north yard width and minimum 0.56 metre west yard width provided by a detached garage located in the front yard of the subject property, whereas the By-law requires that a detached accessory structure be located in the rear yard not less than 1.0 metres from all lot lines. b) 'W' Approval of this variance application is required to bring the subject property into compliance with the provisions of the By-law in order that a building permit may be obtained for a proposed addition to the rear of the existing dwelling. The Secretary-Treasurer outlined comments received from the Planning Department, Public Works Departments and Durham Regional Health Services. The applicant and committee members were provided with a copy of all comments received. Mrs. M. Thomas was present to represent the application. No further representation was present in favour or in objection to the application. DECISION: Moved by Mr. Puterbough, seconded by Mrs. Kerr and carried unanimously that - this application, PICA 42/92 by L. & M. Thomas, as outlined, be APPROVED on the grounds that the requested variances are minor in nature, desirable for the appropriate use of the land and in keeping with the general intent and purpose of the Durham Regional Official Plan, the Pickering District Plan and Section 5(I)(b)(iii) of By-law 2677/88 and Section 5.18(a) of By-law 3037. ~ 8.
