MINUTES of the 10th meeting of the
Committee of Adjustment held in the
Committee Room of the Pickering
Civic Centre on Wednesday, August

The Meeting convened at 7:00 p.m. in the Committee Room of the Civic Complex.
1. MATTERS ARISING FROM THE MINUTES
There were no matters arising from the minutes.
2. ADOPTION OF MINUTES
MOTION: Moved by Ms. S. Archer, seconded by Mr. M. Puterbough and carried
unanimously -
That the minutes of the 9th meeting of the Committee of Adjustment held July 21, 1992 be
adopted.

3. P /CA 55/92 - A. & Z. Mohammed
Lot 16, Plan 40M-1637

The applicants request relief from the provisions of Section 5(I)(b)(vi) of By-law 3178/89 to
permit the continuance of a minimum 7.40 metre rear yard provided by the existing dwelling,
whereas the By-law requires that a dwelling provide a minimum 7.5 metre rear yard depth.
Approval of this variance application is required in order to bring the subject property into
compliance with the provisions of the By-law.
The Secretary-Treasurer outlined comments received from the Planning Department and
Public Works Department.
Ms. Krystyna Lazaridis, a representative of Garthwood Homes Ltd., agent for the applicants,
was present to represent the application. No further representation was present in favour or in
objection to the application.

DECISION: Moved by Mr. Puterbough, seconded by Mr. Bhuta and carried that-
this application, P /CA 55/92 by A. & Z. Mohammed, as outlined, be APPROVED on the
grounds that the requested rear yard depth variance is minor in nature, desirable for the
appropriate development of the land, and in keeping with the general intent and purpose of the
Durham Regional OOicial Plan, the Pickering District Plan and Sections 5.(I)(b)(vi) of By-law
3036 as amended by By-law 3178/89, subject to the following condition:
1. That this approval apply only to the dwelling in existence on the subject property
on the date of this decision.

4. P /CA 56/92 . Discovery Place Limited
Part of Lot 21, Concession 1 (Parts 10 & 11,40R.l0070)

The applicant requests relief from the provisions of:

(a) Section 5(I)(b)(i) - Schedule II of By-law 2349/87 to permit the establishment of a
minimum 0.0 metre yard setback from The Esplanade North whereas the By-law
requires that a dwelling provide a minimum yard setback of 14.0 metres from The
Esplanade North; and
(b) Section 5(I)(b)(iii) of By-law 2349/87 to permit a residential lot coverage of 30 percent
to be provided by the proposed development whereas the By-law requires that
residential lot coverage not exceed a maximum of 20 percent.
Approval of this variance application is required to permit the construction of a residential
development (garden apartments and apartment buildings) on the subject property).
Mr. Steve Upton, a representative of Discovery Place Limited, was present to represent the
application. There were approximately 25 - 30 concerned residents present to hear the
application.
The Secretary-Treasurer outlined comments received from the Planning Department and
Public Works Department. Comments were also received from Councillor Higdon, Town of
Pickering supporting a deferral of the application, and Concerned Owners of Durham
Condominium Nos. 93 and 106, 1880 and 1890 Valley Farm Road, Pickering, Ontario (signed
by Mrs. Sophia Campitelli) also supporting a deferral of the application.
Mr. Upton stated that he was requesting a deferral of the application until other matters
related to this application could be heard by Town Council, and that he would be satisfied
with a deferral at this time.
MOTION: Moved by Mr. Puterbough, seconded by Mr. Bhuta and carried that -
this application, P /CA 56/92, by Discovery Place Limited as outlined, be DEFERRED until
'-" Pickering Town Council considers amendments to the Main Central Area North
Development Plan, the Development Agreement between the landowner and the Town, and
the Site Plan Review Committee has reviewed the submitted site plan.
5. P /CA 57/92 - R. & S. Adams
Part of Lot 28, Plan 311
Also known as 593 Marksbury Road
Town of Pickering
The applicants request relief from the provisions of Section 10.2.3 of By-law 2511 to permit
the continuance of a 7.16 metre rear yard, and the continuance of a 1.39 metre north side
yard provided by the existing dwelling, whereas the By-law requires that a dwelling provide a
7.5 metre rear yard and a 1.5 metre side yard.
Approval of this variance application is required in order to bring the subject property into
compliance with the provisions of the By-law.

Mr. and Mrs. Adams were present to represent the application. No further representation
was present in favour or in objection to the application.
The Secretary-Treasurer outlined comments received from the Planning Department and
Public Works Department.
DECISION: Moved by Mr. Puterbough, seconded by Mrs. Kerr and carried that -
this application, P /CA 57/92, as outlined, be APPROVED on the grounds that the requested
variances are minor in nature, desirable for the appropriate development of the land, and in
keeping with the general intent and purpose of the Durham Regional Official Plan, the
Pickering District Plan and Section 10.2.3 of By-law 2511 subject to the following condition:
1. That this variance apply only to the dwelling in existence on the subject property on
the date of this decision.

6. ADJOU~ENT
MOTION: Moved by Mrs. Kerr, seconded by Mr. Bhuta and carried that -
the 10th meeting of the Committee of Adjustment be adjourned at 7:30 p.m. and the next
regular meeting be held on Wednesday, September 2,1992.
