MATTERS ARISING AND ADOPTION OF MINUTES MOTION: Moved by Bill Utton seconded by Marie Billinger There were no matters arising from the minutes. The minutes of the 6th meeting of the Committee of Adjustment held Wednesday, April 26, 2006, be adopted. CARRIED UNANIMOUSLY 2. ADOPTION OF AGENDA MOTION: Moved by Eric Newton seconded by David Johnson That the agenda for the Wednesday, May 17, 2006 meeting be adopted. CARRIED UNANIMOUSLY 31 3. PICA 33/06 - P. & A. Koleros 496 Rougemount Drive (Part of Lot 96 & 97, Plan 283) City of Pickering The applicant requests relief from Zoning By-law 2511, to permit an accessory structure (detached garage) to be located in the front yard and to permit a maximum height of 4.0 metres for an accessory structure (detached garage), whereas the by-law requires all accessory structures be located in a rear yard and a maximum height of 3.5 metres for accessory structures in a residential zone. The applicant requests approval of these variances in order to obtain a building permit for the proposed construction of a detached garage. Geoff Romanowski outlined comments received from the City of Pickering Planning & Development Department. Written comments were also received from the City's Development Control Supervisor and the City's Fire Prevention Officer, both expressing no concerns. Chris Fairhead, agent, was present to represent the application. Peter Koleros, owner, was also present in favour of the application. Chris Fairhead outlined the application and agrees with the City's recommendations. In response to a question Chris Fairhead explained there is no intent of the accessory structure (detached garage) being used as an accessory dwelling unit. MOTION: Moved by David Johnson seconded by Eric Newton That application PICA 33/06 by P. & A. Koleros, be APPROVED on the grounds that the proposed location of the accessory structure (detached garage) in the front yard and the increase height of the accessory structure (detached garage) are minor variances that are desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Official Plan and the Zoning By-law subject to the following conditions: 1. That these variances apply only to the accessory structure (detached garage), as generally sited and outlined on the applicant's submitted plans with this application. 2. That the applicant obtain a building permit and construct the accessory structure (detached garage) within two years of the date of this decision, or this decision shall become null and void. CARRIED UNANIMOUSLY 32 4. PICA 34/06 - Chris DeGraauw 1883 Kingston Road Part of Lot 5, Plan 469 (40R-16232, Part 6) City of Pickering The applicant requests relief from Zoning By-law 3036, as amended by By-law 5480/99, to permit a minimum west side yard width of 1.2 metres, a minimum of 24 parking spaces, a maximum of 4 dwelling units, and to permit the building to be located outside of the build-to-zone, whereas the by-law requires a minimum side yard width of 1.5 metres, a minimum of 26 parking spaces, a maximum of 2 dwelling units, and a minimum 60 percent of the length of the building to be located within the build-to-zone. The applicant requests approval of these variances in order to obtain site plan approval and a building permit for the proposed construction of a 2-storey addition to a mixed use building. Geoff Romanowski outlined comments received from the City of Pickering Planning & Development Department. Written comments were received from the City's Development Control Supervisor and the City's Fire Prevention Officer, both expressing no concerns. Written comments were also received from the Toronto and Region Conservation Authority with no objections. Chris DeGraauw, owner, was present to represent the application. No further representation was present in favour of or in objection to the application. Written comments were also received from Malcolm MacDonald of 1881 Kingston Road and Councillor Rick Johnson in support of the application. In response to a question Geoff Romanowski explained the zoning by-law requires 2 parking spaces per dwelling unit and clarified that 8 parking spaces will be used for the dwelling units and the remaining 16 parking spaces used for business. MOTION: Moved by Eric Newton seconded by Marie Billinger That application PICA 34/06 by Chris DeGraauw, be APPROVED on the grounds that the proposed reduced west side yard width, the reduction in parking and the increase in dwelling units are minor variances that are desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Official Plan and the Zoning By-law, subject to the following conditions: 1. That these variances apply only to the property, as generally sited and outlined on the applicant's submitted plans with this application. 2. That the applicant obtains site plan approval within two years of this decision, or this decision shall become null and void. 33 3. That the applicant obtain a building permit and construct the 2-storey addition within two years of the date of this decision, or this decision shall become null and void. CARRIED UNANIMOUSLY 5. PICA 35/06 - Mainbram Developments 1672 Valley Ridge Crescent Part of Lot 26, Plan 410 (40R-23991, Part 1) City of Pickering The applicant requests relief from Zoning By-law 3036, to permit a maximum lot coverage of 36% for a detached dwelling, whereas the by-law requires a maximum lot coverage of 33% for a detached dwelling. The applicant requests approval of this variance in order to obtain a building permit for the construction of a detached dwelling. Geoff Romanowski outlined comments received from the City of Pickering Planning & Development Department. Written comments were received from the City's Development Control Supervisor and the City's Fire Prevention Officer, both expressing no concerns. Written comments were also received from the Toronto and Region Conservation Authority with no objections. Michael Benedetti, agent, was present to represent the application. Greg Stokes of 1665 Valley Ridge Crescent and Orazio Gianfriddo of 1670 Valley Ridge Crescent were present to seek additional information on the detached dwelling. Michael Benedetti outlined the increase in the lot coverage is to expand the kitchen and family on the first floor. He also explained the lot coverage will be toward the back of the dwelling. In response to concerns from residents Michael Benedetti noted that he would try and keep construction debris to a minimum. Greg Stokes and Orazio Gianfriddo both expressed concerns with the lot coverage, and debris during construction. MOTION: Moved by Marie Billinger seconded by Eric Newton That application PICA 35/06 by Mainbram Developments, be APPROVED on the grounds that the proposed increase in the maximum lot coverage is a minor variance that is desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Official Plan and the Zoning By-law, subject to the following conditions: 1. That this variance apply only to the detached dwelling, as generally sited and outlined on the applicant's submitted plans with this application. 34 2. That the applicant obtain a building permit and construct the detached dwelling within two years of the date of this decision, or this decision shall become null and void. CARRIED UNANIMOUSLY 6. APPOINTMENT OF SECRETARY-TREASURER MOTION: Moved by David Johnson seconded by Marie Billinger That Geoff Romanowski be appointed as Secretary-Treasurer. CARRIED UNANIMOUSLY 7. APPOINTMENT OF ASSISTANT SECRETARY-TREASURER MOTION: Moved by David Johnson seconded by Eric Newton That Jean Finn also be appointed Assistant Secretary-Treasurer. CARRIED UNANIMOUSLY 8. ADJOURNMENT MOTION: Moved by David Johnson seconded by Marie Billinger That the 7th meeting of the Committee of Adjustment be adjourned at 7:28 p.m. and the next meeting of the Committee of Adjustment be held on Wednesday, June 7, 2006.
