MINUTES of the 6th meeting of the Committee of Adjustment held in the Main
Committee Room of the Pickering Civic Complex on Wednesday, April 26,2006 and
convened at 7:00 p.m.

1. MATTERS ARISING AND ADOPTION OF MINUTES
MOTION: Moved by David Johnson
seconded by Marie Billinger
There were no matters arising from the minutes. The minutes of the 5th meeting
of the Committee of Adjustment held Wednesday, April 5, 2006, be adopted.

2. ADOPTION OF AGENDA

That the agenda for the Wednesday, April 26, 2006 meeting be adopted.

3. PICA 30106 - David Bradshaw
1442 Old Forest Road
(Lot 101, Plan 816)
City of Pickering
The applicant requests relief from Zoning By-law 3036 to permit a minimum side
yard width of 1.2 metres, whereas the by-law permits a minimum side yard width
of 1.5 metres.
The applicant requests approval of this variance in order to bring a recently
constructed dwelling into compliance.
The Secretary-Treasurer outlined comments received from the City of Pickering
Planning & Development Department. Written comments were also received
from the City's Development Control Supervisor, the City's Chief Building Official
and the City's Fire Prevention Officer, expressing no concerns.
Jan De Jong, agent, was present to represent the application. No further
representation was present in favour of or in objection to the application.
In response to a question Jan De Jong explained that the survey was incorrect
due to a siting and construction error.
MOTION: Moved by Bill Utton
seconded by Marie Billinger
That application PICA 30106 by David Bradshaw, be APPROVED on the grounds
that the the proposed 1.2 metre side yard width is a minor variance that is
desirable for the appropriate development of the land, and in keeping with the
general intent and purpose of the Official Plan and the Zoning By-law, subject to
the following condition:
1. That this variance apply only to the north side yard, as generally sited and
outlined on the applicant's submitted plans with this application.

4. PICA 31/06 - Pickering Square Inc.

(Part of Lots 3, 4, & 5, Plan 350)
City of Pickering
The applicant requests relief from Zoning By-law 3036, as amended by
By-law 5756/00 to permit a seasonal outdoor garden centre having open storage
in the west side yard in association with a retail store, whereas the by-law does
not permit open storage in any yard.

The applicant requests approval of this variance in order to operate a seasonal
outdoor garden centre in association with a retail store from May 15, 2006 to
September 15, 2006.
The Secretary-Treasurer outlined comments received from the City of Pickering
Planning & Development Department. Written comments were received from the
City's Development Control Supervisor and the City's Corporate Promotions &
Economic Development both expressing no concerns. Written comments were
also received from the City's Fire Prevention Officer commenting that the open
storage in the west side yard shall not interfere with the existing fire routes
on-site.
Ben Smuskowitz, owner, was present to represent the application. No further
representation was present in favour of or in objection to the application. He
concurs with the City's recommendations.

That application PICA 31/06 by Pickering Square Inc. be APPROVED on the
grounds that the proposed seasonal outdoor garden centre having open storage
in the west side yard in association with a retail store from May 15, 2006 to
September 15, 2006 is a minor variance that is desirable for the appropriate
development of the land, and in keeping with the general intent and purpose of
the Official Plan and the Zoning By-law, subject to the following conditions:
1. That this variance apply only to a seasonal outdoor garden centre associated
with a retail store in the west side yard, as generally sited and outlined on the
applicant's submitted plans with this application.
2. That the seasonal outdoor garden centre be limited to a maximum of
150 square metres in size.
3. The owner apply and receive site plan approval prior to operating the garden
centre in association with a retail store.
4. That the seasonal outdoor garden centre only be permitted to operate
between May 15, 2006 to September 15, 2006.

5. PICA 32/06 - Eugene & Jennie Paiuk

City of Pickering
The applicant requests relief from Zoning By-law 3036, as amended by By-law
1699/83, to permit a minimum rear yard depth of 6.0 metres, whereas the by-law
requires a minimum rear yard depth of 7.5 metres.
The applicant requests approval of this variance in order to obtain a building
permit for a proposed sunroom addition to the existing dwelling.

The Secretary-Treasurer outlined comments received from the City of Pickering
Planning & Development Department. Written comments were also received
from the City's Development Control Supervisor and the City's Fire Prevention
Officer, both expressing no concerns. Written comments were also received
from the Toronto and Region Conservation Authority with no objections.
Eugene Paiuk, owner, was present to represent the application. No further
representation was present in favour of or in objection to the application.

seconded by Marie Billinger
That application PICA 32/06 by Eugene & Jennie Paiuk be APPROVED on the
grounds that the proposed minimum rear yard depth of 6.0 metres to be provided
by the proposed sunroom addition is a minor variance that is desirable for the
appropriate development of the land, and in keeping with the general intent and
purpose of the Official Plan and the Zoning By-law, subject to the following
conditions:
1. That this variance apply only to the proposed sunroom addition, as generally
sited and outlined on the applicant's plans submitted with this application.
2. That the applicant obtain a building permit and construct the proposed
sunroom addition within two years of the date of this decision, or this decision
shall become null and void.

and the next meeting of the Committee of Adjustment be held on
