MATTERS ARISING AND ADOPTION OF MINUTES MOTION: Moved by Marie Billinger seconded by Eric Newton There were no matters arising from the minutes. The minutes of the 3rd meeting of the Committee of Adjustment held Wednesday, February 22, 2006, be adopted as amended. CARRIED UNANIMOUSLY 2. ADOPTION OF AGENDA MOTION: Moved by Eric Newton seconded by David Johnson That the agenda for the Wednesday, March 15, 2006 meeting be adopted. CARRIED UNANIMOUSLY - 17 3. (Tabled at the February 22, 2006 meeting) PICA 06/06 to PICA 23/06 - 2047729 Ontario Inc. 1355 Altona Road (Part of Lot 1 & 2, Plan 228) City of Pickering .- MOTION: Moved by Marie Billinger seconded by Eric Newton That PICA 06/06 to PICA 23/06 - 2047729 Ontario Inc. be lifted from the table. CARRIED UNANIMOUSLY The applicant requests relief from the provIsions of Zoning By-law 3036, as amended by By-law 2658/88, to permit the development of 18 freehold townhouse dwelling units on the subject property. The proposed development is comprised of lots that will front onto a private condominium road; whereas the by-law requires all lots to provide frontage on an opened public street maintained at public expense. The applicant also requests that the lot frontage, lot area, front yard depth, rear yard depth, side yard width, flankage side yard width, and lot coverage of some or all of the lots be reduced; whereas the by-law requires minimum and/or maximum zoning requirements to be met as shown on the chart below. .- The applicant has revised the application and has further reduced the rear yard depth to the dwellings and has requested that a new variance be added to the applications for a reduced rear yard depth to a deck or a balcony of each dwelling. The applicant requests approval of these variances in order to satisfy conditions of Draft Plan Approval, Site Plan Approval and in order to obtain building permits in the future for the subject property. Written comments were received from the City's Development Control Supervisor and the City's Fire Prevention Officer, both expressing no concerns. Written comments were also received from the Toronto and Region Conservation Authority with no objections. John Perdue, agent, was present to represent the applications. Pietro Ferrari, architect, was present in favour of the applications. Councillor Kevin Ashe was also present for the applications. Bill Utton joined meeting at 7:13 pm - John Perdue outlined the applications and presented landscaping and elevation plans to the committee, noted a noise study has been done and a fence will be constructed, and outlined the parking accommodations. 19 - In response to a question John Perdue explained they have submitted and are in the process for site plan approval and that a rezoning application would be a longer process as opposed to minor variance applications. In response to a question Ross Pym explained that Council is circulated all Committee of Adjustment applications and has been notified of the development. Councillor Kevin Ashe noted to the committee that he is not here to speak for or against the applications, however noted that he has met with the applicant and the Community appears comfortable with the project. MOTION: Moved by David Johnson seconded by Bill Utton That application PICA 06/06 to PICA 23/06 by 2047729 Ontario Inc, be APPROVED on the grounds that the lot frontage, lot area, front yard depth, rear yard depth, side yard width, flankage side yard width, lot coverage, rear yard depth to a deck or a balcony and lots frontage on a private street of some or all of the lots be reduced are minor variances that are desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Official Plan and the Zoning By-law, subject to the following conditions: 1. That these variances apply only to the proposed buildings as generally illustrated on the applicant's plans submitted with this application. - 2. That the applicant receives Final ApprovallRegistration for the associated Draft Plan of Subdivision and Site Plan Approval within two years of the date of this decision, or this decision shall become null and void. (Tabled at the February 22, 2006 meeting) PICA 25/06 - Gail Skidmore 1808 Woodview Avenue (Part of Lot 4, Plan M-282) City of Pickering MOTION: Moved by Marie Billinger seconded by David Johnson That PICA 25/06 - Gail Skidmore be lifted from the table. CARRIED UNANIMOUSLY The applicant requests relief from the provision of Zoning By-law 3036, to permit the existing dwelling to remain temporarily on a lot that is proposed to be divided into two lots that will result in insufficient north side yard width of 0.6 metre; whereas the By-law requires a minimum side yard setback of 1.5 metres. The applicant requests approval of the variance to facilitate a future Land Severance application. The Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department. Written comments were received from the City's Development Control Supervisor indicating the roof drainage will need to be addressed prior to land severance. Cesare Gallo, agent, was present to represent the application. No further representation was present in favour of or in objection to the application. Cesare Gallo explained the application and agrees with recommendations from the City. MOTION: Moved by Bill Utton seconded by Marie Billinger That application PICA 25/06 by Gail Skidmore, be APPROVED on the grounds that the variance to permit a minimum north side yard width of 0.6 metre to the existing dwelling is a minor variance that is desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Official Plan and the Zoning By-law, subject to the following conditions: 1. That the variance applies only to the existing dwelling, as generally sited and outlined on the applicant's submitted plans with this application, for a period of three years from the date of this decision, after which this decision shall become null and void. 2. That the applicant apply for, get approval for, and finalize the associated land severance application within one year of the date of this decision, or this decision shall become null and void. PICA 26/06 - Chieftan Development Corporation North Part of Lot 18, Concession 2 (Part 1, 40R-20062) Block 165, 40M-1771 (Block 165 of 40M-1771 together with Block 50, Lot 1 and) (Lot 2 of Draft Approved Plan of Subdivision 18T-97016) City of Pickering The applicant requests relief from Section 6.1 of Zoning By-law 3036, as amended, to permit the establishment of three detached model homes on the subject lands. Draft Plan of Subdivision 18T -97016 has been approved to develop the subject lands for 53 detached dwellings, however, the lots on which the dwellings are to be located will not be created until the draft plan of subdivision is registered. Until the draft approved plan of subdivision is registered, the subject lands are considered to be a single lot, and the zoning by-law permits only one dwellinglmain building per lot. The applicant requests approval of this variance in order to obtain building permits for the proposed construction of three model homes on the subject lands. The Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department. Written comments were also received from the City's Fire Prevention Officer, expressing no concerns and the City's Development Control Supervisor indicating a revised construction management plan is required to the satisfaction of the City of Pickering. David Brand, owner, was present to represent the application. Paul Jones of 2328 Southcott Road, and Steve Caporusso of 2329 Southcott Road were present for the application. David Brand explained the application and agrees with recommendations from the City. Paul Jones and Steve Caporusso both advised they were not opposed to the application however they had some concerns related to construction activity such as construction traffic, truck speed of some contractors and time of construction activities. In response to several questions David Brand explained that he has spoken to the contractors, posted speed signs, crossing guards and beware of children signs within the construction area. He intends to complete registration by the summer, would like to start selling within the next three months and the houses will be built on an as sold basis. MOTION: Moved by Bill Utton seconded by Eric Newton That application PICA 26/06 by Chieftan Development Corporation, be APPROVED on the grounds that the proposed establishment of three model homes on one lot is a minor variance that is desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Official Plan and the Zoning By-law, subject to the following conditions: 22 ·- - ,- 1. That this variance, apply only to the subject lands as generally sited and outlined on the applicant's submitted plans with this application. 2. That for the purpose of this application, a "Model Home" shall mean a dwelling unit which is not used for residential purposes, but which is used exclusively for sales, display and marketing purposes pursuant to an agreement with the City of Pickering. 3. That a revised Construction Management Plan be submitted for Draft Plan of Subdivision 18T-97016 to the satisfaction of the City of Pickering. 4. That no fewer than two visitor parking spaces be provided within the driveway of each model home, and that a location for overflow parking be provided on-site. 5. That the applicant obtain building permits and construct the proposed model homes within two years of the date of this decision, or this decision shall become null and void. CARRIED UNANIMOUSLY 6.
