MINUTES of the 16th meeting of the Committee of Adjustment held in the Main
Committee Room of the Pickering Civic Complex on Wednesday, November 30,2005
and convened at 7:06 p.m.

That the minutes of the 15th meeting of the Committee of Adjustment held
Wednesday, November 9, 2005, be adopted.

PICA 57/05 - Jeremy & Danielle Crawford

MOTION: Moved by Bill Utton, seconded by Marie Billinger
That PICA 57/05, by Jeremy & Danielle Crawford be lifted from the table.
CARRIED UNANIMOUSLY
The applicants request relief from Zoning By-law 3036 to permit a two-storey
detached garage in the rear yard of the subject property providing a maximum
height of 4.8 metres, whereas the by-law permits a maximum height of
3.5 metres for a detached garage.
The applicants request approval of this variance in order to obtain a building
permit to construct a detached garage on the subject lands.
The Secretary-Treasurer outlined comments received from the City of Pickering
Planning & Development Department. Written comments were also received
from the City's Chief Building Official and the City's Fire Prevention Officer, both
expressing concerns with the proposed use of the detached garage.
Jeremy & Danielle Crawford, owners, were present to represent the application.
Paul Papakonstantinou of 1836 Glendale Drive was present to seek information
on proposed garage.
Jeremy noted to the Committee they are willing to reduce the height by 0.3 of a
metre to bring it down to 4.5 metres in height, and requested that the application
be amended to reflect the new height.
MOTION: Moved by Daivd Johnson, seconded by Bill Utton
That application PICA 57/05 as amended, by Jeremy & Danielle Crawford, be
APPROVED on the grounds that the proposed height of 4.5 metres for the
detached garage is a minor variance that is desirable for the appropriate
development of the land, and in keeping with the general intent and purpose of
the Zoning By-law, subject to the following conditions:
1. That this variance apply only to the detached garage, as generally sited and
outlined on the applicant's submitted plans with this application.
2. That the applicant obtains a building permit within two years of the date of this
decision, or this decision shall become null and void.

6. PICA 58/05 - Grand Communities (Altona) Corporation

The applicant requests relief from Zoning By-law 3036, as amended by By-laws
5537/99 and 4366/93, to permit a minimum building height of 4.8 metres to be
provided for buildings in Zone 1 (north section of the subject property) and a
minimum building height of 8.0 metres for buildings in Zone 2 (south section of
the subject property), whereas the zoning by-law requires a minimum building
height of 12.0 metres in Zone 1 and 9.0 metres in Zone 2.
The applicant has requested approval of these variances in order to obtain Site
Plan Approval and building permits to develop a mixed use retail commercial I
residential building and 12 condominium townhouses on the subject lands.
The Secretary-Treasurer outlined comments received from the City of Pickering
Planning & Development Department. Written comments were received from the
City's Development Control Supervisor and the City's Fire Prevention Officer,
both expressing no concerns. Written comments were also received from
Toronto and Region Conservation having no objection, however TRCA require
the applicant obtain an Ontario Regulation 158 permit for any proposed develop
on the subject site, prior to the issuance of a municipal building permit.
Paul Johnston, agent, was present to represent the application. No further
representation was present in favour of or in objection to the application.
Paul Johnston gave a history of the property and agrees with staff's
recommendations. In response to a question, Paul Johnston made a
presentation explaining the building heights.
MOTION: Moved by Bill Utton, seconded by David Johnson
That application PICA 58/05 by Grand Communities (Altona) Corporation, be
APPROVED on the grounds that the minimum heights of 4.8 metres for buildings
in Zone 1 and 8.0 metres for buildings in Zone 2 are minor variances that are
desirable for the appropriate development of the land, and in keeping with the
general intent and purpose of the Official Plan and the Zoning By-law, subject to
the following conditions:
1. That these variances apply only to the proposed buildings as generally
illustrated on the applicant's plans submitted with this application.
2. That the applicant obtains final site plan approval and obtain building permits
within two years of this decision, or this decision shall become null and void.

The applicants request relief from Zoning By-law 3036 to permit the
establishment of a minimum 6.0 metre rear yard depth to be provided by the
proposed rear yard deck, whereas the by-law requires a minimum rear yard
depth of 7.5 metres.
The applicants request approval of this variance in order to obtain a building
permit for the proposed deck to the rear of the existing dwelling.
The Secretary-Treasurer outlined comments received from the City of Pickering
Planning & Development Department. Written comments were also received
from the City's Development Control Supervisor and the City's Fire Prevention
Officer, both expressing no concerns.
Bob & Lynn Lean, owners, were present to represent the application. Jeff
Aucoin, Hickory Dickory Decks was also present in favour of the application.

That application PICA 59/05 by Robert & Lynn Lean, be APPROVED on the
grounds that the proposed 6.0 metre rear yard depth to be provided by the
proposed rear yard deck is a minor variance that is desirable for the appropriate
development of the land, and in keeping with the general intent and purpose of
the Official Plan and the Zoning By-law, subject to the following conditions:
1. That this variance apply only to the proposed rear deck, as generally sited
and outlined on the applicant's submitted plans with this application.
2. That the applicants obtain a building permit and construct the proposed rear
yard deck within two years of the date of this decision, or this decision shall
become null and void.

whereas the Zoning By-law 3036, as amended by By-law 6585/05, requires the

The applicant has requested approval of these variance applications in order to
obtain building permits to develop a townhouse, a detached dwelling and two
semi-detached dwellings on the subject lands.
The Secretary-Treasurer outlined comments received from the City of Pickering
Planning & Development Department. Written comments were received from the
City's Development Control Supervisor and the City's Fire Prevention Officer,
both expressing no concerns. Written comments were also received from
Toronto and Region Conservation having no objections to the minor variance
application as submitted, subject to the following outstanding review fee of
$250.00.
Stephen Hunt, agent, was present to represent the application. No further
representation was present in favour of or in objection to the application.
Stephen Hunt explained the application and presented a site plan to the
Committee that showed the irregularities in the lotting pattern and the need for
the variances.
In response to a question, Ross Pym explained the zoning by-law amendment
recently adopted by City Council.

That applications PICA 60105 to PICA 63/05 by Silver Lane Estates Inc., be
APPROVED on the grounds that the rear yard depth of 5.5 metres for PICA 60105,
5.7 metres for PICA 61/05, and 3.8 metres for PICA 63/05 and flankage side yard
width of 2.2 metres and side yard encroachment of 0.8 of a metre for PICA 62/05
are minor variances that are desirable for the appropriate development of the
land, and in keeping with the general intent and purposed of the Official Plan and
the Zoning By-law, subject to the following conditions:
1. That these variances apply only to the proposed building as generally
illustrated on the applicant's plans submitted with this application.
2. That the applicant receives Final ApprovallRegistration for the associated
Draft Plan of Subdivision or this decision shall become null and void.
3. That the applicant obtain building permits and complete all construction of the
proposed building within two years of this decision, or this decision shall
become null and void.
