MINUTES of the 1st meeting of the Committee of Adjustment held in the Main
Committee Room of the Pickering Civic Complex on Wednesday, January 11,2006 and
convened at 7:05 p.m.

1. APPOINTMENT OF CHAIRPERSON

That Chris Braney be appointed as Chairperson for a 1 year term.

That the minutes of the 16th meeting of the Committee of Adjustment held
Wednesday, November 30,2005, be adopted as amended.

6. PICA 01/06 - Palm Drive Developments Limited
1644-1698 Bayly Street
(Part of Lot 19, Concession 1, Now Parts 1, 2, 4 and 5, RP 40R-4 754)
City of Pickering
The applicant requests relief from Zoning By-law 2511, as amended by By-laws
1893/84 and 2640/88, to establish a maximum gross floor area for a sales outlet
in a warehouse to 40 percent, whereas the by-law permits a maximum gross
floor area of a sales outlet for a warehouse of 20 percent.
The applicant requests approval of this variance in order to obtain a building
permit to occupy Units 6 and 7 of the subject development.
The Secretary-Treasurer outlined comments received from the City of Pickering
Planning & Development Department. Written comments were also received
from the City's Development Control Supervisor and the City's Fire Prevention
Officer, both expressing no concerns.
David McKay, agent, was present to represent the application. Bill Doumouras
was present in favour of the application and submitted a letter requesting
notification of the decision.
David McKay outlined the application and explained the layout of the building and
its functionality. In response to a question, David McKay explained deliveries will
be limited and does not anticipate an increase in traffic.

That application PICA 01/06 by Palm Drive Developments Limited, be
APPROVED on the grounds that the proposed increased gross floor area of
40 percent is a minor variance that is desirable for the appropriate development
of the land and in keeping with the general intent and purpose of the Official Plan
and Zoning By-law, subject to the following conditions:
1. That this variance apply, only to Units 6 and 7 of the existing building, as
generally sited and outlined on the applicant's submitted plan with this
application.
2. That this variance only apply to the industrial fasteners and supplies operation
as outlined on the applicant's submitted plan with the application.

7. PICA 02/06 & 03/06 - Molida Homes
1939 Spruce Hill Road
(Lot 85, Plan 1041 RCP)
City of Pickering
The applicants request relief from Zoning By-law 3036 to permit the
establishment of a minimum of 14.6 metres lot frontage to be provided by the
proposed retained and severed lots, whereas the by-law requires a minimum lot
frontage of 15 metres.
The applicants request approval of these variances in order to facilitate future
land severance applications.
The Secretary-Treasurer outlined comments received from the City of Pickering
Planning & Development Department. Written comments were received from the
City's Development Control Supervisor and the City's Fire Prevention Officer,
both expressing no concerns. Written comments were~ also received from
Dorsey & Isa James of 1943 Spruce Hill Road expressing several concerns.
Cesare Molinaro, applicant, was present to represent the application. No further
representation was present in favour of or in objection to the application.
Cesare Molinaro explained the application is to create two equal size lots through
a future land severance. In response to a question, Cesare Molinaro stated the
homes will be two-storey dwellings approximately 3500 square feet in size and
will be higher value homes.
Dorsey & Isa James stated in their correspondence concerns regarding the
future grading, tree preservation and the importance of façade and design of
homes to the existing streetscape.

That applications PICA 02/06 & PICA 03/06 by Molida Homes, be APPROVED
on the grounds that the proposed 14.6 metres lot frontage to be provided by the
proposed retained and severed lots are minor variances that are desirable for the
appropriate development of the land, and in keeping with the general intent and
purpose of the Official Plan and the Zoning By-law, subject to the following
conditions:
1. That these variances apply only to the proposed retained and severed parcels
as generally sited on the applicant's submitted plan with this application.
2. That the applicant applies, receives approval and finalizes the associated
severance application, or this decision shall become null and void.
