That Pickering Council RECEIVE Report PD 18-06 as its comments on the proposed modifications to the proposed Central Pickering Development Plan, prepared by the Ministry of Municipal Affairs and Housing, dated February 1, 2006, EBR Registry Number: PF05E0002; 2. That, despite the City's continued opposition to the use of the Ontario Planning and Development Act, 1994 (OPDA), should the Provincial government approve a Development Plan for Central Pickering under that Act, (a) Council REQUESTS the Plan be further modified to include a policy specifying that prior to the completion of the first neighbourhood plan, the Minister will enter into appropriate Memorandum of Understanding (MOU) and agreements with the City of Pickering, and other levels of government and agencies as may be required, to provide financial assistance in accordance with section 20 of the OPDA, for the purpose of implementing the policies and programs of the Plan, at a level to ensure achievement of the following: • the provision of sufficient lands in acceptable locations for required municipal facilities, parks and open spaces, and other necessary community facilities such as places of worship, schools, nursing homes and childcare centres; • the early servicing of the Highway 407 employment lands; • adequate long-term funding to maintain and manage the natural heritage system; • the preparation of a heritage study of the Whitevale Road corridor east of the existing Heritage Conservation District as input to the neighbourhood planning process; • the provision of sufficient lands for the development of a university and/or college campus and a medical teaching hospital; Report PD 18-06 February 27, 2006 Subject: Modifications to the Proposed Central Pickering Development Plan Page 2 • the provision of two new Highway 407 interchanges, the construction of the Brock Road by-pass and the Brock Road / Highway 407 interchange, the provision of appropriate regional and interregional transit service, the extension of GO-Transit service, the widening of Highway 7, the construction of the Whitevale By-pass / 14th Avenue connection, and the widening of Steeles Avenue; • the development of an integrated set of sustainability measures and benchmarks for Seaton; • the cost of providing services and facilities in Seaton will not be borne by the City's existing residents and businesses; • funding of all subsequent planning, design and technical studies or exercises; and • any other matters as may be determined; (b) Council REQUESTS the Plan be further modified to incorporate the changes set out in Appendices I and II to Report PD 18-06, which among other matters would result in: • retention of 135 hectares of Prestige Employment lands, which were converted to non-employment uses; • reclassification of Sideline 22 from a Type B Arterial to a Type C Arterial Road; • addition of policies requiring completion of the City's Financial Impact Study for Seaton ahead of the completion of the first neighbourhood plan, and completion of the Whitevale Road Corridor heritage study prior to the completion of the neighbourhood plans for the adjacent lands; • clarification of policies on funding, timing and preparation of studies to ensure that costs are not borne by the City but by the benefiting landowners; and • correction of editorial and technical matters; and (c) Council AUTHORIZES City staff to meet with representatives of the Ministry of Municipal Affairs and Housing after the March 3, 2006 deadline to continue to discuss and provide input on the Provincial Development Plan and to report back to Council through the Net Benefits Committee; and 3. That the City Clerk FORWARD a copy of Report PD 18-06 to the Minister of Municipal Affairs and Housing, the Minister of Public Infrastructure Renewal, the Minister of the Environment, Project Director for the North Pickering Land Exchange Team, the Region of Durham, and the Toronto and Region Conservation Authority. Report PD 18-06 February 27, 2006 Subject: Modifications to the Proposed Central Pickering Development Plan Page 3 Executive Summary: On February 1, 2006, the Ministry of Municipal Affairs and Housing released for comment proposed modifications to the proposed Central Pickering Development Plan, (the "Provincial Plan"), prepared under the Ontario Planning and Development Act, 1994 (OPDA). The Province proposes approximately 50 modifications, addressing a range of land use, transportation, population, employment, retail, cultural, natural heritage and implementation matters. Staff agree with the intent of most of the proposed modifications, as similar wording was contained in Amendment 13 and related policy work. Some other minor revisions and additions to the proposed modifications are recommended in Appendices I and II to Report PD 18-06. The most significant concern to the City with the package of modifications is the absence of a commitment from the Minister to address the provision of funding for matters essential to the achievement of a fiscally, socially and environmentally sustainable development. Through a submission by the Chair of the Seaton Net Benefit Committee to the Province, a wide range of matters important to the implementation of Seaton were identified as requiring resolution prior to the approval of the Provincial Plan. It continues to be our position that these matters be resolved prior to the approval of the Development Plan. While a few of the proposed modifications relate to these matters, there is no clear commitment to financial assistance. Since the Province has advised it does not believe the matters must be resolved prior to the approval of the Plan, an alternate approach of integrating the commitment into the Plan is recommended. Section 20 of the OPDA specifies that the Minister of Municipal Affairs and Housing may provide financial assistance to the City (and others) for implementing any policy or program of an approved Development Plan. Although the City continues to oppose the use of the OPDA for the planning of Central Pickering, if a Development Plan is to be approved, it is requested that the Plan be amended to include a policy requiring the Minister to enter into an appropriate Memorandum of Understanding and agreements with the City (and others as necessary) to provide financial assistance to those key matters as outlined in recommendation 2.(a) of Report PD 18-06. Another major concern with the package of proposed modifications is the redesignation of about 135 hectares of Prestige Employment lands for other uses (open space and mixed use/residential), and the failure to address Council's request to require the servicing of the Prestige Employment lands prior to or concurrent with the commencement of any residential development. An `early servicing' policy is necessary to support the City's objective of creating jobs in the first phase of development. Revisions to the proposed modifications to address these concerns are recommended in Appendices I and II. Further, the proposed modifications also do not require the completion of the City's Financial Impact Study prior to development, and download to Pickering the responsibility of providing financial incentives to create higher density and/or affordable housing through reduced or waived development charges, planning application fees, and building permit fees. Revisions to address these concerns are also recommended in the Appendices. Report PD 18-06 February 27, 2006 Subject: Modifications to the Proposed Central Pickering Development Plan Page 4 It is also recommended that Council authorize staff to continue working with Provincial staff to finalize wording of the Provincial Plan and to report back to Council through the Net Benefits Committee. Financial Implications: No direct financial implications in adopting the recommendations of this Report. Background: 1.0 PROPOSED PROVINCIAL PLAN FOR CENTRAL PICKERING 1.1 In July 2005, the Province released its Proposed Central Pickering Development Plan for comment. The Ministry of Municipal Affairs and Housing on July 14, 2005 released the proposed Development Plan. The proposed Provincial Plan envisaged a sustainable, mixed use, transit-supportive urban community of up to 60,000 persons and 30,000 jobs on the Seaton lands, and an agricultural area on the Cherrywood lands, within an extensive natural heritage system throughout both areas. There was no change to the existing Hamlets of Brougham, Green River, Whitevale and Cherrywood. The land use, transportation and neighbourhood schedules from the proposed Provincial Plan are provided as Attachment #1 to this Report. 1.2 Council responded that there was insufficient investigation, survey and consultation on the proposed Development Plan and that the Development Plan should not be pursued until a full environmental assessment was completed. In September 2005, Council advised the Minister of Municipal Affairs and Housing that the proposed Central Pickering Development Plan was unacceptable as there was insufficient investigation, survey and consultation on the proposed Development Plan. Council further requested that if the Minister proceeds to finalize the Development Plan under the OPDA, it should be done through the framework of a full environmental assessment. 1.3 In early February 2006, the Ministry of Municipal Affairs and Housing released proposed modifications to the Central Pickering Development Plan. On February 1, 2006, the Ministry of Municipal Affairs and Housing released proposed modifications to the proposed Development Plan. Written comments on the proposed modifications are to be received by the Ministry by March 3, 2006. Report PD 18-06 February 27, 2006 Subject: Modifications to the Proposed Central Pickering Development Plan Page 5 Approximately 50 modifications are proposed by the Province, which addressed a range of land use, transportation, population, employment, retail, and cultural, natural heritage and implementation matters. Most notable are the modifications proposing a population increase from 60,000 to 70,000 with 35,000 jobs; redesignating employment lands to open space and residential/mixed use; requiring the benefiting landowners to fund all plans/studies; creating a committee to establish sustainable benchmarks to be incorporated into neighbourhood plans; enlarging the hamlet buffer open space for the Hamlet of Whitevale; and establishing additional medium density and high density areas along arterial roads. A summary of the proposed modifications including the revised land use, transportation and neighbourhood schedules are provided as Attachment #2 to this Report. 1.4 Council requested the Minister of Environment to issue a Part II Order (a "bump-up" to an Individual Environmental Assessment) relating to the ORC Class EA Environmental Study Report. Earlier this month, Council requested the Minister of Environment to issue a Part 11 Order (a "bump-up" to an Individual Environmental Assessment) to address the concerns identified in the Dillon Peer Review Report on the ORC Class EA Environmental Study Report. As of the writing of this Report, the City has not received a response to its request. 2.0 DISCUSSION 2.1 Since agreements have not yet been reached between the Province and the City (and others, such as the Region of Durham) addressing such matters as provision of land for municipal facilities and funding for critical infrastructure, it is imperative that such a commitment be included by policy modification to the proposed Provincial Development Plan. On January 25, 2006, the Net Benefit Committee Chair submitted a list of matters to the Ministry of Municipal Affairs and Housing that has been under discussion over the past few months. These matters comprise a number of outstanding vital infrastructure and community needs that must be provided in a timely manner to serve the community. Examples include the widening of Brock Road, provision of interregional road and transit connections including higher order transit, the construction of the Highway 407 interchanges, early servicing of the employment lands, and land for community facilities and services. In response, the Ministry has advised that the resolution of the issues identified in the submission is not a pre-requisite for their completion of the land exchange or approval of the proposed Development Plan (see Letter, Attachment #3). Given the Provincial position to move ahead with its Plan, staff concludes it is unacceptable for the Plan to be approved without containing a policy to address these matters. Report PD 18-06 February 27, 2006 Subject: Modifications to the Proposed Central Pickering Development Plan Page 6 Section 20 of the OPDA allows the Minister of Municipal Affairs and Housing to provide financial assistance to the City in undertaking any policy or program that implements the Plan. Accordingly, staff recommends that a new policy be added to the proposed Central Pickering Development Plan to commit the Province to enter into appropriate agreements with the City of Pickering (and other governments and agencies as necessary) respecting the matters addressed in recommendation 2.(a) to Report PD 18-06. These agreements must be entered into prior to the approval of the first Neighbourhood Plan. 2.2 The proposed modifications not only fail to address Council's request to require the early servicing of the Prestige Employment lands, and decrease the amount of Prestige Employment land by about 135 hectares. No modifications have been made to the Development Plan requiring the provision of water and wastewater services to the employment lands prior to or concurrent with the first phase of residential development. A provision for early servicing of the employment lands was requested by both the City and Region to support an employment objective of creating a balanced live/work relationship in the early stages of neighbourhood development. Accordingly, staff recommends that the proposed Development Plan be modified to specifically require that all employment lands be fully serviced and released for purchase prior to the commencement of any residential development within the first neighbourhood of Seaton. In addition, staff does not support with the conversion of employment lands located northeast of the Hamlet of Green River and south of Highway 407 along the future Brock Road by-pass. This change negatively impacts the job targets planned by the City for the employment lands within Seaton. Additional lands for open space or residential/mixed uses are not required within Seaton. 2.3 The City's Financial Impact Study will need to consider the impact of the proposed 10,000 person population increase on the provision of municipal facilities and services (e.g. recreational facilities, libraries, fire halls, etc.). The City's Financial Impact Study has been delayed for three months to allow the IBI Group to concentrate on the Seaton landowner's initiative to front fund the initial stages of development, particularly in regard to regional services. The completion date for the City's study is expected after the anticipated March 2006 approval of the Development Plan. The analysis will be subject to review by the City and its peer review consultant, C.N. Watson, and will address Pickering's concern that development of Seaton not create a financial burden on the City with respect to the timely provision of municipal facilities, services, and infrastructure. Report PD 18-06 February 27, 2006 Subject: Modifications to the Proposed Central Pickering Development Plan Page 7 The delay will also enable the City to reassess municipal land and facility needs to support a higher population. This information will serve as further input to the City's Study. As the North Pickering Landowner Group (who retained the IBI Group) has indicated that the Study will not be completed until after the approval of the Development Plan, it is necessary that the Province include policies in the Development Plan that provide for the City's financial requirements to be satisfied prior to the approval of the first Neighbourhood Plan. 2.4 The Province has downloaded the responsibility for providing financial incentives for the creation of higher density and/or affordable housing in Seaton to Pickering and Durham Region. The Province is proposing a modification that would have the City and Region provide financial incentives for the creation of higher density and/or affordable housing in Seaton through reduced development charges and building permit and planning approval fees. Staff agrees that financial incentives would assist landowners who are interested in constructing higher density or affordable housing units. However, it is premature to propose that the City provide incentives until new and improved fiscal tools are available to municipalities, as requested by Pickering and other municipalities through the review of the proposed Growth Plan. It is recommended that Council request this policy be deleted as it represents another downloading of Provincial responsibility to the City and Region. 2.5 Most of the proposed modifications to the Central Pickering Development Plan are generally supported. Many of the issues raised by staff and Council on the proposed Development Plan have been addressed through the proposed modifications. In addition, staff met with representatives from the North Pickering Land Exchange Team and appreciated the clarifications provided on the proposed modifications. A copy of staff's detailed comments on the proposed modifications is provided for Council's review and endorsement (see Appendices I and 11). There is general agreement with most of the proposed modifications and, were necessary, minor revisions to the proposed modifications are recommended to provide clarity. Other new or revised modifications not discussed to date in this Report include revisions to: permit a review of the retail floorspace needs and locations through a Retail Market Analysis, to be implemented through the neighbourhood planning process, without amendment to the Provincial Plan; accommodate an expansion to the Brougham Pioneer Christian Cemetery in the Hamlet of Brougham; recognize the City's Whitevale Road Corridor Heritage Conservation Study; and incorporate the Greater Toronto Airports Authority request for a 25 Noise Exposure Forecast contour limit. It is recommended that Council request the Province incorporate the new modifications. Both you and your committee have put considerable thought into the list of items that you are requesting that the Province address in regards to Seaton. Some of these items were identified by you during our meetings late in 2005, and others have since been added. As we have previously acknowledged, the City and the Province share common objectives in seeing Seaton become a model community for natural and cultural heritage protection, sustainability and a balance of employment and population growth. At the time of writing your letter, you did not have the benefit of reviewing the package of proposed modifications to the proposed Central Pickering Development Plan that were released on February 1, 2006. Several of the proposed modifications would, if approved, respond to items identified in your submission, including: • Additional requirements for evaluation of groundwater sensitivity and mitigation measures that would respond to potential development impacts through the use of a three-dimensional modeling evaluation; Additional protection of cultural heritage features, including aboriginal sites; • Policies that speak to the servicing of employment lands early in Seaton's development horizon; o Removal of policies that would allow residential development within the Highway 407 employment lands; • Identification of the potential for locating a college/university campus in Seaton; • A new policy that would strengthen the proposed Plan's commitment to sustainability; and • Clarifying the obligation of benefiting landowners to pay for required studies that facilitate development in Seaton. These proposed amendments would not only address items included in your submission, they also respond to comments received to date during our public consultation process. Of course, as you are aware, public consultation is on-going until March 3, 2006 with respect to she proposed modifications. We would welcome any comments that you may have on the proposed modifications. Further, the ministry's proposed amendments to the Planning Act, which were introduced late last year in Bill 51, would, if passed, also respond to the City's request for additional tools with which to achieve sustainable development in Seaton. The ministry has listened carefully to the City's requests for Seaton and responded. At the same time, we do not feel that the resolution of all of the issues identified in your submission is a pre-requisite for either completion of the land exchange or approval of the proposed Central Pickering Development Plan. As you can appreciate the scope of many items identified in your submission is extensive, especially in terms of financial implications, and covers the mandate of a number of provincial ministries and agencies. Indeed, in some cases, your requests address matters that extend beyond the boundaries of development in Seaton. Accordingly, arriving at a provincial position on all of the items will require time to discuss with these ministries and agencies. Until those discussions proceed to a point where the government has a position on individual items, it would appear to be premature for us to meet. I think it also worth noting that as it relates to Seaton, the Province has taken the position that growt'.'n should pay its fair share. As you know, the Development Charges Act, 1997 provides the legal framework for funding the capital costs associated with new growth. This ministry, as always, wants to work co-operatively with the City to ensure that development in Seaton meets all of our shared objectives. We will continue to facilitate a discussion with provincial officials and others, both during the completion of work on the proposed Central Pickering Development Plan and afterwards.
