Public Alerting
- Installation of Sirens and Related Matters

That Report CAO 12-05, concerning the installation of public
alerting sirens and related matters be received; and
That the Commissioner of Emergency Management Ontario
and the Region of Durham be advised that the City agrees
with the Commissioner's proposal to have four sirens installed
in the Pickering Contiguous Zone and to conduct an
evaluation of their effectiveness as outlined in the
Commissioner's letter to Mayor Ryan dated September 13,
2005; and
That the Region of Durham be requested to commence the
process of installing the four siren design in the Pickering
Contiguous Zone, as recommended by DPRA/Aercoustics,
including detailed survey work, and that staff be authorized to
grant municipal consent where required; and
That the Province be requested to deal with the remaining
nuclear public alerting issues (i.e. indoor public alerting and
alerting within the 3-10 km area) only in the context of a
comprehensive, community-wide public alerting system that
addresses all types of potential community emergencies, and
that staff be directed to work on this basis only with the
Province and the Region on these issues; and
That staff be authorized to request reimbursement from the
Province and/or the Ontario Power Generation for the
DPRA/Aercoustics re-design consulting costs that the City
incurred; and
That a copy of this Report and Resolutions be forwarded to
the Province of Ontario, Region of Durham, M.P. Dan
McTeague, M.P. Mark Holland, M.P.P. Wayne Arthurs, and
the Ontario Power Generation.

That Pickering Council RECEIVE Addendum to Report PD 37-05 relating to
an amendment to the existing zoning on subject lands to permit a variety of
office and commercial uses, on lands being North Part of Lot 29, Range 3,
B.F.C. (40R-23222, Parts 1 & 2), in the City of Pickering.
That the additional provisions affecting adjacent westerly lands are technical
and minor in nature and do not affect the general intent and purpose of
Zoning By-law Amendment Application A 8/05 therefore, NO FURTHER
NOTICE is required to be given with respect to this application, in the City of
Pickering.
That Zoning By-law Amendment Application A 8/05, be, APPROVED as set
out in the draft by-law attached as Appendix I to Addendum to Report PD 37-
05, to amend the existing zoning on the subject lands to permit a variety of
office and commercial uses, on lands being North Part of Lot 29, Range 3,

provide professional engineering services for the development of a Frenchman's
Bay Stormwater Management Master Plan; and
That staff, in conjunction with the Toronto and Region Conservation Authority be
authorized to short-list up to four (4) of the highest scoring firms on the EOI and
issue a detailed Request for Proposal document; and

Region Conservation Authority for retaining the firm of Gartner Lee Limited for
project management services for the Frenchman's Bay Stormwater Management
Master Plan, at a cost to the City not to exceed $15,000; and
That a Steering Committee be assembled to guide the process, and provide input
into the direction of the Master Plan, whose membership shall consist of City
staff, TRCA staff, one member from the Waterfront Coordinating Committee,
external agencies and a resident of the City of Pickering; and
That appropriate officials of the City of Pickering be given authority to give effect
thereto.

South Asia Earthquake
Donation to Canadian Red Cross
Moved by Councillor Dickerson

WHEREAS, an enormous earthquake has struck South Asia and has
resulted in untold thousands of lives lost and million more left homeless;
WHEREAS, this has occurred in an area of the world where, by Canadian
standards, poverty and desperation are the norm;
WHEREAS, the Federal Government has today (Oct. 11/05) announced
that any relief funds donated to, amongst others, the Canadian Red Cross
- South Asia Fund will be matched by the Federal Government if received
by such authorized agency within fourteen days;
WHEREAS, the City of Pickering has demonstrated on many occasions its
generosity, on behalf of all residents, to assist financially and otherwise,
those people, whether in Canada or abroad, who have experienced
disaster but are least able to recover;

BE IT THEREFORE RESOLVED, that the City of Pickering commits the
sum of $5,000.00 to be donated to the Canadian Red Cross - South Asian
Fund and that such amount be matched with contributing Federal dollars
and that these monies be over and above the $20,000,000 already
announced and committed by the Federal Government; and,
BE IT FURTHER RESOLVED, that the Council of the City of Pickering
hereby extends its most heartfelt condolences to the Governments of
Pakistan and India, to their citizens who have lost loved ones and homes,
and to their many friends and relatives, and our fi'iends and residents,
living here in Pickering.

Councillor Brenner requested that the City Clerk bring forward a report
requesting that the Regional Municipality of Durham appoint City of
Pickering By-law Enforcement Officers to enforce the Regional Smoking
By-law within the City limits of Pickering in relation to the taxicab industry.
Councillor Pickles confirmed the receipt of a petition from the residents of
Buckingham Gates with regards to restricting construction traffic to
Southcott Road. Councillor Pickles noted that the problem was being
investigated and a response would be issued to Buckingham Gates
residents shortly from City staff.
Councillor Dickerson requested that the City Clerk investigate the
procedure for putting a question on the ballot for the 2006 Elections with
regards to the direct election of the Regional Chair, of the Regional
Municipality of Durham's as per the action recently taken by the City of
Pickering.

Executive Summary: It has been determined that the subject lands are no longer
required by the City. In accordance with the Municipal Act, 2001 and the City's

lands surplus to the needs of the Corporation for the purpose of sale to the adjacent
owner.

Background: On March 7, 2003, 1441483 Ontario Inc. entered into an agreement
with the City for the construction of a portion of Helm Street and a turning circle.
Provisions of that Agreement required 1441483 Ontario Inc. to convey certain lands to
the City for turning circle purposes until such time as the lands to the south were
developed. Those lands were conveyed to the City and subsequently dedicated as
public highway by By-law 6156/03.
As Helm Street has now been extended southerly, the turning circle is no longer
required. Accordingly, a by-law should be enacted to:
(a)
stop-up and close that part of Lot 5, RCP No. 819, Pickering, being Part 2, Plan
40R-21838 as public highway;
(b)
declare that part of Lot 5, RCP No. 819, Pickering, being Part 2, Plan
40R-21838 surplus to the needs of the Corporation for the purpose of sale by
the Corporation; and
(c)
authorize the Mayor, City Clerk, Director, Planning & Development and the City
Solicitor to obtain all relevant documentation and execute all documentation
required to effect the sale of that part of Lot 5, RCP No. 819, Pickering, being

REPORT
THE CORPORATION OF THE CITY OF PICKERING
BY-LAW NO.
Being a by-law to stop-up and close that part of Lot 5,
RCP No. 819, Pickering, being Part 2, Plan
40R-21838 as public highway and authorize the sale
of the land as it is no longer required for municipal
purposes.
WHEREAS the portion of Helm Street being that part of Lot 5, RCP No. 819, Pickering,
designated as Part 2, Plan 40R-21838 was dedicated as public highway by By-law 6156/03;
and
WHEREAS, pursuant to the Municipal Act, the Council of the City may pass by-laws to stop-up
and close a highway, or part thereof, and to authorize its sale or the sale of a part thereof; and
WHEREAS, Notice of this by-law has been published for two (2) consecutive weeks and the
provisions of the Municipal Act, the Sale of Surplus Land Policy and the City's Notice By-Law
relating to the stopping-up and closing of a highway have been complied with.
NOW THEREFORE, the Council of The Corporation of the City of Pickering HEREBY
ENACTS AS FOLLOWS:
1. The following portior.q of highway is hereby stopped-up and closed to both vehicular and
pedestrian traffic:
· that part of Lot 5, RCP No. 819, Pickering, being Part 2, Plan 40R-21838.
That part of Lot 5, RCP No. 819, Pickering, being Part 2, Plan 40R-21838 is hereby
deemed surplus to the needs of the Corporation and shall therefore be offered for sale to
the adjacent owner, for nominal consideration, subject to any required easements.
The Corporation of the City of Pickering shall ensure that all utility easements over any of
the lands described herein are conveyed to the appropriate utility authority for nominal
consideration ($2.00).
The Mayor, Clerk, Director, Planning & Development and City Solicitor are authorized to
obtain all relevant documentation necessary and execute all documentation required to
effect the stopping-up and closing of that part of Lot 5, RCP No. 819, Pickering, being
Part 2, Plan 40R-21838 and to effect the conveyance of it.
BY-LAW read a first, second and third time and finally passed this 7th day of Novermber, 2005.

That the request of Ronald Hinchliffe to change the name of a portion of Old Brock
Road to Jenash Court, be denied.
Executive Summary: On June 6, 2005, Council provided direction to staff through
Resolution #88/05, Item #4 to commence preliminary initiatives to change the name of
a portion of Old Brock Road to Jenash Court and report back to Council following
contact with the affected residents. Staff have contacted the seven landowners that
would be affected by this change and they have responded unanimously in objection to
the street name change.

commence preliminary initiatives to change the name of a portion of Old Brock Road to

In accordance with Council's directive, letters were sent to the seven landowners
fronting the subject portion of Old Brock Road that would be impacted by the name
change (see Sample Letter, Attachment #4).
Responses have now been received from all seven owners. Four owners are not
opposed to changing the name of this portion of Old Brock Road, however all seven are
opposed to the name "Jenash Court" (see Landowner Responses, Attachment #5).
Accordingly, based on the responses from the affected landowners, it is recommended
that R. Hinchliffe's request to change the name of a portion of Old Brock Road to
Jenash Court be denied.

Executive Summary: In 1986, Ronald Hinchliffe obtained consent for the

of Old Brock Road fronting the newly created lots.

Background: In 1986, Ronald Hinchliffe obtained consent for the development of
five lots fronting Old Brock Road in Claremont. One of the conditions of that severance
was that he enter into an appropriate Development Agreement with the City respecting
the upgrading, to municipal standards, of the portion of Old Brock Road fronting the
newly created lots.
Upon completing the road, R. Hinchliffe requested that the City initiate the process to
change the name of that portion of Old Brock Road to Jenash Court (which name
reflects a combination of his daughters' names, Jennifer and Ashley) and while there is
evidence in CitY records that his request was received, the matter has never been
considered by Council.
R. Hinchliffe has once again contacted the City requesting that this matter be pursued.
His request has been circulated internally and to the Region and while there were no
objections to the concept of changing the name, it was noted that the City's present
practice does not support the use of 'proper names' for streets, unless they are of
demonstrated historical significance.
Should Council wish to 'further pursue renaming this portion of Old Brock Road to
Jenash Court, staff would then contact the five residents affected by the name change
advising them of the City's potential intent to enact a by-law to rename the road fronting
their property to Jenash Court (see Attachment #1 - Location Map). That
correspondence would also advise each resident that the City would contribute up to
$100.00 toward any expenses they may incur due to their municipal address changing
(i.e. new home numbers, changing information on personal documentation, driver's
licence, etc.). Staff would report back to Council with the results of our resident contact
and seek direction respecting the enactment of the necessary by-law to formally change
the name of this portion of Old Brock Road to Jenash Court.
It should also be noted that in order to finalize this matter, a reference plan will be
required to legally describe the boundaries of the portion of road that will be subject of
the name change and new signage will be required once the name change by-law has
been registered. The cost for preparation and registration of the reference plan is
approximately $2,000.00. Other costs to implement the street name change are
estimated at $800.00, which includes the new street name signage and address
change expenses incurred by residents. This brings the total costs for this initiative to
the City of approximately $2,800.00.
Accordingly, staff is seeking direction as to whether or not Council wishes to pursue
changing the name of the portion of Old Brock Road identified on the location map
attached hereto. Should Council concur, staff is requesting that Council pass a
Resolution authorizing the Director, Planning & Development to commence preliminary
initiatives to have the subject portion of Old Brock Road renamed to Jenash Court and
to report back to Council following contact with affected residents.

In 1986/1987 the road fronting your property was constructed to municipal standards
pursuant to a Development Agreement between the City of Pickering and Ron Hinchliffe.
Shortly thereafter, there was a request made of the City to rename_ the newly
cohstructed portion of Old Brock Road to Jenash Court and while the concept of this
name. change has been contemplated throughout the years, the request has never
formally been dealt with.
OnMay 24, 2005, this matter was brought before City Council for consideration. At that
meeting staff was directed to:
(a) commence preliminary initiatives to change the 'name of the portion of Old Brock
Road fronting your property to Jenash Court; and
(b) report back to them following contact with the residents.
Accordingly, we are asking that you advise us of your position in this matter by filling out
the attached form and returning it to us, in the envelope provided, on or before July 4,
2005.

Should there be no objection to the City changing the name of the portion of Old Brock

Your new address would be 4830 Jenash Court.
Further, the City is aware that certain personal documentation may have to be changed
to reflect your new address. The City is prepared to reimburse you for any reasonable
expenses you may incur as a result of this name change, up to a maximumof $100.00,

My wife and I object to the City's proposal as presented. We offer the following
comments and suggestions in response to your correspondence dated June 17, 2005:
We believe the name "Jenash Court" (the proposed street name), is a derivative of
the names of a couple of the developer's family members (Jennifer and Ashley).
The developer sold all of his interests on this street back in the late 1980's. At
this point, the suggested name has no relevance to any current property owner. A
more neutral name, in keeping with the natural surroundings and character of the
street and the community in general would be more appropriate, several suggested
alternatives being: Willow Court, Arbour Court or Moraine Court.
Since this portion of roadway is in fact the original Old Brock Rd. (pre-dating the
Claremont by-pass and the current south entrance into Claremont, a number of
residents along this portion of roadway continue to receive their mail via Rural
Route 5, Canada Post mailbox delivery service. It is imperative that the City
ensure that any renaming of the road does not disqualify the rural route mailbox
delivery privileges currently enjoyed by these residents. The mailboxes in
question are located at the southeast comer of Old Brock Rd. and Old Brock Rd.
(the currently posted street signage).
If the above concerns cannot bc satisfied, then we would respectfully suggest that
the newer portion of roadway (co,meeting the Claremont by-pass to the original
Old Brock Rd., be the section of roadway that is renamed.

Executive Summary:
As result of a meeting with the Commissioner of Emergency Management, the Mayor
has received a letter from the Commissioner asking the City to agree to the installation
of four outdoor alerting sirens in accordance with the design that was developed for the
City by DPRA/Aercoustics. The Commissioner also included in his letter a
commitment to revisiting the issues surrounding indoor public alerting in the Contiguous
Zone and the expansion of the system into the Primary Zone (3-10 km).
It is recommended that Council concur with the Commissioner's proposal, and request
the Region of Durham to initiate the installation process for four sirens. As well, it is
recommended that the Province be requested to deal with the remaining nuclear public
alerting issues (indoor public alerting and alerting within the 3-10 km area) only in the
context of a community-wide public alerting system that addresses all types of potential
community emergencies, and that staff be directed to work on these issues with the
Province and Region only within this context. In addition, Council's direction is sought
to request reimbursement from the Province and/or OPG for the consulting costs
incurred by the City in using DPRA/Aercoustics siren re-design study.
Financial Implications:
Should Council concur, staff will seek reimbursement from the Province and/or OPG for
consulting costs associated with DPRA/Aercoustics redesign study. These costs
totalled $23,965.52.
The City would not incur any costs, other than staff time, in relation to the installation of
the four sirens.
Background:
On September 1, 2005 the Commissioner of Emergency Management, Julian Fantino,
met with the Mayor, four councillors, the CAO, and the Community Emergency
Management Coordinator primarily to discuss nuclear public alerting in the Pickering
Contiguous Zone. During the meeting, the Commissioner proposed that the four sirens
proposed by the Pickering DPRA/Aercoustics re-design study be installed and
subsequently evaluated to determine their effectiveness in meeting the Provincial
nuclear emergency public alerting requirements. In discussions on the matter, the CAO
reminded the Commissioner that the Region of Durham was designated as the public
alerting project manager and therefore if the four siren design were to be used, the
Region would be responsible for the siren installations and evaluations.

In a letter dated September 13, 2005 and addressed to Mayor Ryan, the Commissioner
of Emergency Management formalized his position on public alerting and in particular
the idea of proceeding with the four siren design (see Attachment 1).
On October 5, 2005, Gary Cubitt, the Regional CAO wrote to the Commissioner of
Emergency Management to clarify that the Region was responsible for the public
alerting project and requesting clarification on the Commissioner's position (see
Attachment 2). In his letter, Mr. Cubitt noted that he understood the Province intended
to have a scientific review conducted of the original Regional design for twenty-nine
sirens, and the City's design for four sirens. Mr. Cubitt also noted that the proposal to
install four sirens at this time might pose financial and legal implications for the Region.
The Commissioner's letter to the Mayor also gave a "commitment to revisiting the
technology for the indoor alerting system as well as the criteria that will govern public
alerting for the 3-10 kilometre area." This is welcome news, as the City had previously
raised both of these issues with the Province (and Region) and had suggested that
these issues be dealt with only in the context of a comprehensive, community wide
alerting system. The memorandum to the CAO dated September 27, 2005 from the
Community Emergency Management Coordinator (CEMC) provides a comparative
analysis of various community public alerting system options, and can be used as a
basis for future discussions with the Province and Region in this regard (see
Attachment 3 - previously distributed at the October 3, 2005 Management Forum
Meeting).
Accordingly, it is recommended that Council request that the Province deal with the
indoor public alerting issue, and the issue of nuclear alerting within the 3-10 km area,
only in the context of a comprehensive, community-wide public alerting system that
addresses all types of potential community emergencies, and that staff be directed to
work with the Province and Region on these issues only within this context.

I am glad we had the opportunity to meet on September 1, 2005 to discuss and move
forward the issues of public education and public alerting for your City.
To reiterate our agreement on that date, you will move ahead with the installation of 4
sirens as per the Aerocoustics Engineering Ltd. and DPRA study commissioned by the
City of Pickering. The installation will be followed by a period of testing and then, of
mutual evaluation. The aim of the evaluation will be to determine if the system meets
the (outdoor) public alerting criteria as laid out in the Province of Ontario Nuclear
Emergency Plan. I envisage the evaluation team as consisting of representatives from
the City of Pickering, the Region of Durham, Ontario Power Generation and Emergency
Management Ontario.
Further, I committed to revisiting the technology for the indoor alerting system as well as
the criteria that will govern public alerting for the 3-10 kilometre area.
I understand your Council will consider this agreement at their meeting on September
19, 2005. I look forward to your Council's resolution on this matter so that we may
begin to move ahead on further enhancing the safety of the citizens of the City of
Pickering.

Thank you for a copy of your letter to the Mayor of the .City of Picketing
dated September 13, 2005
As ~ou are aware, Durham Region is a "designated municipality" under
the Provincial Nuclear Emergency Plan (PNEP) (March 1999), a
Provincial plan that is legislated under the Emergency Management Act.
The PNEP directs Durham Region to establish and maintain a public
alerting system in the Contiguous (3 km) Zones that meets the Provincial
standard;
The public alerting project in Durham Region is directed by a Steering
Committee consisting of the Chief Adm nistrat ve Officers of the Region
and affeCted iakeShore communities (Pickering,.Ajax', Wh tby., Oshawa, '
Clarington), as well as the Chief, Emergency Management Ontario and a
senior executive of Ontario POwer Generation. A qualified design
consultant was selected and the 'subsequent alerting design was
endorsed by Regional Council and the Councils of the lakeshore
municipalities. An-RFP process was initiated for the equipment and
installation'. A contract was signed in October 2003 and equipment was
purchased.
In July 2004. the City of Pickering's Council passed a resolution
requesting that the original design, consultant undertake a review of the
alerting SYstem in Pickering. This review was not completed as a peer
.review consultant retained by the City produced an alternate design with
substantially fewer sirens

The original design included 29 outdoor sirens for the Pickering 3 km
zone. while the May 2005 design by the consultant retained by the City
indicates that only 4 of the same s~rens are required.
Due to this disparity, I wrote to Nell McKerrell on June 10th asking that
the Province review the two designs to determine which meets the
requirements of the Provincial standard. On. June 15th, Mr. McKerrell
confirmed by letter (attached) the intention of Emergency Management
Ontario to initiate a scientific review of the two reports and
subsequently, provide advice as to an acceptable model:
Although it is. acknowledged your letter addresses an agreement with the
City of Pickering, and makes no commitment for the Region of'Durham,
we remain, nonetheless, concerned that action taken' by the Prownce
and the City of Picketing may have significant financial and lega~l
implications for the Region..

confirm our understanding regarding the commitment of the Province to
initiate a scientific review of the.two outdoor siren designs for compliance

During the summer I conducted a review of public alerting systems to examine the
various options that are currently available. Attached is a table that summarizes the
options and evaluates some aspects of each system.
In summary, it appears that to meet the outdoor aspect of the Ontario public alerting
requirements, which is contained in the Provincial Nuclear Emergency Plan, there is no
alternative to the use of sirens. However, there exist a variety of options for indoor
alerting as an alternative to the Region's proposed indoor tone alert devices. Those
options could complement the use of sirens so as to establish a system that provides
community-wide public alerting for all types of emergencies instead of just nuclear
events.
The Ontario nuclear public alerting requirements are very specific in terms of the
percentage of the population that must be alerted, the time of alerting, and the location
of the people that must be notified. The requirements are consistent with the standards
for public alerting in the United States and other nuclear host countries. I also have
learned that only sirens have been used to meet the outdoor alerting requirements in
those other jurisdictions.
The following is the current public alerting wording that has appeared in the Provincial
Nuclear Emergency Plan since 1997; note that the requirements are only provincial
policy and not law:
The nuclear installations at Pickering / Darlington shall provide the resources and
assistance to their designated municipafities to enable them to establish a pubfic
alerting system in their Primary Zones.

The public alerting system in the Contiguous Zone (0-3 km) must provide, within
15 minutes of initiation, waming to practically 100% of the people in the
Contiguous Zone at that time, whether they are indoors or outdoors, and
irrespective of the time of day or year.
As part of my recent review, I was asked to investigate a system known as Wireless
Audio Visual Emergency System (WAVES), which was promoted by its supplier as an
alternative to the Region's proposed siren system. My research has revealed that
WAVES includes the use of large sirens like the ones that the Region currently owns -
in fact WAVES has been installed in several locations in the USA using the same
model of ATI sirens that the Region of Durham purchased. WAVES also operates
using additional smaller sirens, strobe lights, and other devices that compliment the
large sirens. The president of the company that sell WAVES informed me that an area
the size of the Pickering Contiguous Zone would require at least the number of sirens
that were originally planned for Pickering, plus in his opinion, smaller sirens that could
number in the dozens, as well as strategically placed strobe lights throughout the
community.
WAVES has one notable advantage over the Region's proposed system in that it uses
a more sophisticated two-way radio system for activating the sirens. WAVES' high
frequency scrambled radio signals are used to prevent false sounding of the sirens by
would-be hackers. I did not receive a cost estimate for WAVES, but the person that I
spoke to indicated that the Region's existing sirens could be used to augment the
required additional equipment.
I also learned that WAVES has never been installed for use in community public
alerting. The systems were designed and installed at institutional settings such a
military bases and industrial complexes like oil refineries.
During the past four months I have also been working as a member of a national
committee that is developing guidelines for public alerting systems in Canada. These
activities have enhanced the work that I have been conducting for Pickering and have
confirmed to me that a combination of systems, including the four siren arrangements
that our consultants have designed, would not only meet the Ontario nuclear public
alerting requirements, but would establish a comprehensive community-wide system for
all types of emergencies. In addition, such a system would meet the future national
standard for public alerting.
Based on what I have learned from my review and participation in developing a set of
national public alerting guidelines, I am now convinced that a combination of
technologies are needed to effectively alert citizens of a community emergency,
including nuclear events. Even though the use of sirens for outdoor alerting is a
standard practise throughout the world for nuclear emergency alerting, I am not
convinced that such a single method is the best option of choice.

However, as long as the Provincial Nuclear Emergency Plan stipulates that outdoor
alerting is required, it seems that there is no choice but to accept that sirens will be the
primary component of a public alerting system for the Pickering Nuclear Contiguous
Zone.

Being a by-law to appoint By-law Enforcement Officers for certain
Purposes (Parking Regulation-1355 Kingston and 1822 Whites

WHEREAS pursuant to section 15(I) of the Police Services Act, R.S.O. 1990, c.P.15, as
amended, a municipal council may appoint persons to enforce the by-laws of the
municipality; and
WHEREAS pursuant to section 15(2) of the said Act, municipal by-law enforcement
officers are peace officers for the purpose of enforcing municipal by-laws;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF
