ADOPTION OF MINUTES
MOTION' Moved by Bill Utton, seconded by Marie Billinger
That the minutes of the 3rd meeting of the Committee of Adjustment held
Wednesday, March 2, 2005, be adopted as amended.

City of Pickering
The applicant requests relief from the following provisions of Zoning By-law 3036,
as amended by By-law 1894/84:
To permit a minimum rear yard depth of 4.0 metres, a minimum south side yard
width of 0.5 metres and a maximum lot coverage of 49 percent, whereas the
by-law requires a minimum rear yard depth of 7.5 metres, a minimum side yard
width of 1.2 metres and a maximum lot coverage of 40 percent.
The applicant requests approval of these variances in order to obtain a building
permit for a proposed addition attached to the rear of the dwelling.
The Secretary-Treasurer outlined comments received from the City of Pickering
Planning & Development Department. Written comments were also received
from the City's Development Control Supervisor and the City's Fire Prevention
Officer, both expressing no concerns.
Chris Braney noted that he has had previous professional dealings with the
owner but does not have a conflict of interest. The applicant responded that he
did not have a problem with Chris Braney taking part in the final decision.
Kim Brown, agent from Patio Enclosures Inc., was present to represent the
application. Jan McKay and Don Voorhees, the owners were present in the
favour of the application.
Kim Brown noted the proposed addition is to extend the owners living space
without having to relocate.
Jan McKay noted she has severe arthritis and would like the room to
accommodate her needs.
Kim Brown stated that she wants to do everything she can to accommodate her
clients and asked if they could have time to review the height and size of the
structure with City staff.
Ross Pym, in response to questions, explained staff could provide guidance
however, staff only gives recommendations on the variances and the Committee
will be making the decision. Upon site inspection, from the rear of the property,
Ross Pym observed that the addition would be located on an existing elevated
deck.
MOTION: Moved by Bill Utton, seconded by David Johnson
That application P/CA 10/05 by J. McKay & D. Voorhees, be TABLED until the
next Committee of Adjustment meeting being held on April 13, 2005, to allow the
applicant time to review their design.

The applicant requests relief from the following provisions of Zoning By-law
3036:
To permit a minimum side yard width of 1.8 metres and maximum lot coverage
of 13 percent, whereas the by-law requires a minimum side yard width of
3.0 metres and maximum lot coverage of 10 percent.
The applicant requests approval of these variances in order to obtain a building
permit for a proposed addition attached to the east side of the dwelling.
The Secretary-Treasurer outlined comments received from the City of Pickering
Planning & Development Department. Written comments were also received
from the City's Development Control Supervisor and the City's Fire Prevention
Officer, both expressing no concerns.
Peter Barton, agent, was present to represent the application. Boyd and Nancy
Penny, the owners, were present in support of the application.
Peter Barton noted the owners have an 18-year-old son with cerebral palsy and
the addition is being constructed to better suit his needs.
MOTION: Moved by Bill Utton, seconded by Marie Billinger
That application P/CA 11/05 by Boyd & Nancy Penny, be APPROVED on the
grounds that the proposed minimum 1.8 metre side yard width and the proposed
maximum lot coverage of 13 percent are minor variances that are desirable for
the appropriate development of the land, and in keeping with the general intent
and purpose of the Official Plan and the Zoning By-law, subject to the following
conditions:
That these variances apply only to the proposed addition attached to the east
side of the dwelling, as generally sited and outlined on the applicant's
submitted plans with this application.
That the applicant obtain a building permit and construct the proposed
addition within two years of the date of this decision, or this decision shall
become null and void.
