MATTERS ARISING FROM THE MINUTES
There were no matters arising from the minutes.
ADOPTION OF MINUTES

That the minutes of the 2nd meeting of the Committee of Adjustment held
Wednesday, February 9, 2005, be adopted as amended.

(Lot 13, Plan 40M1987)
City of Pickering
The applicant requests relief from the following provisions of Zoning By-law
3036, as amended by By-law 5575/99:
To permit a minimum rear yard depth of 6.8 metres and a maximum lot coverage of
45 percent, whereas the by-law requires a minimum rear yard depth of 7.5 metres
and a maximum lot coverage of 38 percent.
The applicant requests approval of these variances in order to obtain a building
permit for an existing addition attached to the rear of the dwelling.
The Secretary-Treasurer outlined comments received from the City of Pickering
Planning & Development Department. Written comments were received from
the City's Development Control Supervisor and the City's Fire Prevention Officer,
both expressing no concerns. Written comments were also received from
Elizabeth & John Potts of 877 Voyager Avenue, lan & Leslie McCullough of 1787
Helm Street and Ginger & lain Bowman of 1789 Helm Street in objection to the
application.
Paul Gomes, owner was present to represent the application. Kiro Gudov, of 881
Voyager Avenue was present in favour of the application.
Paul Gomes explained that the brick fireplace being used in the addition is a
barbeque and he is aware the chimney needs to be raised from its current
height. In response to questions from the Committee Paul Gomes indicated he
started to build in the fall and is looking at a couple of months until completion,
he was not aware that a building permit was needed for the structure.
Kiro Gudov stated he supports his neighbour and the addition looks great.
The correspondence from Elizabeth & John Potts indicated; the size of the
extension is out of balance; materials being used to construct do not fit in with
the style of the home and with the surrounding homes; concerns with fire and
safety with respect to a fire pit within the existing structure; and that the
extension was built without planning permission.
The correspondence from lan & Leslie McCullough indicated; concern with how
the structure will maintain the integrity of the rear streetscape where visible from
Helm Street; how will the requirements of the Ontario Building Code be met
considering the flat roof is without a railing; and concerned with the structure
being a fire hazard because it appears they have a wood burning fireplace within
the structure.

The correspondence from Ginger & lain Bowman indicated; a need to improve
the visual appearance of the addition to have it consistent with the surrounding
homes; concern whether the structure meets building code; and concern with the
structure being a fire hazard because it appears to have a wood burning stove or
chimney of some sort within the structure.
MOTION: Moved by David Johnson, seconded by Bill Utton
That application P/CA 08/05 by Paulo Gomes, be TABLED in order to give the
members an opportunity to visit the site, and no date was provided as to when
the application will be heard by the committee.

The applicant requests relief from the following provision of Zoning By-law 3037:
To permit a minimum lot frontage of 66 metres, whereas the by-law requires a
minimum lot frontage of 80 metres.
The applicant requests approval of this variance in order to facilitate an
associated land severance application.
The Secretary-Treasurer outlined comments received from the City of Pickering
Planning & Development Department. Written comments were also received
from the City's Development Control Supervisor and the City's Fire Prevention
Officer, both expressing no concerns.
Alex Artuchov, agent was present to represent the application. William Brown,
owner was also present in favour of the application.
Alex Artuchov noted they are satisfied with the recommendations that the
Planning & Development have provided for this application. He also presented a
letter to the committee from Robert Seiler of Salem Road noting that he is in
favour of the application.
The correspondence from Robert Seiler states that he has confidence the
proposed development will be conducted in a responsible manner and that he
and his wife whole-heartedly support the application.

MOTION' Moved by Bill Utton, seconded by Marie Billinger
That application P/CA 09/05 by William Brown, be APPROVED on the grounds
that the proposed minimum lot frontage of 66 metres is a minor variance that is
desirable for the appropriate development of the land, and in keeping with the
general intent and purpose of the Official Plan and the Zoning By-law, subject to
the following conditions:
1. That this variance apply only to the proposed lot as generally sited and
outlined on the applicant's submitted plans with this application.
That the applicant finalizes land division applications LD 220/04 and LD 221/04
for the proposed lot within one year of the date of this decision, or this
decision shall become null and void.
