J. Quinn - Chief Administrative Officer (Medical Leave) INVOCATION Mayor Ryan called the meeting to order and led Council in the saying of the Invocation. (11) ADOPTION OF MINUTES Regular Meeting of March 7, 2005 Special Meeting of February 28, 2005 Special Meeting of March 11, 2005 -1- PICKEI G Council Meeting Minutes Monday, March 21, 2005 7:40 PM (111) DELEGATIONS John Byberg, 2450 Conc. 6, Greenwood, requested Council to reconsider the approval of his request to place a sign on the property of Mr. Lee, which is located at Hwy. 7, north of Concession 6 to advertise his fine dining Pepperberry Bistro in Brooklin. He advised that the Ministry of Transportation have no concerns and that the sign would be maintained. Mayor Ryan rose on a point of personal privilege to respond to comments made at the Special Council Meeting of March 11, 2005. Resolution #49/05 Moved by Councillor Dickerson Seconded by Councillor McLean That the rules of procedure set out in By-law 3665/91 be suspended in order to debate the comments made by Mayor Ryan. CARRIED (IV) RESOLUTIONS Resolution #50105 Moved by Councillor Ashe Seconded by Councillor Brenner 1. That Report PD 11-05 regarding the final assumption of plans of subdivision M- 1154, 40M-1273, 40M-1303 and 40M-1320 be received; and 2. That the following by-laws be enacted: a) assume roads and services within Plans M-1154, 40M-1273, 40M-1303 and 40M-1320; and b) amend By-law 1416/82 (Places of Amusement) to include the roads within Plans 40M-1273 and 40M-1320; and 2 Council Meeting Minutes Monday, March 21, 2005 7:40 PM c) authorize the release and removal of the Subdivision Agreements from title relating to Plans 40M-1154, 40M-1273, 40M-1303 and 40M-1320. CARRIED Resolution #51105 Moved by Councillor McLean Seconded by Councillor Johnson 1. That Report OES 07-05 regarding a proposed amendment of the parking By-law 2359/87, be received; and That the attached draft by-law be enacted to amend Schedule 'A' to By-law 2359/87 to provide for the regulating of parking, standing, and stopping on highways or parts of highways under the jurisdiction of The Corporation of the City of Pickering and on private and municipal property. CARRIED Resolution #52/05 Moved by Councillor Dickerson Seconded by Councillor McLean That Report CS 21-05 respecting the appointment of Special Municipal Law Enforcement Officers for the purpose of enforcing the Parking By-law on private property, be received; and That the draft by-law to appoint persons to enforce the Parking By-law at 1822 Whites Road, 1100 Begley Street, 650, 705 and 1865 Kingston Road, 1400, 1410 and 1420 Bayly Street, 1915 Denmar Road, be forwarded to Council for approval; and 3. That the appropriate officials of the City of Pickering be authorized to take the necessary actions to give effect thereto. That Report to Council CS 25-05 regarding nominations for appointment to the York Region South-east Collector Advisory Committee be received; and That Les Fisher, David Steele and Ralph Sutton be nominated for appointment to the York Region South-east Collector Advisory Committee; and That the appropriate officials of the City of Pickering be authorized to take the necessary actions to give effect thereto. CARRIED -4- Council Meeting Minutes Monday, March 21, 2005 7:40 PM Resolution #54105 Moved by Councillor Johnson Seconded by Councillor Brenner That Mayor Ryan be authorized to make the following proclamations: "Day of Mourning" - April 28, 2005 - to recognize persons killed or injured in the workplace. CARRIED Resolution #55105 Moved by Councillor Dickerson Seconded by Councillor Brenner WHEREAS the residents and businesses of the City of Pickering rely on the professionalism and dedication of the City's Firefighters to prevent and suppress fires in houses, businesses and property, to take whatever action is necessary to save the lives of persons caught in a fire or other disaster and to become involved with the community in educating residents in fire prevention techniques; and WHEREAS the Council of the Corporation of the City of Pickering is proud of its Firefighters and recognizes the danger they face every time they respond to an alarm; and WHEREAS it is expedient to establish a policy to recognize those Firefighters who have been killed on the job or as a result of a job-related injury; and WHEREAS the naming of a street to recognize those Firefighters who have been killed on the job or as a result of a job-related injury would be an appropriate and permanent memorial to those Firefighters; NOW THEREFORE the Council of the Corporation of the City of Pickering hereby establishes a policy of naming streets to recognize those Pickering Fireflghters who have been killed on the job or as a result of a job-related injury; and FURTHER THAT all streets named in honour of those Pickering Firefighters who have been killed on the job or as a result of a job-related injury be identified by displaying an appropriate marker; and 5 PICKEF4NG Council Meeting Minutes Monday, March 21, 2005 7:40 PM FURTHER THAT the Pickering Professional Firefighters Association be invited to assist with the formalization of this policy and the naming of streets. CARRIED Recorded Vote: Yes: Councillors Ashe, Brenner, Dickerson, Johnson, McLean, Pickles and Mayor Ryan Resolution #56/05 Moved by Councillor Brenner Seconded by Councillor Pickles WHEREAS when the Council of The Corporation of the City of Pickering in approving the transfer of the Ajax Pickering Transit Authority (APTA) to the Region of Durham under the terms and conditions put forth by the Region also understood that the transfer of funds in 2005 would be without conditions as in past years; and WHEREAS the Council of the City of Pickering continues in its support of the transfer of the APTA to the Region of Durham and the formation of a regional transit system; and WHEREAS the City of Pickering has in the past, traditionally funded its proportionate share of the net annual operating costs of APTA; in part through the application of the "Go Funds" transferred annually from the Region of Durham; and WHEREAS the Regional Transit Implementation Committee deferred, at its meeting of March 1, 2005; a Motion to restrict the use of these funds to capital purposes only for 2005 to a meeting of the Committee and to a meeting of Regional Council on Wednesday, March 23, 2005; and WHEREAS the Council of the City of Picketing requires unrestricted use of these funds in formulating its own 2005 Current Budget; NOW THEREFORE, be it resolved that the Council of the City of Pickering strongly urges the Council of the Region of Durham to not impose restrictions on the use of transferred funds so as to enable Picketing to continue operating, maintaining and funding APTA as in the past. CARRIED -6- Council Meeting Minutes Monday, March 21, 2005 7:40 PM Recorded Vote: Yes: Councillors Ashe, Brenner, Dickerson, Johnson, McLean, Pickles and Mayor Ryan (V) BY-LAWS That Councillor Johnson, seconded by Councillor McLean, took leave to introduce by- laws of the City of Pickering: By-law Number 6491/05 Being a by-law to appoint By-law Enforcement Officers for certain purposes (Parking Regulation - 1822 Whites Road, 1100 Begley Street, 650 705 and 1865 Kingston Road, 1400, 1410 and 1420 Bayly Street, 1915 Denmar Road.) By-law Number 6492/05 Being a by-law to assume the roads within Plans 40M-1273 and 40M-1320 for public use as public highways and to assume the services within Plans M-1154, 40M-1273, 40M-1303 and 40M-1320 under the jurisdiction of the City of Pickering. By-law Number 6493/05 Being a by-law to amend By-law 1416/82 providing for the regulation and licensing of places of amusement. By-law Number 6494/05 Being a by-law to authorize the release and removal of the Subdivision Agreement and all related amendments from title respecting Plan M-1154, Pickering. By-law Number 6495/05 Being a by-law to authorize the release and removal of the Subdivision Agreement respecting Plan 40M-1273, Pickering, from title. By-law Number 6496/05 Being a by-law to authorize the release and removal of the Subdivision Agreement respecting Plan 40M-1303, Pickering, from title. 7 PICKEI NIG Council Meeting Minutes Monday, March 21, 2005 7:40 PM By-law Number 6497/05 Being a by-law to authorize the release and removal of the Subdivision Agreement respecting Plan 40M-1320, Pickering, from title. By-law Number 6498/05 Being a by-law to amend By-law 2359/87 providing for the regulating of parking, standing and stopping on highways or parts of highways under the jurisdiction of the City of Pickering and on private and municipal property. CARRIED THIRD READING: Councillor Johnson, seconded by Councillor McLean, moved that By-law Numbers 6491/05, 6492/05, 6493/05, 6494/05, 6495/05, 6496/05, 6497/05, and 6498/05, be adopted and the said by-laws be now read a third time and PASSED and that the Mayor and Clerk sign the same and the seal of the Corporation be affixed thereto. CARRIED (VI) 1. OTHER BUSINESS Councillor Brenner questioned the position of the City with respect to the transfer of fill from the Museum by Transport Canada for the properties of demolished homes. Councillor Brenner also inquired into the grading of Conc. 7, west of Brock Road and Sideline 24. He asked if Transport Canada had paid to improve these roads for the moving of the fill. Councillor Brenner requested that Council be informed when Fire Orders are issued. Councillor Brenner reported that the alignment proposed for Whites Road by the Region of Durham and the Seaton Planning Group is contrary to the City's position in the Growth Management Study. Councillor Johnson inquired into the Whites Road alignment. -8- Council Meeting Minutes Monday, March 21, 2005 7:40 PM 10. 11. Councillor Johnson reported that Brampton, the fastest growing municipality, has stopped new development due to affordability. He questioned if a cap should be implemented by the City on the number of homes to be built yearly. He requested a report from staff on sustainability. Councillor Dickerson advised that the 2nd Annual Easter Parade would be held on Saturday, March 26th, hosted by the Ladies Auxiliary of the Royal Canadian Legion Branch 606. Councillor Pickles requested that an invitation be made to the Minister of Heritage to meet with the Pickering Historical Society and Heritage Pickering for a tour of the Federal lands and the proposed homes listed for demolition. He further requested that a letter be forwarded to Transport Canada for an appointment to the local heritage committee. Councillor Pickles stated that a letter was forwarded to Transport Canada and the Greater Toronto Airport Authority requesting funding for a peer review and asked that this letter also be forwarded to the Greater Toronto Airport Authority Board of Directors. Councillor Pickles gave notice of a motion concerning Pawn Brokers. Councillor Pickles asked that we recognized today, March 21st, as International Day for the Elimination of Racial Discrimination. {VII) CONFIRMATION BY-LAW By-law Number 6499~05 Councillor Ashe, seconded by Councillor Johnson, moved for leave to introduce a By- law of the City of Pickering to confirm those proceedings of the Council of The Corporation of the City of Pickering at its Regular Meeting of March 21,2005.
