PRESENT Marie Billinger David Johnson Eric Newton - Chair Bill Utton ALSO PRESENT Ross Pym, Secretary-Treasurer Lesley Dunne, Assistant Secretary-Treasurer Jean Finn, Observer ABSENT: Chris Braney The meeting convened at 7:09 p.m. in the Council Chambers of the Civic Complex. 1. MATTERS ARISING FROM THE MINUTES The Committee discussed amendments to the minutes of November 10, 2004. Ken Koson of 563 Creekview Circle and Michelle Jean of 573 Creekview Circle addressed the Committee to provide clarification on their comments in the minutes for P/CA 55/04. 2. ADOPTION OF MINUTES MOTION: Moved by Bill Utton, seconded by David Johnson That the minutes of the 14th meeting of the Committee of Adjustment held Wednesday, November 10, 2004, be adopted as amended. CARRIED UNANIMOUSLY 3. ADOPTION OF AGENDA MOTION: Moved by Bill Utton, seconded by Marie Billinger That the agenda for the Wednesday, December 1,2004 meeting be adopted. CARRIED UNANIMOUSLY 88 4. ADOPTION OF 2005 MEETING SCHEDULF MOTION: Moved by David Johnson, seconded by Marie Billinger That the Committee of Adjustment Meeting Schedule for 2005 be adopted. CARRIED UNANIMOUSLY P/CA 57/04 - Bon L Canada Inc. 1850 Clements Road (Part of Lot 19 & 20) Plan M-1040, Lot 13,16 City of Pickering The applicant requests relief from the following provisions of Zoning By-law 2511, as amended By-law 0061/74 and By-law 1972/85: Section 5.19(a) to permit the establishment of an accessory building in the east side yard, whereas the by-law requires that all accessory buildings, which are not part of the main building, be erected in the rear yard. The applicant requests approval of this variance in order to obtain a building permit for the proposed accessory building. The Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department. Written comments were also received from the City's Development Control Supervisor and City's Fire Prevention Officer, both expressing no concerns. Additional comments received from Corporate Promotions & Economic Development indicating support for the application. James Parkin, agent, was present to represent the application. No further representation was present in favour of or in objection to the application. MOTION: Moved by Bill Utton, seconded by David Johnson That application P/CA 57/04 by Bon L Canada Inc., be APPROVED on the grounds that the proposed east side yard location of the accessory building to be a minor variance that is desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Official Plan and the Zoning By-law, and therefore recommends approval of the proposed variance, subject to the following conditions: 1. That this variance apply only to the proposed accessory building, as generally sited and outlined on the applicant's submitted plans with this application. That the applicant obtain a building permit and construct the proposed accessory building within two years of the date of this decision, or this decision shall become null and void. CARRIED UNANIMOUSLY 89 P/CA 58/04 - Odyssey (Pickering) Inc. 1795 & 1801 Valley Farm Road (Block 4, Plan 40M-2153) City of Pickering The applicant requests relief from the following: Section 5(2)(iii)A and F of Zoning By-law 3036, as amended by By-law 6119/03, to permit a condominium apartment building having: a 3.0 metre north yard depth and a 2.8 metre west yard depth; a covered entrance feature having a 0.0 metre west yard depth and a 1.5 metre north yard depth; and, a minimum 0.3 metre setback from the north property line to the underground parking structure whereas the by-law requires that buildings and structures shall be located entirely within the building envelope and that below grade parking structures shall be permitted beyond the limits of the building envelope, but no closer than 0.5 metres from the limits of the lands. The applicant requests approval of these variances in order to obtain site plan approval and building permits for a 15 storey condominium building and 6 townhouses. The Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department. Written comments were also received from the City's Development Control Supervisor and City's Fire Prevention Officer, both expressing no concerns. No further MOTION: Moved by Bill Utton, seconded by Marie Billinger That application P/CA 58/04 by Odyssey (Pickering) Inc., be APPROVED on the grounds that the proposed establishment of a 3.0 metre north yard depth and 2.8 metre west yard depth to a portion of the condominium building, a 0.0 metre west yard depth and 1.5 metre north yard depth to the covered entrance feature, and the establishment of a minimum 0.3 metre setback from the north property line to the underground parking structure to be minor variances that are desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Official Plan and the Zoning By-law, and therefore recommends approval of the proposed variances, subject to the following conditions: That these variances apply only to the proposed 15 storey condominium building and 6 townhouses as generally sited and outlined on the applicant's submitted plans with this application. 2. That the applicant obtain site plan approval and building permits within two years of the date of this decision, or this decision shall become null and void. CARRIED UNANIMOUSLY 90 P/CA 59/04 - Coug's (Whites) Limited 761 Sunbird Trail (Plan 40M-2208, Part Block 71,40R-23025, Part 8) City of Pickering The applicant requests relief from Section 5(2)(c)(i) of Zoning By-law 3036, as amended by By-law 6176/03, to permit the establishment of a minimum 4.2 metre front yard depth for a townhouse dwelling unit, whereas the by-law requires a minimum 4.5 metre front yard depth. The applicant requests approval of this variance in order to recognize the townhouse unit on the subject property. The Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department. Written comments were also received from the City's Development Control Supervisor and City's Fire Prevention Officer, both expressing no concerns. Brian Collins, agent, was present to represent the application. No further representation was present in favour of or in objection to the application. MOTION: Moved by David Johnson, seconded by Marie Billinger That application P/CA 59/04 by Coug's (Whites) Limited, be APPROVED on the grounds that the proposed establishment of a minimum 4.2 metre front yard depth for the townhouse dwelling unit to be a minor variance that is desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Official Plan and the Zoning By-law, and therefore recommends approval of the proposed variance. CARRIED UNANIMOUSLY P/CA 60/04 - Coug's (Whites) Limited 737 & 739 Sunbird Trail (Plan 40M-2208, Part Block 72, 40R-23039 Parts 4 & 5) City of Pickering The applicant requests relief from Section 5(2)(c)(i) of Zoning By-law 3036, as amended by By-law 6176/03, to permit the establishment of a minimum 4.3 metre front yard depth for two townhouse dwelling units, whereas the by-law requires a minimum 4.5 metre front yard depth. The applicant requests approval of this variance in order to recognize the existing townhouse units on the subject property. 91 The Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department. CARRIED UNANIMOUSLY o P/CA 61/04 - Chris & Tammy Wright 1289 Ilona Park Road (Lot 1140, Plan M15) City of Pickering The applicant requests relief from the following provisions of Zoning By-law 2520: Section 7.2.3 to permit the establishment of a 3.9 metre front yard depth to the existing covered porch, whereas the by-law requires a minimum front yard depth of 7.5 metres. Section 7.2.3 to permit the establishment of a 1.8 metre side yard width to a proposed 2-storey addition, whereas the by-law requires a minimum side yard width of 2.4 metres. The applicant requests approval of these variances in order to obtain a building permit for the proposed 2-storey addition. The Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department. Written comments were also received from the City's Development Control Supervisor and City's Fire Prevention Officer, both expressing no concerns. Chris Wright, owner, was present to represent the application. Larry and Susan Poole of 1296 Ilona Park Road and Darlene LeBlanc of 1287 Ilona Park Road were present in favour to the application. M. Maides of 1284 Ilona Park Road, Mr. and Mrs. Brethour of 1288 Ilona Park Road and Lisa LeBlanc of 1287 Ilona Park Road submitted letters in favour of the application. 92 MOTION: Moved by Bill Utton, seconded by Marie Billinger That application P/CA 61/04 by Chris & Tammy Wright, be APPROVED on the grounds that the existing minimum 3.9 metres front yard depth and the proposed minimum 1.8 metre side yard width to be minor variances that are desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Official Plan and the Zoning By-law, and therefore recommends approval of the proposed variances, subject to the following conditions: 1. That these variances apply only to the existing covered porch and the proposed 2-storey addition, as generally sited and outlined on the applicant's submitted plans with this application. That the applicant obtain a building permit and construct the proposed 2-storey addition within two years of the date of this decision, or this decision shall become null and void.
