PRESENT: ALSO PRESENT: Marie Billinger- Acting Chair Chris Braney David Johnson Bill Utton Ross Pym, Assistant Secretary-Treasurer Flora Niro, Secretary-Treasurer ABSENT: Eric Newton The meeting convened at 7:04 p.m. in the Main Committee Room of the Civic Complex. 1. MATTERS ARISING FROM THE MINUTES There were no matters arising from the minutes. 2. ADOPTION OF MINUTES MOTION: Moved by Bill Utton, seconded by David Johnson That the minutes of the 10th meeting of the Committee of Adjustment held Wednesday, July 28, 2004, be adopted. CARRIED UNANIMOUSLY 3. ADOPTION OF AGENDA MOTION: Moved by Chris Braney, seconded by Bill Utton That the agenda for the Wednesday, August 18, 2004 meeting be adopted. CARRIED UNANIMOUSLY 6O (Tabled at the July 28, 2004 meeting) P/CA 39/04 - S. Gnanasekaram 2372 Denvale Drive Lot 58, Plan 40M-1512 City of Pickering MOTION: Moved by David Johnson, seconded by Bill Utton That P/CA 39~04, by S. Gnanasekaram be lifted from the table. CARRIED UNANIMOUSLY The applicant requests relief from Section 5(1)(b)(vi) of Zoning By-law 3036, as amended by By-law 1975/85 to permit a minimum 4.7 metre rear yard depth to be provided by the proposed sunroom addition, whereas the by-law requires a minimum rear yard depth of 7.5 metres. The applicant requests approval of this variance in order to obtain a building permit for the construction of a sunroom addition to the rear of the existing dwelling on the subject property. The Assistant Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department and advised of a revised plan submitted by the applicant. Written comments were received from the City's Development Control Supervisor and City's Fire Prevention Officer, both expressing no concerns. Comments were received from Rick Johnson, Regional Councillor - Ward 3, in support of the application. John Kewell, agent, was present to represent the application. No further representation was present in favour of or in objection to the application. John Kewell submitted a revised plan illustrating a reduction in the size of the proposed sunroom addition. Ross Pym stated that the reduction is not significant and the recommendation provided by Planning Staff will remain the same. John Kewell asked if the Committee would consider tabling the application. Marie Billinger felt that the applicant had been prOvided ample opportunity to address issues. DECISION: Moved by Bill Utton, seconded by David Johnson That application P/CA 39~04 by S. Gnanasekaram, be REFUSED on the grounds that the proposed minimum 4.7 metre rear yard depth to be provided by the proposed sunroom addition is a major variance that is not desirable for the appropriate development of the land, and not in keeping with the general intent and purpose of the Official Plan and the Zoning By-law. CARRIED UNANIMOUSLY P/CA 41/04 - Shaun Gallagher 1774 Appleview Road (Part Lot 53, Plan 1051) (Part 5, Plan 40R-22516) City of Pickering The applicant requests relief from Section 9.2.3 of Zoning By-law 3036, as amended, to permit a minimum 1.1 metre north side yard width provided by the existing dwelling and proposed additions, whereas the by-law requires a minimum side yard width of 1.8 metres. The applicant requests approval of this variance in order to recognize the existing situation and to obtain a building permit for a second-storey and garage addition to the existing dwelling. The Assistant Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department. Written comments were also received from the City's Development Control Supervisor and City's Fire Prevention Officer, both expressing no concerns. Shaun Gallagher, owner, was present to represent the application. No further representation was present in favour of or in objection to the application. Shaun Gallagher stated that approval of the variances would allow for a more pleasing fa~:ade and that the location of the proposed garage will not disturb existing services on the property. DECISION: Moved by David Johnson, seconded by Chris Braney That application P/CA 41104 by Shaun Gallagher, be APPROVED on the grounds that the proposed minimum 1.1 metre north side yard width provided by the existing dwelling and proposed additions are minor variances that are desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Official Plan and the Zoning By-law, subject to the following conditions: That this variance apply only to the existing dwelling and proposed additions, as generally sited and outlined on the applicant's submitted plans with this application. That the applicant obtain a building permit and construct the proposed additions within two years of the date of this decision, or this decision shall become null and void. CARRIED UNANIMOUSLY P/CA 42~04 - C. Gates & B. Pim 1989 Sprucehill Road Lot 95, Plan 1041 (Part 1, Plan 40R-2023) City of Pickering The applicants requests relief from Section 10.2.3 of Zoning By-law 3036, as amended, to permit a minimum front yard depth of 7.0 metres to be provided by the proposed front porch addition to the existing dwelling, whereas the by-law requires a minimum front yard depth of 7.5 metres. To permit a minimum north side yard width of 1.2 metres to be provided by a proposed addition to the existing dwelling, whereas the by-law requires a minimum side yard width of 1.5 metres. The applicants request approval of these variances in order to obtain a building permit to build the front porch and second-storey additions to the existing dwelling on the subject property. The Assistant Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department. Written comments were received from the City's Development Control Supervisor and City's Fire Prevention Officer, both expressing no concerns. Written comments were received from the Toronto & Region Conservation Authority expressing no objections. Chris Gates, owner, was present to represent the application. No further representation was present in favour of or in objection to the application. Chris Gates submitted a letter from Michael Stoker of 1991 Spruce Hill Road stating that he had no objection to the application. DECISION: Moved by Chris Braney, seconded by Bill Utton That application P/CA 42~04 by C. Gates & B. Pim, be APPROVED on the grounds that the proposed minimum north side yard width of 1.2 metres and minimum front yard depth of 7.0 metres to be provided by the proposed additions to the existing dwelling are minor variances that are desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Official Plan and the Zoning By-law, subject to the following conditions: That these variances apply only to the proposed additions, as generally sited and outlined on the applicant's submitted plan with this application. That the applicant obtain a building permit and construct the proposed additions within two years of the date of this decision, or this decision shall become null and void. CARRIED UNANIMOUSLY P/CA 43/04 to P/CA 44/04 - Estate of Donald Arthur Rouse 1788 Appleview Road (Part Lot 56, Plan 1051) City of Pickering The applicant requests relief from Section 9.2.1 of Zoning By-law 3036, as amended, to permit a minimum lot frontage of 15.0 metres provided by the proposed severed and retained parcels on the subject property, whereas the by- law requires a minimum lot frontage of 18.0 metres. The applicant requests approval of this variance in order to facilitate proposed severances. The Assistant Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department. Written comments were received from the City's Development Control Supervisor and City's Fire Prevention Officer, both expressing no concerns; Toronto and Region Conservation Authority requesting a deferral of the application; Walter & Irene Feigl of 1794 Appleview Road, both opposed to the application; Terrianne Teigen-Katsumi of 1782 Spartan Court, including a petition with signatures from area residents expressing no concerns with the severance of the subject property, but did express concerns with traffic on Appleview Road. John Foster was present to represent the application. No further representation was present in favour of or in objection to the application. John Foster acknowledged comments received from the Toronto and Region Conservation Authority. He stated that the Conservation requirements would be addressed at the building permit stage and should not interfere with the Committee making a decision. In reply to a question, Ross Pym stated that he was in support of the recommendation by Toronto and Region Conservation Authority to defer the application. MOTION: Moved by David Johnson, seconded by Bill Utton That applications P/CA 43~04 to P/CA 44~04, by the Estate of Donald Arthur Rouse be TABLED until such time that a topographic survey is received to determine appropriate setbacks for new development in order to satisfy the requirements of the Toronto and Region Conservation Authority. MOTION CARRIED 8. ADJOURNMENT MOTION: Moved by Bill Utton, seconded by Chris Braney That the 11th meeting of the Committee of Adjustment be adjourned at 7:25 p.m. and the next meeting of the Committee of Adjustment be held on Wednesday, September 29, 2004. Due to a lack of applications, the September 8, 2004 Committee of Adjustment meeting will be cancelled. CARRIED UNANIMOUSLY SECRETARY-TREASURER
